SMITH, Esq. .T '.4 RULES m RECUlATIOl -4C,\ ;v OF THE ADVOCATES ASSOCIATION OF ^^^^^^P ^^^ ^^w^ ^^^B ^W^PW ^^P^F ^Kf^^^ ^^^^F iS I. — Each Member shall bind and oblige himself to submit to such Orders, Rules and Regulations as may be adopted by the majority of the Members, for the good government of the body, and any Member of the Bar who shall not so bind himself shall not participate in any of the privileges enjoyed by th« Members of this Association. II. — Advocates actually practising at the Bar, only, shall be admissable as Members. III. — There shall be a general meeting of the body held on the first Monday following each Superior Term of the Court of King's Bench, at ten of the A* (6) clock in the forenoon, in the Advocates' Chamberj provided that when the Monday shall be a holiday or day of F6te ci' Obligation, the meeting shall be held on the following day. The President may also convoke extraordinary meetings whenever he shall be requested in writing by any three Members of the Association, who shall state in such request the cause or causes for which they require a meeting to be called, and it shall be necessary to mention in the notice for such meeting its object. IV. — For the transaction of business each meeting must be composed of at least the majority of the ]\Tem])ers of the Association, and in the event of a suiTu'/ient number not being present at any meeting to constitute a quorum within half an hour after the time at which it was summoned, absent Members shall each pay a fine of Is. 3d., provided their absence shall not have been caused by sickness or absence from town, and each artd every member who shall leave a meeting before its adjournment without per- mission of the President or Chairman shall also pay a fine of Is. 3d. (7) V. — All Resolutions and matters whatsoever shall be submitted to the meeting in writing and shall be se- conded, and decided by the majority of votes of the Members present. VI. — Each Member shall pay to the Treasurer the sum of lis. 8d. on signing the articles of Associa- tion. VII. — Each IVIember shall keep secret the delibe- rations of the body. VIII. — Each Member shall pay to the Treasurer annually the sum of 10s. payable semi annually in advance. IX* — Any Member who shall refuse to pay the above sum of lis. Sd., entrance money or the annual subscription of 10s., shall not be permitted to be pre- sent at or take any part in the deliberations of the Association. X. — All differences that may arise between the Members with respect to the profession shall be sub- mitted without delay and explained to the body to whose decision the parties shall be bound to submit on pain of expulsion, provided that such expulsion can- (8) Hot be pronounced unless by a majority of the Asso- ciation. The body sliall also have the power of supervisiion over the professional conduct of its Members and of expulsion when circumstances demand it. XI. — A President shall be annually elected from among ihc Members of the body by a plurality of votes and by ballot. He shall preside at all the meetings and in case of absence the senior Memlter present shall preside. XII' — The President shall have no vote except when the votes are equally divided but he may take a part in the deliberations. Xllf. — There shall annually be elected by ballots, a Secretary, an assistant Secretary and Treasurer. XIV' — The Secretary shall keep a Register which shall be open to the inspection of every Member of all the proceedings of the body, of the names of the Members present at each meeting and generally of all the deliberalions that do take place ; he shall convoke meetings by written or printed notices, and in the manner which shall be prescribed to him by the Pre- T "■ T ( 9) sidenl, ho Hhall deliver up to his successor all papers and tiocuments which may have come to his posses- sion as Secretary and in hin absence the Assistant Secretary shall fulfd all these duties. XV. — The Secretary shall he bound to convoke and to assist at all meetings of Committees and to keep minutes oftlieir proceedings. XVI. — The Treasurer shall keep an account of all sinns by him received from each Memberj and of all sums paid by him in consequence of votes of the boJy ■\vitli proper vouchers. XVIi. — The Treasurer shall submit at each meet- ing a list of the Members who shall not have paid the sum of lis. 8d. on their entrance into the Association or who shall be in arrear in the payment of their an- nual contribution, or of the fines which they shall have incurred XVIII. — The Treasurer shall be bound to pay to his successor all monies in his hands and to deliver up the Register and generally all papers and docu- ments which may have come into his possession in his quality of Treasurer. ( 10 ) XIX- — There sheAl be annually named a Com- mittee of three members to whom shall be submitted the accounts and documents of the Treasurer for exa- mination, and the Committee shall report concerning the same at the first meeting thereafter. No account shall be paid by the Treasurer unless submitted to and approved of by the majority of the Members of the said Committee and certified by the President of the same. XX- — There shall be annually named a committee .of five members of whom three shall form a (quorum •^vlio shall meet on the first Saturday of each month in the Advocates' Chamber, unless when such Saturday shall be a holiday, and then on the day preceding, for the purpose, whenever required of examining persons desirous of binding themgelves as Students to any ]Meml)ers of the body. XXI- — Every person who shall intend so to bind himself shall give notice to the Secretary, and the Pre- sident of the said committee shall fix the day and hour to take the matter into consideration. XXII.— If the candidate produce to the said com- mittee proper certificates of qualification and should (11) the Committee find such candidate qualified as well as regards education, as good conduct, there shall then be granted him a certificate of these facts signed by the President and countersigned by the Secretary. XXII' — -^^ Member of the Association shall re- ceive into his office as a Student any person who has not previously submitted himself for examination to the said Committee and obtained from them a certifi- cate of qualification as above stated, and every mem- ber who shall contravene this regulation shall be ex- pelled from the Association. XXI V'"—'^^^ l^s* named Committee shall be char- ged with the examination of all certificates, papers and documents of Candidates for admission into the pro- fession, and should the said Committee believe that the indentureship of any Candidate has not been regularly completed or that such Candidate has not the requisite certificates to be admitted into the profession, they are hereby authorised to oppose the reception of such Candidate and (o submit to the Judges in the name of the Body either verbally or in writing the reasons of their opposition the same Committee shall also ex- amine before the Judges all aspirants to the profession. ( 12) XXV. — On the decease of any Member of the Association the Members shall assist at liis Funeral in the usual mourning fm'nishcd by themselves. Resolved,— That the Rules of the .Association be translated into the English language, and enregistered, and be printed in the two languages for the use of the members. Resolved,— That the Sheriff and the Prothonota- ries of the Court of King's Bench, who shall be mem- bers of the Bar, shall be ehgible as members of the Association. Resolved,— Thai a Vice-President be named who shall exercise the functions of the President in his ab- sence, and in the absence of both the eldest member of the as,sociation present shall discharge the duties. Resolved,— Tliat in lieu of a Secretary and an Assistant Secretary, as provided by the 13th Rule of the Association, two Secretaries be annually elected. MONTREAL, 2Gth APRIL. Resolved— That t!ie Treasurer be authorised to pay all accounts approved by the Secretary not exceeding one pound five shillings currency, but all those exceed- ing that sum shall be submitted to the Committee of Accounts as provided for by the 1 9th clause of the Rules of the Association.
