FEINTED BY JOHN LOVELL & SON. 1882. i2 STATUTES, RULES AND ORDINANCES OF BISHOP'S COLLEGE, ENACTED BY THE COEPOEATION. I. OF THE CORPORATION GENERALLY. 1. The Corporation consists of the Bishops of Quebec and Montreal, and such persons as they shall appoint as members of the Board of Trustees, and of the (JoUege Council, as hereinafter provided. 2. Five members of the Corporation shall form a quorum, provided that the Board of Trustees and the College Coun- cil shall each have a representative present. 3. The Senior Bishop of the Church of England in the Province of Quebec shall be President of the Corporation, and the other Bishop or Bishops Vice-Presidents. 4. The President shall preside at all meetings of the Corporation, and in his absence the Senior Vice-President. If neither President nor Vice-President be present a Chair- man shall be chosen by the meeting. 5. The Corporation shall meet at Bishop's College an- nually, on such day as the President, or in his absence from the Province the Senior Vice-President, shall appoint. The Senior Vice-President shall also, in such absence, exercise all the powers and privileges of the President. 6. Special meetings shall be held at other times as the President shall judge necessary ; or upon the requisition of any three members of the Corporation ; — such meetings to be held at such time and place as the President shall appoint. 7. Notice of all meetings shall be given in writing to each member, at least one week before the time appointed for holding such meeting, stating the object or objects thereof; and no alteration or amendment of the original and funda- mental regulations of the Corporation shall be made at any- meeting of the Corporation, unless notice of such altera- tion or amendment shall have been given in writing to each member of the Corporation at least one month previously to such meeting. All questions at such meetings shall be determined by a majority of votes of those present, includ- ing that of the President, who shall have a casting vote. 8. There shall be a Standing Committee of the Corpora- tion, consisting of the Chairman of the Board of Trustees, the Principal of the College, the Bursar, and one other member, whose duty it shall be to meet at such time and place as they shall see fit, to ]irepare and digest business for the Corporation at its meetings. Nevertheless it shall be in the power of any meniber of the Corporation in his place to propose such measures as he shall deem expedient. 9. The seal of the Corporation shall be kept by the Registrar. II. OF THE TRUSTEES. 1. The mode in which the Trustees are appointed is laid down in the Act (o4th Vict. c. 48). They shall have the direct disposal and management of the funds of the College, of the buildings, and of all other property belonging to it, whether fixed or moveable ; and the President of the Corporation, or his attorney duly appointed to that effect under his hand, shall have power to execute, by affixing the College S?al, any instrument whatever, by which any property shall be alienated or acquired. |hall ach for of; da- "y ura- cil sly be |jd- 2. The Trustees shall hold such meetings as shall be found necessary, at the call of their Chairman (to be elect- ed by themselves), or at the requisition of any two True- tees ; with power to adjourn as they i)leaae. They shall also have power to ap])oint out of their own number a Standing Committee for the transaction of ordinary busi- ness ; which business shall be defined at a meeting of Trustees called for that purpose. Notice of all general meetings shall be given in writing to each member, at least three days beforehand, by the Chairman, or, in his absence, by any two Trustees. At all meetings three Trustees shall form a quorum. 3. All proceedings of the Trustees shall be communicated to the Corporation at its meetings. III. OF THE COLLEGE COUNCIL. 1. The mode in which the members of the College Council are appointed is laid down in the Act (34th Vict c. 48). 2. The Principal of the College, or, in his absence, the Vice- Principal, being members of the College Council, or, in their absence, a Chairman elected by the members, shall preside at all meetings. 3. The Council shall meet at the call of the Chairman in the College, after three days' notice, to deliberate upon such matters as may be submitted by the Principal or any other member of the Council. Three shall form a quorum. 4. The Council shall have power at any such meeting to make and establish rules, orders and regulations not contrary to the Statutes, Eules and Ordinances, for the better government of the affairs of the College, whether relating to morals, learning, the good government or the economy of the house. 6 5. All rules, orders and regulations made by the College Council shall be eoinniunicated to the Coii)oration at their meetings, who may amend, alter, rescind, or confirm the same. IV. OF THE VISITORS. 1 . The President and Vice-Presidents of the Corporation, acting jointly, or singly after communication with one another, are Visitors of the College, with power to inspect from time to time the state of the College, its concerns, management and proceedings ; to adjust dis- putes; to di.ect and enforce the reformation of any irregu- larity, neglect or abuse ; and for this purpose to call before him or them any officer, resident graduate, student, or ser- vant of the College ; if need be, acting jointly, to remove or suspend any such officer, resident graduate, student, or servant for misconduct or incompetence, and to make such further provisions or regulations as may seem to him or them expedient ; — Provided always, that such provisions and regulations be not contrary to the principles on which the College is founded, that they be approved and signed by a majority of the Visitort;, and that they be laid before the Corporation at their next ensuing meeting and be su oject to their approval ; but such provisions and regulations shall have force and effect until altered or annulled by the Cor- poration. 2. The President of the Corporation, as Senior Visitor shall interpret the Statutes in doubtful caseij. v.— OF THE PRINCIPAL, VICE-PRINCIPAL AND OFFICERS OF THE COLLEGE. 1. The Principal, Vice-Principal, and Professors of the College shall be communicants of the Church of I jllt'ge their |i the ition, [1 one !r to )llege, t dis- Cor- England, and shall, before entering upon the duties of their respective offices, take the oath of allegiance, and shall subscribe the thirty-nine articles of Religion and the three articles of the thirty-sixth Canon. The enact- ments of this section are not to be taken as applying to the Professors in any School of Law or Medicine connected with Bishop's College. 2. The salaries, fees and emoluments of the Principal and Otiicers of the College shall be paid by the Corporation. 3. The Principal of the College shall be a Clergyman in full oi'ders of the Church of England, and a graduate of some University of repute, and shall be appointed by the Corporation. 