This Association shall be known as the St. Lawrenob Division, No. 9, op the Sons op Tempeeance, of Canada East, article: 119— l^lctig^ No brother shall make, buy, sell, or use, as a beverage, any Spirituous or Malt Liquors, Wine, or Cider.* ARTicjLs: III.— ^Mcet^. The Officers shall consist of a W. P., W. A., R. S., A. R. S., F. S., T., C, A. C, I, S., and 0. Sect. 1.— It shall bo the duty of the W. P. to pre- side in the Division, enforce a due observance of the Constitution and By-Laws, and exact a compliance to the Rules and Usages of the Order ; to see that all Officers perform their respective duties ; appoint all committees and officers not otherwise provided for ; give the casting vote on all matters before the Division, when a tie may occur ; inspect and announce the result of all balloting or other votes ; direct the R. S. to call special meetings when application shall be made in writ- ing, by five members of the Division ; draw upon the T. for all sums necessary to pay the benefits provided for by the Constitution and By-Laws, and other appropriations made by the Division. He shall, on the night he va- cates the chair, see that the Quarterly Returns are pre- pared for the Grand Division, and the per centage appro- priated, and forward the same in time for the Quarterly Session, certified by him, with the seal of the Division. He shall perform such other duties as the Division or his charge shall require. Sect. 2, — It shall be the duty of the W. A. to render the W. P. such assistance as he may require of him, and in the absence of the W, P., the W. A. shall perform his duties. Sect. 3.— The R. S. shall keep a fair and impartial re- cord of the proceedings of the Division ; write commu- nications ; notify all Subordinate Divisions not more than ten miles off its place of meeting, within one week after , of the name, occupation and residence of every person suspended, rejected or expelie-ii from this Division. He shall fill up certificates ; notify meetings when ordered by the W. P. ; attest to all monies ordered to be paid at a regular meeting, and none other. He shall make out at the end of his term, for the Division, a full report of the proceedings during his term ; and also the quarterly re^ turns to the Grand Division, which shall embrace the number of members initiated, admitted by card, initiated by dispensation, suspended, re-instated, and who have withdrawn during his term — together with the names and occupations of those suspended, expelled, and rejected, with the dates, and causes of expulsion, the number who TUB SAINT LAWRENCE DIVISION. '^ violate the pledge, how many sign over, and how many violate it the second time, the number of deaths, and the whole number of actual contributing members— -the amount of receipts for initiation fees and dues, with the per cen- tage due the Grand Division— the amount expended for benefits, with the amount on hand — and, with the W. P., certify to the same. He shall perform such other duties as may be required of him by the Division or his charge ; and deliver up to his successor, within one week from the expiration of his term, all books, papers, or other property in his possession belonging to his office. Sect. 4. — The A. R. S. shall be an aid to the R. S., under whose direction he shall act. He shall render such assistance to the R. S. in the performance of his duties, as he or the Division may require of him. Sect. 5.— It shall be the duty of the F. S. to keep just and true accounts between the Division and its members ; credit the amounts paid, and pay the same over to the T. immediately, taking his receipt. He shall, just previous to the close of his term, notify every member who is two months or more in arrears, of the amount due by him to the Division, adding 7)^d. to each notice. At the end of his term, he shall make out for the Division a full report ; and furnish the R. S. with the amount of receipts for ini- tiation fees and dues during his term, with any other infor- mation connected with his office necessary to enable the R. S. to prepare correct returns for the Grand Division. He shall perform such other duties as the Division or his charge may require of him. He shall deliver up to his successor all matters appertaining to his office in his pos- session. Sect. 6. — It shall be the duty of the T. to pay all or- ders drawn on him by the W. P., attested by the R. S., and none others ; he shall receive all monies of the Divi- sion, and hold the same until the expiration of his term, unless otherwise ordered by the Division. He shall keep a full and correct account of all monies received and ex- pended. He shall give the Division a monthly statement of the funds ; and deliver up, when legally called upon, all monies, books, papers, and other property of the Divi- sion, to his successor in office, or to whom the Division may specially appoint. He shall perform such other du- ties as may be required of him by the Division or his charge. CONSTITUTION OP Skct. 7.