PAllTIAL MINUTES of the proceedings of the District Municipal Council for the District of Huron, holden at Goderich, this eighth day of Fehruary 1842, in pursuance of an act of the first session of the first Provincial Parliatneut of Canada, passed in the fourth and fifth year of our Soverign Lady, Victoria, and entitled, "An act to provide for the better internal government of that part of this Prov- ince, which formally constituted the Province of Upper Canada, by the establishment of local or municipal authorities therein." William Dunlop, Esquire, M.P.P., Warden. The acting District Clerk read in open council the commission of William Dunlop, Esquire, M.P.P., as Warden of the District of Huron. Daniel Lizars, Enquire, read his appointment by the Warden, con- stituting and appointing him acting District Clerk in pursuance of the 28th section of the above recited act. The Clerk read the names of the Councillors, viz:— Messrs. Chalk, Dickson, Daly, Gait, Geary, Gordon, Helmer, Holmes, R. Hodgins, J. Hodgins, Hawkins, Mcintosh, McConnell, Sebring. On the motion of Mr. Geary, Mr. John Hawkins was proposed to act as chairmiin in the absence of the Warden, seconded by Mr. McConnell. Mr. Gait proposed as an amendment that Mi. Chalk do take the chair, seconded by Mr. Dickson. On the question being put the motion was carried Mr. Gait moved that the Clerk be directed to examine into the qualifications of the Councillors in terms of the 15 Jind IH sections of the act. Seconded by Mr. Chalk.— Carried. The Council adjourned to meet at Rattenbury's hotel at 10 o'clock, a. m. Goderich, Wednesday, 9th February, 1842, The district council met this day at Rattenbury's hotel in pui-suance of the adjournment of yesterday. n 6 William Duiilop, Esquire, M.P.P., Warden, in the chair. Moved by Mr. Gait that each member be paid six pens(i for milen(?e aud seven shillings and six pence per day as compensation for expenses whilst on actual service. Seconded by Mr. Dickson.— Carried. The Council nominat and appointed Mr. Kydd, Esquire, auditor for the District Council ol Huron. Messrs. John Haldane, George Eraser, Don, Daniel Lizars, were nominated as fit and proper persons to act as Clerk of the District Council of Huron. On a vote being taken Mr. Don was elected. Moved by Mr. Daly that a seat be ])rovided within the bar for the magistrates and other officers of the district and for the ladies, seconded by Mr. Hawkins. —Cairied. Messrs. Gait, Dickson and Helmer were appointed a conmiittee to draft laws fctr the regulation of the Council. Following is the report: — 1 That all persons elected as njeml)ers of the District Municipal Council for the District of Huron, and refusing to act as such, £2 slO. 2 That the Council do meet every morning at 10 o'clock a.m. 3 That all petitions be presented to the Council the first thing in the morning of each day during session, giving preference to those having reference to schools. 4 That all parties in anywise interrupting the Council be fined not less than ten shillings, not more than £5. ANDREW HELMER, Chairman. Petition of Henry Hyndman, Esquire, Sheriff of the District of Huron, for compensation to constables and others for services at the late general election in March, 1841, was ordered to be laid on the table Moved by Mr. Holmes that all lauds liable to be assessed be taxed at one penny per acre, and one penny per pound on assessed property. Whereas it is considei'ed desirable by the County Oouncil of the said County of Huron to repeal the existing By-Li\v respecting the above named subject matters and to pass a new By-Law. Therefore be it enacted and it is hereby enacted by the said County Oouncil of the County of Huron as follows: 1. That By-Liw No. 8 of the year 1887 is hereby repealed. 2. That from and after the passing of this By-Law all Hawkers, Peddlers, Petty Chfpmen and other persons carry- ing on Petty Trades, or who go from place to place or to other men's houses, on foot or with any animal bearing or drawing any good^, wares or merchandise for sale or in, or with any boat, vessel or other craft, or otherwise carry- ing goods, wares or merchandise for sale within the said (bounty of Huron, shall before exercising the said occupa- tions or callings, or any of them, within the said County, procure in the manner hereinafter provided. Licenses in that behalf. In force. 3. But no such License shall be required for Hawking, Peddling or selling from any vehicle or other conveyance, any goods wares or mercViandise, to any retail dealer, or for Hawking or Peddling any goods, wares or merchandise, the growth, produce or manufacture of the Province of On- tario, [not being Liquors within the meaning of the L»w relating to Taverns or Tavern Licenses,] if the same are being Hawked or Peddled by the manufacturer or producer of such goods, wares or merchandise, or by his bona flde servant or employees, having written authority in that be- half, but such servant or en>i)loyees shall produce and ex- m- fire ide 101 hibit such written authority when required so to do by any Municipal or Peace OfHcer. 