All the real and personal estate, rights, easements, privileges, and immu- nities of every nature 'or kind whatsoever,. now vested in or belonging to " The Chancellor, President, and Scholars of King's College, at Fr^dericton, in the Province of New Brunswick," shall be and' they are hereby vested in the University of New Brunswick ; and all leases and contracts whatsoever made by or with the Chancellor, President, and Scholars of King's College, shall be dealt ^Vith in all respects as if the same had been m«de by and with the Uni- versity of New Brunswick ; and ^all debts, rents, interest, or moneys due or W grow due thereon, shall be henceforth payable to and recoverable by the Vm- versity of New Brunswick ; and all covenants, contracts, or agreements, made with or entered into by the said Chancellor, President, and Scholars of King's College, shall be deemed and taken in all Courts of Law and Equity to have been made with and entered into by the University of New Brunswick ; and all tenants of tho said Chancellor, President, and Scholars of King's* College, shall bo deemed and taken to bo the tenants of the new Corporation ; and all debts due by the said Chancellor, President, and Scholars of King's College, shall be paid and payable by the said new Corporation ; and the Graduates and Students of the late King's College shall be deemed and taken to be Graduates and Students of the said University of New Brunswick, and entitled to the rights and privileges as such. 4. The Corporation shall consist of such and so many laymen, not exceeding nine, as the Governor in Couricil shall appoint, of whom the President of the University, when appointed, shall be one; and three, including the President, "" shall be a quorum for the transaction of business ; one third of whom, not including the President, shall' go out of oflSce annually, in the order of their appointment, but shall be eligible for re-appointment ; and the Corporation shall be deemed organised when any number not less than five shall be ap pointed &s aforesaid. 5. Tbe Members of the Corporation shall constitute the Senate of the Uni- versity, and if any member of the Corporation shall refiise to act or shall neglect to attend the meetings thereof for the space of twelve months, his place shall be vacated and another person appointed in his stead. ^^^6.. Any person, or body politic or corporate, may found such and so many Professorships, "Lectureships, Scholarships, exhibitions, prizes, or other rewards in th$' University, not inconsistent with the spirit and provisions of this Act, as they may think proper, by providing a suflScient endowment therefor inland or other property. 21. The programme of the courses of instruction contained in the Schedule to this Act, shall be provided for and pursued in the University until altered by the Senate. 22^. All Students nq^ residing in the. University, and all Scholars of the Col- legiate School, will be required to board with their parents, or with, persons approved of by tBpm, or by their guardian or other persons having charge of their education, or by the President. 23. Scholars of the Collegtete School may receive free tickets to attend such course of Lectures. at the University as they may sdect, ajfter not less than three months' attendance at the School, and upon a certificate from the Head Master setting forth, that from their studious habits and general good fconduct, they are deserving of su(A privilege. 24. No person shall borrow any book from the LibrAry without, the know- ledge or presence of the Librarian : and no person shall Ijavo a key to the Library except the President and Librarian ; and they shall not let the keys go from their personal custody. ^ 26. The President may prepare a list of Books and Documents which the Librarian shall not allow to bo taken out of the Library. ■ ": IX. Students. • ■ . 27._Students of the University may b6 either candidates or not candidates for a Degree. All, however, shall be subject to tho same laws, equally entitled to any certificate of standing which they may have deserved, and liable to the same punishments for transgression of the laws. 28. Every Student shall show in speech and behaviour all tokens of respect and obedience to tho Professors and other Instructors ; and tho junior members of tho University shall in public and private treat their seniors with tho customary marks of attention and civility. 29. If a Student occupy a room in College, he will be required to keep it in a neat and orderly manner, to remain in it during the hours approprfated to study, to open his floor at all times to an officer of instruction or discipline and to obey all the regulations pi:^cribed for his government, either by the Senate or tho University Board. X. Admission. .30. Every candidate for admission into the University, shall produce satis- factory evidence of good moral character ; and if he shall hayo been connected with any other CQllege, he shall present a Certificate from the authorities of that College, oF his regular and honorable dismission and standing. 31. There shall be three Classes of Students in the University, namely the Freshman, Junior, and Senior Classes. And no person shall be admitted' into tho Freshman Class, who shall not have passed a satisfactory examination by the University Board, in such books, and on suoh subjects, as may from time to time be prescribed by the President and approved by tho Senate. Nor shall any person bo admitted into the Junior Class, nor to any advanced stand- ing unless, upon examination, ho is found acquainted with the studies which have been pursued by the class into which he seeks admission. 32. Whenever the University ^ard shall find that any Student ia not ^fulfilling the purposes for whicli he entered, or that'ho is not likely to fulfil *them, or that he is addicted to improper or vidious habits, or that he is othotwiao disobedient or disorderly, so as to prove himself an unworthy member of the Institution, the President may, after due admbnition, request his pi^rent or guardian to i-etaove him from the University, or ho may apply tc^the Senate for his dismission or expulsion. . 48. The President and Professors shall have power and authority to enter the apartments of all other members of the University, at all times. And if any Student shaU obstruct or delay the entrance of a member of the University Board into his room,, or refuse to assist in suppressing any disorder, or decline to give evidence when required, he may receive such a punishment as' the nature and circumstances of the case may eeem to demand. • 49. Punishments may be inflicted for offences' against the Statutes, and Regulations founded thereon : and in Case of any violation of the laws where the laws ihemselvos do not specify the penalty, as also in any case not -expressly mentioned in the laws, where the rules of propriety or morality are clearly violated, the OflBcers having authority in the matter, may, at their best discre- tion, inflict such punishment as the nature and circumstances of the offence may require. 50. Punishments shall be limited to fines, impositions or exercises ; confine- ment to private apartments or to the University ; disallowance of Terms ; post- ponement or refusal of Degrees ; suspension or dejprivation of places, oflices, or privileges ; rustication, expulsion, or degradation. 51. No member of the University shall^^e suspeaded from a% ofiice or situ- ation in the University, or rusticated for a longer peripd than iwo Terms, or deprived of his Degree, without the approbation of the Senate. 52. All fines, forfeitures, and pecuniary punishments, shall be carried to the University account by the Registrar, and duly levied by him ; and, when they are not imposed as a compensation for injuries, shall be applied to the support of the Library. , 53. An appeal from any sentence or punishment may at any time be made to the Senate, through the medium of any member thereof, who shall see fit to sanction or bring Forward the same. XV. Attendance at Church. 54. AU the Students of the University are strictly required to attend public worship tmcp on the Sabbath, at such churches as may be designated by their parents or guardians. , XTl. EncAia. \ 55. A Public Festival, called the Encaonia, shall bo celebrated annually, on or about the last Thursday in June, in commemoration of the foundation of the Institution, when the Public Academical Act shall be lield, and Degrees con- ferred.
