Said proceedings were under and by virtue of an act of the Legislature of the State of Cali- fornia, entitled "AN ACT AUTHORIZING THE INCURRING OF INDEBTEDNESS BY CITIES, TOWNS, AND MUNICIPAL CORPORATIONS FOR MUNICIPAL IMPROVEMENTS; AND REG- ULATING THE ACQUISITION, CONSTRUC- TION, OR COMPLETION THEREOF," which became a law February 25th, 1901, together with all Amendments thereto. The City of Avalon was incorporated June 26th, 1913, as a Municipal Corporation of the Sixth Class, under the provisions of an Act of the Legislature of the State of California, ap- proved March 13th, 1883, entitled "An Act to provide for the organization, incorporation and government of municipal corporations," and of the Acts amendatory thereof. Population 1919 (estimated) - 1,000 Assessed valuation as shown by the Assess- ment Roll of 1919-1920, $1,099,965.00. Tax rate limited by law to $1.00 on the $100.00 except upon a two-thirds vote of quali- fied electors. There is no bonded indebtedness other than that herein set forth. There is no litigation pending or threatened affecting City Officers, City Boundaries, or this or any bond issue of said City, or the corporate existence of the City of Avalon. Second: The acquisition, construction and completion of gas works by the City of Avalon, including the acquisition of lands, rights of way, machinery, pipes, appurtenances, and other property necessary and proper for supplying said City and its inhabitants with gas for light, power and heat. And that said improvements and each of them are necessary and convenient to carry out the objects, purposes and powers of said City. Section 2. That the estimated cost of said municipal improvements is as follows, to-wit: First: For the acquisition, construction and completion of combined electric light and water works, including the acquisition of lands, water rights, rights of way, machinery, pipes, wires, appurtenances and other property necessary and proper for supplying the City of Avalon and its inhabitants with light, heat, power and water, the sum of Eighty-eight Thousand ($88,000.00) Dollars. Second: For the acquisition, construction and completion of gas works by the City of Ava- lon, including the acquisition of lands, rights of way, machinery, pipes, appurtenances and other property necessary and proper for supplying said City and its inhabitants with gas for light, power and heat, the sum of Fifty-five Thousand ($55,000.00) Dollars. And that the cost of said municipal improve- ments and each of them is and will be too great to be paid out of the ordinary annual income and revenue of said City. Section 3. The City Clerk shall certify to the passage and adoption of this Resolution by a vote of two-thirds of all the members of the Board of Trustees of the City of Avalon, and its approval by the President of said Board, and shall thereupon cause the same to be published once in The Catalina Islander, a weekly news- paper of general circulation, published and cir- culated in said City of Avalon. Second: The acquisition, construction and completion of gas works by the City of Avalon, including the acquisition of lands, rights of way, machinery, pipes, appurtenances, and other prop- erty necessary and proper for supplying said City and its inhabitants with gas for light, power and heat; and Whereas, said Resolution was approved by the executive of said City, to-wit: the Presi- dent of said Board of Trustees, on said 19th day of April, 1919, at said meeting of said Board of Trustees, and was published on the 22nd day of April, 1919, in The Catalina Islander, a week- ly newspaper of general circulation, published and circulated in said City of Avalon; and Whereas, the estimated cost of said munici- pal improvements is as follows, to-wit: First: For the acquisition, construction and completion of combined electric light and water works, including the acquisition of lands, water rights, rights of way, machinery, pipes, wires, appurtenances and other property necessary and proper for supplying the City of Avalon and its inhabitants with light, heat, power and water, the sum of Eighty-eight Thousand ($88,000.00) Dollars. Second: For the acquisition, construction and completion of gas works by the City of Ava- lon, including the acquisition of lands, rights of way, machinery, pipes, appurtenances and other property necessary and proper for supplying said 15 City and its inhabitants with gas for light, power and heat, the sum of Fifty-five Thousand ($55,- 000.00) Dollars; and Whereas, such estimated cost of said muni- cipal improvements and each of them is, and will be, too great to be paid out of the ordinary annual income and revenue of said City; Section 