4. The Vice-Principal shall be appointed by the same authority. 5. The Principal shall reside in or near the College. He shall be the chief Executive Officer of the College Council, and shall be charged with the internal government of the College, have authority to appoint and remove subordinate officers and servants ; and it shall be his duty to enter Stu- dents of the College, to take care that the Statutes, Rules and Ordinances and other Regulations of the College be faithfully observed, to enforce discipline, and to preside over College exercises. 6. Thi? Principal shall have the power of reprimanding publicly, and, if need be, of rusticating or expelling any Student guilty of misconduct, provided that sentence of expulsion be not carried into effect until confirmed by the President of the Corporation. 7. In the absence of the Principal and Vice-Principal, or during the vacancy of these offices, the Senior Professor shall have the powers and perform the duties of the Principal. T 8 8. The Professor of Divinity shall be appointed by the Visitors jointly, and shall be a Clergyman in full orders, and a graduate of some University of repute 9. All other Professors shall be appointed by the Corpo- ration. It shall be their duty to carry on the course of instruction prescribed by the College Council, and accord- ing to its direction. 10. (Eemoval of Professors) 11. Lecturers and Teachers to assist the Professors, or to give instruction in particular branches of education, may be appointed by the College Council, by whom their duties shall be prescribed. Their appointment, however, shall be subject to the approval of, and their emolument shall be regulated by, the Corporation. 12. The Officers of the College above mentioned may obtain leave of absence, not exceeding one fortnight, from the Principal, who shall report the same to the College Council. Leave of absence for a longer period may be obtained only from the Visitors. 13. The Bursar shall be appointed, and, if need be, removed by the Corporation. i 9 5y the [rders, )orpo- lirse of Iccord- 14. It shall be his office to act as Treasurer of the Col- lege, to superinteiid the College accounts, to ins])ect and take care of the buildings and grounds, direct small repairs and improvements and refer larger ones to tlie Trustees. He shall account to the Corporation at each annual meeting, up to the 1st January, and, when so required by the Cor- poraticjn, at the commencement of each term. His accounts shall also at all times be open to the inspection of the Col- lege Council. 15. The Registrar shall be appointed and, if need be, removed by the Corporation. 16. It shall be his duty to take and preserve the minutes of the meetings, and to have the custody of all deeds and documents of the Corporation and Convocation, except such as belong to the Bursar's department. He shall also dis- charge such duties in connection with the University as the Convocation may assign to him. 17. A Librarian and a Curator of the Museum shall be appointed by the College Council, and act under their direc- tion. I VI. OF ADMISSION, 11P:SIDENCE, STUDIES, AND DISCIPLINE. i.— students in arts. 1. Admission. be, I a. — Candidates for admission into the College shall present testimonials of good conduct, and shall be admitted at such standard of attainment as the College Council shall determine. I 10 h. — They will be required to subscribe the following decla- ration : — I, A B, do solemnly promise and declare that I will, with the assistance of Divine Grace, faithfully obey the laws of the College, and diligently prosecute all the studies required of me, according to the Eules of the Institution. 2. Residence and Studies. a. — The ordinary course of study shall extend over a space of three years. The subjects taught shall consist of Classical, English and French Literature and Lan- guages, History, Mathematics, Natural Philosophy, Logic, Ehetoric, Moral Philosophy, Divinity and such other subjects as the College Council may be able to provide for. 6. — The period allotted to study in each year shall be divided into three terms. I 1st. Michaelmas. — From the second Saturday in Septem- " ber to the twenty-first of December. m 2nd. Lent. — From the third Saturday in January to the first Saturday in April. fl| 3rd. Trinity. — From the first Saturday in April to the last Thursday in June. c. — During these terms constant residence will be required of all Students unless they be prevented by ill-health or be detail' ed by urgent business ; in either case noti- fication and proof must be given to the Principal, and in the latter leave of absence obtained from him . Such Students shall keep their terms by attendance at Chapel and lectures and the performance of all exer- cises to the satisfaction of the Principal and College Council. e. — Casual Students and such as cannot keep continuous residence may attend particular courses of instruction with the approval of the Principal ; such Students observing the Rules of the College so far as these may be applicable to their case. 3. Discipline. a. — Dress. All members of the College shall provide them- selves with a decent gown and cap, according to the prescribed fashion ; which they shall wear at Church, Chapel, lectures and meals, and whenever they appear in public, except at certain hours to be defined by the College Council. 12 h. — Attendance at Divine Service. There shall be morning and evening prayers every day in the College Chai)el, at which all members of the College shall attend, unless their attendance be disj»eiised with by the Principal. lu the case of Students who are not members of the Church of England attendance at the above services may be dispensed with, if their parents or guardians so desire, under such regulations as the Principal shall make for their attendance elsewhere. c. — Lectures and Examinatio7is. All Students shall be required to attend such lec- tures and pass such Examinations as the Council shall appoint. d. — Moral Conduct. The moral conduct and discipline of the Students shall be carefully attended to by all the Professors, .0 shall have power to punish Students by impo- sition, and by confinement to chambers or the College precincts, such punishments to be immediately reported to the Principal. 4. II. Students in Divinity. 1. Admission. All Students who are admissible to the degree of B.A. are entitled to become Students in Divinity ; also such persons, not being Graduates of this or any other Univer- sity, as may be recommended thereto by the Bishops. 2. Residence and Studies. All such Students shall attend a course of Lectures drawn up under the direction of the Bishops, which shall occupy the space of two years. 3. Discipline. Students in Divinity shall he subject to the General rules of the College, so far as they are apj)licable to their cases. VII. OF SCHOOLS OF LAW AND MEDICINE CONNECTED WITH BISHOP'S COLLEGE. 