TARIFF OF CUSTOMS OF THE DOMINION OF CANADA. = ' ■ ' * ]'■■ i' i;u ' '. via !>!;; • ( . ; ; .r.TM !!,,' 7t'f; ;. iti:.'; /Resolved, that it is expedient to provide that the value of all bottles, flasks, jars, demijohns, carboys, casks, hogsheads, pipes, bar- rels, and all other vessels or packages manufactured of tin, iron, lead, zinc, glass, or any other material, and capable of holding liquids ; crates, barrels, and other packages containing glass, china, crockery or earthenware, and all packages in which goods are commonly placed for home consumption, including cases in which bottled spirits, wines or malt liquors are contained, and every package being the first receptable or covering enclosing goods for purpose of sale, shall in all cases not otherwise provided for in which they contain goods subject to an ad valorem duty be taken and held to be part of the fair market value of such goods for duty And when they contain goods subject to a specific duty of Customs of twenty per centum ad valorem^ to be computed upon their original cost or value. And all or any of the above packages described as capable of holding liquids, when containing goods exempt from duty under this Act, shall be charged with duty of twenty per centum ad valorem. Bitt all packages not hereinbefore specified, and not specially charged with duty by any unrepealed enactment, and being the usual and ordinary packages in which goods are packed for exportation only, according tc the general usage and custom of trade, shall be free of duty. Resolved^ that it is expedient to provide that on all goods im- ported into Canada subject under this Act or any oiher Act to an ad valorem duty upon which a drawback of duties has been allowed by the Government of the country where the same were purchased, the amount of such drawback shall in all cases be taken and consid- ered to be a part of the fair market value of such goods, and duty TARIFF OF CUSTOMS OF '.!i Hli:.ii shall be collected thereon. And in cases when the amount of such drawback shall be deducted from the value of such goods upon the face of the invoice under which entry is to be made, the collector of customs, or proper officer, shall add the amount of such deduction and collect and cause to be paid the lawful duty thereupon. And the fair market value of all goods, wares and merchandise imported into Canada shall be understood to be the ordinary wholesale price at which the same are sold for home consumption in the country where they are purchased, without de'ducticn of any kind because of any drawback paid or to be paid thereon, or because of any special arrangement between the seller and purchaser haying reference to the exportation of such goods or the exclusive right to territorial limits for the sale thereof, or because of any royalty payable upon patent rights, but not payable when goods are purchased for exportation or on account of any other consideration by which a special reduction in price might or could be obtained. Provided that nothing herein shall be understood to apply to the general fluctations of market Resolved^ That it is expedient to provide that any or all of the following articles, that is to say, animals of all kinds, green fruit, hay, straw, bran^ seeds of all kinds, vegetables, including potatoes, and other roots, plants, trees and shrubs, coal and coke, salt hops, wheat, peas and beans, barley, rye, oats, Indian corn, buckwheat, and all other grain, flour of wheat and flour of rye, Indian meal and oatmeal and flour, or meal of any other grain, butter, cheese, fish, salted or smoked, may be imported into Canada free of duty or at a less rate ot duty than is provided by this Act upon proclamation of the Governor in-Council, which may be issued whenever it appears to his satisfaction that similar articles from Canada may be imported into the United States free of duty, or at any rate of duty not exceed- ing that payable on the same under such proclamation when import- ed into Canada. . , . United States on tea or coffee imported from Canada. Provided that the tea or coffee imported into Canada from any country other than the said United States, but passing in bond through the United States, shall be taken and rated as a direct importation from the country, wherever the tea or coffee was purchased. Resolved, That it is expedient to provide that an allowance may be made for deterioration by natural decay or breakage upon all per- ishable and brittle goods imported into Canada, such as green fruits and vegetables, crockery, china, glass and glassware. Provided such damage is found to exceed 25 per ctntum of the value thereof upon an examination to be made by an appraiser or proper officer of Cus-" toms at the first landing, or within three days of such landing. But such allowance shall be only for the amount of loss in excess of 25 per centum of the whole quantity of such goods contained or includ- ed in any one invoice j and provided the duty has been paid on the full value thereof, a refund of such duty may be allowed and paid in the proportion or fulfilment of the conditions above specified, but not otherwise, on application to the Minister of Customs. Resolved, That it is expedient to provide that m determining the suitable value of merchandise there shall be added to the cost or the actual wholesale price, or fair market value at the time of