A'A'A'.— 34 Vkf. le re le id III >n Her Majesty, by and with the advice and consent of the Lcgishitive Council and Legishitive Assembly of Manitoba, enacts as follows : 1. There shall be appointed in each Parish a Pound- keeper, by the Lieutenant-Governor, who shall take charge of all animals taken up for trespass, or as estrays, and who shall be responsible for their custody and shall collect all damages and charges for keep and other incidental expense.^, before delivering up the animal to the owner. 2. It shall be the duty of the Pound-keeper imme- diately to inform the owner of any animal impounded, of the fact, or if the owner be not known, to advertise in English and French in a local newspaper three times, giyinn- as near as possible all the marks, natural and artificial, color and 'probable age ; and if after the expiration of thirty days from the date of the last adver- tisement no owner be found, the Pound-keeper shall advertise the sale of the said animal by public auction, by posting notices in three of the most public places in the parish giving at least a week's notice of the sale. 3. If the sale of the said animal produces more money than is necessary to defray all legal charges, the surplus shall be paid into the County Treasury, but if the pro- ceeds of the sale be not sufficient to cover all charges, the Pound-keeper's claim shall take precedence of all others. And if at any time within six months after the date of sale, the owner of said animal or animals should be known, the surplus amount which may be in the hands of the County Treasurer, over and above the payment of all expenses connected with the sale of said animal or animals shall be paid to the owner thereof on application by him to the County Treasurer. 4. No person shall take up any stray animal unless such person shall be at the time a resident within the parish wherein such stray animal shall be found, and unless such stray animal be found doing damage upon vnod or occupied by the Under. aU., 1.-.- -l_ 5. XXIII.—d4: VicL Whereas, it is expodient that provision he made for tho prevention of the too early progeniture of Lambs, and the consequent loss entailed uponthe stock-breeders in the Province ol Manitoba : Therefore, Hei Majesty, by and with the advice and consent of the Leg-ishitive Council and Legislative Assembly of Manitoba, enacts as follows. 1. It shall be unlawful for any person or persons owning a Kam, or Earns to allow them, or any ofthom, to run at large from the first day of August to the lirst day of November in each year. 2. Any person or persons may capture any Ham found running at large within the time prescribed by this Act, and shall be entitled to recover the sum of Two Dollars from the owner of any such Ram, on laving a complaint with a Justice of the Peace for the County, and shall be entitled ovn- and al)0ve the said sum, 'to a fm-ther sum of Twelve Jents for each and every day during whicli he has the Kam conlined. 3. If the capturer of any such Ram so captured,, knows the owner thereof, he shall immediately notify him of the capture, and if not, he shall publish it in one of the local newsi^apers, or post a notice at the Church door, or the School-house nearest the place of capture, and the owner of any Ram or Rams shall not be entitled to clai:.n his property imtil he shall have paid all expenses as herein provided. 4. It shall be unlawful to permit any Stallion of two years old, or upwards, to run at large, and any Stallion found running at large, may be captured and delivered to the keeper of the Pound of the Parish in which such capture shall have been made, and the keeper of the Pound shall give notice in the English and French lansuau-es, ])y advertisement in the newspapers of the *=r-"-o' Province, of sucli animal being- in liis eliarge, and tlio owner of such animal shall "be liable to a line not- exceeding- Ten Dollars, one-half of which sum shall be, paid to the keeper of the Pound in trust for the person from whom he r«^ceived the Stallion captured, and the other half of such line shall accrue to the Treasury of the Province, and the owner shall pay the cost of advertisement, and twenty-five cents per diem ibr the keeping- of the animal while the same is in the Pound, before any such iStalliou shall be delivered over to any Kuch owner. Cap, XXL- -3o Vict. IXku M.v.TESiTY, by and with the advice and consent of the Legislative Council and Legislative Assembly of Manitoba, enacts as follows: — 1. The second clause of this Act shall be amended by inserting after th(^ word " days," and before the "word "from" in the sixth line, the following words : — ■"As regards horned cattle, horses and mules ; and in the case of sheep, pigs, and goats, ten days." Cap. XXX.