It is desirable to draw closer the ties of human sympathy, and strengthen the bond of brotherhood between the members of the Saint John Fire Department, by the formation of a Society, having for its object the relief of sick and disabled members of the Fire Brigade ; it is therefore Resolved, That the undersigned members of the Saint John Fire Brigade shall form them- selves into an Association for the purpose of effecting uniformity in the administration of relief, and render pecuniary aid to each other during sickness or accidents incident to human life, and let Union and Friendship be their motto. CONSTITUTION OF THE St. John Firemen's Mutual Relief Association ARTICLE I. Name of Association. The Society shall be known as the Saint John Firemen's Mutual Relief Association. ARTICLE II. Government of the Association. The government of the Association shall be vested in a Board of Trustees, consisting of the Chief Engineer (being a member of the Association) and six other members of the Association. Four members of the Board of Trustees shall constitute a quorum for the transaction of business by the Trustees. The Chief Engineer, if a member of the Association, shall be, and he is hereby declared to be a Trustee by virtue of his office. The other Trustees shall be elected by ballot from the members of the Association at the Annual Meeting on the first Thursday in November, and shall hold office for the year. In case of the death, removal or resignation of any of the elective CONSTITUTION. Trustees during the year, the vacancy shall be filled by ballot from annong the members of the Association at any regular or special meeting. ARTICLE III. Officers and Election of Officers. The officers of the Association shall consist of a President. Vice-President, Treasurer. Secretary and Chairman who shall be elected annually by the members of the Association from their number, and said election shall be held at the Annual Meeting of the Association in the month of November. ARTICLE IV. Duties of Officers. Section 1. Duties of Trustees. It shall be the duty of the Board of Trustees to manage and superintend all things appertaining to the Association, to make grants for aid, issue orders for relief by Committee, or in body, in accordance with the terms of the Constitu- tion ; control and direct the manner of investing the funds, and generally to do and perform all things not inconsistent with the votes of the Association. It shall also be their duty to receive and investigate all applications for aid, to levy assessments, and cause the same to be collected by the Secretary, in accordance with the provisions of the Constitution, and to appoint a visiting and such other Committees, to facilitate their business, as are not provided for in the Constitution. . CONSTITUTION. Section 2. The Board of Trustees shall annually appoint a Committee on Resources, whose duty it shall be to use any means, not derogatory to the honor of the Association, to obtain contributions to the funds of the Association, independent of the annual payments of the members. Section 3. The Trustees may by vote, in which two-thirds of the Board concur, expel any member from the Board, and in case of any such expulsion from or any vacancy in the Board, shall report to the Association, at the first meeting after such vacancy occurs, the circumstances connected with such vacancy or expulsion, and it shall then be the duty of the members of said Association to elect a trustee from their number to fill such vacancy. Section 4. Duties of President. It shall be the duty of the President to preside at the meetings of the Association and of the Board of Trustees, and to keep order therein in accordance with the principles and rules of Parliamentary law ; to call meetings of the Board of Trustees or Association whenever he may deem necessary. He shall, at the written request of three members of the Board of Trustees, call Special Meetings of the Board of Trustees. He shall also call Special Meetings of the Association whenever any ten members of the Association shall request him in writing to do so. and it shall be his duty to order the Secretary to notify, in writing or printing, the Board of Trustees or the members of the Association, of any such meetings. 8 CONSTITUTION. Section 5. In case of the refusal or neglect of the President for one week, to call a meeting of the Board of Trustees, when requested by the Board, the Vice-President shall call the same, and in case of the Vice-President's refusal or neglect to do so, any three of the said Trustees, shall have power to call the same and to transact business. And in case of the refusal or neglect of the President to call a meeting of the Association when requested, the Vice-President shall, on the written requisition of at least twenty members of the Association, call the same, and in case of the refusal so to do by the Vice-President, any twenty members of said Association shall notify the Secretary in writing, and may call a meeting in their own names by signing an advertisement which shall be inserted in one of the newspapers published in the City of St. John for one week previous to ich meeting. The said advertisement to set forth the time and place at which such meeting is to be held, and also the reason and