The law for the regulation of the practice of dentistry in the State of Michigan, as amended in 1891, now reads as follows: The People of the State of Michigan enact as follows; SECTION 1. It shall hereafter be unlawful for any person to practice dentistry in this State unless such person has received a diploma from the faculty of a reputable dental college, duly incorporated under the laws of this, or some other State of the United States, with a course of instruction and practice fully equal or equivalent to that of the College of Dental Surgery of the University of Michigan, or a certificate of qualification from the Board of Examiners provided for by this act; Provided, That the provisions of this act shall in no way apply to or affect any person who is now located and lawfully in actual practice in this State. SEC. 2. Said board of examiners shall be appointed by the Governor of this State, and shall consist of three practical dentists who shall be regular graduates of a reputable dental college, duly incorporated under the laws of this State or some other State of the United States, or otherwise possess the necessary qualifications contemplated by this act. — 4 — SEC. 3. Each member of this board of examiners shall serve for a term of three years, and until his successor is duly ap- pointed and qualified; except in the case of the first board, the members thereof shall serve respectively one, two and three years as specified in the appointment of the governor. Sec. 4. The board of examiners shall be organized as follows: The member having but one year to serve shall be president of the board; the One having two years, shall be treasurer, and the one having three years, shall be secretary. The treasurer shall make and file with the Secretary of State a good and sufficient bond to the people of the State of Michigan, in the penal sum of one thou- sand dollars, conditioned that he will well and truly pay over all monies received by him as such treasurer, in compliance with the provisions of this act and otherwise faithfully discharge the duties of his office. SEC. 5. The board of examiners shall meet at least once in each year, for the purpose of examining applicants, after having given, personally or by mail, thirty days’ written or printed notice to each practicing dentist in the State who had filed his name and address with the secretary of said board. The said board is authorized to incur all necessary expenses in the prompt and efficient discharge of its duties, and pay the same with any monies in the hands of its treasurer. SEC. 6. Each member of said board shall qualify by taking the oath of office prescribed by the Constitution of this State, and filing the same with the Secretary of State before entering upon the duties of his office. Should a vacancy occur in said board, the Governor of this State shall fill the same by appointment. * SEC. 7. Any member of said board of examiners may, when the board is not in session, examine applicants, and in case any appli- cant is found competent, grant a license to him to practice dentistry in this State until the next meeting of Said board, and no longer. Each applicant so examined shall pay the sum of three dollars: Provided, That no member of the said board shall grant a license to any one who has been rejected on examination by the board. SEC. 8. Should any member of said board be unable to attend at the meeting of the board for the examination of applicants, he may appoint in writing a substitute, who shall have the same power — 5 — on the examination that the member appointing him would have, if present. Provided, Such substitute be a person eligible to be a member of said board within the provisions of this act. And pro- vided further, That the appointment of such substitute be by and with the written consent of the other members of the board. SEC. 9. Each applicant for examination by the board shall pay into the treasury of the board the sum of ten dollars, which shall constitute a fund to defray the expenses of the board; and each mem- ber of the board shall receive therefrom the sum of three dollars per day for services rendered as such examiner. The board shall keep a list of the names of all persons to whom licenses have been grant- ed under the provisions of this act, and also of all persons practicing dentistry in this State in a book provided for that purpose, with the names arranged in alphabetical order. SEC. 10. Any sum in excess of one hundred dollars which, un- der the provisions of this act, may accumulate in the treasury of said board, shall be paid by the treasurer thereof into the treasury of this State. SEC. 11. Each person now engaged in the practice of dentistry in this State shall, within ninety days after this act take effect, send an affidavit to the secretary of the board setting forth his name, place of business, postoffice address, the length of time he has been engaged in practice in this State, and if a graduate of a dental col- lege, state the name of the same, and also pay to the treasurer of said board the sum of twenty-five cents, and on failure to comply with said provisions of this section he shall be required to appear and be examined by said board. (NOTE.-The above Section 11, was in no way altered or changed by the amendments of 1891, and applied only to persons in prac- tice at the time of the passage of the original act in 1883.) SEC. 12. Any person who shall practice dentistry in this State, in violation of the provisions of this act, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined not less than twenty-five dollars, nor more than one hundred dollars, or sentenced to imprisonment in the county jail for a period not ex- ceeding ninety days, or both, such fine and imprisonment, is in the discretion of the court. Provided, That nothing in this act shall be construed so as to interfere with physicians and surgeons in their practice as such. — 6 — SEC. 18. For the purposes of instruction students may be em- ployed to assist in dental offices, and in the College of Dental Sur- gery of the University of Michigan, under the immediate observa- tion and advice of the legal proprietors and professors thereof, but no person not legally qualified and registered under this act shall assume the charge and management of any dental office, or the res- ponsibility of deciding upon or the doing of dentistry at any private residence or elsewhere. SEC. 14. All persons