And, whereas, it is desirable to consolidate the broken amounts (being the ratepayers' share) named in the several By-laws, and also to raise and consolidate the several arhounts which make up the said sum of $251.00 and to raise by loan on the credit of the city the said sum of $251.00 with interest thereon at the rate of 4 per cent, per annum for ten years. Therefore, the Municipal Council of the Corporation of the City of Ottawa, enacts as follows : X. That the amounts mentioned in the said several By-laws as the ratepayers' portion of the cost of the improvements^ be, and the same are hereby consolidated, and that a sum not exceeding $251.00 being the property holders' proportion of the cost of the said improvements as shown in the preamble to this by-law be raised by loan by this Cor- poration on the security of the special rates imposed m the several by- laws above named, and that the debt so to be created is further guaran- teed by the municipality at large, and that debentures not exceeding in amount the said sum of $251.00 be issued by the said Corporation therefor, and it shall be lawful for the Mayor of the said municipality to raise by way of loan upon the security of such debentures and special rates aforesaid, from any person or persons, body or bodies corporate, who may be willing to advance the same upon the credit of the deben- tures to be issued hereunder, a sum of money not exceeding in the whole the sum of $251.00 as aforesaid, and to cause the same to be paid mto the hands of the Treasurer of the said city for the purposes and with the objects above recited. 2, That it shall be lawful for the said Mayor to cause any number of debentures to be made for such sums of money as may be- required, of not less than one hundred dollars Canadian currency, and not ex ceeding in the whole the said sum of $25 i.oo as in the preceding section mentioned, and that the said debentures shall be sealed with the seal of the said Corporation and be signed by the said Mayor and Treasurer. n 3 That the said debentures shall be made payable on the 21st day of December, A. D. 1906 at theoffice of the Quebec Bank in the City of Ottawa, and shall have attached to them coupons for the oav- ment of interest. ^ ' 4. That the said debentures shall bear interest at and after the rate of 4 per cent, per annum from the date of the issue thereof, which mterest shall be payable half yearly on the 21st days of the months of June and December in each year at the said office of the Quebec Bank in the City of Ottawa. 5. The said debentures shall be made payable on the ist day of March, A D, 1907, and shall bear interest at the rate of 4 per cent per annum', payable on the 1st day of March and on the ist day of Sep- tember in each year. 5. And, whereas, the said Council is of the opinion that it is inequitable to charge the whole cost of the said improvement on the lands fronting thereon ; And, whereas, the said Council has ascertained and finally deter- mined that the following lands are benefitted by the said improve- ment, and that the costs of thereof shall be assessed against the lands so benefitted in «^^he following proportions : Area No. i . And, whereas, for paying the interest and including a yearly sink- ing fund for paying the said sum of $2,100.00 and interest, as here- inafter mentioned, it will require an equal annual special rate of 4 7/^ cents per foot frontage on the said streets named in the first area of the property described in the said first area.; and 3 4-10 cents per foot frontage on the said streets named in the seeond area of property described in the said second area ; and 2 3-10 cents per foot frontage on the said streets named in the third area of the property described in the said third area, to pay the interest and create an annual sinking fund for paying the* said principal debt of $2,100 00 within ten years, accord- ing to law, which said debt is created on the security of the special rate settled by this By law, and further guaranteed by the municipality at large. And, whereas, it is expedient to grant the prayer of the said petition and to raise the said sum of $2,100.00 by debentures of the Corporation of the City of Ottawa to defray the expense of the opening up and extension of the said street. Therefore, the Council of the Corporation of the City of Ottawa enacts as follows : 48 i'mi 1. Sparks street shall forthwith be opened up and extended Irom Concession street westerly to Wellington street, in the City of Ottawa, according to a plan to be approved of by the City Engineer and under his direction., 2. It shall be lawful for the Mayor of the City of Ottawa to raise by way of loan upon the security of the debentures hereinafter mentioned, from any [)erson or persons, body or bodies corporate, who may be willing to advance the same upon the credit of such debentures, a sum of money not exceeding in the whole the sum of $2,100.00 and to cause the same to be paid into the hands of the Treasurer of the said City, (or the purposes and with the objects above recited. 