4. The sums to he paid for the said licenses shall be as follows: For a person exerercising or following any of the .-lid occupations or callings retjuired by this By-Law to havo a license, and who travels on foot or with one or more horses or other animals, the sum of Twenty-five dollars, and for every boat, vessel or other similar craft used by such per- son for the purpose of his said occupation or calling, the sum of Five dollars. 8. The said license shall not be transfpra'^ie, but slu'll be used only by, and shall only protect the person named therein as licensee and such licensee shall produce such license for inspection whenever required so to do by any Constable or other Officer of the Peace acting in arid for the said County of Huron, 9. That for the infraction of any of the provisions of this By-Law the party violating the same shall for each and every breach thereof, on conviction thereof, before one or more Justices of the Peace, having jurisdiction within the said County, forfeit and pay for each offense a penalty of not less than Ten dollars, njv more than Fifty dollars, and the costs of prosecutions, to be recovered in case de 102 fault is made in pHynient by distress and sale of the goods, and chattels of the otfender, and in the event of there not being sufficient distress, the offender may l>e imprisoned in the common gaol of the said County for any period not exceeding twenty-one days, with or without hard labor unless the said penalty and all lawful costs are sooner paid. 10. Any person may be cimiplainant in prosecutions under this By-f^aw. 11. One half of the penalty imposed and collected in such prosecutions shrill be paid to the prosecutor. 12. All fees received for licenses and all penalties receiv- ed in prosecutions under this By-Liw, not herein before otherwise provided for shall be paid to the County Ti-eas- urer and shall form part of the funds of the said Coimty. 13. "• And, whereas, it '.s considered by the Municipal Council of the said County to be expedient and necessary to pass a By-Law for the pui- poses above recited and hereinafter mentioned, l)e it therefore enacted by the Municipal ('ouncil of the County of Huron under and by virtue of the said recited Act and the amendments thereto, and it is hereby enacted liy authority of the sanie in manner following: lOG STANDING COMMITTEE OF COUNCIL. That a committee of five members of the Coiinoil, to be called the " Standing Committee on House of Industry and Refuge," shall be ap- pointed annually at the first session of each and every year, as pro- vided in the rules of order, whose duty it shall be to oversee the man- agement; to examine into the state of all matters and things rehiting to the support and eujployment of the pauper inni-ites, to audit all accounts quai-terly, and report thereon half-yearly to the County Coun- cil at its regular meetings in June and January, and shall itlso, at the June session in each year present an estimate of the probable amount required for the ensuing year for the support and maintenance of the poor; the said Standing Conmiittee shall have power to discharge any inmate whom they deem an improper person to l)e kept at the ex- pense of the County, and they may also admit any inmate without the order of the Reeve or Deputy-Reeve if they deem it expedient iind necessarv. wia BILLS AND CLAIMS. That nil bills and claims against the corporation for s'lppUes furn- ished the House of Industry and Refuge and Industrial Farm shnll be duly certified as being correct by the Inspector or Keeper before being ))resented for audit, and on the same being examined and passed by the aforesaid Connnittee the Warden shall be authorized to grant his orders on the County Tieasm-er for the several amounts allowed. ^l ADMISSION OF PAUPERS, &c. if'l No person shall be received into the House of Industry and Refuge for their maintenance unless in accordance with the law or upon a written order under the hand and seal of the Reeve or Deputy-Reeve of any municipality within the County, and such person must have been a resident of the County, for at le;ist one year. The expense of sending all persons to the House of Industry and Refuge shall be borne by the municipality from which such persons are sent. 107 BURIAL GROUND. That a snttable place on some part of the Industrial farm shall be selected for a V>iii-ial ground for the burial of the pauper inmates as may die in the House of Industry and Refuge (and whose friends do not claim their bodies for interment) said burial grnitud shall be fenced in and properity laid out in tiers or rows, and graves to be plainly num- bered. A burial register shall be kept in the foi-m of schedule C, to this By-Law. DUTIES OF INSPECTOR. It shall be the duty of the Inspector to see that the rules and reg- ulations hereinafter provided are duly enforced. He shall visit the House at least four times per month, hear any complaints that nmy be made and report the same to the Standing Conjinittee in the House of Industry and Refuge at its meetings. He shall also, under instructions from the said Committee, or Coun- ty Council, authorize the keeper to procure all necessary help and sup- plies for the House jind farm, and certify all bills and claims for the same to the Board of Audit, the aforesaid Standing Commrttee. The Inspector shall also, and in books to be provided at the ex- pense of the Corporation, keep the following registers and afjcounts, that is to say: I — A register of names of ail paupers, vagi-ants, etc., admitted into the House in the form of schedule D to this By-Ljnv. II. — An account of the expenses keeping, upholding and maintaining the House of Industry and Refuge and farm, in the form of Schedule E to this By-Law. III.