That the faid Proclamation held forth and afiured your Petitioners, that a Government and Conflitution fhould be made and con- firmed to your Petitioners, and the fubjedts of the Crown refidlng in the province of Quebeck, fimilar to thofe in his Majefty's ..j.^^ ..-J. t ^j- ^ ^ provinces in America. The adions and the conduct of your Petitioners, when truely reprefentcd, will beft exprefs the fm- cerity of their Loyalty, and attachment, to tl>e Crown of Great-Britain, i ^^ J » r- J With the utmoft loyalty and attachment, to the Crown and Government of Great- Britain, your Petitioners approach this Houfe. of Commons to intreat, from the Parliament, of Great-Britain, a repeal of the adl pafled in the fourteenth year of his Majefty, Chap. 83, making provilion for the govern- ment of this province, and that an Ad of Parliament may be pafTed for the eftablifli-' ment of a government in the province of Quebeck formed to move and exifl upon the principles which have raifed and fupported the En";lifli Conftitution. ^, 'i It is wltli concern your Petitioners oehold the burthen of Great-Britain ; and with great pain and c.ommiferation they witnefs the infinite diftrefles of the loyal fubjefls of the Crown, who, expelled from their native country, are daily taking fhelter, and feeking a poor and even a painful exiflence, in this; a Britifh Colony. However their diftrefles may as yet fubdue their petitions or their claims, the Parliament of Great-Britain will readily perceive, ** that a free conftitution; and a government fimilar, or fuperiour, to that under which they had been born, had lived, and been happy, will be coniidered by thofe, the injured, the diftrefled fubjedts of the Crown, as the firft protedlion and com- fort which the Parliament and the Nation,^ in relief to their diftrefles, can now grant ;*' and the more fo, as it will be a protc(ftion' and a blefling not merely granted to them, but extended to their children and pofte- nty. • - ^' Your Petitioners, perfuaded that the wel- fare, happinefs, and profperity, of the peo.^ pie and province of Quebec k are objedls of the ferlous and benign coniideration of Par- liament, humbly prefume to fuggeft, ancf ardently pray, that fome amendment may be "■ - ^ mad^ * • i r 9 1 made to the fyftem of government which the Royal Proclamation of 1763 hath pro*- mifed to the fubjeds of the Crown of Great-* Britain, who fhould thenafter and thereby be induced to refidc in this province. Your Petitioners feniibly feel, that, were the mod wife and fit laws eftablifhed among the people, yet their welfare^ their fecurity, and their comfort, muft intirely de- pend on a juft and impartial execution of fuch laws. Whatever conftitution the fubjedls of the Crown in the province may obtain, the equal and true adminiftration of juftice muft be the bafis of their happinefs ; nor is it but with the utmoft fervency that your Petiti- oners implore that the feats of juftice may be filled by men of jurifprudent learning, and whofe abilities, at the fame time they are adequate to their employments, may be fo rewarded, as to be confined to the fundions of adminiftring juftice: and that their ap- pointments may be made tp them, to hold .; r,; - during* If during their good behaviour: — That every caufe of accufation in order to a removal of them, proceeding from the Governour, (hall follow the rule laid down in the 9 th article jj and every accufation in order to a removal of them, made on the part of the publick, (hall proceed from the Houfe of Affembly, and be heard by the Legiflative Council ; which, if well-founded, ihall operate as a fufpeiifion j and, in either cafe, be decided, on appeal and report to his Majefty, by the Lord Chancel- lor and the twelve Judges of England.