1. The Rules and Regulations of the Schools of Law and Medicine connected with Bishop's College are enacted by the joint action of the Corporation of the College and the Convocation of the University, and cannot be changed except by such joint action. 2. The Professors in such Schools shall be appointed by the Corporation. i 14 VIII. OF BISHOP'S COLLEGE SCHOOL. 1. Bishop's College School is subject to the control of the Corporation. 2. The Eector of the School, who shall also be a Pro- fessor in the College, shall be appointed by the Corporation. 3. Instruction in the College School shall be given with a view to residence in the College, and also in such branches of Education as are usually taught in the best Grammar and Commercial Schools. IX. OF FEES. All fees (not otherwise specially appropriated), including those prescribed by the Royal charter for membership of Convocation shall be placed in a distinct fund, to be applied by vote of Corporation, from time to time, to such general objects as the following, viz : to provide suitable buildings, furniture or servants for the use of the University, or to increase the Library, or purchase philosophical apparatus, or provide a museum, or observatory, or be applied in such other way as the interests of the University may require. , J_ 15 3l of the a Pro- )oration. given in such the best icluding rship of applied general lildings, y, or to paratus, in such jquire. f nULES AND REGULATIONS. Framed by the College Council and approved by the Corporation. I. HOUES. 1. Chapel Week-days at 8.45 a.m. and 5.30 p.m. Sundays, 9.30 a.m. and 7 p.m. Meals — Breakfast at 8 a. m. Dinner at 1 p.m. Tea at 6 p.ra. ; on Sundays at 5.30 p.m. 2. Ingress and egress from daylight to 10 p.ra. without leave. Students desirous of remaining out later than 10 p.m. must obtain leave from the Principal ( or the Dean in the absence of the Principal ), and shall enter the hour of their return on their weekly Lecture lists, and in the Book kept for that purpose. 3. No strangers are allowed to remain later than 12 p.m. in the College, without special leave from the Principal or the Dean. II. LECTUKES. 1. The Lecture List will be given out at the commence- ment of each Term. 2. The List shall be prepared by the Principal and Pro- fessors, and given out by the authority of the Principal of the College, until it can be submitted to the Council. 3. All Eed-Letter Days are free days to the Students, at the discretion of the several Professors. 4. Any Student obliged to absent himself from a lecture shall give account of his absence to the Professor. 16 ! '■ ! III. EXAMINATIONS. 1. College Examinations shall be held at the end of each Michaelmas and Lent Term, on such days as the Principal, in conjunction with the Professors, shall appoint. Any Student failing to obtain the requisite number of marks (one-third) at any such examination shall forfeit the Term. 2. Supplementary Examinations will be granted ( at the discretion of the Council) to such Students as obtain one- third of the marks on the aggi'egate, but fail in particular subjects. IV. CHAPEL. The members of the College shall attend Divine Ser- vice in the Chapel daily at the hours appointed. V. ORDEK. 1. In the absence of the Principal or one of the Pro- fessors order shall be ke})t at meal-times by the President, who shall be one of the senior Graduates. The other Gra- duates and the Students of the third year shall in turn, ac- cording to the alphabetical order of their names, be Vice- Presidents of the table. 2. Students sliall be present in their respective lecture- rooms, and in Chapel, within five minutes after the bell begins to ring. .3. All Students shall hand in to the Principal every Monday morning a list, in prescribed form, showing their attendance at lectures and Chapel, signed by themselves and countersigned by the several Professors. The- ^^ap and Gown are to be worn by all Students as enacted in the Statutes (VI. i. 3a), except between the hours of 1 and 6 p.m. VI. EXTRA MEALS. 1. Extra tea shall be served in the dining hall at 9 p.m. at a charge of ten cents each. Those who wish to have this meal shaU signify their desire to the housekeeper at tea time. 2. The meals of guests shall be charged to those who introduce them, at the following rates : breakfast, tea, extra tea, fifteen cents ; dinner, twenty-five cents. Notice of their coming to be given to the housekeeper. 3. No meals or provisions from the kitchen are to be taken up-stairs, except by leave of the Principal, in cases of sickness. VII. PROHIBITIONS. 1. Students are forbidden to smoke in the public rooms play-grounds, or streets. 2. Intoxicating liquors ( unless by permission of the Principal for medical purposes ) are strictly forbidden. 3. Incurring debts, frequenting taverns, and playing games for money, are strictly forbidden. 4. No school-boy shall enter any room in the College and no Student shall enter any room in the School, without leave from the Rector. VI ti. BREAKAGE. 1. All articles broken or lost must be paid for by the owner for the time being. The cost of all articles broken, which have no special owner, shall be charged (if it be not known by whom they were broken) in fair proportion upon all parties concerned in the use of them. 2 : 18 2. The Bursar will inspect the rooms monthly, in order to ascertain that the furniture and other property are fairly used. IX. ROOMS. 1. Rooms shall be assigned by the Principal to the Students in order of their College seniority, and no ( hange of room shall be made without his permission. 2. It is a breach of College order for any Student to enter the room of another aganist the will of the occupant. X. FINES. 1. For breach of the rule about the Cap and Gown : 25 cents. 2. For neglecting to provide for the duty of Reading in Chapel, when appointed by the Principal : 25 cents. 3. For being out of College without leave after 10 p.m. ; 10 to 11, 10 cents ; 11 to 12, 20 cents, 4. For any other breach of College order (at the discretion of the Principal) : 25 cents. These fines shall go to the Library Fund. The enactment of these fines is not to be taken as pre- cluding the imposition of such other penalties for breach of rules as may seem necessary to the Principal or the College Council. RULES OF THE COLLEGE LIBRARY. 1. No member of the College, except Professors and Lecturers, is allowed to have out of the Library more than four volumes at one time, without special permission from the Librarian or the Principal. 2. Graduates of the University resident in the neighbor- hood may obtain books from the Library, but only through the Librarian or Principal. Graduates residing at a distance, and other persons approved by the College Council, may also obtain books from the Librarian, upon depositing with him the value of the books so taken out, or of the set, if they form portions of a set. 5. All books shall be returned to the Library on some day at the end of every Term appointed by the Librarian. The Librarian may also require the return of all books, or of any particular book, at any other time when he may judge it expedient. 