3. During the twenty years, the currency of the debentures to be issued under the authority of this Bylaw, the sum of $84.00 shall be raised annually for the payment of interest on (he said debentures ; and also the sum of $74. 55 shall be raised annually for the payment of the debt, making in all the sum of $158.55 to be raised annually as afore- said, and an annual special rate on the real property benefitted by the said improvement of 4}i cents per foot, is hereby imposed on each foot frontage on the said streets of the property so described in the first area : and 34-10 cents percent is hereby imposed on each foot frontage on the said streets of the property so described in the second area ; and 23-10 cents per foot is hereby imposed on each foot frontage on the said streets of the property so described in the third area, over and above all other rates and taxes, which said special rate shall be sufificient to produce in each year the sum of $158.55 and shall be annually inserted in the Collector's Roll lor Dalhousie Ward in each year for the next succeeding twenty years, and shall be payable to and collected by the Collector in the same way as the other rates on the said Roll. 4, During the period of twenty years the currency of the said debentures, the said above described real property shall bt exempt from any general rate or assessment for the like purpose, except the cost of works and improvements at the intersection of streets, and, except such portion of the general rate as may be imposed to meet the cost of works and improvements opposite real property which is exempt from such special assessments, and the general rate which may be impoged to meet the cost of maintenance and repairs on works and improve- ments constructed under Local Improvement By-laws. 5. The sum of $2,100.00 shall be raised by way of loan by this Corporation on the security of the special rate hereby imposed and further guaranteed by the municipality at large ; and debentures amounting to the sum of $2,100.00 shall be issued by the said Corpor- 49 ation therefor in sums of not less than $ioo each, and the said deben- tures shall be sealed with the seal of the said Corporation, and be signed by the said Mayor and Treasurer thereof. 6. And, whereas, the cost of the opening up and extension of the said street will be $1,015.00 and of this amount, the City disburses the sum of $507.50 as its share of the cost of the said improvement, and the remaining $507.50 is to be repaid by the pro'perty owners within the aforesaid limits, and is the amount of the debt created by this By- law. And whereas, it will require the sum of $20.30 to be raised an- nually for a period of ten years, the currency of the debentures to be issued under and by virtue of this By-law to pay the interest of the said debt to be created by this By-law. Also, the sum of $43.40 to be raised annually during the said period for the payment of the debt to be created by this By law, such sum of $63.70 being sufficient, with the estimated interest on the investment thereof, to discharge the said debt when the same becomes payable. And, whereas, the total amount to be raised annually by special rate for paying the said debt and interest thereon is $63.70. And, whereas, there are one hundred and fifty-four feet of frontage of the said assessable real property on the streets aforesaid, according to the said description in the first area hereinbefore mentioned, im- mediately, directly, equally and specially benefitted by the proposed improvement ; and one thousand two hundred and fifty-four feet of frontage of the said assessable real property on the streets aforesaid, according to the description in the second area hereinbefore mentioned immediately, directly, equally and specially benefitted by the proposed improvement, making in all 1,408 feet of frontage of the assessable real property on the streets aforesaid according to the said description im- mediately, directly and specially benefitted by the proposed improve- ment. Thornton street shall forthwith be opened up and extended Irom Bank street to Monk street, in the City of Ottawa, according to a plan to be approved of by the City Engineer and under his direction. 2. It shall be lawful for the Mayor of the City of Ottawa to raise by way of loan upon the security of the debentures hereinafter mentioned, from any person or persons, body or bodies corporate, who may be willing to advance the same upon the credit of such debentures, a sum of money not exceeding in the whole the sum of $507.50 and to cause the same to be paid into the hands of the Treasurer of the said City, for the purposes and with the objects above recited. 