— A burial register. Schedule C. IV. — The Inspector sh;ill also in addition to the account of exjient-- es for the House and farm, and the earnings of the farm, make a yearly report of the Coiuity Council for the year endinur with the Slst day ot December in each and every year, in the form provided in Schedule F to this By-Law with a report upon any other matter or thing he may consider of sufficient importance to bring under the notice of the Council. V. — He shall also, «)n or before the 31st day of December in each and every year, check the Inventory of personal pro{)erty belonging to the institution, and value the amount of produce on hand. ■1;,!. 108 I t "if li ill DUTIES OF KEEPER. It shall be the duty of the keeper to undertake the general super, intendence of the IJouse of Industiy and Refuge, and the Industrial Farm attached thereto. He shall not accept any person as an inmate into the said House unless he receives the commitment (Schedule 1) properly filled, in ac- cordance with this By-Law, and when not otherwise engaged shall de- vote his time in tilling and cultivating said farm, securing and harves- ting the crops, or at other manual lalior, according to the requirements of the several seasons of the year, and in order to work such farm in a skilful and husband-like manner, he shall give his attention and time for the benefit of the institution, and shall carry into effect all the rules and regulations adopted from time to time l)y the County Coun- cil for the government and management of the House. He shall also provide, under the direction of the Inspector, all the provisions required for the House, and shall see that the provisitins furnished to the in- mates are of good quality and sufficient in (piantity, and that no waste thereof be permitted. He shall not permit the use of intoxicating drinks by any of the inmates. He shall also, under the direction of the Inspector, purchase all raw materials for manufacture, and suffi- cient working tools for the full employment of such of the inmates as are able to work, and dii-ect and superintend their work and labor. He shall also keep a fair and regular accoimt in wiiting of all mater- ials, prov'isions, fuel, clothing and supplies generally furnished for the use of the institution, and of all expenses and charges attending the maintenance and support of the poor, and of all moneys received from the sale of the products of their labor or *,tJ>orwise, and shall submit the said list and ac(!ounts to the Standing Conunittee in the House of Industry and Refuge at the meeting of Ihe Siiid Committee. He shall also keep a "wearing apparel book" and therein keep a correct and particular account of each and every article issued to the inmates, and shall keep a complete inventory of all personal prt)perty in and about the place, and assist the inspector in checking the same for the piu-- pose of tile annual report; ajid also assist in the valueiiig of provisions produce, etc., on hand. He shall also keep a visitor's book in which parties v'sitiug the institution shall enter their names with any re- marks or comments tliev m.-iv see fit to make. 109 He sliall also exiiniiiie all paupers on their admission into the House, note such facts in regard to them as are important to be preserved: shall cause them to be thoroughly cleansed and suitably located, having referense to their age and sex and general character. Shall be especi- ally (rareful that the infirm inmates are treated with considerate care and kindness, and shall see that proper attention is given to the sick. He shall also see that every department, and all furniture and utinsils are kept neat, clean and in order, and that all provisions, fuel and every other article consumed in and about the pren>ises aie used with the strictest economy. He and th':« matron, or their assistants, detailed for the purpose, shall nightly visit each and every occupied room after ringing ot the retiring bell, and see that the inmates have all retired, excepting those on duty, and shall see that all the fires are made secure and safe, and that all lights are extinguished, save and excepting only where fire and lights are permitted to be kep'. for the benefit of the sick, and he shall also attend to the heating of the said building in a proper manner. He may also, for viohition of any of the rules, for disoViedience or bad conduct by any of the inmates, infliet suitable punishment at his discretion (but employ no improper means) by confinement or ether- wise, but