—m Vict. IL It shall be unlawful for any pinson owning a bull or bulls over nine months old, to allow them or any of them to run at large between the lirst day of March and the lirst day of December, and any ])ersou so al- lowing his bull or bulls to run at large, shall bo lined in a sum not exceedmu- ten dollars. Prosecutions under Jhis Act shall be Summary, and may be disposed of by any Justice of the Teaco residinu- in the locality in which the olh-uee is com- mitted, and the lines arising therefrom shall be paid into the hands of the Trovincial Treasurer for the benefit of the Province. V. Nothing in this Act shall prevent the party nggrieved from recovering damages from the owner of the animal or animals through which any damage has been caused. YI. This Act shall, till furthcn- amended, extend only to the western part of the C'ounty of Manpiette, com- mencing at the eastern limits of Electoral Division No. 4, or l^oplar Point and extending westward to the western boundary of the Province ; and apply only to animals of the discription above given, the projicrty of residents of the said District or County. Any bull or boar belonging to persons residing without the said District may be removed beyond the limits of the same, Avithout imi)osiiig thereby any expenses on the same : Provided always that such animal be not r(>movod out of the limits of the Province nor be injured in any way. XXXII.— m Vict. ■VViiEiiEAS it is expedient to amend the Act passed in the 34th year of Her Majesty's reign, intituled : An Act concerning Stray Animals ; therefore, Her Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of Manitoba, enacts as follows : L In the first line of the first clause of the Act hereby amended, the words " parish a " are hereby struck out, and the following words inserted thereto, " electoral division one or more." 1. It shall bo the duty of the round-koopor imme- diately lo nilonn the owner of any animal impounded ot the tact, or if the owner be not known, to cause public notices to ))e posted ui> in three of the mon* public plac<-s in the electoral division, Drovided always that in the case of animals exceeding in value the sum of $15, to be ai)praised by one of the n-urest Justice^' nf the Peace, it shall be the duty of the round- keeper to advertisi^ the same three times in a local J!.ngiish and h^rench newspaper, giving as near as possible all the r irks, natural and artilici-1, color, and probable age of such animal ; and if after the expira- tion ot fifteen .lays from the date of the posting up of saia notices, or three days from the date of the last advertisement, as the case may be, no owner be found, the Pound-keeper shall advertise the sale of the said animal by public auction, by posting iip notices cf such sale as aforesaid, giving at least eight days' notice ot such sale; audit the owner be known and after being duly informed, neglects or refuses to pay all damages and other expenses connected with the im- pounding of such animal, within five days after being informed of the fact, the Pound-keeper may forthwith offer such animal for sale by public auction, giving at least one day's notice cf such sale. IT. The third clause of the Act hereby amended will be also struck out, and the following clause substituted thereto : 8. If the sale of Ihe said animal produces more money than is necessary to defray all legal charges, the surplus shall remain in the hands of the Pound- keeper ; but if the proceeds of the sale be not sufficient to defray all legal charges, the Pound-keeper's claim shall take precedence of all others ; and if at any time within six months after the date of sale the owner of such animal should be known, the surplus amount which may be in the hands of the Pound-keeper, over and above the payment of all expenses connected with the impounding and sale of such animal, shaii be paid to the owner lliereof on application by him to the Pouiid-koopor, who shall tak(» a recoipt for iho samo ; provided always that after the expiration of six months from the date of such sale, if no owner be known, the I'ound-koepcr will transmit the said surplus amount to the Provincial Secn'tary ; and for the purposes of this Act, Pound-keepers may exercise the powers of auctioneers, and for every animal so sold lie shall be entitled to a fee of one dollar, III. And after the word " finder," at the end of the fourth chmse of the Act hereby amended, the following- words will be added, " and unless such lands be i)ro- perly enclosed." And any person known to harbor or keep any animal or animals not belonaino' to him shall be liable to a fine not exceeding twenty dollars, which fine may be levied in a summary manner before a Justice of the Peace on the oath "of one credible witnes.s.