exporta- tion in the principal markets of the country from whence the same has been imported into Canada, the cost of inland transportation, shipment and transhipment, with all the expenses included from the place of growth, production or manufacture, whether by land or water, to the vessel in which shipment is made either in transitu or direct to Canada. , ,, i, . :fo;;_) \,\ ,. r ,;. Eesolvedy That it is expedient to provide that no refund of duty paid shall be allowed because of any alleged inferiority or deficiency in the quantity of goods injported and entered and which have pass- ed into the custody of the importer, under permit of the Collector of Customs, nor because of the omission in the invoice of any trade discount or othei matter or thing which might have the effect of such goods for duty, unless the same shall have been reported to the Collector of Customs within ten days of the date of entry and the said goods shall have been examined by the said Collector, or by an appraiser, or other proper officer of Customs, and the proper rate or amount of reduction certified by him after such examination. And if such collector or proper officer reports that the goods in question cannot be identified as those named in the mvoice and entry in question, then and in such case no refund of the duty, or any part thereof, shall in any case be allowed. The following articles shall be prohibited to be imported, under a penalty of two hundred dollars, together with the forfeiture ot the parcel or package of goods in which the same may be found, viz.; — Books, printed papers, drawings, paintings, prints, photographs or representations of any kind of a treasonable or seditious, or of an immoral or indecent character, Coin, base or counterfeit. -»»-08C-<»- EXCISE. m 2. Resolved. — That it is expedient to provide : — 1st. That any party in whose favor a license is granted to have and use a chemical still, shall, upon receiving the said license, pay to the Collector of Inland Revenue the sum of ten dollars. 2nd. That any party in whose favor a license for manufacturing Tobacco wholly or in part from foreign leaf is granted, shall pay therefor to the Collector of Inland Revenue the sum of seventy-five dollars. 3rd. Tkat any party in whose favor a licence for manufacturing Tobacco exclusively from Canadian leaf, is granted shall pay therefor to the Collector of Inland Revenue the sum of fifty dollars. 4th. That any parly i.i whose favor a license for manufacturing in bond for exportation is granted shall pay therefor to the Collector of Inland Revenue the sum of three hundred dollars. . 5th. That any party in whoso favor a license to have an Excise Bonding Warehouse is granted shall pay to the Collector of Irland Revenue for one such Warehouse the sum of forty dollars, and for each additional Warehouse the sum of twenty dollars. 6th. That as respects the duties of Excise on Spirits : — (a.) When the material used in the manufacture thereof con- sists of not less than ninety per cent, by weight of raw or unmalted grain, on every gallon of the strength of proof by Sykes' 11. When manufactured exclusively from molasses or sugar taken to the distillery in bond, and on which no duty of Customs has been paid, on every gallon of the strength of proof by Sykes' hydrometer, and so in proportion for any greater or less strength, and for any less quantity than a gallon, one dollar and three cents. 7. That as respects the duties of Excise on manufactured Tobacco, t'*e said duties shall be as follows : — (5) On manufactured Tobacco and SnufF of all kinds, except Cigars made in whole or in part from foreign or imported leaf Tobacco and containing not less than ten per cent, by weight of moisture, and so in proportion for any greater or less degree of moisture, on every pound or less quantity than a pound, twenty cents. (6.) On Cigars made in whole or in part from foreign or im- ported leaf Tobacco and containing not less than ten per cent, by weight of moisture, and so on in proportion for any greater or less degree of moisture, on every pound or less quantity than a pound, forty cents. (7) On manufactured Tobacco of all kinds (except Cigars and common Canada Twist), when made solely from Tobacco grown in Canada and in a manufactory where no imported or foreign Tobacco is used or kept, and containing not less than ten per cent, of moisture, and so in proportion for every greater or less degree of moisture, on every pound or less quantity than a Tponnd, fourteen cents. (8.) On Cigars made solely from Tobacco grown in Canada, and made in a manufactory where no foreign or imported Tobacco is used or kept, and containing not less than ten per cent, of moisture, 5° TARIFF OF CUSTOMS OF and so in proportion for every greater or less degree of moisture on every pound or less quantity than a pound, thirty cen^s. 8. That as respects the duty of Excise on Vinegar : — Vinegar containing six per cent, of acetic acid, the strength to be determined by such tests as may be establislied by Orders in Council, and so in proportion for any greater or less strength, on every gallon or less than a gallon,^///- cents. 9. That as respects the duty of Excise or Methylated Spirits : — Methylated Spirits being composed of Alcohol, mixed with wood naphtha in such proportions, and subject to such regulations as may from time to time be made by the Treasury Board, there shall be paid a duty of fifteen cents for every g.illon of the strength of proof, and so in proportion for every greater or less strength, and for every less quantity than a gallon. 