— It shall be the duty of the C. to introduce for initiation persons who have been previously elected. Ho shall seethattlio officers* regalia are in their proper places at the opening of the Division, and take charge of the same at the close. He shall have charge of such property of the Division as may not be otherwise provided for, and render a full report to the Division at; the end of his term. Skct. 8. — It shall be the duty of the A. C, to render such services as the C. or Division may require of him. Skct. 9.— It shall be the duty of the I. 8. to attend the door— to admit none but members of the Order, and can- didate,'-' tor initiation. fcfix'T. 10 — The O. S. shall guard the door outside, and keep oiT intruders. ARTICLE 5;~l£((8tt(Wti) for iWembm^Jp* Sect. 1. — No person shall be initiated into this Divi- sion under eighteen years of age, nor for a less sum than ten shillings. Skot. 2 — No person shall be admitted into this Divi- sion who does not possess a good moral character, or who is in any way incapacitated from earning a livelihood, or has no visible means of support. Provided, that persons of old age, or under disability or disease, may be admitted, hut remain in the position < f members not entitled to be- nefits. Skct. 3, — The name of a person offered for member- ship must be proposed by a member in writing, stating age, residence, and business, which must be entered on the jecord, and the subject reierred to three brothers for in- vestigation, who shall report in writing at a succeeding meeting, when the candidate shall be balloted for with ball ballott^, and if not more than iour black balls appear against him, he shall be declared elected; but if five or more blauk balls appear, he shall be rejected, and so declared. Sect. 7» — Any brother applying for membership by deposit of card, shall he subject to the same ballot as a new applicant. ARTICLE 6.— ©onttibudon^ mt> ^tntfit^. Sect. 1. — The regular dues to this Division shall not be loss than three pence per week. Sect. 2. — Every bona fide member, who shall be quali- fied as required by the Constitution and By-Lixws of this Division) shall, in case of sickness or disability, be enti- tled to, and receive weekly, not less than One Dollar ; except it be shown that such sickness or disability be • brought on by his own improper conduct. Nevertheless, this Division may suspend benefits by a two-third vote of the members present at a regular meeting, after two weeks' notice of such action. Sect. 3. — No brother residing within five miles of the Division of which he is a member, shall be entitled to benefits for more than one week previous to his case being reported to such Division. No benefits shall be granted for a less time than one week. All arrears, either for dues or fines, shall in every case be deducted from the first payment. Sect. 4. — In case of the death of a brother entitled to benefits, the sum of not less than Fifteen Dollars shall be appropriated as a funeral benefit. The W. P., in the ab- sence of competent relations or friends, shall take charge of the funeral, and keep an account of the disbursements. Sect. 6. — On the death of the wife of a brother, also beneficial, he shall be entitled to the sum of not less than two pounds ten shillings, as a funeral benefit. it 8 CONSTITUTION OP V » i i ARTICLE 7.—©ffettCc, Sect. 1. — Any member who shall offend against these Articles, or the by-Laws, shall be subject to be fined, re- primanded, suspended or expelled, as two- thirds of the members present, at iny regular meeting, may determine. Sect. 2. — Every member shall be entitled to a fair trial for any offence involving reprimand, suspension, or expulsion ; but no member shall be put on trial, unless charges, duly specifying his offence, be submitted in writ- ing by a member of the Division. Sect. 3 — When charges have been preferred against a brother in a proper manner, or any matters of grievance between brothers are brought before the Division, they shall be referred to a special committee of five members, who shaU, with as little delay as the case will admit, sum- mon the parties, examine and determine the matter in question ; and if their deoisior does not involve the sus- pension or expulsion of a mcniber, and no appeal be taken from it to the Division, it shall be final, without other ac- tion. Should the committee be convinced of the necessity of suspending or expelling a member, they shall submit a motion for the purpose to the Division, for action. Sect. 4 — When a motion for the expulsion or suspen- sion of a member shall have been submitted in due form, it shall be announced at one regular meeting previous to action being tuken ; and the accused shall be summoned to be in attendance at the Division, at the time when it may have been determined to consider the question — at which time, whether the implicated member be present or not, the Division may proceed to consider and determine it. Two-thirds of the members present voting in favor of the motion, it shall be carried ; but the Division shall be ful- ly competent, while such motion is under consideration, to vary the penalty from the original motion.