6. The penalty for not returning books when required by the Librarian is 5 cents per diem for each volume. 7. Encyclopa3dias, Dictionaries, and other Books of Reference shall not be removed from the Library except by special permission. 8. Students of the College shall have access to the Library for purposes of study at the discretion of the Principal and the Librarian. 9. Any member of the College taking down a book from its place and failing to replace it is liable to a fine of 10 cents. I i so 1 i 1 STATUTES, RULES AND ORDINANCES OP THE UNIVERSITY OF BISHOP'S COLLEGE. The sections marked (*) having been enacted by the Cor- poration can only be changed by the same body. I. Of the Convocation. I. Of the Chancellor and Vice-Chancellor. * 1. The Chancellor and Vice-Chancellor shall be elected by the Convocation, the former for five years, and the latter for three years. * 2. The Chancellor, when present, shall preside at all meetings of the Convocation, and, in case of an equality, have a casting vote. He shall confer all degrees in the name and on behalf of the University, in such form and in such manner as the Convocation shall determine. * 3. The Vice-Chancellor shall preside and exercise the functions of the Chancellor in his absence, and execute at all other times such duties of his office as the Chancellor shall delegate to him. * 4. The election of the Chancellor and the Vice-Chancel- lor shall be by ballot ; but it shall be in the power of any member of Convocation to nominate or support a candidate for either office. The candidate who obtains the greatest number of votes shall be declared duly elected, provided that number be not less than half the number of members present. 5. Of Memheusiiip. * The Principal and Professors of Bishop's College, and the Pritfussors of any School of Medicine or Law attaclied thereto, are ex-officio members of Convocation ; and all Masters of Arts of this University, and all persons admitted therein to any degree in Divinity, Law, or Medicine, are members on condition of an annual payment of four dollars currency to the funds of the University. III. Of the Duties and Powers of Convocation. * 1 . All degrees, whether in Arts or in the Faculties of Divinity, Law and Medicine, which it is in the power of the University to grant, shall be conferred by vote of Con- vocation, and all graces and dispensations provided for by the Statutes shall likewise be granted by it • vote. * 2. The Convocation shall prescribe the subjects and standards of Examination for all degrees and for admission into the University, together with the time and manner thereof, and shall appoint Examiners. It shall meet annually at a set time, and meet and adjourn as it shall see fit at other times for conferring degrees and for other business. It shall also appoint the academical dresses of all members of the University according to their several degrees? and stations. * 3. Nevertheless the Convocation shall enact no law, nor adopt any custom or order, contrary to the Statutes of Incorporation of Bishop's College, the Eoyal Charter which constitute the said College an University, or the Statutes, Rules and Ordinances enacted by the Corpora- tion. liti j m I 22 ■ IV. Of MEETiNoci OF Convocation. 1. Meetings of Convocation shall be called by the Regis- i trar, under the direction of the Chancellor, or in his absence 1 the Vice-Chancellor, at such times (other than the time ] appointed for the annual meeting) as shall be determined by the Chancellor or Vice-Chancellor. 2. The annual meeting shall be held on the last Thurs- day in June^ or on such other day as the Chancellor or Vice-Chancellor, and tLj Principal of Bishop's College, shall determine. 3. Notice of meetings shall be given by circular at least a month beforehand, and in case of special meetings, the object of the meeting shall always be stated in the notice. 4. At any meeting ten members shall form a quorum. V. Of the Order of Proceedings in Convocation. 1. The Convocation is in Session so soon as the Chan- cellor, or his deputy, has taken his seat, and shall be closed by his declaring it to be either prorogued or adjourned. 2. The names of all Candidates for degrees shall be presented, with the necessary documents, by the Registrar to the Chancellor, who shall thereupon submit them severally to the Convocation for approval. Provided always that it shall be competent for either of the Visitors of Bishop's College (being members of Cox^vocalion) to sub- mit the names of any persons for degrees during the sitting of Convocation. G. The Faculty of Divinity. 1. Persons admitted to study Divinity in Bishop's College, under the provisions of the College Statutes ;( VI. ii. 1 ), may after two years of residence, and having ■*|)assed two satisfactory examinations in the subjects pursued in the Divinity course, receive a license or certifi- cate, and be publicly admitted by Convocation to the title of Licentiate in Sacred Tlieology. 2. Licentiates of Sacred Theology of nine years' and .Masters of Arts of seven years' standing shall be eligible for the degree of Bachelor of Divinity ; and Bachelors of Divinity of ten years standing for that of Doctor of Divi- nity. 3. Clergymen who have complete their course in the 38 College of St. Augustine in Canterbury, and who hold Ministerial cures in this Dominion, shall have the same privilege of proceeding to the above degrees as Licentiates in Sacred Theology. 4. Candidates for the degree of Bachelor of Divinity shall be examined in the following subjects : — 1. A selected portion of the Old Testament in the Hebrew Original or in the Septuagint, such portion to be one entire Book or several Minor Books, in quantity not less than twenty chapters. Introduction and Criticism upon the same. 2. Of the New Testament in the Original, either the Four Gospels and the Acts of the Apostles, or the . Epistles of S. Paul, or the Catholic Epistles and the Apocalypse. Introduction and Criticism upon the same. 3. One Treatise of a Greek Father. 4. " " « Latin Father. 5. Ecclesiastical History. Every Candidate for the degree of Doctor of Divinity shall be required to compose an original Treatise in Latin on some subject the choice of which has been sanctioned by 89 the Professor of Divinity, which Treatise shall be sent in at a certain date for the approval of the said Professor. The Candidate shall further preach an English Sermon before the University in the College Chapel. It is also expected that he make a donation of books to the College Library. 6. The degree of Doctor of Divinity jure dignitatis may be conferred upon any Bishop of the Church at the discretion of Convocation. 7. The expression of any opinion inconsistent with the doctrine and discipline of the Church of England shall constitute a disqualification for any purely Theogical degree. 