 of any part or parts of any Ordinance or Ordinances or of any Act or Acts of the

 Imporutions, Exportations, Duties or otherwise, for carrying on the Trade by

 Ill And His E.^cellencv the Governor in Chief by and with the advice oiid con- 
 sent of the said Executive Council doth further order that before any such Flour 
 so permitted to be imported as afoiesaid into this Province from the said United 
 States shall be allowed to pass any of the hereaflc/ mentioned ports of* entry and clear- 
 ance, a Bond shall be entered into by the Owner or Importer thereof, with two suf- 
 ficient Sureties,, to His iVlajesty, His UeirsandSuocessc*-" in double the valueof the 
 aaid F.our that the same and every part thereof shall be Vvcll and truly exported from 
 this Province, and that no part thereof shall be consumed therein j whicb Bond 
 shall not be afterwards discharged or delivered up uutil a Certificate sliall have been 
 obtained from the Collector and Comptroller of His Majesty's Customs at the 
 Pojc of Quebec, that the Flour for which such Bond shall have been given as 
 aforesaid, has been duly shipped for exportation from this Province-, which 
 Certificate the said Collector and Comptroller are hereby required to grant, upon 
 the oath of the Owner of the said Flour or that of liis Agent, that the said Flour 
 or Meal so shipped for exportation is the same for which Bond may have been

 be removed whh tlieir marks and numbers, and certifying that such goods or 
 comZiitie have been duly entered at the Port of St. Jolm or C6teau du Lac or 
 rhTa rrv respectively, and that the Duties thereon have been paid or secured

 time within which the said protection shall be m force. 
 
 XL And His Excellency the Governor in Chief; by and with the advice and 
 consent of the said Executive Council, doth further order, that any goods or 
 commodities imported or brought in or upon any vessel, boat, raft or carnage from 
 any po.t or place in the said Umted States shall not be unladen, or delivered 
 from such vessel, boat, raft or carria ;e at the said Forts of St. Joh« or C6teau du 
 Lac or Chateauguay, but in open day, that is to sa), between the nsing and set. 
 ting of the Sun. except by special licence for that purpose from the chief Oihcer, 
 of the Customs at the sdd Port of St. John or Cdteau du Lac or Chateauguay. 
 and if any goods or commodities shall be unladen or delivered contrary to the 
 directions aforesaid, or either of them the master or person having the command 
 or charge of such vesseF, boat, raft or carriage, and every other person who shal 
 knowingly be concerned or aiding therein, or in removing or secreting the said 
 coods or commodities, shall forfeit and pay a sunt not less than five pounds, nor ex- 
 ceeding fifty pounds for each offence, and all such goods or comuiodiiies so un- 
 laden or delivered, shall become forfeited and may be seized by any Ofhcer ot 
 the Customs, and when the value accoiding to the highest market price of t le 
 jjame shall amount to twenty pounds, the vessel, boat, raft or carriage with tlie 
 tackle, apparel, furniture, harness and horse or horses, thereunto belonging, shall 
 ako become forfeited, and shaU and may be seized by any Officer of the Customs. 
 
 XIL And His Excellency the Governor in Chief, by and with the advice a.id 
 consent of the said Executive Council, doth further order, that no dutiable 
 goods or commodities imported or buought into this Province in or upon any ves-

 duty of all Officers of His Majasty's Customs whalsoeycr. to seize and secure 
 any vessel, boat, raft or carriage, goods or conunodit.es vvh.ch shall be hable 
 to seizure by viriue of this order, as well vvithuut as within ^^^^^F.^'^V^l^^Z 
 Districts within this Province ; and all goods or conunodities which shall he 
 seized by virtue of this order, shall remain in the custody ot the seizing Olhcer 
 until sucii proceedings shall be had as by Law are required to ascertain wh. her 
 the same have been forfeited or not, and all penalties and forfeitures created by 
 this order, shall be recovered and declared in any ot His Majesty s Courts having 
 iurisdiction in this Province, in the same manner and form, and upon the same 
 evidence and by the same rules and regulations as any penalties or forfeitures 
 incurred for any offences against the I^ws relating to the Customs and Trade ot 
 of His Majesty's (olonies in America, may now be recovered or declared lor- 
 feited in such Courts respectively ; and in all cases of penalties or forfeitures 
 incurred by virtue of this order, after deducting the charges of prosecution from 
 the gross produce thereor, the remaiu.ler shall be paid and divided as tol lows, 
 that is to fay: one-fourth to His Majesty, one-fourth to the Governor ot this 
 Province or Person administering the Government thereof, one-fourth to the seiz- 
 in*' Officer suing for the same, and one fourth to the Collector and Comptroller ot 
 the Customs, at the Custom-House to which the seizing Officer belongs, or to

 aggrieved. 
 
 XXI And His Excellency the Governor in Chief, by and with the advice and 
 consent of the said Executive Council, doth hereby further order and direct that 
 all Monies that shall arise by Duties and be paid at ihe said Ports of St^ John or 
 cLeauT Lac or Chateauguly, shall be oaid by the Collector at each o the .a.d 
 Ports respectively into the hands of His Majesty 's Receiver-General ot this Pro- 
 vince for the time being, deducting therefrom tor levying, collecting, recovering 
 and paying, answering and accounting for the same three per cent, and all other 
 miavoiLble, necessary and accustomary charges. Provided always that nothmg 
 herein contained shall extend or be construed to extend to au honze such doduc- 
 Son from any monies levied by virtue of any Act or Acts ot the Provincial Parh- 
 ament of Lower-Canada, by which such deductions are prohibited. 
 
 XXII And His Excellency the Governor in Cliief, by and with the advice 
 of the said Executive Council, doth hereby lastly order, that so inucli ot earh 
 and every Ordinance of this Province and of each and every Act of the Pr(>vin- 
 cial Parliament of Lower-Canada, which iaany manner or vvay is and shall be 
 found to be reaugnant to this order or to any provision, direction or regulation, 
 therein contained, shall be and the same to all and every intent and purpose

 leil Executif, enjointet ordonne en outre par le present, que tons les argents qui 
 proviendront des droits et auront et6 payes aux dits Ports de St. Jean, du Cdleau 
 duLac, ou de Chateauguay seront pay^s par le Collccteur dechacun des dits 
 Ports, respectivenient, entre les mains du Receveur G^n^rai de Sa Majeste, de 
 cette Province, pour le temps d'alors, apres une deduction faite sur iceux a raison 
 de trois par cent pour preiever, recueiller, recouvrer et payer, r^pondre et rendre 
 compte des droits susdits, ainsi quede tous autres fiais indispensables et coutumiers. 
 
 jPourvu toujours queriende contenu par le present ne s'elendra ou no sera en- 
 itendu s'etendre aautoriser une semblable deduction sur aucun des argents pielev^s 
 [en verlu d'aucun Acte ou Actes du Parlement Provincial du Bas-Canada, qui 
 Iprohibent telles deductions. 
 
 XXII. Et Son Excellence le Gouverneur en Chef, par et de I'avis du dit Conseil 
 JExecutif, ordonne par le pre»e it en derniere instance, qu'autant de toutes et 
 Ichacunedes Ordonnances d ; cette Province, et de tous et chacun des Actes da 
 iParlement Provincial du Bas Canada, qui en aucune maniere ou voie sont ou