* Sect. 5. — When the decision of a committee appointed under Sect. 3 of this Article, otherwise final, shall not be satisfactory to all parties, either of those interested shall have the privilege of an appeal to the Division ; and at the time appointed for trying the appeal, the committee shall present to the Division, in writing, the grounds on « A member suspended for the period of six months o r longer, for Ron-payment of l^duesi may be admitted as a new member. THE SAINT LAWRENCE DIVISION. 9 which their decision was founded ; and the parties shall have the privilege of being heard before the Division ; and the Division shall determine the correctness of the deci- sion of the committee by a majority of votes present. Sect. 6. — Any member having been expelled, shall not be proposed for membership under six months from the date of expulsion. Sect. 7. — The provisions of this Article shall not ex- tend to violations of Article 2. ARTICLE 8.— ^am^. Regular Quarterly Terms shall commence on the first of October, January, April, and July, Officers elected previous to the expiration of half the Term, shall be enti- tled to the full honours of the Term. Those elected after half the Term has expired, shall not count the honours, except where they may be elected to fill vacancies occa- sioned by resignation, suspension, expulsion, or death, in which case the brother who serves the residue of the Term shall be entitled to the full honours, and he who resigns, or is suspended or expelled, shall forfeit his claim. ARTICLE e.—IEHsiMUts foe ®iiicf iJ^ffices, , Sect. 1. — After a Division has been instituted three terms, no brother shall be eligible to the office of W. P. unless he has served a regular quarterly term as W. A., norshall any brother beeligible to the officeof W. A., unless he has served two terms in a subordinate office or offices, or as Chaplain. Sect. 2. — No brother shall be eligible to the office of W. P. , VV. A., or T.» who is under twenty-one years of age. ARTICLE 10.-Fio!atins Article 2. Sect. 1. — Any member who knows a brother to have violated Article 2, nnd neglects to prefer the charge and ' specify fha offence to the Division, within three weeks af- ter the violation shall have come to his knowledge, shall be fined five shillings. Sect. 2, — The charge for violation of Article 2, shall be presented in writing, duly signed, when it shall be re- ferred to a committee of five members, who shall, as soon as practicable, summon the parties, and investigate the matter. 10 CONSTITUTION OF l.h ii; ;i^ 1 1 Sect. 3. — The committee shall organize by appointing a chairman and sf ^cetary. The secretary shall make a correct record >f a proceedings, with such testimony as may be presenter ^ which record shall be produced to the Division on the call of any member, after the committee have reported. Sect. 4. — If the committee agree that the charge is sus- tained, they shall report the fact to the Division, by reso- lution, with a second resolution to the effect that the bro- ther be reinstated or expelled, as the case may be ; which report and resolutions shall lie upon the table at least one week, and the offending brother sliall be notified of the character of the resolutions, by the R. S.,and requested to be present at the time appointed for considering the same, with a view of giving him an opportunity to make a de- fence. Sect. 5. — If the committee agree that the charge is not sustained, they shall report a resolution to thateffecf, and if the resolution be adopted, the charge shall be dismissed. Sect. 6. — When the committee report the charge sus- tained, and a majority of the members present at a regular meeting ballot in favour thereof, the offending person shall forfeit his membershin, and the W. P. shall direct his name to be erased from the Constitution. If a majority of the Division vote in opposition to- the resolution, all fur- ther proceedings shall be stayed, subject to appeal.