3. The sum of $507.50 shall be raised by way of loan by this Corporation on the security of the special rate hereby imposed'and further guaranteed by the municipality at large ; and debentures amounting to the sum of $507. 50 shall be issued by the said Corpor- ation therefor m sums of not less than ^100 each, and the said deben- tures shall be sealed with the seal of the said Corporation, and be signed by the said Mayor and Treasurer thereof. 6. If at any time the owners of the said real property hereinbefore described, or of any part thereof, shall desire to commute the assess- ment imposed by this By-law by the payment of his or their propor- tionate share or shares of the cost thereof, as a principal sum in lieu thereof, he or they may so commute by the payment of 63 cents per foot frontage on the property described in the first area ; or 34 J4 cents per foot frontage on the property described in the second area at any time during the first year after the passing of this By-law, or in any subsequent year, by the payment of a similar sum reduced by one tenth thereof for each year during which the said annual special rate shall have been actually paid. 9. All monies arising out of the said annual special rate, and all monies received in communication thereof under the preceding section of this By law shall be invested by the City Treasurer, under resolution of this Council, from time to time, as the law directs. 10. And whereas it is necessary that such annual sum of $4252 shall be raised and levied in each year during the said period of twenty ye'ars by a special rate sufficient therefor on all rateable property m the municipality in the City of Ottawa. And whereas, the amount of the whole rateable property in the City of Ottawa, according to the last revised assessment rolls of the said city, is$2i,947.635- And, whereas, the amount of the existing debenture debt of the Citv of Ottawa, exclusive of local improvement debts secured by special acts, rates or assessments, is the sum of $3,166,957, of which no part of the principal or interest is in arrear. :•#,. j 80 Therefore the Council of the Corporation of the City of Ottawa enacts and ordains as follows : 1. Being a by- law to provide for the issue of debentures for water works purposes to the amount of seventy-five thousand dollars. Whereas by an act of the Legislature of the Province of Ontario, passed in the sixtieth year of her Majesty's reign r\nd chaptered 72, intituled "An Act respecting Local Improvements m the City of Ottawa and for other purposes," it is among other things enacted that for the purpose of enlarging and extending the water mams m certam streets of the City of Ottawa and enlarging and improvmg the pumpmg machinery and other appliances with a view to the better protection of the property of the citizens against fire, it shall be lawful for the Council of the Corporation of the said City of Ottawa to pass a by-law or by-laws to authorize the issue of debentures of the said Corporation for a sum of money not exceeding the sum of seventy-five thousand dollars ($75- 000,00) as therein provided. And, whereas, it is expedient and desirable iri the interests of the ratepayers and residents of the City of Ottawa to raise upon the credit of the municipality of the City of Ottawa, the sum of $75.0°° ^o be expended in the enlarging and improving of the water works system of the city of Ottawa, as hereinbefore mentioned. The Standing Committee on Fire and Light shall have, subject to the orders and resolutions of the City Council, and subject to the special powers herein- after conferred upon the Chief of the Department, the management and control of the Fire Department and shall have full power and authority over its government and shall have control of the buildings, engine houses* and all other property and furniture belonging to the Department. 2. The said Committee shall have power from time to time to make such rules and regulations as they may consider necessary for the care and protection of ail property belonging to the Fire Department ; for deter- mining the qualification of all persons appointed to oflice or membership in the said Department; for im- posing reasonable fines and forfeitures upon the officers and members ; and generally, for the government and good order of the Department, and for the manacle- raent and extinguishment of fires occurring within the City, but no such rules and regulations shall have any force or effect until they have been submitted to and approved of by the City Council. OFFICERS AND MEMBERS. 3. The Fire Department shall consist of a Chief two Assistant Chiefs, a Secretary, a Medical officer' a Captain for each fire station, a Superintendent and an Assistant Superintendent of the Fire Alarm TeWraph and such other ofticers and members as may from time to time be appointed as hereinafter provided, but no person who has not be?a a resident of the City of Qtt^yj^ if ■Mi %'i ' 92 for two years or mure, or wlio is under the ajrc of twentv-one years or over the asje of twenty-sc^veii yi^&n shall bo appointed as an officer or member of the Fire Department, exoeptino; that in tlie case of an Engineer the age limit shall be thirty years. 