10. That any provisions imposing any new duty, or making any alteration in any duty of Excise imposed by the Laws now i;i force, or any alteration in the mode of calculating any such duty by which the amount thereof may be increased or diminished, shall come into force immediately on the day of passing of the Act making such alterations, and shall apply to and the duties hereby imposed shall be payable on all spirits and Tobacco, Vinegar, Fer- mented Beverages or Methylated Spirits, distilled, manufactured or made, or taken out of bond for consumption on and after the said day, and such alterations as aforesaid shall apply to and the duties hereby imposed shall be payable on all malt h<"ld by any brewer, malster, distiller, or other person on the said day, 01 manufactured or made thereafter, and the duties hereby made payable on licenses shall be payable only on licenses issued after the said day, existing licenses remaining in force during the time for which they were granted. 3,, Resolved, That it is expedient to provide that the foregoing Resolutions, and the alterations made in the duties of Customs and Excise, and on the articles therein mentioned, shall take effect upon, {ind after the jpth March, instant, / ^. ... Affidavits — In all cases in which affidavits are made on an entry to cover the admis5;ion of goods at special rates for special pur- poses — such as cordage for ship purposes, coutille and horn strips for corset manufacture — the Entry Clerk should attach a memorandum of the fact to the invoice for the information of the Appraiser; and in all cases in which articles are imported for such special uses, such as for the "' fisheries" for " ships' use, corset making, &c.," the importer's own affidavit should declare that they will be actually used lor such purpose and none other. Discounts for Cash. — Invoices of Dry Goods representing less than a credit of 60 days shall be considered cash values, and shall be subject to such addition as may be necessary to bring them to the fair market credit-values. Export Duty forms part of the value for duty ; and in sugar invoices is not to be considered as an expense on where duty is to be remitted in cases of direct importation. iNVOiCEfi — No alteration in, will be allowed on the part of the Im- porter or Customs Officer, whether in regard to Trade discounts or any other matter. Invoices — Press copies or duplicates will not be accepted. The original will be insisted upon as required by law. Invoices. — The widths of all goods paying a specific duty (square measure) should be upon the Invoices. The weights of all goods paying specific duty (by weight) should be upon the invoices, weight being on or opi)osiie each line. All goods where the material of which they are chiefly made is not clearly stated, should say on the invoice, viz. : wood, tin, THE 'DOMINION OF CANADA. 53 leather, wire, brass, paper, and such like, considerable diffi- culty and tinie would be saved by adopting this plan. Making up Charges clearly form part of the value of goods for duty. Trade Di ^ounts are those discounts which are allowed to the trade generally and known as such in the acceptation of the term. These are the only discounts allowed by the Customs. Special discounts, or those which are allowed to some importers to induce them to increase their purchase, or which are allowed as discriminating in favor of purchasers from the Dominion, are not allowed by the Customs. Numbers on Cases — All cases should be numbered distinctly and the invoice marked the same. This relates more particularly to American goods coming into Canada. Weights. — Importers should be particular and give special instruc- tions, that the weight of goods is put on the invoice by the party selling the goods. It is not the duty of the Customs officers to weigh the goods for the importer before the entry is made. Foreign Currencies. — Invoices representing foreign depreciated currencies should be accompanied by an affidavit by the shipper before the British Consul at the place of purchase, as to the fact ot the purchase having been made in said currency, and a certificate from the Consul as to the value of said currency at the time. Shipping Goods to Manitoba. — (i) Make three copies of invoices. (2) Take one copy of invoice to Custom-house and have certified on the face that the goods are either Canadian manufacture or duty paid, and be particular to have it stamped with the Customs' official seal. (3) Send the certified copy and one other by mail to the consignee. (4) Hand the remaining copy of the invoice to the tompany carrying the goods to accompany them. Shipping Goods from Canada to Foreign Ports. — Make a regular outward entry. Remanifesting Goods. — Duplicate papers are made out, stamped and signed at the Custom-house. These papers are then given to the Customs Officer in charge of the goods, who sends them on with the goods. N.B. — Importers returning goods to the United States for the purpose of having anything done to them, and said goods .0 be returned, should always have the Appraiser view them, . ,^ so that a memo, can be taken, and the goods identified when they come back. 11 \ W.