2. Now, therefore, a special elec- tion is hereby called to be held in the said City of Avalon, California, on the 3rd day of June, 1919, for the purpose of submitting to the qual- ified voters of the said City the following propo- sitions set forth in said Resolution: First: The proposition of incurring a bond- ed debt of the sum of $88,000.00 for the acqui- sition, construction and completion by said City of Avalon of combined electric light and water works, including the acquisition of lands, water rights, rights of way, machinery, pipes, wires, appurtenances and other property necessary and proper for supplying the City of Avalon and its inhabitants with light, heat, power and water; Second: The proposition of incurring a bonded debt of the sum of $55,000.00 for the acquisition, construction and completion of gas works by the said City of Avalon, including the acquisition of lands, rights of way, machinery, pipes, appurtenances and other property neces- sary and proper for supplying the said City of Avalon and its inhabitants with gas for light, power and heat. Section 3. That the objects and purposes for which said indebtedness is proposed to be incurred are as follows: First: The acquisition, construction and completion of combined electric light and water works, including the acquisition of lands, water rights, rights of way, machinery, pipes, wires, ap- purtenances and other property necessary and proper for supplying the City of Avalon and its inhabitants with light, heat, power and water. That the estimated cost of such proposed public improvement is $88,000.00. That the amount of the principal of the indebtedness to be incurred therefor is the sum of $88,000.00, and that the 16 rate of interest to be paid on said indebtedness is six per cent, per annum. That if the propo- sition of incurring said indebtedness for said pur- pose, so submitted at said election, receives the requisite number of votes, to-wit: the votes of two-thirds of all the voters voting at such special election, bonds of said City to the amount of $88,000.00 shall be issued and sold for said pur- pose. Said bonds shall be One Hundred and Sixty (160) in number and eighty (80) of said bonds shall be issued in the denomination of One Thousand ($1,000.00) Dollars each, and eighty (80) of said bonds shall be issued in the denomination of One Hundred ($100.00) Dollars each, and the principal and interest thereon shall be payable in lawful money of the United States. They shall be dated June 30th, 1919, and bear interest at the rate of six per cent, per annum, payable semi-annually on the 30th day of Decem- ber and the 30th day of June of each year. And said one hundred and sixty (160) bonds shall be payable in the manner following: Two of said bonds of the denomination of $1,000.00, and two of said bonds of the denom- ination of $100.00, shall be paid on the 30th day of June, 1920, and two of said bonds of the de- nomination of $1,000.00, and two of said bonds of the denomination of $100.00, on the same day and date of each and every year thereafter, at the City Treasury of said City of Avalon, to- gether with the interest on all sums unpaid at such date. Second: The acquisition, construction and completion of gas works by the City of Avalon, including the acquisition of lands, rights of way, machinery, pipes, appurtenances, and other property necessary and proper for supplying said City and its inhabitants with gas for light, power and heat. That the estimated cost of such pro- posed public improvement is $55,000.00. That the amount of the principal of the indebtedness to be incurred therefor is the sum of $55,000.00, and that the rate of interest to be paid on said indebtedness is six per cent, per annum. That if the proposition of incurring said indebtedness for said purpose, so submitted at said election, receives the requisite number of votes, to-wit: 17 the votes of two-thirds of all the voters voting at such special election, bonds of said City to the amount of $55,000.00 shall be issued and sold for said purpose. Said bonds shall be one hundred sixty (160) in number and forty (40) of said bonds shall be issued in the denomina- tion of One Thousand ($1,000.00) Dollars each, and eighty (80) of said bonds shall be issued in the denomination of One Hundred ($100.00) Dollars each, and forty (40) of said bonds shall be issued in the denomination of One Hundred Seventy-five ($175.00) Dollars each, and the principal and interest thereof shall be payable in lawful money of the United States. They shall be dated June 30th, 1919, and bear interest at the rate of six per cent, per annum, payable semi-annually on the 30th day of December and the 30th day