8. The following fees shall be payable in the Faculty of Divinity, the fee in each case including the cost of the Diploma : — Matriculation (to be paid by any candidate for a theological degree or title (other than D. SPECIAL PROVISIONS FOR THE REMISSION OF THE REQUIREMENT OF RESIDENCE IN THE FACULTIES OF ARTS AND DIVINITY IN THE CASE OF CLERGYMEN. Clergymen of the Dioceses of Quebec and Montreal may be admitted to the title of Licentiate in Sacred Theology or to the degree of Bachelor of Arts on the following conditions : — m 1. Clergymen of fifteen years' standing or it p wards may proceed to the degree of Bachelor of Arts, by passing, at intervals of not less than six months, three Exami- nations equivalent to the three annual Examinations required of ordinary Students in Arts, without resi- dence. 2. Clergymen of ten years' standing or upwards may proceed to the title of Licentiate in Sacred Theology, by passing, with an interval of not less than six months, two Examinations equivalent to those required of ordinary Divinity Students, without residence ; or they may pro- ceed to the degree of Bachelor of Arts by keeping three terms of residence and passing the three Examinations mentioned above, two before residence with an interval between them of not less than six months, and the third at the end of their third term of residence. 3. Clergymen of five years' standing and upwards may proceed to the title of Licentiate in Sacred Theology by keeping three terms of residence and passing the two Examinations mentioned above, one before residence and the other at the end of the third term thereof; or they mey proceed to the degree of Bachelor of Arts by keeping six terms of residence and passing the three Examinations mentioned above, one before residence, one at the end of their third term, and one at the end of their sixth term. 4. Such Clergymen may proceed to the degree of Bachelor of Divinity when they have been fifteen years in Holy Orders, not being of less than four years' stand- ing from their L.S.T., or three years' standing from their B.A. 41 (The following two chapters are enacted by the Corpo- ration and Convocation jointly). V. THE FACULTY OF MEDICINE. I. The medical degrees of this University are — Master of Surgery (CM.) and Doctor of Medicine (M.D.). The degree of Master of Surgery is not conferred on any person who does not also at the same time obtain the degree of Doctor of Medicine. II. The preliminary examinations shall be upon the following branches of extra medical education, viz., English, Latin, Arithmetic, Algebra, Geometry and one of the following optional subjects, Natural Philosophy, Greek, French or German, which examination each student will have to undergo prior to the commencement of his medical studies. III. A degree in Arts, not being an honorary one, of any recognized university or its equivalent shall exempt from the preliminary examination. IV. No one shall be admitted for examination for the degrees of Master of Surgery and Doctor of Medicine who has not been engaged in medical and surgical study for four years ; but a certificate of having studied one full year with a duly licensed practitioner, previous to taking his first session, will reduce the period of study at the Univer- sity to three sessions. V. At the commencement of every session each student must enrol his name and residence in the Eegister of the Medical Faculty, and ol)taiu from the llegistrar a ticket of Matriculation. VI. The Matriculation Books of the Eegistrar shall be closed on the first day of December in each year. iL^Baams Br^ 42 VII. No student can obtain his ticket from any of the professors without having previously obtained his Matricu- lation ticket. VI IT. Every candidate for graduation in Medicine and Surgery must give sufficient evidence, by certificates — 1. That he has attended lectures on each of the following departments of medical science, — viz., Anatomy, Physiology, Chemistry, Materia Medica and Therapeutics, Theory and Practice of Medicine, 1^ Two courses of six months each. > One course of each. Principles and Practice of Surgery, Midwifery and the Diseases of Women and Children, Hygiene or State Medicine, Medical Jurisprudence, Pathology, Botany and Zoology, Practical Chemistry & Microscopy, 2. That he has attended clinical lectures in Medicine and Surgery, two courses of three months each. 3. That he has performed dissections during not less than two winter sessions. 4. That he has attended for at least twelve months the Medical and Surgical practice of a General Hospital approved of by this University. 5. That he has been engaged for at least three months in compounding and dispensing drugs at a hospital, a dispensary, or with a duly licensed practitioner. 6. That he has attended at least six cases of midwifery, either in a lying-in hospital or in private practice, under the supervision of a regular medical practi- tioner. 43 IX. Out of the four years of medical and surgical study- required by Clause IV, one full course on each branch men- tioned in Section 1, Clause VIII, must be attended in this University. X. Courses of less length than the above (Clause VIII) will only be received for the time over which they have extended. XI. Every candidate for the Degree must, on or before , the first day of March, deliver to the Dean of tiie Medical Faculty — 1. A declaration, in his own handwriting, that he has completed his twenty-first year of age (or that he will have done so before the day of graduation). 2. A statement of his studies, accompanied with proper certificates. 3. A Thesis or Inaugural Dissertation, written by him- self, either in the English or French language, on some subject connected with Medical or Surgical science. XII. Every candidate shall be examined both in writing and viva voce. The examinations are divided into I'rimary and Final. The Primary comprehends Anatomy, Chemistry, Practical Chemistry, Materia Medica, Physiology, and Botany or Zoology. The Final — Practice of Medicine, Surgery, Midwifery and Diseases of Women and Children, Medical Jurisprudence, Pathology, and Hygiene. XIII. Candidates may, if they choose, be admitted to examination on the Primary Branches at the end of the third year of their study. The Final Examination shall not take place until the candidate has completed his fourth year of study. 44 VI. THE FACULTY OF LAW. 1. The Law degrees of this University are : Bachelor of Laws (LL.B.), Master of Laws (LL.M.), Doctor of Laws (LL.D.). 2. Students shall be admitted to Matriculation in the Faculty of Laws upon presenting a certificate of good character and passing the Examination in Latin, French and English. 3. The course of study shall extend over three years, and shall be distributed as follows : — First Year. — 1. Legal History. 2. Civil Law — Persons, Property, Ownership. 3. Roman Law 4. Civil and Commercial Law — Obligations. 5. Civil Procedure. 6. Criminal Law. Second Year. — 1. Civil Law — Eents, Transactions, Suretyship, Usufruct, Servitudes, Gifts and Wills and Substitutions, Sales. 