object for calling the same. The proceedings of such meeting shall be as legal and binding on the Association as if called by the President, provided always that a duplicate copy of the notice as advertised signed by the twenty members, shall first be transmitted by them to the Secretary for the purpose of being filed by him with the records of the Association. Section 6. Duties of Vice-President. It shall be the duty of the Vice-President to discharge the duties of the President in the absence of that officer. Section 7. Duties of the Chairman. It shall be the duty of the Chairman elected by the Association to CONSTITUTION, preside at all meetings of the Association in cases when the President and Vice-President are both absent, either from inability to attend or refusal or neglect by either of said officers to call a meeting when requested, or in cases where the presiding officer wishes to take part in any debate before the meeting. Section 8. In the absence of both the President and Vice-President, from any cause, or of the regular Chairman referred to in the preceding section, the members present may elect from their number a Chairman to preside over the meeting, and such Chairman shall have and exercise all the powers of the President at such meeting until the President or Vice-President or regular Chairman arrives, when the Chairman so chosen shall vacate the chair, and the same shall be taken by the President, Vice-President, or the regular Chairman. Section 9. Duties of Secretary. It shall be the duty of the Secretary to keep a fair and true record of the proceedings of the Association, and of the Board of Trustees ; to notify the Board of Trustees and all members of all meetings when directed ; to collect and receive all money due the Association for dues and assessments, and pay the same over to the Treasurer, taking his receipt therefor ; to faithfully perform all duties relating to the clerkship of said Board and Association. It shall be his duty also to publish in one of the newspapers published in St. John, immediately after their election, a list of the trustees and officers elected for the year. His remuneration 10 CONSTITUTION. for his services shall be $25.00, payable out of the funds of the Association at the Annual Meeting in November. .'Section 10. Duties of Treasurer. The Treasurer sN^'shall have charge of the funds of the Association. recelve^'liTl moneys due the same, and pay all bills and benefits, when ordered so to do by a vote of the Beard of Trustees. And he shall render to the Association at the Annual Meeting, and also to the Board of Trustees whenever by them requested, a full and correct amount of all receipts and disbursements, and of the financial condition of said Association. ARTICLE v. — Meetings. The meetings of the Association shall consist of an Annual Meeting, to be held on the first Thursday in November in each year, and Quarterly Meetings to be held on the first Thursday in February, May and August, and such Special Meetings as may be called in accordance with the Constitution. Ten members shall constitute a quorum for the transaction of busi'^esc. The Secretary shall notify, by postal cards, all members of the Association of such meetings. ARTICLE VI. — Membership. Section 1. Every member of the St. John Fire Department, whether call, subswttute or permanent. CONSTITUTION. 11 shall have the right to be admitted to and become a member of this Association op his written application to the Secretary thereof, addressed to the President, or in his absence the Vice-President or Chairman, and enclosing therewith a certificate from the Chief Engineer of the Fire Department of his then existing membership in said Department. Such application also to enclose the sum of five dollars for his entrance fee and three dollars for the current year's dues. Said current year to end on the 1st November succeeding his application. The Secretary on receipt of said application shall forthwith forward the same to the President, or in his absence the Vice-President, or in his absence the Chairman, and it shall then be the duty of the President. Vice-President or Chairman, as the case may be, to call a meeting of the Association within one week after reception of said application. At this meeting an order shall be made for the medical examination of the applicant as to the state of his bodily health and fitness to be a member of the Fire Department and this Association. Such examination to be made by a legally qualified Medical Doctor, registered under the laws of the Province of New Brunswick, and to be named by the Association. Such examination to be made at the expense of the applicant on notice to the applicant. On receipt of such medical certificate by the Association, and it appearing to be favorable to the applicant, notice shall be sent to the applicant to attend a meeting of the Association, and on his attending he shall then sign the Constitution. Should the medical certificate be unfavorable to the 12 CONSTITUTION. K applicant, his application shall be rejected, and the Association shall order that the sums enclosed by hinn for his membership and yearly dues shall be returned to him by the Secretary, with notice of his rejection and the cause thereof. Section 2. The year mentioned