of June of each year. And said one hundred sixty (160) bonds shall be payable in the manner following: One of said bonds of the denomination of $1,000.00, and two of said bonds of the denom- ination of $100.00, and one of said bonds of the denomination of $175.00 shall be paid on the 30th day of June, 1920, and one of said bonds of the denomination of $1,000.00, and two of said bonds of the denomination of $100.00, and one of said bonds of the denomination of $175.00, on the same day and date" of each and every year thereafter, at the City Treasury of said City of Avalon, together with the interest on all sums unpaid at such date. Section 4. That for the purpose of pay- ing the principal and interest on such bonds the Board of Trustees of said City shall at the time of fixing the general tax levy, and in the manner for such general tax levy provided, levy and collect annually, each year, until said bonds are paid, or until there shall be a sum in the treasury, of said City set apart for that purpose sufficient to meet all sums coming due for prin- cipal and interest on such bonds, a tax suffi- cient to pay the annual interest on such bonds, and also such part of the principal thereof as shall become due before the time for fixing the next general tax levy. 18 Said tax shall be in addition to all other taxes levied for municipal purposes, and shall be collected at the same time and in the same manner as other municipal taxes are collected, and be used for no other purpose than the pay- ment of said bonds and accruing interest. Section 5. The polls for said election must be opened at 6 o'clock a. m. of the day of elec- tion, and must be kept open until 7 o'clock p. m. of the same day, when the polls shall be closed; except and provided, however, that if at the hour of closing there are any other voters in the polling place or in line at the door, who are qualified to vote and have not been able to do so since appearing, the polls shall be kept open a sufficient time to enable them to vote. But no one who shall arrive at the polling place after 7 o'clock in the afternoon shall be entitled to vote, although the polls may be open when he arrives. The ballots to be used at such election shall be printed substantially in the following form: INSTRUCTION TO VOTERS To vote on any proposition of incurring a bonded debt for the purpose specified in such proposition, stamp a cross (X) in the voting square after the word "Yes," or after the word "No." All marks except the cross (X) are for- bidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the Inspector of Election and obtain another. Shall the City of Avalon incur a bonded debt of $88,000.00 for the acquisition, construction and completion of combined electric light and water works, including the acquisition of lands, water rights, rights of way, machinery, pipes, wires, appurtenances, and other property necessary and proper for supplying the City of Avalon and its inhabitants with light, heat, power and water? That for the holding of such election, said City of Avalon shall be and is hereby consolidated into one municipal election precinct, the boundaries of which said precinct shall be and are hereby fixed as the exterior boundaries of the City of Avalon and the polling place shall be and is hereby located at the City Hall on the Westerly side of Metropole Avenue between Beacon Street and Crescent Avenue in said City of Avalon, and the Board of Election for such special election is hereby appointed as follows: Inspectors: Joseph H. WHEREAS, the Board of Trustees of the City of Avalon, California, at a regular meeting thereof, held on the nineteenth day of April, 1919, by vote of two-thirds of all its members, 'duly passed and adopted a resolution deter- mining that the public interest and necessity demanded the acquisition, construction and com- pletion by said City of Avalon of the following municipal improvements, to-wit: First: The acquisition, construction and completion of combined electric light and water works, including the acquisition of lands, water rights, rights of way, machinery, pipes, wires. 