2. International Law. 3. Roman Law — Institutes of Justinian. 4. Com- ercial Law — Partnership, Corporations, Bills of Ex- change. 5. Civil Procedure. 6. Criminal Procedure. Third Year. — 1. Civil Law — Privileges and Hypo- theques, Prescription, Successions, Marriage Con- tract, Dower, IMandate, Loan, Deposit, Pledge. 2. International Law. 3. Commercial Law — Common Carriers, Insurance, Mandate, Loan, Deposit, Pledge. 4. Roman Law. 5. Evidence. 6. Civil Proced- ure 7. Criminal Law and Procedure. 4. Candidates for the Degree of LL.B. must have at- tended the full course of Lectures, and must have passed an examination t.o the satisfaction of the Faculty at the end of each of the first two years in the subjects appointed for those years. At the end of the third year they shaU be exam- 45 ined in the subjects appointed for that year, together with such portions of the Course laid down for the earlier years as Convocation, in conjunction with the Faculty, shall see fit to appoint. Masters of Laws of ten years standing are eligible for the degree of Doctor of Laws. The exercises, for this degree shall consist of an examination (in subjects to be hereafter determined) and the writing of a thesis on some subject proposed by the Faculty. 7. Any of these degrees may be conferred without exam- ination on any person employed in teaching Law in this University within three years after the establishment of the Faculty. 8. The fees to be paid to the University for these Degrees (including dii)loma) shall be : — LL.B.— Five dollars; LL.M.— Five Dollars ; LL.D.— Ten Dollars ; and for Matriculation Three Dollars. VIL OF THE AFFILIATION TO THE UNIVEESITY OF COLLEGES AND SCHOOLS. I. Affiliation of Colleges. Colleges may be affiliated to the University by Convo- cation on the following conditions : — 1. Students of such affiliated Colleges may matriculate as members of the University on their fulfilling the requirement of the Statutes relating to Matriculants. 2. Any such Student, having resided for not less than i . 46 three terms at Bishop's College, and the remainder of the prescribed period of three years at the affiliated College, and having passed three annual Examinations to the satis- faction of the College Council and the University Exam- iners shall be admitted to the degree of Bachelor of Arts. 3. Students of affiliated Theological Colleges, being graduates of an University, or persons recommended by the Bishops, may in like manner become Licentiates in Sacred Theology of this University after a residence at Bishop's College of not less than two terms, and the remainder of the prescribed period of two years at the affiliated Theolo- gical College, by passing the required Examinations. II. Affiliation of Schools. Schools may be received into connection with the Uni- versity on the following conditions : — 1. Scholars of such Schools who have been examined in certain specified subjects may matriculate in the University without further examination. 2. As soon as may be after the affiliation of any School steps shall be taken to found an Exhibition in Bishop's College, tenable only by scholars of such School ; and until this be done the Corporation will offer an Exhibition yearly for competition among all such Schools. 3. Scholars of such Schools who can pass an Examina- tion in the subjects of the First Year of the Arts Course, or equivalent subjects, may be admitted as Second Year Students of Bishop's College, and may proceed to the Degree of Bachelor of Arts after two years of residence. 4. The higher classes of such Schools shall be examined annually by Examiners appointed by the College Council. / 47 7th VICT. CAP. 49. An Act to Incorporate " Bishop's College " in the Diocese of Quebec. (9th December, 1843.) WHEREAS it has been represented to the Legislature of this Province, that divers inhabitants of the said Province have used their etforts to establish a College, in connection with the United Church of England and Ireland, near Lennoxville, in the Township of Ascot, in the District of S nt Francis, and within the Diocese of Qiiebec, under the style and title of "Bishop's College," aid are engaged in erecting and establishing th« same ; And whereas, it would tend greatly to advance and extend the use- fulness of the said College, and to promote the purposes for which it was established, that it should be incorporated ; Be it therefore enacted by the Queen's Most Bxcellent Maje8ty,by and with the advice and consent of the Legislative Council and of the Legislative Assembly of the Province of Can- ada, constituted and assembled by virtue of and under the authority of an Act passed in the Parliament of the Uniied Kingdom of Great Britain and Ireland, and intituled : An Act to re-unite the Provinces of [^/>per and J^oiver Canada^ and Jor the Government of Canada, and it is hereby enacted, by the authority of the samt;, that there shall be, and there is hereby consti- tuted and established, at or near Lenuoxville, in the Township of Ascot, in the District of Saint Francis, in thia Province, and within the Diocese of Quebec, a Body Politic and Corporate, under the name of " Bishop's Col- lege," which Corporation shall consist of— Firstly, the Lord Bishop of Quebec, or other the Superior Ecclesiastical Functionary of the United Church of England and Ireland, in the said Diocese of Quebec,— Secondly, the Trustees of the said Bi3hoi)'3 College, not less than three in number, — and Thirdly, the College Council of the said Bishop's College, not less than three in number, which said Trustees and Members of the said Col- lege Council shall be named by the said Lord Bishop of Quebec, or other Superior Ecclesiastical Functionary as aforesaid, and shall, in the event of their death, removal from the Province, dismissal from office, or resigna- tion, be replaced by other persons to be named in like manner, and so on continually forever. II. And be it enacted, that such Corporation shall have perpetual succes- sion, and may have a Common Seal, with power to change, alter, break and renew the same when and as often as they shall think proper; and the said Corporation may, under the same name, contract and be contracted with, sue and be sued, implead and be impleaded, prosecute and be prose- cuted, in all Courts and places whatsoever in thia Province, and shall have full power to make and establish such and so many rules, orders, and regu- lations (not being contrary to the Laws of the Country or to thia Act) ai . 