in case of solitary confinement, not for a longer period thaii twenty-four hours, unless by the direction of the Inspectin'. All such case-« of punishment shall be recorded and reported to the committee at each session. The Inspector and Keeper shall act jointly in the sale of any pro- ducts of the labor of the inmates and a statement showing quality and pj'ice shall invariably be siilmiitted to tlie connnittee at the first meet- ing after the sale takes place. DUTIES OF MATRON It shall be the duty of the Matron to take charge and over sight of all indoor operations, and shall see that all the female inmates are provided for according to their rr>spective wants, that cleanliness both in their person and apartments is pieserved and good order and de- corum be observed at all times. She shall be careful of all the good^', I)roperty and furniture committ<>d to her charge, that the same be not lost or emliezzled. She shall direct the detailing of the women under her charge to such branches of labor as in her judgment they are best fitted to perform. 110 She shall at proper and stated times have all the clothing of the inmates and the bed clothes changed and replaced with clean apparel, and shall be vigilent over every part of the House in regard to cleanli- ness; and shall see that the female inmates observe all the rules that may be prescribed for ablution. DUTIES OF THE PHYSICIAN. It shall be the diiby of the Physician to undertaki? the sanitary supervision of the said House, and to attend all cases of sickness that may occur, including Keeper, Matron and family. He shall also in a book, to be furnished to him for that purpose, note nil cases treated by him, and in cases of death, to certify therein the cause, and shall also report in such book all the births in said House. He shall also, when called upon by the Keeper, examine any of the pauper inmates feigning illness or otherwise as to their ability to work. He shall visit the House at lea?t once a week. RULES FOR THE INMATES. 1. At the ringing of the morning bell every inmate in the House (the sick and those iu confinement excepted) must rise, dress, wash and be in readiness to proceed to work. 2. The bell will ring ten minutes before each meal, when all will leave their work and be in readiness with clean hands and faces for the ringing of the second bell, when they will repair to the dining rooms for nioi'ning prayer, and then take such seats at the table as are assigned to them by those in charge, where they must observe silence, decency and good order. 3. Aj^. the ringing of the slow bell after meals every inmate shall repair to work. 4. No inmate shall loiter about the kitchen nor shall any provis- ions or food (excepting at regular meals) be carried to any part of the House without the consent of the Keeper, nor shall any cooking be done except in the kitchen. Ill 5. At nine o'clock in the evening, at the ringing of the retiring bell, the inmates must secure the fires, put out the lights, and retire to bed in their respective apartments. 6. No inmates shall he Hllovved to trade or exchange clothing, or any other thing with any person "'honisoever, or heg of those who visit them, nor shall they receive any money or other article for any one without the consent of the Keeper. 7. All inmates shall diligently and faithfully perform the duty or task alloted to them by the Keeper, unless otherwise excused. 8. Any person guilty of drunkenness, disobedience, immorality, ob- scenity, disorderly conduct, profane or indecorous language, theft, waste, or who shall absent himself or herself from the premises with- out the permission of the keeper, or who shall be guilty of injury or defacing any part of the house or furniture therein, or who shall com- mit waste of any kind, shall be punished as the case may seem to demand. 9. In all cases of solitary confinement the prisoners shall be de- barred from seeing or conversing with any person excepting the In- spector or Keeper, or the person employed to supply their wants, and the food of such persons shall consist solely of bread and water, unless otherwise ordered by the Inspector or Physician. 10. Any person who shall have communication either directly or indirectly with any r>ne thus confined, without permission, shall be subject to punishment by a like ccmfinement. 11. No one shall go beyond the limits of the Industrial farm im- less by permission of the Keeper, nor remain out beyond the time specified by the Keeper. 12. The Sabbath day shall be strictly observed, and no irreligious diversions or unnecessary labor be indulged in. At the ringing of the bell for the purpose of assembling for re- ligious instruction and worship every person, (unless excused by Keep- er) shall appear dressed in clean apparel in the instruction room, and shall behave with decency and sobriety. No noise or disturbance shall be made in any part of the house during such exercises. 13. All persons wilfully absenting themselves from the place of meeting or violating the Sabbath day shall be subject to prompt and severe punishmenl. 