* Sect. 7. — If two thirds of those voting are in favour of reinstating a member who has been found guilty of violat- ing Article 2, he shall be restored to membership by re- signing the Constitution, and paying, for the first offence, five shillings, and for the second offence, ten shillings, which shall be paid to the F. S. by the meeting succeeding the vote, or the member to stand suspended until the fine is paid. The power to reinstate, however, shall not extend over the term of one month from the time the offence was proven. Sect. 8. — When the Division vote in favor of reinstate- ment, and the member neglects to come forward to sign the Constitution for one month thereafter, he may be de- clared expelled by a two-third vote. * Erasure of name for violation of Art. P., and the R. S. shall give the usual notice. jf» ScT. 10. — A member convicted of violation of the pledge, after the second time, can be re-instated by a two- third vote of the Division, the Division prescribing the penalty. Sect. 1 1 . — If a brother come forward and acknowledge that he has violated Article 2, (except it be the third of- fence,) the Division, after erasure of name, &c., may, at their option, reinstate him on the same evening, if two- thirds of the members voting are in favour thereof. Sect. 12. — An officer or representative to the Grand Division violating Article 2, shall not be eligible to fill any official positi(vn for twelve months from the time he is re- instated. Sect. 13. — A member expelled under this Article shall not be eligible for membership under six months thereaf- ter. ARTICLE 11. The Divi- sion shall be opened at Eight o'clock, P. M., precisely. The Division shall come to order within ten minutes of the appointed time, and in the absence of the W. P. and W. A., the senior P. W. P. present shall take the chair. Sect. 'I, — Ni»< members shall constitute a quorum for the transaction of business; at any meeting of this Divi- sion. Sect, 3 — No brother shall be permitted to enter the Di- vision, unless clothed in regalia. Sect. 4. — Special meetings may be called in accordance with article IV. of the Constitution, but no appropriation of money shall be made except at a regular meeting. P. shall be chairman of the visit- ing Committee, and in case of the sickness of a brother he shall appoint, in rotation, two brothers to act as watchers, who shall attend to such duty or provide a substitute, under the penalty of five shillings, provided always, that the disease be not contagious, infectious or dangerous to others, in which case the committee shall, if necessary, employ a nurse, to be paid from the funds of the Division. Sect. 4. — It shall be the imperative duty of the W. P. to enforce the penalties of the Constitution and By-Laws upon any brother who renders himself liable to them, un- less excused by a two-third vote of the Division. Sect. 5.— It shall be the duty of the R. S., to record in the Black Book the names and residences of all persons rejected, suspended, or expelled from. this Division, with the dates, and causes of rejection, suspension, or expul- sion, and also the names of parties reported from other Divisions as rejected, suspended, or expelled* Sect. 6. — Upon the election of any person as member of this Division, the R. S. shall forthwith give written notice thereof to the individual so elected, ard such elec- tion shall stand good for six weeks and no longer, unless the candidate is unavoidably absent from town, or disabled by sickness. Sect. 7. — It shall be the duty of the F. the Bonds of the Trustees and Treasurer, same in trust for the Division. S. to receive and hold the Sect. 8. — The Treasurer, prior to his installation in otfice, shall give a joint and several Bond to the W. P., or his successor in office, in the sum of Twenty Five Pounds, with two sureties, to be approved of by the Division, for the faithful performance of his duty as Treasurer; and he shall at the end of each month, pay over to the Trustees all sums exceeding Twelve Pounds Ten Shillings, taking their receipt, which shall be his voucher for the same. ' ARTICLE 3.— atimds^iom _^ ; Sect. 1. — Every brother, on being, admitted, shall sign the Constitution and By-Laws of this Division, and thereby agree to support the same, and pay all legal de- mands against him, so long as he remains a member. He shall also furnish the F. S. with his residence, and in the case of changing or removing, he shall notify him thereof, within one month thereafter, under the penalty of One Shilling and Three Pence. iSect. 2. -^Before a Candidate is initiated in this Divi- sion, it shall be the duty of the W. A. to enquire of him whether he is subject to any hereditary or intermittent disease, which will be likely to render him chargeable to the Division : and if it shall afterwards appear that the Candidate concealed any knowledge of this kind from the Division, it shall debar him from receiving any bene- fits in case of disability resulting or having origin from such disease. ARTICLE 4.