48 thoy shall deem useful or necessary, ns well concerning the system of ediication in, as tor the conduct, and government of tlio said College, and of any other Inslitution or Sciiuol connected with or dependent on the same, and of tiie Corporation tliereof, and for the sn(ierintondence, ad van tape and improvement of all the properly, moveable or immoveable, be- longhig to, or which shall hereafter belong to tiie said Corporation ; and shall have power to lake, under any hgul title whatsoever, and to hold for the said College, without any further authority. License or Letters of M(Utniain, all land and property, moveable or immoveable, which may hereafter be sold, ceded, exchanged, gi"en, bequeathed, or granted to the faid Corporation, or to sell, alienate, convey, lot or lease the same if need be: Provided always, that the net rents, issues, and proHts arising from the immovenble property of the said Corporation shall not at any time ex- ceed the annual sum ot three thousand pounds, current money of this Province ; and the said Corporation shall further have the right of appoint- ing nn Attorney or Attorneys, for the management of their affairs, and generally shall enjoy all the rights antl privileges enjoyed by other liodiea Politic iind Corporate, recognized by the Legislature : Provided always, that no rule, order or regulation which shall be made and establislied by the said Corporation in manner aforesaid, shall be of any force or effect until the same shall have been sanctioned and confirmed by the said Lord Bishop or other Ecclesiastical Functionary as aforesaid. III. And bo it euHcted that all the property which shall at anytime belong to the said Corporation, as well as the revenues thereof, shall at all times be exclusively applied and ai)propriated to the advancement of edu- cation in the said College, and to no other object, Institution or Establish- ment whatever, unconnected with or independent of the same. IV. And be it enacted, that this Act shall be considered a public Act by all Judges, Justices of the Peace, and Officers of Justice, and by all other persons whomsoever, and shall be judicially taken notice of without being specially pleaded. V. And be It enacted, that this Act shall not extend to weaken, diminish or extinguish the rights and privileges of Her Majesty, Her Heirs and Suc- cessors, nor of any other person or persons, Body Politic or Corpornte, excepting only such rights as are hereby expressly altered or extinguished. 16th VICT. CAP. 60. An Act to amend the Act incorporating I5ishop's College. (loth November, 1852). WHEREAS it is expedient to amend the Act passed in the seventh year of Her Majesty's Reign, intituled. An Act to incorfiorate bishop's College in the Diocese of Quebec, to confer upon the Bishop of 49 Montreal co-ordinate powers witli the Bidhop of Quebec, in the Corporation of Bishop's College: Be it therefore enacted, by the Queen's Most Kxccllent Majesty, by and with the advice and consent of the Legis- lative Council and of tlie Legislative Assembly of the Province of Canada, constituted and assembled by virtue of and under the authority of an Act passed in the Parlinment of the United Kingdom of Great Britain and Ire- land, and intituled, An Act to re-unit« the I'rouinre of Upper and Lower Canada, ami/or the Government of Canada, and it is hereby enacted by the authority of the same, That the Bishop of Montreal, as well as any other Bishop or Bishops, who may be appointed for any Diocese of the United Church of England and Ireland, which may hereufter be constituted in Lower Canada, together witii the Bishop of Quebec, shall hereafter con- stitute the first branch of the Corporation of Bishop's College ; and the said Bishops shall have and possess equal co-ordinate powers in the appoint- ment of the Trustees and of the College Council, and shall have and exer- cise jointly all and every the powers and privileges heretofore possessed, exercised and enjoyed by the Bishop of Quebec, in the management of the affairs of the said Corporation: Provided that Incase of a difference of opinion between the said Bishops, in the event of their being equally divided in the exercise of any of the powers hereby conferred upon them, the opinion of the Bishop who is senior by priority of appointment shall prevail, and his decision shall be final. 34th VICT. CAP. 48. An Act respecting " Bishop's College." (^Assented to 2\th December, 1870.) WHEREAS the Corporation of Bishop's College " have, by their peti- tion, prayed for legislative provisions whereby the Diocesan Synods of the United Church of England and Ireland in this Province may be enabled to participate in the management and government of the said Col- lege, and it is expedient to grant the said prayer, in so far, and in such manner as may be done consistently with the Royal Charter of the said College ; Therefore, Her Majesty, by and with the advice and consent of the Legislature of Quebec, enacts as follows : 1. Such Trustees and Members of the College .as may hereafter, under the Acts establishing the Corporation of "Bishop's College," be named by the Bishops constituting the first branch of the said Corporation, shall be so named from among the following persons, that is to say : five Trustees and five Members of Council, from among a greater number of persons chosen for that purpose by the Synod of the Diocese of Quebec ; the same number of Trustees and Members of Council from among a greater number of persons so chosen by the Synod of Montreal ; a like number of Trustees 4 CO anfl Members of Council, for every other diocese of the United Church of Enghmd and Ireland, which may hei-eafter be constituted in this Province, from among a greater numbe" of persons chosen for that purpose by the Synod of such other diocese ; and the remainder of the Trustees and Mem- bers of Council from among such other Members of the said United Churches of England and Ireland as the said Bishops may deem fit; the number of such remainder to be in the proportion of three Trustees and three Members of Council for every five named by every Synod. 2. The said Trustees and Members of Council shall be so named for a period of three years only, but, after that time, may be again chosen or named as aforesaid. 3. The said College shall lay before each of the said Synods annually a report, exhibiting the financial and educational condition of the Institution. ROYAL CHAETER OF BISHOP'S COLLEGE. Victoria, hy the Grace of God of the United Kingdom of Great Britain and Ireland, Queen, Defender of the Faith. To ALL to whom these pioscnts shall come, Greeting : WHEREAS, by an Act passed by the Legislature of our Province of Canada, in the seventh yenr of our reign, intituled, " An Act to incorporate Bishop's College in the Diocese cf Quebec," there was consti- tuted and established, at Lennoxville, in the Township of Ascot, in the District of Saint Fraucis, .ind within the Diocese of Quebec, in our said Province of Canada, a Body Corporate and Politic, under tlie name of Bishop's College, in connection with the United Church of England and Ireland, which said Corporation is, by the said Act, made to consist of: First, the Lord Bishop of Quebec, or other superior Ecclesiastical Funct'on- ary of the United Church ot England and Ireland, in the said Diocese of Que- bec ; Secondly, the Trustees of the said Bishop's College, not less than three in number; and. And whereas it is by the said Act