in this Article, shall end on the first of November in each year, and a member joining the Association previous to the first of November, shall pay a full year's dues up to said first of November. Section 3. Each member shall on or before the fifteenth day of November, in each year, pay into the hn^JdroTtKr Association the sum of three dollars as annual dues. Any member failing to pay his^wfjt. assessments, and all legal demands of the Association 'against him in the allotted time laid down in Article XII. for the payment of assessments sh^U be degriyed of ^11 benefits untilsuch time as he shall pay all such arrears against himH^rovided that no payment of arrears by such member shall entitle him to receive any benefits accrued or to which he would have been entitled at any time before such payment but for so being in arrear. Section 4. Any member who shall be in arrears for dues or assessments for the space of eighteen months shall thereupon cease to be a member of the Association. Section 5. No member shall be entitled to vote at any meeting of the Association until all arrears for dues or assessments are paid to the Association. CONSTITUTION. 13 ARTICLE VII. Honorary Membership. Honorary Membership of the Association may be conferred upon any person not a member of the Fire Department, by a vote of the Association, provided always, that any person so elected, upon signifying his intention of acceptance of such membership, shall pay into the funds of the Association the sum of $100, and shall be eligible for an election to and may hold any of the before mentioned offices ; he may also vote at all meetings, and shall be subject to the same assessments and annual contributions as other members. ARTICLE VIII. Any person connected with the Fire Department and a member of this Association, having been discharged or withdrawn from said Department, and if he be willing to remain a member of the Association and pay his dues, in case of accident he shall be entitled to receive the sum of five dollars per week for a period of twelve weeks, and at the expiration of twelve weeks, if he still be unable to attend to his business, his case shall be brought before a meeting of the Association, and by a two-third vote of the members present at such meeting, a further allowance can be made to him. In case of the death of said member, his widow, or heirs, or representatives, shall receive the sum of Two Hundred and Fifty Dollars of the general funds of the Association and a further amount of one dollar from each member, the same to be collected by order of the 14 CONSTITUTION. Board of Trustees. The member referred to in this Article is required to give the same notice to the Trustees as is required by Article IX. and be governed by the same rules as apply to cases under Article VI. 1 ARTICLE IX. Any member of this Association, in good standing who may receive an injury, or contract sickness while in the discharge of his duty (1st) as a Fireman ; (2nd) or as a Member of the Fire Department ; (3rd) or while engaged in performing duties connected with the Fire Department directed by the Chief Engineer, or any district engineer or superior officer, shall give notice to the Trustees, or to one of them, within one week after receiving such injury or contracting such sickness, and shall adopt such methods and take such precau- tions as will insure his speedy recovery; and any member who neglects to do so, shall, in the discretion of the Board of Trustees, be deprived of any relief from the Association. Any member dissatisfied with the order of the Trustees depriving him of benefits, shall have the right of appeal to the Association subject to the provisions laid down in Article X. ARTICLE X. — Benefits. Section 1 . Any member of the Association in good standing, in case of an injury or sickness, caused by reason of attending to his duty, as in the last preceding Article mentioned, shall be entitled to receive, while the funds of the Association do not exceed three hundred CONSTITUTION. 15 dollars, the sum of five dollars per week, as long as the Board of Trustees shall deem it expedient, but in no case longer than twelve weeks, unless by a two-third vote of the members of the Association who may be present at a regular or special meeting. When the funds of the Association amount to five hundred dollars, the weekly indemnity to be paid to the member shall be eight dollars per week, and subject to the same conditions as in this section are previously expressed. Provided always, that should any member of the Association, being a member of the Fire Department, meet with an accident while not in the exercise of his duty as a member of the Fire Department, as afore- said, he shall be entitled to receive the sum of five dollars per week, as mentioned in this Section. In all cases the member claiming benefits is to produce to the Trustees, if so required, a certificate of the Physician appointed by the Association stating the cause of accident or sickness, and the time when such accident occurred or sickness began, and in case of the neglect or refusal of said member to comply with this rule he shall not be entitled to receive any benefits without the order of the Association, on his appeal being brought before the Association at a regular