4. Upon the enrolment of any person as a member of the Department he shall bo entitled to. receive a certificate that he is so enrolled, which certificate shaU contain the date of his admission and such other particulars as the Committee may consider necessary and expedients. 6. The otficers of the Fire Department with the exception of the Captains, shall be appointed by the Council. The Captains and all other members shall bo appointed by the Chief. 7. The salary or remuneration of all officers and members in or connected with the Fire Department shall be determined by the Committee subject to the approval of the Council. 8. SUPERINTENDENT OF FlliE ALARM TELEGRAPH. 15 The Superintendent of the Fire Alarm Tele- graph shall have the entire charge of the telegraph and of the telegraph lines, instruments, battery and the battery room, and all other apparatus belongmg thereto, and shall keep them in workmg order ; and for this purpose he shall at all times have access to the instrumentri in the Fire Station and other places on the lines He shall give practical instructions to persons in the Department and to all telegraph key holders. (2) To check and certify all accounts for lighting the City, and forward the same to the Committee. (3) To report to the Committee locations or places where lamps or ligh.a are required, and all applications tor lamps or lights, and to see to the erection of the same when ordered by the Committee. (4) To renort to the Committee the number and location of all lamps on the streets and squares of the City not lighted or kept lighted as required by the contract between the City Corporation and the Ottawa Electric Company. 16. The Assistant Superintendent of Fire Alarm Telegraph shall perform all such duties as the Super- intendent may require, ai»d in his absence shall per- form the duties of the Superintendent. MEDICAL OFFICER. 17. The Medical Officer shall examine all applicants who may be selected for positions in the Fire Depart- ment and report the result of such examination to the Chief of the Fire Department. He shall also at the request of the Chief visit any member of the Depart- ment who is reported unfit for duty, through illness, and report to the Chief the condition of such member. He shall receive such remuneration as shall be agreed upon. APPARATUS. 18. Whenever the Corporation shall not have a sufficient number of horses to dravvthe engines and other apparatus to and from lires, the Committee may contract with such person or persons as they may consider ad- visable for securing and hiring the services of such good and efficient horses and drivers as they may con- sider necessary, to be kept always in readiness for hauling and driving the engines and other apparatus to and from fires, and for 'the performance of such other duties connected with the Fire Department as may be determined upon 19. The whole apparatus and management of the Fire Department shall be under the direction of the Chief. He shall have sole and entire control over all engines, apparatus, appliances and equipments, officers and members of the Department and overall persons engaged at any fire, and shall have power to dismiss or suspend, subject to the penalties of this By-law, any officer, member or other person engaged at any fire, who shall refuse or neglect to obey any legal order either of himself or a superior officer. 20. No engine, hose or othr ■ apparatus or property of the Fire Department shall be lent or applied to any private use, without the permission of the Mayor of the City or Chairman r f the said Committee. 21. In the event of a fire occurring in a munici- pality adjoining the City, and City property may bo thereby endangered, tiie Chief of the Fire Department may in his discretion allow the use of the City fire appliances to prevent the spread of such tire. FIRES. 22. Every member of the Fire Departtnent shall attend as expeditiously as possible at every fine within the City and shall use his utmost endeavours to extinguish the same. 23. All piersons at or near any fire shall assist at ex- tinguishing the same, and in removing furniture, good^ and merchandise from any building on fiie or iu dan- 99 ger thereof, and in guardinor and securing the same, and in demolisliing any house or building (if oecasion reqrire) wlien ordered so to do by the Cliief, Assistant Chiefs or any other officer of the Department in com- mand at the fire. 34. Tlie Chief or other officer in charge at any fire may cause to be pulled down or demolished, adjacent houses or other erections when necessary to prevent the spreading of any fire, but not otherwise. 