further provided that the said Corporation of Bishop's College shall, besides other corporate powers and capacities necessary to the well ordering of their affairs, have full power to make and estaV'isb such and 61 so many rules, orders and regulations (not being contrary to the Laws of Canadu or to the said Act) aa they shall deem useful and necessary, as well concerning the system of education in, as for the conduct and gov- ernment of the said College, and of any other Institution or School connected with or dependent on the same, and of the corporation thereof, and for the superintendence, advantage and improvement of all the property, moveable or immoveable, belonging to or which shall hereafter belong to the said Corporation, and shall have power to take under any legal title whatsoever and to hold for the said College, without any further authority, license or letters of mortmain, all land and property, moveable or immoveable, which may hereafter be sold, ceded, exchanged, given, bequeathed, or granted to the said Corporation, or to sell, alienate, convey, let or lease the same, if need be ; Provided always, that the net rents, issues and profits arising from the immoveable property of the said Corporation, shall not at any time exceed the annual sum of three thou- sand pounds current money of the Province of Canada. Provided, also, that no rule, order t regulation, which shall be made and established bv the said Corporation in the manner aforesaid, shall be of any force or eflfect, until the same shall have been sanctioned and confirmed by the said Lord Bishop or other Ecclesiastical Functionary, as aforesaid. And WHEUBAB, by another Act, passed by the Legislature of the Province of Canada, at a Session held in the fifteenth and sixteenth years of our reigr, intituled, "An Act to amend the Act incorporating Bishop's College, " it is enacted that the Bishop of Montreal, as well as any other Bishop or Bishops who may be appointed for any Diocese of the United Church of England and Ireland which may hereafter be constituted in Lower Canada, together with the Bishop of Quebec, shall hereafter constitute the first branch of the Corporation of Bishop's College. And whehkas since the passing of the said first-mentioned Act, the Corporation of the said College have with the sanction of the Lord Bishop of Quebec, by their petition to us, humbly set forth that in pursu- ance of the provisions of the said Act, Bishop's College has been duly organized by the appointment of Trustees, and of a College Council, and that certain statutes, rules and ordinances have been made by the said Corporation, with the ajiproval of the Lord Bishop of Quebec ; and further, that a suitable building has been erected, and a Principal, and Professors in the faculties of Divinity and of the Arts have been duly appointed, and are now engaged iu the education of a number of scholars duly admitted, according to the statutes and ordinances of the said Cor- poration, and the said College being according to the said Act of Legis- lature of our Province of Canada in strict connection with the Church of England and Ireland, and supported by an endowment provided by the bounty of members of that Church and otherwise, an humble application bas been made to us by the said Corporatiou that we would be pleased at to grant our Royal Charter for the more perfect establishment of the said College, by granting to it the privileges hereinafter mentioned. Now KNOW TB that Wk having taken the premises into our Royal consi- deration, and being willing to promote the more perfect establishment within that part of our Province of Canada called Lower Canada, of a College in connection with the United Church of Fngland and Ireland for the education of youth in the doctrines and duties jf the Christian religion as inculcated by that Church, and for their instruction in the various branches of Science and Literature, which are taught in the Universities of this Kingdom, have of our special grace, certain knowledge and mere motion, willed, ordained and granted, and do by these presents, for us, our heirs and successors, will, ordain and grant, that the said College shall be deemed and taken to be an University, and shall have and enjoy all such and the like privileges as are enjoyed by our Universities of our United Kingdom of Great Britain and Ireland, as far as the same are capable of < ' being had or enjoyed by virtue of these our Letters Patent ; and that the Students at the said College shall have liberty and faculty of taking the Degrees of Bachelor, Master and Doctor, in the several arts and the facul- ties of Divinity, Law and Medicine, at the appointed times, and shall have liberty within themselves of performing all scholastic exercises for the con- ferring of such degrees, in such manner as shall be directed by the Statutes, Rules and Ordinances of the said College : and in order that such degrees may in due form be granted in the said College, Wk do further will and direct, and ordain, that there shall be at all times a Chancellor and Vice Chancellor of the said University, to be chosen at and for such periods of time, and under such rules and regulations as the Corporation of the said College may, by their Statutes, Rules and Ordinances, to be from time to time passed for that purpose, think fit to appoint, and that the Chancellor Vice-Chancellor, Principal and Professors of the said College, and all persons admitted therein to the degree of Master of Arts, or to any degree in Divinity, Law or Medicine, who, from the time of such their admission to such degree, shall pay the annual sum of twenty shillings of current money for and towards the support Hud maintenance of the said College shall be and be deemed taken and reputed to be members of the Convocation of the said University, and as such members of the said Convocation, shall have, exercise and enjoy all such powers and privileges, in regard to con- ferring degrees, and in any other matters, as may be provided for by any Rules, Orders and Regulations of the said College, duly sanctioned and confirmed, as far as the same are capable of being had and enjoyed by virtue of these our Letters Patent, and consistently with the provisions thereof. And we will and by these Presents for us, our heirs and succes- sors, do grant and declare that these our Letters Patent, or the enrolment or exemplification thereof, shall and may be good, firm, valid, sufficient and effectual in the Law, according to the true intent and meaning of the same, , 53 , . and shall be taken, construed and adjudged on the most favorable and bene- ficial sense, and to the best advantage of our said College, as well in our Courts of Record as elsewhere, and by all and singular Judges, Justices, Officers, Ministers, and other subjects whatsoever, of us, our heirs and suc- cessors, any misrecital, nonrecital, omission, imperfection, defect, matter, cause or thing, whatsoever to the contrary notwithstanding.
