 HE RE AS the bringing of Gun Powder on board of 
 
 Ships or other Vcllels into the Harbour of Moniuol, 
 
 is attended with great rilk and danger to the Tow 11, 
 
 and alarming to ilie Inhabitants thereof, by rcjfon of 
 
 the proximity of the Buildings to the Harbour or iiiiiai 
 
 place of unloading at the market Gate. And whereas the landing of Gun 
 
 Powder from on board of Ships or other VelTcIs, and the Carting thenof 
 
 into the Powder Magazines may, if not carefully attended to, be pro- 
 
 dudive of the moll fatal effecls. 
 
 I. Be it therefore enacted by the King's moft Excel- 
 lent Majefty by and with the advice and confent of the Lrgiilative 
 Council and the Allembly of Loiver-Ccinoda, condituttd and alkniblcd 
 by virtue of and under the Authority of An Act palled in the Parliament of 
 Great Britain intituled " An Att to repeal certain parts of an act palled 
 " in the fourteenth Year of His Majclly's Reign imitulcd an Aft for n;a- 
 " king more effetiual Provifion for the Government of the Provintc of 
 " Quebec in North America and to make further Provifion for llie Govera- 
 " ment of the faid Province." That from and after the publicauon of 
 this- Aft, it Ihall not be Lawful for the Mailer or Mailers ol any Ship or 
 other VefTel to enter into the Harbour o[ Montreal, which Ihall be ronli- 
 dered for this purpole to extend to the Channel on the oif lide of the little 
 llland near to the Town, with more than five pounds of Guii Powder on 
 board any fuch Ship or other Vcffel, under die penalty often pounds 
 current money of this Province. 
 
 Provided always, that it fhall be lawful to all and every Maflcr or 
 Mailers of Ships or other Veffels on arriving at the Crofs or I'oot of the 
 current near to the Town of Montreal, there to unload and land the Gun 
 Powder he or they fhall have on board of their refpective Ships or other 
 Veflels. 
 
 II. And be it enacted, by the Authority aforcfaid, that all and e^rry 
 Mailer or Mailers of Ships or other Vellels in the landing of Gun Powtler 
 at Montreal aforefaid, (hall employ Boats or Battoese\<'ry and each of 
 which fhall have fuHicienl Tarpaiilings or Oil Cloths to covt:r the lai<l 
 Gun Powder, under the penalty of Forty Shillings for each Boat or Battue 
 which (hall not be fo provided and covered.

 pipes of fuch nature and kinds as are ufed in the Indian Trade to the Wef*

 pum fhall be forfeited, and it ftiall be lawful to and for the Cuftom Houfe 
 Officer or Officers at St. John's, to infpeft and examine all packages faid 
 to contain Wampum and fhould there be found therein any prohibited 
 Goods, Wares or Merchandife, the whole of the Wampum fo packed, fhall 
 be forfeited in like manner as prohibited Goods, Wares or Merchandife.

 V. Provided nevertheless and be it enacted, by the fame Au- 
 thority, that no Quaker ffiall by virtue of ihis Acf, be qualified or permit- 
 ted lo'give evidence in any Criminal caule or to ferve on Jniie:;, or to bear 
 any oliice or place of profit in the Gcvernment, any thing herein contain-

 I. Be it therkfore enactfd, by the King's mofl Excellent Ma- 
 jclly by and with the advice and conient of the Legillaiive Council and 
 Affenibly of the Province of Lower Canada, conilituud and alTembled by 
 virtue of and undor the auihorny of an Arl piilfed in the Parliament of 
 Great Britain intituled " An Ait to repeal ceitain parts of an Aiii palled 
 " in the fourteenth year of His Majelly s Reign intituled an Aft for mak- 
 " ing more elf^clual Provihon for the Government of the Pro\ ince of 
 " Quebec in North America, and to make further Provifion for the Go. 
 " vernmrntofthe faid Province." And it is accordingly cnafled by the 
 Authority of the fame, that the fame powers and authorities heretofore 
 veiled in and exercifable by the Governor, Lieutenant Governor and cldcft 
 Councillor and ths Council ol the Province of Quebec, by virtue of the Or- 
 dinances thereof, or any or either of them, lliall and may be in future ve!"- 
 ted in and exercifable by a Court of Special or Quarter Sellions of that l>if- 
 Xnti in which the Roads and Bridges regulated or to be reophued may