25. The Chief or other officer in charge at anv fire, niay in his discretion prescribe the limits in the vicinity of atjy fire within which no person, horse or vehicle (including street cars) shall be permitted to come unless they are residents therein, or are admitted by order of an officer of the Department, or Police officer, and any person who shall without permission enter upon any portion of such limits during the time the same shall be closed, shall be subject to the pen- alties of this Bv-law. 26. On all occasions of fire, the side of the street nearest the fire, and for a distance of fifty feet on each side of the fire and for two-thirds of the width of the street in front thereof, and also the centre of the street on both sides of the space above described for such distances as may be necessary for the working of the Department, and also any lane or by-way between the public street and the rear of any premises on fire, through or along which it may be necessary to run any oortion of the fire apparatus, shall be kept clear by the rolice constables of all persons who may in any way obstruct the working of the Fire Department, and all persons who shall be in any of the said places shall immediately retire therofrum when called upon so to do by any otiicer of the Department or Police Officer. RULES AND REGULATIONS. 27. All officers and members of the Fire Depart- ment shall be furnished with a copy of the Rules and Regulations foi' the government of the Department, and it shall be their duty to conform to all the require- ments, and to perform all the dut^ies therein contained, i- 100 REWARDS. 38 Any person who distinguishes himself in the performance of a gallant act, by which life or property 18 saved, shall bo entitled to the presentation of a medal or such othei reward^as the Council may by resolution direct. »3. When any person, who, while engaged in his duty as a fireman, or other person assisting in extin- guishing a fire at the request of the Chief or other officer in command at any tire, has received any iriurv resulting in death, his widow and orphans (if any) shall be entitled to receive such pecuniary aid m the Coun- cil may by resokition determine. GENERAL PROVISIONS. 30." It shall be the duty of the Chief, Assistant Chiefs, Captains, and every member of the Fire Department, and every employee engaged in the Fire Department who may be in charge of or have occasion to use any property of the Fire Department, to take good and proper care of such property of the said Corporation as he may have occasion to use or bo in charge of, and !ie shall not lend, give away or use the same or any part thereof except for the purposes of the said Corporation. 31. Whereas the resident ratepayers of that portion of Metcalfe street lying between the south side of Maria street and the north side of McLeod street, in the City of Ottawa, have petitioned for the prohibition of heavy traffic and the driving of cattle, sheep, pigs and other animals in the said portion of said street, and that it is advis- able to grant the prayer of the said petition. Therefore the Council of the Corporation of the City of Ottawa enacts and ordains as follows : 1. That after the passage of this By-law no person or persons shall convey or cause to be conveyed any load of goods, wares, mer- chandise or lumber, containing in weight over 1,500 pounds, in any cart, truck or waggon or sleigh or other vehi( le or conveyance for the carriage of goods, in or over that portion of Metcalfe street lying between the south side of Maria street and the north side of Mc- Leod street, in the City of Ottawa ; nor shall any person or persons drive or cause to bj driven cattle, sheep, pigs or other animals in or over the said portion of said street. Provided however that the prohibition aforesaid shall not apply to the portion of any other street crossing the said portion of Metcalfe street aforesaid. 2. Any person or persons who shall be guilty of any infraction or broach of this By-law, or of nou-compliance with any of the re- (luirements thereof, shall, upon conviction thereof before the police magistrate, mayor, or any justice or justices of the peace having jurisdiction in the matter, forfeit and pay such fine as the said police magistrate, mayor, justice or justices convicting shall iuflict, of not less than one dollar and not more than fifty dollars, together with the costs of prosecution ; and in default of payment thereof, the same shall be collected by distress and sale of the goods and chattels of the offender, and in case of non-payment of the fine in- flicted for any such breach, and there being no distress found out of which the same can be levied, such offender shall be imprisoned in the common gaol of the County of Carleton, with or without hard labor, for any time in the discretion of the police magistrate, mayor, justice or justices so convicting, not exceeding six months, unless such fine and costs be sooner paid. f-^n. 116 Given under