 Some thirty years passed away, and, aB a rule, the Township Rec- 
 torial Eritlownionts did not rise to the level required for tho "comfort," 
 much less tho Vconipjoto maintenance" of tho Rectors. There is, prob- 
 ably, only one exception,- -St. James', Toronto, legally entitled "The 
 First Rectory in the Township of York." In regard to this, however, 
 the " life interest " of the Incuml>ent was undisturbed, he was left in 
 quiet possession of an increasingly large income. No enquiry was 
 needed td revval tho fact that it was greatly in excess of what was 
 required for his most "complete maintenance.'! There was a strong 
 moral (and l«gal) right that the endowments should bo distributed 
 wherever in the City and Township it was moa^ tifeilfid, in accordance 
 with the invariable spirit of all tlie Acts, Orders in Council, Imperial 
 Instructions, and spceitic grants from the Crown. All that was done,^ 
 however, was for the Toronto Synod to get the Provincial Synod to 
 promote the passage of an Act of Parliament, which, while respecting 
 the rights of existing Incumbents, would provide limited incomes for 
 succeeding Incumbents, and divide any surplus " in proportion" from 
 time to time among certain secondary l)eneticiaries. It was virtually 
 the "doctrine of Cy Pr^s" eihbodied in an Act of Parliament, .

 The general efloct of this legislation, then, la to emphmizi' the idea

 expediency of varying or altering its exact provisions is made a subject

 Nothing can be conceived more at variance with the whole spirit, 
 tendency fchd direction of Parliament throughout these Rectory Acts 
 than the brand new notion of " equal (thot is, in(Ii$criininate) distribu- 
 tion." The only possible or imaginary circumstances in which an equal 
 division would be morally justiliablo under such legislation, would be 
 (m was pointed out by a layman in the recent Hynod) when tho 
 conditions of all the parishes, and tuicls of all the incuuil>ent8 interested 
 ahould be found to be alike : a state of things not pretended to exist 
 in the present instance ai}d one practically impossible evcrywhero I 
 Just as surely as there are essential differences between the needs 
 respectively of cities, towns and countsy places, so there are contrasts, 
 actually much greater, l>etween the poorer and richer parU of cities. 
 To descend to " the short and easy method " of equal division is, 
 therefore, simply to shirk the duty and responsibility of carrying out 
 the principle of distinction and discrimination according to needs of 
 parishes and incumbents as laid down by Parliament in Acts of 1866 
 and 1878.

 Naturally, then, when the St. James' Rectory became vacant, 
 the very first act of the Toronto Synod was to illustrate the spirit of 
 the law. In introducing the Resolution, {»ee Journal, 16th June, and 
 Mail, 17th June, 1882) Rev. A. Sanson said distinctly, " the principle 
 of the distribution proposed was that the toeU-off Churches should help 
 the poor ones." Accordingly wo lind the aiitounts thus " ordered and 
 directed "for the time being varied from ^518.77 to $1111.68, out of 
 % total of $14,461.81, supposed to be then available for the purpose. >

 until last year. Indeed, tlie idpa of speqinl provision for the poor 
 parishes and nior^ needy incumhcnts is expressly emphasized in the 
 Resolution of the Archdeacon. It provides for 8200 per annum (as a 
 first charge) on the funds for eacii of tho Rectors of the following 
 parishes, Oracq Church, St. Matthias', and St Bartholomew's, described 
 as " situated in the poorer parts of the city," see Journal. This 
 lessens the average available for incumbents of all other Churches.
