BYE-LAWS OK THE NOVA SCOTIA BARRISTERS' SOCIETY. 1 ■ 1. All members of t'l ., Bar Society who have paid their sub- scriptions up to the MichtBlmas Term, 1859, are and shall be members of the Nova Scotia Barristers' Society. 2. All members of the Bar of Nova Scotia not in arrears to the Bar Society may become members of this Society. Any Barrister desiring to become a member, shall cause to bo posted up in the Law Library and Prothonotary's OflBee, at Hal- ifax, for at least one month immediately preceding the general meeting at which he is to be proposed, a notice of his intention to apply for admission at such meeting. No person shall be admitted against whom it shall appear that more than one-third of the members present at the meetiqg shall have voted. But if the candidate shall have been excluded by less than four votes, he may appeal to another general meeting. 3. The Chief Justice for the time being, shall be Patron of the Society. 4. The Officers of the Society shall be a President, Vice- President, Treasurer, Librarian and Secretary, to be elected an- nually at the general meeting. 8 o. There shall be a (>ouncil, to bo composed of the Presi- dent, Viee-FresideRt and five Barristers, to be elected annually at the general meeting. The Judges or the Supreme Court and Court of Admiralty being members of this Society, shall be honorary members of the Council. Four members shall be a quorum. 6. All members and office-bearors of this Society shall be elected and admitted by ballot. 7. The Council may at any time call a special meeting. If a member of the Society apply to the Council in writing to call a special meeting, and the Council refuse, then any six members may call it. The notices for such meeting stating the matters to be submitted thereto and to be signed }iy such members. 8. After the first day of October next, no Bye-Law of this Society affecting the rights or privileges of members or the amount of their subscription, shall bo passed or altered except at a meeting consisting of more than ten members, two-thirds whereof shall concur in such new law or alteration,— nor unless notice of proposed new hvf or alteration shall have been given at the meeting immediately previous thereto. 9. The Council shall have the general management of the affairs of this Society, and shall settle all questions between merrbers relative to their practice, and regulate all other matters which can come under the cognizance of this Society ; but an appeal shall in all cases be allowed from the Council to the next general or special meeting, a notice of such appeal to be given to the Secretary within four days after notice of the decision. 10. A member complaining of any infringement of the rules or By-laws of the Society, or of any conduct of another member, shall inform the Council, in writing, of the nature of his com- plaint, and the Council shall thereupon, after having given <'-■ t}l 9 lit least ten ^ays previous notice to the person coarpTained of, proceed to the investigation of auch complaint, and make suc^ decisio© therein as they may deem right. * 11. The ahnual meeting of this Society 6liall take place in the month of February in each year, unless otherwise ordered hy the Council. 12. It shall be the duty of the President — ^aad, ill his absence, of the Vice-President^^to inquire into the regularly of every admission to the office at Barrister or Attorney, and to guard against and oppose, in the name of the Society, evety irregular or improper admission, and to advance such olyections in every case as may be thought expedient or necessary for the honor or credit of the profession, and to act as th6 advocate of the Society on all occasions before the Court. 13. There shall be annually devoted to the Law 1ij\}mSrf, fbt -the purchase of books, as much money aa can be spared from the funds of the Society. 14. The Council shall have the general management of the Law Librarj'. 15. The Librarian shall have, under the direction of the Council, the superintendence and care of the books and of the room. 16. The Council shall have power to admit Attomies to the use of the Law Library on the payment of such fee as they shall approve. 17. No books shall be removed from the Law Library except to a room where a Court is sitting, or a Judge holding Chambers, in the same building, under a penalty of £1 for the first offence, and a fine of 5s. for every day of its detention j and m the event of any meniber being twice guilty of an infringement RsstI 10 of this rule, he shall, ipse facto, cease to be a member of tliis Society, and in case the book is not returned within ten days, he shall be liable to pay to the Society, in addition to the fines, the Talue of the whole set, estimated according to the cost of importation. When the sot is replaced, he shall be entitled to the odd volumes. 18. None but members of this Society shall have the use of the Law Library, or students of members who may have received from the Barrister with whom they are studying a written per- mission to be filed with the Secretary, and every such permission shall only be in force from the time of such filing thereof until three months thereafter. 19. The fee for each student, when any is received by a member of the Society, shall not be less than £100, to be paid on entrance to his oflSce ; but members shall be at liberty to take students without fee. 20. No articled clerk shall receive any salary or remuner- ation for his services from the Barrister with whom he studies. 21. There shall be paid by all members resident or prac. tising in Halifax the sum of £2 annually, in even half-yearly payments on the 1st day of July and the 1st day of January of every year. 22. It is oedered, that no person sliall hereafter be received as an Articled Clerk by any Barrister of this Court, until he shall have undergone an Examination at Halifax, before one of the Judges and two of the Office-Bearers of the Barristers' Society, as to his educational qualifications, such qualifications to compre- hend a knowledge of Geography and of ihe leading events of English History, of the three first books of Caesar's Commenta- ries, or the two first books of the ^neia, or an adequate portion of any other Latin Classic Author, to be approved of by the Examiners, and of the two first books of Euclid ; the Examina- tioij to be conducted orally or by written questions to be answer- ed in writing oq the spot, or in both forms at the option of tho: Examiners j and the applicant shall also produce a certificate o^ his moral character from such person as the Examiners may ap- prove, which certificate along with a certificate of the applicant's having passed a satisfactory Examination in the above branches, shall be filed with his Articles in the Office of the Prothonotary, at Halifax, pursuant to the Act of last Session. It is ordered, that notice of the intention to apply for being received, shall be posted up by the applicant for at least one month previously, in the Prothonotary's Office, at Halifax.