33 appurtenances, and other property necessary and proper for supplying the City of Avalon and its inhabitants with light, heat, power and water. Second. The acquisition, construction and completion of gas works by the City of Avalon, including the acquisition of lands, rights of way, machinery, pipes, appurtenances, and other prop- erty necessary and proper for supplying said City and its inhabitants with gas for light, power and heat; and that the estimated cos^ of the first of said municipal improvements above stated was Eighty-eight Thousand Dollars, and that the estimated cost of the second of said municipal improvements above stated was Fifty-five Thousand Dollars, and that said esti- mated cost of said municipal improvements, and each of them, was, and will be too great to be paid out of the ordinary annual income and rev- enue of said city; and WHEREAS, said resolution was approved by the executive of said city, to-wit: the Pres- ident of said Board of Trustees, on said 19th day of April, 1919, at the said meeting of said Board of Trustees, and was duly published on the 22nd day of April, 1919, in The Catalina Islander, a weekly newspaper of general circu- lation published and circulated in said City of Avalon; and WHEREAS, the Board of Trustees of said City of Avalon, at a regular meeting thereof held on the 2nd day of May, 1919, by a vote of two- thirds of all its members, duly passed and adopt- ed an Ordinance calling a special election and submitting to the qualified voters of said City the following propositions set forth in said Res- olution: First: The proposition of incurring a bond- ed debt of the sum of $88,000.00 for the acqui- sition, construction and completion by said City of Avalon of combined electric light and water works, including the acquisition of lands, water rights, rights of way, machinery, pipes, wires, appurtenances and other property necessary and proper for supplying the City of Avalon and its inhabitants with light, heat, power and water; 34 Second: The proposition of incurring a bonded debt of the sum of $55,000.00 for the ac- quisition, construction and completion of gas works by the said City of Avalon, including the acquisition of lands, rights of way, machinery, pipes, appurtenances and other property neces- sary and proper for supplying the said City of Avalon and its inhabitants with gas for light, power and heat, and said Ordinance was ap- proved by the Executive of said City, to-wit: the President of the Board of Trustees, on said 2nd day of May, 1919, and said Ordinance was there- upon duly published once a week for two weeks in The Catalina Islander, a weekly newspaper of general circulation, published less than six days a week, in said City of Avalon; and WHEREAS, such special election was duly held on the 3rd day of June, 1919, as provided by said Ordinance calling the same, and by law for holding municipal elections in said City; and each of said propositions of incurring such bonded indebtedness herein above set forth, re- ceived the votes of more than two-thirds of all the voters voting at such special election; and WHEREAS, all and singular the provisions of the Act of the Legislature of the State of Cali- fornia entitled: "An act authorizing the incur- ring of indebtedness by cities, towns and munici- pal corporations for municipal improvements, and regulating the acquisition, construction, or completion thereof," which became a law Feb- ruary 25th, 1901, together with all amendments thereto, and the Law and Ordinances of said City have been fully complied with so as to authorize the issue of said bonds: NOW, THEREFORE, the Board of Trustees of the City of Avalon do ordain as follows: Section 1. That bonds of the said City of Avalon in the sum of Eighty-eight Thousand Dol- lars be issued in accordance with the provisions of the Act of the Legislature of the State of California, entitled: "An act authorizing the incurring of indebtedness by cities, towns, and municipal corporations for municipal improve- ments, and regulating the acquisition, construc- tion, or completion thereof," which became a law 35 February 25th, 1901, together with aO amend- ments thereto, and with the Ordinances of said City; that said bonds shall be one hundred and sixty (160) in number and eighty (80) of said bonds shall be issued in the denomination of One Thousand ($1,000.00) Dollars each, and eighty (80) of said bonds shall be issued in the denomination of One Hundred ($100.00) Dollars, each, and the principal and interest thereon shall be payable in lawful money of the United States. They shall be dated June 30th, 1919,. and bear interest at the rate of six per cent per annum, payable semi-annually on the 30th day of December and the 30th day of June of each year. And said one hundred and sixty (160) bonds shall be payable in the manner following: Two of said bonds of the denomination of $1,000.00, and two of said bonds of the denomi- nation of $100.00, shall be paid on the 30th day of June, 1920, and two of said bonds of the de- nomination of $1,000.00, and two of said bonds of the denomination of $100.00, on the same day and date of each and every year thereafter, at the City Treasury of said City of Avalon, to- gether with the interest on all sums unpaid