— 13utg of iWemi&erjs. Sect. 1. — When a person has been proposed for mem- bership, the fact that such a proposition has been made, shall not be mentioned by any brother to any person who is not a member of tJds Division, until a decision shall have been had on the proposition, and not then, unless such decision is favorable. Sect. 2. — It is particularly enjoined that all members of this Division shall treat each other with courtesy and respect, and that all ungenerous remarks, personal allusions, or sarcastic language, be carefully avoided, by which the feelings of any brother may be wounded, and the most prominent objects of our institution (tem- perance, benevolence, and harmony,) be diminished or interrupted ; and that all discussions be conducted in that spirit of candor, moderation, and open generosity, which is productive of concord and good fellowship ; and it shall be the duty of the W. P. to suppress any thing to the contrary. A., on Thursday, and the W. P. on Friday, all of whom shall render a verbal re- port at each meeting of the Division, until the brother is declared well ; and either of the Committee failing to visit the sick on the day appointed for him so to do, shall be fined One Shilling aud i Three Pence^ for each case ; sickuess or absence from the city only excepted. The Visiting Committee shall be exempt froni watching with the sick. Sect. 2. — Investigating Committee* — It shall be the duty of the Investigating Committee to receive the pro- positions for membership, and if not personally acquaint- ed with the Candidates, they shall call upon the References, and ascertain their character and health, and make their Reports to the Division : they shall have access to the Black Book, and make themselves acquainted with the matters therein recorded. Sect. 3. — Committee of Finance and Audit. — It shall be the duty of this Committee to examine all Bills and Accounts against the Division, and if in their opinion cor- rect, they shall endorse their names^upon the same. They shall audit the accounts of the F. S. and T., and report at the next meeting after their appointment. Sect. 4. — Special Committees. — All Committees ap- pointed for special purposes shall report their doings, in writing, to the Division, signed by a majority ; and no person shall be appointed Chairman of any Committee un- less he be present at the time of appointment. Sect, 1 . — Every elected officer, who shall absent him- self from the Division at the time of its opening, &hall be subject to and pay a fine ofseven pence half-penny, t^hould either the R. 8. or F. S. fail to have their books in the Divisionat the opening of the same, he shall forfeit and pay the^sWn of two shillings and sixpence. Shonld the officers when duly notified, fail to attend any special meet- ing whftn convened by the W. P., they shall be subject to the same fines as at regular meetings. Sect. 2. — Any elected officer absenting himself for thre© successive nights of meeting (except in case of sickness or absence from town) shall be liable to have his seat declar- ed vacant by a vote of the Division. Sect. 3.— Should the R. S. refuse or neglect to attend to the duties required of him, under sections 5 and 6 of arti- cle 2, he shall be subject to pay the fine of one shilling and threepence for each offence. Sect. 4. — If any member be convicted of felony, fraud, or any disgraceful. crime, or be guilty of any conduct bringing disgrace and reproach upon the Order, or if he follow any. wicked or improper practices, or use any unlaw- ful means in procuring a livelihood, if proof be made there* of, he shall be fined, suspended, or expelled, as the Divi- sion may direct. Sect, 5. — Any member who shall in the Division make use of any profane or indecent language, or refuse to obey the commands of the W. P. when called to order, or use disrespectful expressions towards the officers or members, shall be subject to a fine for each offence not exceeding fivo shillings. Sect. 6. — Any member who shall divulge the name of a brother who has voted against any person proposed to become a Bon of Temperance, or misrepresents the discussions of the Division, so as to' cause disturbance or angry feelings among the brethren, or reveals private business done in this or any other Division to a person not a Son of Temperance, shall be fined not less than two shil- lings and sixpence, suspended, or expelled, as the Division may determine. Sect. 7.— Any brother receiving benefits from the Di- 'Vf' 18 BY-LAWS OF 11 vision, who may be found imposing thereon, by feigning sickness or disability, shall be fined, suspended, or expel- led, as the Division may determine. THE CHAIR. The W. P. shall state every question coming before tiie Division, and immediately before putting it to vote, shall ask, " Is the Division ready for the question?" Should no brother rise to speak, the W. P. shall proceed to state the question, and after he has risen, no brother shall be permitted to speak upon it. The term Kegular Standing, as used in these By-Laws, or elsewhere, shall be understood to mean, not being, un- der suspension, or being indebted to the Division for three months' dues or more ; and any member having been so indebted, shall not be considered in good standing, until after the lapse of thirteen regular nights of meeting, from the date of his paying the same, nor shall any brother who has been suspended, and re-elected, be considered in good standing for a like period after his re-election.