or special meeting thereof, subject to the same rules as are hereinafter expressed. Section 2. In case of the death of a member in good standing, caused by the performance of his duty as a fireman, or otherwise, the surviving members shall be assessed the sum of one dollar each, and said sum so assessed, together with the sum of two hundred and fifty dollars, to be drawn by the Trustees from the funds of the Association, shall be paid by the Associa- tion to the family or relatives of the deceased. Section 3. The Board of Trustees may give orders on the Treasurer for benefits due while the assessment is being collected ; provided that the funds in the hands of the Treasurer will warrant the same. ARTICLE XI. The Chairman of the Board of Trustees, upon receipt of notice from any Trustee stating that any member of his company has been injured or disabled by sickness caused by performance of his duty as a fireman, or otherwise, as expressed in Article IX, shall investigate as to the cause and nature of said injury or sickness, and, in connection with the other Trustees, have general supervision of said case, and at any regular or special meeting of the Association report the facts of the case. CONSTITUTION. 17 ARTICLE XII. .-^ Notice of Assessment. X When an assessment shall have been levied by the / \ Board of Trustees, due notice shall be given to the / \members of the Association in such manner as the Trustees may deterjnine, and the same shall be paid to the Board of Trustees within two weeks from the time the notice is given. Any member, without good; cause shown to the Trustees at their then next meeting. \ neglecting or refusing to pay the assessment within the time specified in this Article, shall be considered in arrears to the Association, and shall forfeit all rights, j benefits and privileges he may have in the same. ARTICLE XIII. The yearly dues and all moneys received for admis- sion fees, and all legacies, donations or gifts to the Association, after paying all bills against the Associa- tion, shall constitute a general fund, and shall be invested under the direction of the Trustees. ARTICLE XIV. No subject or question of any kind shall be intro- duced or discussed at the meetings of this Association except such as are connected with the management of its affairs and the benevolent purposes mentioned in this Constitution. 18 CONSTITUTION. In no case shall any of the preceding Articles be added to, altered, amended or repealed, unless by a vote of two-thirds of the members present at a meet- ing of the Association, and on a previous notice given by a member at a regular or special meeting, desiring to have the addition, alteration, amendment or repeal. That John Kerr, Chief Engineer of the Saint John Fire Department, James Dinsmore, Oliver Thompson, Albert Winchester, Thomas McPherson, and Charles H. Jackson, and all other persons who now are or hereafter may become members of the Saint John Firemen's Mutual Relief Association, and their successors, be and they are hereby declared to be a body politic and corporate, by the name of "The Saint John Firemen's Mutual Relief Associa- tion," and to acquire, have, hold, receive and dispose of any property, real or personal, in the Province of New Brunswick, to an amount not exceeding five thousand dollars, with all the powers incident to a Corporation by law. (19) 20 ACTS OF INCORPORATION. 2. The government of the Association shall be vested in a Board of Trustees, consisting of the Chief Engineer for the time being by virtue of his office, if he shall be a member of the Association; one District Engineer, and one representative from each Hose and Hook and Ladder Company (bemg members of the Association), at the Annual Meeting on the first Thursday in November, and shall hold office for one year; but in case of the death, removal or resigna- tion of any of the elective Trustees during the year, the vacancy shall be filled by ballot from among the members of the Association at any regular or special meeting. 3. Four members of the Board of Trustees shall constitute a quorum for the transaction of business by the Trustees. 4. The officers of the Association shall consist of a President, Vice-President, Treasurer, Secretary and Chairman, who shall be elected annually in the month of November by the members of the Associa- tion from their number. 5. Section 1 of the Act 51 Victoria, Chapter 31, intituled "An Act to incorporate the Saint John Firemen's Mutual Relief Association," is hereby amended by striking out the word "five" in the eleventh line of the section and substituting therefor the word " twenty." 2. Section 2 of the said Act is hereby repealed, and the following is hereby substituted in lieu thereof: "2. The government of the Association shall be vested in a Board of Trustees, consisting of the Chief Engineer (being a member of the Association), and 'six other members of the Association. In addition to the officers of the Association mentioned in Section 4 of the said Act, it shall and may be lawful for the said Association to appoint from time to time and to displace a medical doctor, duly registered under the laws of this Province, as one of the officers of said Association, and such other officers as may from time to time be found necessary. ^