112 It. Every person, previous to admission as an inmate of the House shall be subject to examination and search by the Keeper or one of his assistants. 15. No visitor shall have admission to the House on the Sabbuth dj'iy without the wi-itten permission of the inspector, or by the consent of the Keeper upon good cause shown. 10. All persons aggrieved may prefer their con)plaints to the In- spector when he is visiting the Home. OFFENCES AGAINST THE BY-LAW. That any person or persons, who shall commit any infriiigeinent oi- breach of any one of the pnn'isions, requirements, enactments, sec- tions or clauses of this 13y-La\v, or any offence against this By-Law, or any such person neglecting or refusing to obey and perform any of the reasonable orders of the Inspector, Keeper or Physician, given in the execution of the duties of their respective offices aforesaid, he, she, or they may be liable to a fine not exceeding twenty dollars, exclusive of costs, and not less than fifty cents, exclusive of costs, and in the case of non-payment of such fine, to be inflicted for any such breach ' r offence, and there being no distress found, out of which such fine ca!» be levied, such person or persons so offending as aforesaid against tie By-Law, shall be imprisoned with or withfuit hard labor, in the gaol of the County of Huron, for any period not exceeding twenty d lys, and upon an information laid, or a complaint made before any one or more of Her Majesty's Justices of the Peace of the Coiuity of Huron. That every person or persons has or have committed, or are suspected to have committed any such breach of this By-Law, such .lustice or Justices may proceed thereupon and hear and determine the matter of such information or complaint summarily in the manner and form provided b\' the statutes, and such person or persons so of- fending against this By-Law, upon conviction before such Justice or Justices shall forfit and pay such fine as may to him or them seem meet, not exceeding twenty dollars, exclusive of costs, and not less than fifty cents, exclusive of costs, as aforesaid (together with costs if ordered) such fine to be paid to the Treasurer of said county and to form part of the fimds of the said- coi-poration of the Coimty of Huion and in the event of non-payment of the fine imposed by such Justice or Justices, together with the costs if ordeied, inuntdiately oi within 113 such p.^riod as siioli Justi •« or Justices at the time of conviction ap- points, thereupon such Justice or Justices may issue his or their war- rant of distress for the purpose of levying the same out of the (roods and chattels of the person or persons so otfendinj?, and if there he no distress found out of which such fine can he levied then such Justice or Justices may adjudge the offender to he imprisoned in the gaol of the said county, there to he kept, with or without -hard lahor, for any space not exceeding twenty days, unless such costs and charges there- upon shall sooner he paid. VISTORS. The Warden of the County, for the time h.'ing, the Inspector up- pointed under this By-Law, and the members of the House of Indus- try and Refuge Committee, appointed annually, shall have admission to the House and out buildings at all times. The members of the County Council shall he visitors to the said House of Industry and Refuge and to be^entitled to admission to all parts ot the said House and premises Ht all times. OFFICERS. 1. Whereas it is necessary to amend By-Law No. 4, of 1895, to make other provision for tlie payment of accounts in connection with the House of Hcfuge and Industrial Farm, and also to appoint a physician of thf. House of Refuge in place of Dr. ('ampbell. Be it therefore enacted by the t'orporation of the Comity of Huron and it is hereby enacted, that at the eiul of each month the Keeper shall make out a list of the accounts for that month, that the Inspec- tor shall examine said lists and if correct certify to the same and for- ward to the County Clerk, and that the Warden shall therefore iss\ie his orders on the Treasurer for the respective amounts. The original accounts to be kept by the Inspector and produced at the meetings of the Council, to be examined and reported upon by the Finance Committee. 121 The salaries, and supplies furnished by tender, to be dealt with quarterly instead of monthly, and in the same manner. BY-LAW NO. 3, 1898. To amend By-Law No. 4 of 1894, so that a person before being ad- mitted as an inmate of the County House of Refuge, must have been a resident of this County for two yefirs at least, and that every order of Committee shall be countersigned by one County Councillor of the District or Division from which the inmate is sent or resides. Therefore, be it enacted by the Council of the County of Huron, that By-Law No. 4 of 1895, be amended in the clause for "Admission of Paupers, &c.," by striking out the words "one year," and in pl(u;e thereof inserting the words " two years." And that an order for commitment shall bf countersigned by one County Councillor of the Division in which the inmate resides. This By-Law shall take effect immediately on the passing thereof. WM.
