(ZA ( 1 417 In presenting the second and final portion of the Catalogue of the Library of the late Governor Lawrence to book buyers, many of whom may not have seen the previous part, and which com- prised the “General Literature," it will be well to again call attention to the late owner of the collection, and in the same ap- propriate words that prefaced the First Part : “ THE BOOKS described in the following pages constitute the library of the late WILLIAM BEACH LAWRENCE. They illustrate the life and character of their deceased owner. He was an author, a statesman, and a diplomat of the highest order. His reputation as an International Jurist, is claimed by his biographers to have been more European than American. His ‘Commentary on the Elements of International Law,' which has yet been only pub- lished in French; his editorship of Wheaton's International Law;' and his translation of the 'History of Louisiana,' by Mar- bois, assign to him a high rank in the world of literature. “WILLIAM BEACH LAWRENCE, who was born on the 23d of Oc- tober, 1800, graduated at Columbia College in 1818. During the period Albert Gallatin was Ambassador to Great Britain, he was appointed Secretary of Legation, and upon the return of that iii iv distinguished man to America, in 1827, was made Charge d'Af- faires at London, and 'entrusted with the difficult task of carry- ing out the provisions of the recently ratified treaty of peace, and sustaining a protracted diplomatic correspondence with the Eng- lish government. But for the change of the national administra- tion from Adams to Jackson, he would have been our Minister at Berlin. “He was elected Lieutenant-Governor of Rhode Island in 1850, and later on became Governor of that State by constitutional pro- vision. He appeared before the British and American Commis- sion in 1873, and made tható International Tribunal' reverse a decision of the United States Supreme Court. This was the only instance of the kind that ever occurred, and obtained for his clients a sum aggregating over half a million of dollars. "Gov. LAWRENCE was Professor of the Law of Nations in the University at Washington, and it is over a half a century since he delivered a series of lectures before the New York Historical Society, and another course in Columbia College, in which he en- dorsed the Ricardian theory. He was a member of the 'Institute of the Law of Nations,' composed of the thirty-five most eminent publicists in the world ; LL.D. of Brown University, and the recipient from the New York State University of the first degree of Doctor of Civil Law ever granted in America. “The library of Gov. LAWRENCE has been referred to again and again by competent authorities as the most comprehensive collec- tion of literature in America relating to the subject of Interna-. tional Law. Professor C. H. Hart, in a biographical sketch, written for Men of Progress,' stated that it contains the best collections of work in his speciality, in German, Spanish and Italian, as well as in English and French, to be found in any library, public or private, in this country. It is that section of the Library, viz. : “International, Civil, and Criminal Law, as well as Foreign and American Diplomacy," which Professor Hart eulogized, that will be found in the follow- ing pages. Without such a collection, the immortal literary labors of Governor Lawrence would have been impossible. Among these volumes will be found many presentation copies, and others filled with the owner's manuscript notes, also the works of Henry Wheaton, and Governor Lawrence, with numer- ous memoranda by the last named. In the domain of “Diplomacy and International Law," French authorities take the palm, and the German come next. Heinec- cius, Phillimore, Fiore, Binkershoek, Gentilis, Calvo, Haute- feuille, Travers—Twiss, Capefigue, Hugo Grotius, Woolsey, and other leading writers are well represented. There is a complete set of “Le Nord," and which is only overshadowed by the great work of the collection (lot 189), Du- mont, Rousset, Barbeyrac, and Saint Prest's, “CORPS UNIVERSEL 1 I V DIPLOMATIQUE,” in nineteen volumes, folio, which was published in the beginning of the eighteenth century. The “ British-Foreign Papers” are very full, and there is a splendid set of “ Archives Diplomatiques" in 27 vols. There should also be noticed Felix's “Revue Etrangère," 17 vols. ; lots 2 17-19, the United States Foreign Relations; Jared Sparks ' "Diplomatic Correspondence," 12 vols., original edition, and lots 538 and 534, two collections of 20 and 9 volumes respect- ively of pamphlets relating to International Jurisprudence. To working civil and criminal lawyers, such lots should be acceptable as-Chancellor D'Aguesseau's Works in 13 vols. ; "Opera Omnia Caseregis," 3 vols., folio, Veneris, 1740; " Causes Celèbres et Interessantes,” 20 vols., Paris, 1739–43, and being a series of remarkable trials; the various editions of the French, Belgian, Spanish, and Italian Codes; Lancelottus' " Corpus Juris Canonici,” printed in 1605 ; Domat's “Les Loix Civiles dans leur Ordre Naturel ; " the Commentaries of Gaius and Jus- tinian, various editions ; lot 314, a set of the French “ Jurispru- dence Generale” in 14 vols. ; Euvres de R. Pothier," 10 vols. ; Savigny's Works, lots 568-71; and Vinnius' “ Institutes," printed by Daniel Elzevir, in 1665, at Amsterdam What are always indispensable in a good and complete Law Library, are the Reports of Cases. Nearly every lot is well bound in either half morocco or full calf, and all are in good condition. It is impossible in this brief preface to enumerate all the jurispru- dential bibliophilistic gems. These the reader must discover for himself in the pages of the catalogue, and which has been as carefully compiled as possible, with a view to the legal book- buyer running as he reads. C. S. to ! CONDITIONS OF SALE. 1. The highest Bidder to be the Buyer, and if any dispute arise between two or more Bidders, the Lot so in dispute shall be im- mediately put up again and re-sold. 2. The Purchasers to give their names and addresses, and to pay down twenty-five per cent. on the dollar in part payment, or the whole of the Purchase money if required, in default of which the Lot or Lots so purchased to be immediately put up again and re-sold. 3. The Lots to be taken away at the Buyer's Expense and Risk within three days from the conclusion of the Sale, and the re- mainder of the Purchase money to be absolutely paid, or other- wise settled for to the satisfaction of the Vendors, on or before delivery : in default of which Messrs. Geo. A. LEAVITT & Co. will not hold themselves responsible, if the Lots be lost, stolen, dam- aged, or destroyed, but they will be left at the sole risk of the Purchaser. 4. The sale of any Lot is not to be set aside on account of any error in the description. The library will be exposed for Public Exhibition at least three days, and the Lots will be sold just as they are without recourse. 5. To prevent inaccuracy in delivery and inconvenience in the settlement of the Purchases, no lot can, on any account, be re- moved during the Sale. 6. Upon failure of complying with the above conditions the money deposited in part payment shall be forfeited ; all Lots un- cleared within the time aforesaid shall be re-sold by public or pri- vate Sale, without further notice, and the deficiency (if any) at- tending such re-sale, shall be made good by the Defaulter at this Sale, together with all charges attending the same. The first edi- tion, a large portion of the matter of which was really furnished by Mr. Lawrence himself, appeared in 1855, and immediately made Wheaton's name famous in America and Europe. It met with universal recognition and adoption in courts and consular offices. A second edition, carefully revised and furnished with elaborate notes bringing the text down to date, was published by Mr. Lawrence in 1863. The appearance of a rival work, by Richard H. Dana, purporting to be original and covering exactly the same ground, led to a sharp litigation between Mr. Dana and Mr. Lawrence in the United States Circuit Court for Massachu- setts. Mr. Lawrence's claims were fully sustained, and Mr. Dana's work declared an infringement of the copyright law.
