THE RESPONDENT'S CASE.

On the 19th of March, 1811, the Respondent sold to the Appellant
a Lot of Land near Montreal, subject to a rmi" foncie/e in favor of the
General Hospital of thai City. The conditions of the sale were that
A])pell«nt should pay the said rente fonnerr, amounting to 680 livres
per annum, and further that he should pay the sum of 1*421 : 13 : 4,
currency, in manner following, to wit, " Aux dites Demoiselles de la
*• Charite a I'acquit et decharge du dit vendeur la somme de £184 : 17 :
*• 6, cours actuel, pour arrerages de la susdite rente fonciere a elles dus
•• et echus Ic premiere Janvier dernier : et quant a la somme restante de
«• deux cent treme cinq livres 15s. lod. courant, le dit sieur acquereur
*• /'fomettoit d s'<il)ag(vitde labaiHeret payer a'l dit sieur vendeur aussi
** lot qu'd seroit constat^ au mo\en dii deciit (cy) apres stipule, qu'il
•* n'existe sur le dit lopin de terre et niaison sus vendus aucunes hypo-

The stipulation relating to the decret and the costs thereof (respecting
the payment ol which the present contestation has arisen) is in these words,

In execution of this clause of the contract the Appellant caused the

The present action was brought for the recovery of sixty pound,