at such date. Said bonds shall be substantially in the fol- lowing form, to- wit: No United States of America State of California City of Avalon Combined Electric Light and Water Works Bond Avalon, California, June 30, 1919. On the 30th day of June, A. D. (year of ma- turity), the City of Avalon will pay to the bearer at the office of the City Treasurer of the City of Avalon, in the County of Los Angeles, State of California, the sum of Dollars, with interest at the rate of six per cent per annum, payable semi-annually on the 30th day of December, and the 30th day of June of each year, as specified in the interest coupons hereto attached, at the office of the City Treas- 36 urer upon the presentation and surrender ot said interest coupons. Principal and interest pay- able in lawful money of the United States. This bond is issued in pursuance of the pro- visions of an Act of the Legislature of the State of California entitled: "An act authorizing the incurring of indebtedness by cities, towns, and municipal corporations for municipal improve- ments, and regulating the acquisition, construc- tion, or completion thereof," which became a law February 25th, 1901, together with all amendments thereto. IT IS FURTHER CERTIFIED, that all the requirements of law and of the Ordinances of the City of Avalon for the issuing of this bond have been fully complied with by the proper officers; that this issue of bonds has been duly authorized by the votes of two-thirds of all the voters voting at a special election duly and regu- larly called and held in the said City on the 3rd day of June, 1919, and that the total amount of this issue, together with all indebtedness of said City, does not in the aggregate exceed fif- teen per cent, of the assessed value of all the real and personal property of the said City of Avalon, nor does it exceed the limit prescribed by the Constitution and Laws of the State of California. They shall be dated June 30th, 1919, and bear interest at the rate of six per cent per annum, payable semi-annually on the 30th day of December and the 30th day of June of each year. That the President of the Board of Trustees of the City of Avalon being the Ex- ecutive of the municipality, and the C.ity Treas- urer of said City, are hereby authorized and di- rected to sign all the bonds herein provided for, and the City Clerk is hereby authorized and di- rected to countersign the same and to affix the corporate seal of the City of Avalon thereto, and the City Treasurer of said City is hereby authorized and directed to sign the interest cou- pons of said bonds, and said bonds shall be de- livered by said City Clerk to said City Treas- urer in such amounts as the Board of Trustees of said City may from time to time determine. Section 4. That for the purpose of paying the principal and interest on such bonds, the Board of Trustees of said City shall, at the time of fixing the general tax levy, and in the man- ner for such general tax levy provided, levy and collect annually, each year until said bonds are paid, or until there shall be a sum in the Treasury of said City, set apart for that purpose, sufficient to meet all sums coming due for prin- cipal and interest on such bonds, a tax sufficient to pay the annual interest on such bonds, and also such part of the principal thereof as shall become due before the time for fixing the next general tax levy. 41 Said tax shall be in addition to all other taxes levied for municipal purposes, and shall be collected at the same time and in the same manner as other municipal taxes are collected, and be used for no other purpose than the pay- ment of said bonds and accruing interest. Section 5. The proceeds of the sale of said Combined Electric Light and Water Works Bonds shall be placed in the City Treasury to the credit of a fund to be known as the Combined Electric Light and Water Works Bond fund, and the same shall be applied exclusively for the pur- poses and objects above mentioned in this Or- dinance, for which such indebtedness of $88,- 000.00 was incurred. Section 6. The proceeds of the sale of said Gas Works Bonds shall be placed in the City Treasury to the credit of a fund to be known as the Gas Works Bond fund, and the same shall be applied exclusively for the purposes and ob- jects above mentioned in this Ordinance, for which such indebtedness of $55,000.00 was in- curred. Section 7. The City Clerk shall certify to the passage of this Ordinance, and shall cause the same to be published once in The Catalina Islander, a weekly newspaper of general circu- lation, published and circulated in said City of Avalon, and thereupon and thereafter it shall be in full force and effect.