 happened at Ferries on the Poll roads, the remedy whereof in future will 
 rt-quire lonie (urvcys of diRances, many enquiries refpefting the Rivers 
 interacted by the laid Roads, Diagrams of fuch as will admit of Bridges, 
 and an attention to the titles of fuch as claim the rights of ferria;;e and 
 traiifj)ortation, on ail which fubj efts, the Legillature may expect informa- 
 tion I'roni the fuper intendant of the Poll roads or any other perfon who 
 inav he appointed by the Government. 
 
 11. Be it therefore enacted, by the fame authority, that thp fu- 
 per intendant or any other perfon to he appointed by the' Govenimciit, 
 i! all and may caufe fufh furveys and dia^jram^ to be made and lay the' 
 lame before the fevcrnl Branches of the Le^jiQature in tlio fiid week of 
 the next Sellion, together with fuch Reprefentation of the enquiries he may 
 make, and the remarks they may require, the better to anfwer tiie inten- 
 tion of providing the remedies before mentioned and to the fame Ihall

 That the Governor, Lieutenant Governor or Perfon admininering the 
 Government of this Province for the time being, Ihall have the lame power 
 and authority of appointing Returning Ollicers as by the fa.d Uatutc was 
 cranted to provide for the Reluming Olhcers, to the prefent or firll af- 
 rcmhly under the fame Ibtute, and that fuch power and authority lo 
 craiued, (hall continue and be in force for and during the term of four 
 years to commence from and after tfie twemy fixth day of December m 
 the year of our Lord one thoufand feven hundred and nmciy-threeand no 
 longer. 
 
 IL Akd BE IT FURTHER IN ACT ED, by tlic fame authority, that 
 every ncrfon refuhng to perform the duty of the Ofi.ce of Returning Offi- 
 cer after his being nominated and appoi.itca thereto m manner atoreiaid, 
 and his recriptofa Writ of election, lliall forfeit the lum of twenty-f^ve 
 pounds of the current money of this Province. Provided always, that 
 each perfon named and appointed Returning Olt.cer be a rdident and 
 qualified as an Elc6\or of the County, Town or Borrough, for winch he 
 fhall have been fo named and appointed. 
 
 III And be it also enacted, by the fame authority, that every 
 Returnino- Olficer fn nominated and appointed, fhall not be obliged to 
 execute tl°f o'.ficc of Relurning (Wicer for any longer tune man one year, 
 or oliencr than once. Provided alway:, that no Member of the hxccu- 
 tive or Leiriilative Council, or Houf= of Alicmblv, or of any Keli^tous 
 Order, or any Clcrgymao, Phylician, Surgeon, Miller or Maiire de Pofle, 
 fhall be named or appointed a Returning Ollicer. 
 
 IV And be it further enacted, by the Authority aforefaid, 
 that nothing contained in this Act, ihall extend or be conllrued to extend 
 to prevent or exclude any perfon nominated and appointed, or who iiiall 
 be nominated and appointed to execute the o\\xcc of a Returning O.hccr. 
 from being eleded a Member of Alfembly, if otherwife duly qualified to 
 reprelent any County, City, Town or Borough other than any County 
 Citv Town or Borough, for which fuch perfon Ihall nave been nominated 
 and appoimed I^eiurmng Officer. Provided always that m cale of any 
 Rcturmng Officer being thus elected a Member of Ahcinbly his nomina- 
 tion and appointment to the olhce of Returning Officer Ihall thence^forth 
 ceafc and lletcnnine, unlefs fuch Returning Officer Ihall have been chofen 
 a Member of Alfembly at a general eleclion, m which cale he Ihall conti-