the Corporate Seal of the City of Ottawa this 7th day of July, A.D. 1897. Whereas under end by virtue of a resolution of the Council of the City of Ottawa, dated the 3rd day of May, 1897, a certain agreement was authorized to be entered into with the Ottawa Elect- ric Railway Company in the words and figures following : Memorandum of agreement made this twenty-second day of October, A. D. 1897 BETWEEN The Ottawa Electric Railway Company hereinafter called the " Company " of the First Part AND The Corporation of the City of Ottawa, hereinafter called the " Cor- poration " of the Second Part Whereas the Company have made an application to the Cor- poration for permission to construct and lay additional tracks as hereinafter mentioned. And WHEREAS the Council of the said Corporation dealt with the said application by a resolution passed at the meeting of the Council held on the 3rd day of May, 1897, adopting the Report of the Board of Works of the said Council in the words and figures following : " Your Board have considered the application of the Ottawa Electric Railway Co., asking permission to lay additional tracks within the city, and recommend that permission be granted the said railway to lay the following tracks : (a) A branch from their tracks on Bridge street, along Head street, to the premises of the McKay MiUing Co. (6) A branch from their tracks on Bridge street, a^ong Oregon street, to connect with the tracks of the Canadian Pacific Railway ; i ■h m 186 (c) A turnout from their tracks on Bridge street, connecting with the tracks of the Canada Atlantic Kailway on that street, on the understanding that they will submit plans shewnig the exact proposed location of said tracks, and that they will agree to make such changes in the location as may be required by the City En- gineer and that they will sign, before commencement of work an agreement to be prepared by the City Solicitor and approved by His Worship the Mayor, binding the Company to pay all expenses in connection with the work, and also protecthig the city's interests in the future maintenance and repairing of said tracks. 5. Your Board also recommends that the City Clerk be re- quested to write to the Ottawa Electric liy. Co., stating that the Council will grant them permission to lay a single track on the south side of Archibald street, from their Elgin street track to Cartier street, on the understanding that they will remove their present track on Elgin street, between Archibald street and the Canada Atlantic Railway." And whereas the Company has agreed to the terms and con- ditions imposed by and stipulated in the said resolution of Council. Now THIS AGREEMENT WITNESSETH that in Consideration of the covenants and agreements on the part of the Company in these presents contained, as well as the covenants and agreements men- tioned in a certain original agreement bearing date the 28th day of June, 1893, a copy of which is hereto annexed marked " A" and made between the Corporation of the First Part, the Ottawa City PassencTcr Railway Company of the Second Part, and the Ottawa Electric Street Railway Company of the Third Part, the Corporation doth hereby give and grant to the Company (in so far as the Cor- poration can legally 'o so) permission and authority to construct, complete, maintain i operate during the balance of the term of thirty years mentioned in the said original agreement, a single iron street railway, the propelling power of which shall be electricity, as follows : (a) A branch from their tracks on Bridge street, along Head street, to the premises of the McKay Milling Co. (h) A branch from their tracks on Bridge street, along Oregon street, to connect with the tracks of the Canadian Pacific Railway. S. 0., 18U7, en- titled "The Street Railway Act," and any amendment' or amend- inents thereto that may have aeretofore been enacted or that may liereafter be enacted from time t(j time during the currency of this agreement so far as the same shall not be inconsistent herewith. In consideration of the said permission and authority the Company for itself, its successors and assigns doth hereby covenant and agree with the Corporation, its successors and assigns, as follows- 1. That the Comj)any shall and will in the construction of their railway on the said streets use only such rails as may be ap- proved of before the laying of the same by the City Engineer of the Corporation. 2. That the works to be performed by the Company shall be consiructfd and carried on, and shall be in all respects subject to the terms of the said original agreement and the Street Railway Act and amendments thereto, that have heretofore been enacted, or that may hereafter be enacted, from time to time, during tb^ cur- rency of this agreement, so far as the same shall not be inconsistent herewith. 