not now registered, who desire to practice dentistry in this State, shall apply to the secretary of the board for registration. Each person seeking registration by virtue of a dip- loma shall send an affidavit to the secretary of the board, setting forth his name, place of business, postoffice address, the date of his graduation, and the name of the dental school from which gradu- ated, and a registration fee of three dollars. All applicants found qualified under this act shall be properly and promptly registered by the secretary of the board. The above law as amended, took effect on the first day of October, 1891. — 7 — TO THE DENTAL PROFESSION OF THE STATE OF MICHIGAN : As some misapprehension exists among the profession as to the application of the law to regulate the practice of dentistry in this State, it was thought advisable, through this medium, to correct, as far as possible, erroneous ideas. It is not the duty of the board or any member thereof (as popu- larly supposed) to travel about the State to apprehend and prosecute infractors of the law. There is no provision in the law for such an officer as prosecutor, but it is the duty of every dentist as well as every person in the State, to see the law is obeyed, and the duty of the Prosecuting Attorney of each county to prosecute every infractor of the law on the receipt of information of such infraction and evi- dence to substantiate the same. - HOW TO PROSECUTE A VIOLATOR OF THE LAW : 1st. Secure positive evidence of the violation. 2nd. Write the Secretary of the State Board of Examiners, who will furnish you a sworn statement that the accused is not registered or licensed. * 3d. Hand this statement, with a formal information and list of witnesses, to the Prosecuting Attorney of your county, and he is in duty bound to prosecute the case. The following letter was written nearly six years ago, but will be found just as instructive in interpreting the amended law and will be of interest to every practicing dentist in the State. We offer it as a warning to those who are evading the law, which is clearly defined in this letter: : GRAND RAPIDs, MAy 10, 1886. G. S. SHATTUCK, D. D. S., Secretary State Board Dental Eacaminers: SIR-Your communication of the 8th instant, relative to con- struction of Act No. 140, of the Laws of 1883, duly received. You ask three questions, which, I assume, refer to actual experi- ence of your Board in the performance of its duties under the law. 1st. Whether a qualified dentist, in active practice, can leave his office for six months or a year for a trip abroad, and employ, during his absence, a man to carry on his business who is not qualified, either by license, registration or otherwise, and whether such person can do ordinary dentistry without violation of the law. — 8 — 2d. Whether a man, without license or authority to practice dentistry, can, by agreement with an authorized practitioner to pay him a certain sum or per cent. upon the receipts of his business for the use of his name, carry on the business of dentistry under such cover without violation of law, either locally or by traveling about from point to point. 3d. Whether a regular practitioner can employ an assistant who is not qualified under the law to fill and extract teeth and insert artificial teeth, and do other work of a dentist. I answer to the first two questions an unqualified negative. The law would be rendered nugatory and without effect if suscep- tible of a construction which would permit such practices. It was intended to protect the public from quack dentists, and must be so construed. As to the third question, the answer depends upon the circum- stances of each employment. I can see no objection to the employ- ment of a student in a dentist’s office, who by observation, as well as practice under the direct charge and instruction of his principal, is endeavoring to fit himself for the profession. If one is employed and paid as an assistant, and not as a princi- pal, under the direction and instruction of his employer, an author- ized dentist, my opinion is it would be permissible under this law, and that such work should be considered that of the regular practi- tioner. * The assistant cannot act as a principal and perform work in- dependent of his employer. The object of the law is to secure to the public skilled scientific work; and while a student or assistant under the directions of a competent dentist might perform a parti- cular act of dentistry properly, or aid the scientific practitioner so, perhaps, as to secure a good or better work than he alone can ac- complish, further than this he cannot go. Such employment should not be permitted to be used as a cloak to avoid compliance with this law. Your Board can best determine, from its knowledge of the profession, what assistants are Ordinarily used or needed in its practice. Very respectfully, MOSES TAGGART, Attorney-General. The object of the dental act, is to protect the community from the serious effects of incompetency in the practice of dentistry. The law is a good one, and should be enforced. It is an easy matter for all qualified persons to procure registration, and thereby become legal practitioners. — 9 — The following is a complete list of all registered dentists in the State of Michigan, up to Feb. 1, 1892. All others (excepting a few who have been able to exhibit short term temporary licenses,) who have practiced dentistry in this State since the amended law took effect, at any rate, have unmistakably done so in violation of a just law, and are liable to prosecution and fine. Every law abiding citizen has a duty to perform in the direc- tion of upholding and enforcing any just law. Let no person, therefore, hesitate to enter complaint against any offender. It is earnestly requested that each dentist who may receive a copy hereof, will immediately send to the Secretary of the State Board of Exam- iners in dentistry, the full name and address of each unregistered dentist within his knowledge, who is practicing dentistry in the State of Michigan. The fact of having a diploma from a reputable Dental College does not constitute the holder a legal practitioner of dentistry in this State, and unless his name is registered with the State Board, he is liable to prosecution the same as if he had no diploma. Blanks will be furnished upon application. Registration fee, $3.00. Diplomas from foreign countries are not recognized in this State.