3. That the said Company shall and will in all respects ob- serve, perform, keep and fulfil with reference to the said works, and to all matters and things in connection therewith all the terras conditions, covenants, stipulations and provisions contained in the said resolution of the Council hereinbefore referred to, and in the said original agreement, which said terms, conditions, covenants stipulations and previsions are hereby made applicable to the line of railvay and additional lines of railway mentioned or referred to in the said resolution of the Council. 4. That the Confpany shall and will indemnify and I.eep in- demnified and save harmless the Corporation at all times from all costs, damages and expenses of every nature and kind whatsoever, winch the Corporation may be put to or have to pay by reason of the exercise by the Company of its powers or any of t"hem, or by reason of the neglect by the Company in the execution of its works or any of them, or by reason of the improper or imperfect execution m 138 of its works or any of thoiii, or by reason of the said works becom- ing unsafe or out of repair, or otherwise howsoever ; and sliould the Corporation incur, i)ay or be put to any such costs, damages or ex- penses the Company shall forthwith upon dem ,ad repay the same to the Corporation. 5. That except as h-rein set forth the said agreement of the 28th of June, 1893 (herein called the original agreement) and the said Street Railway Act and amendments thereto and herein mentioned, shall apply to the said additional or substituted lines of railway hereinbefore nentioned or authorized hereby, and especially the terms thereof as to maintenance of the tracks and rails thereof, and to the removal of snow from the streets on which the same may be built and the period of time for which the charter or permission to operate said line of railway shall continue and the rights of the Corporation to acquire and assume the ownership and the works, plant and property, real and personal, used in connection therewith and as to the fares to be charged passengers and the transfer privi- leges enjoyed by passengers, and also all other stipulations and terras thereof in any way applicable to the branches hereby men- tioned or authorized. It being hereby understood and agreed be- tween the parties hereto that the said original agreement shall be read with and form part of these presents. 6. That the Company shall and will remove the old track on Elgin street, between Archibald street and the Canada Atlantic Railway, and will leave the said street in good condition to the sat- isfaction of the Citv- Engineer. 7. That the Company shall and will do all the necessary grad- ing to lay the proposed tracks, on all the said streets hereinbefore reteiTed to at their own expense, leaving the streets in as good re- pair as they were at the commencement of the work, and shall and will maintain, repair and keep in repair the tracks and rails on the said streets to the satisfaction of the City Engineer. 8. That before commencing the work >n the turnout from their tracks on Bridge street, the Company shall and will submit to the Corporation plans showing the exact projjosed location of said tracks and w)'l make such changes in the location thereof as may be re- qu-' a oy the City Engineer. Being a By-law to amend By-law No. 1077 of this Council. The Municipal Council of the Corporation of the City of Ot- tawa enacts and ordains as follows : 1. That By-law No. 1077 be and the same is hereby amended by striking out the 5th section of said By-law and substiti.tinc/ in lieu thereof the following : ^ " 5- No transient trader or other person who occupies premises "in the Municipality of the City of Ottawa and is not entered upon '• the Assessment Eoll, or who may be entered for the first time on " the Assessment Roll of the said Municipality in respect of income "or personal property, shall offer good 3 or merchandise of any des- " cnption for sale by auction or in any other manner conducted by " himself or by a licensed auctioneer or by his agent or otherwise " within the limits of the said City of Ottawa without or until he "first shall have duly obtained a license for that purpose. Pro- " vided always that the sum paid as license shall be credited to "the trader paying the same upon and on account of taxes for tba « unexpired portion of the current year, as well as any subsequent " taxes, should such trader remain in the Municipality a sufficient " time for taxes to become due and payable by him, and in any other " event to be taken and used by the Municipality of the said City '* of Ottawa as a portion of its license fund; and provided further " that this section shall not affect, apply to or restrict the sale of the " stock of an insolvent estate which is being sold or disposed of " within the said City of Ottawa whe e the insol ent carried on " business therewith at the time of the issue of a writ of attach- " ment or of the execution of an assignment."
