Canada, for regulating the Practice of Medi- cine, Surgery and Midwifery, require amend- ment; And whereas it is highly desirable that the Medical Profession of Lower Cana- da aforesaid be placed on a more respectable and efficient footing, and that better means should be provided for the conviction and punishment of persons practising the same without license: Be it therefore enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legisla- tive Council and of the Legislative Assembly of the Province of Canada, constituted and assembled by virtue of and under the autho- rity of an Act passed in the Parliament of the United Kingdom of Great Britain and Ireland, and intituled, An Act to re-unite the Provinces of Upper and Lower Canada, and Ordinance of L.C,28Geo.3, c. 8, repealed, except so much ai relates to Druggists. proviso : Act 4 & 5 Vict, c. 41, not to be affected. Proviso : This Act not to affect any for the Government of Canada, and it is hereby enacted by the authority of the same, That from and after the passing of this Act, the Act or Ordinance of the Legislative Council of the late Province of Quebec, passed in the twenty-eighth year of the Reign of His late Majesty King George the Third, and intituled, An Act or Ordinance to prevent persons practising Physic and Surgery within the Province of Quebec, or Midwifery in the Towns of Quebec and Montreal, without license, except so much thereof as relates to the vending or distri- buting of Medicines by retail,— and all other Acts or parts of Acts in any manner relating to the Practice of Physic, Surgery or Mid- wifery in Lower Canada, or in any manner relating to the mode of obtaining licenses to practice Physic, Surgery or Midwifery there- in, shall be and are hereby repealed, except in so far as relates to any offence committed against the same or any of them before the passing of this Act, or any penalty or for- feiture incurred by reason of such offence: Provided always, that the Act of this Pro- vince, passed in the fourth and fifth years of Her Majesty's Reign, intituled. To examine all credentials purporting inspecting to entitle the bearer to a certificate for li- cense to practise in this Province, and to oblige the bearer of such credentials to attest (on oath to be administered by the Chairman for the time being) that he is the person whose name is mentioned therein, and that he became possessed thereof honestly. 3. To fix the period of probation which persons must undergo before being eligible for election as Members of the College, which period shall not be less than four years, and to make all such rules and regu- lations for the government and proper work- ing of the said Corporation and the election of a President and Officers thereof, as to the members thereof may seem meet and expe- dient, which said rules and regulations shall, before they shall come into effect, be sanc- tioned by the Governor of this Province after the same shall have been submitted to him for approval and by him allowed. The affairs of the College shall bo conducted by a Board of Governors, thirty-six in number; fifteen of whom shall be elected from among the members of the College, in the Districts of Quebec and Gasp^; fifteen from among its members in the District of Montreal, and six from among its Members in the Districts of Three Rivers and St. Francis. IL The above Board of Governors shall be elected every three years, on the second Wednesday of July. The Meetings for this purpose to be held in the Town of Three Rivers, after at least one month's notice of such Meeting having been published in the Qjfficial Gazettt, in one Medical Journal of each District (if published), and in at least one English and one French newspaper, in eaoh District. 20 III. The election shall take place by ballot, those members being elected who have received the majority of votes. rV. All ties, whether in cases of election or ordinary business of the College, to be decided by the casting vote of the Presiding Ofl&cer, and this shall be his only vote. V. All vacancies in the Board of Governors, whether arising from death, resignation, removal from the District, or otherwise, shall be filled up by the Board of Gover- nors, from among the Members of the College in the District where such vacancy shall occur, by an election by ballot, at the next ensuing Meeting subsequent to the occurrence of such vacancy. VI. The Officers of the College shall consist of a Pre- sident, a Registrar and Treasurer, and for each of the Districts of Quebec and Montreal, of a Vice-President and Secretary, who shall be elected by ballot, by the Governors, from among their own body, the said Offi- cers to be actually residing in the Cities of Quebec and Montreal, and they shall continue in otfice until the ensuing Triennial Meeting. II. The President shall preside at all the Meetings of the College, and sign all vouchers for the payment of money. III. In the absence of the President, the Vice-Presi- dent of the District ohall possess all his powerf . I. The Registrar shall keep in his possession, the Books of Enregistration, one of which shall be for Stu- dents entering upon the Study of Medicine, and the other for the enregistration of the Members of the College, and he shall have charge of the Seal of the College. II. As Treasurer he shall receive all moneys due to the College, whether from its Members, Licentiates or 22 otherwise, and forthwith deposit the same in one of the legally instituted Savings Banks of the Province, and make a full Statement of all Receipts and Disbursetoents, at each Semi-annual Meeting, (exhibiting at the same time his Bank Book,) and also, at any other time he may be called upon to do so by the President, and liiUst fur- nish security to the amount of (£100) one hundred pounds currency. 111. No one can be admitted as a Member who has not been a Provincial Licentiate of four jrears standing. II. All applications for Membership must be accom- panied by a document signed by two Members of the College, testifying as to the moral qualifications of the appHcant. m. Immediately on admission as a Member, the applicant shall sign the Rules and Regulations in posses- sion of the Registrar, thereby binding himself to fulfil all regulations provided in this behalf. IV. Members of the College are at once eligible as Governors; but no Member shall vote at any of the Triennial Elections for the Board of Governors, unless he shall have previously paid up all his dues. V. Every person proposed as Member shall be consi- dered elected by receiving a majority of votes of Mem- bers present at the Board. VI. All Members are entitled to the appellation of " Member of the College of Physicians and Surgeons of Lower Canada." VIJ. The Certificate of Membership shall be signed by the President and all the other Officers of the College, and the ^al of the College shall be affixed thereto. 24 I. The Licentiates are those who have received a Certificate of Qualification from the Board of Governors, in their capacity as " The Provincial Medical Board," and afterwards received a Provincial License, thereby be- coming entitled to the appellation of « Licentiate of the College of Physicians and Surgeons of Lower Canada." II. After the expiration of four years such Licentiate may apply for Membership, subject to the regulations in that behalf. IIL The Certificate of Qualification for License shall be signed by the District President and Secretary, and also by the Registrar and Treasurer, and have the Seal of the College affixed thereto. I. The Regular and Stated Meetings of the Board of Governors shall be held on the second Tuesdays of May and October, in each year. The May Meetings in the City of Quebec, and the October Meetings in the City of Montreal. Any person possessing a Diploma, &c. from British Universities, wishing to obtain a Certificate for License to practice in this Province, is required to present himself in person, and prove to the satisfaction of the Board that he is the person whose name is mentioned in said Diploma. n. Candidates for Provincial License commencing their studies subsequently to the passing of the Act of Incorporation of this College, (July 28, 1847,) will be required to submit to a Literary and Classical Examina- tion on entering upon his studies, and a Professional one at their close. m. At the Preliminary Examination the Candidate must furnish proof of his possessing a good moral cha- racter, and a competent knowledge of Latin, History, Geography, Mathematic!^, and Natural Philosophy, and from and after the year 1850, he must also possess a general knowledsre of the French and Endish laniruasrea. 26 IV. The Professional Examination shall be held after the completion of the Curriculum hereinafter enjoined, and shall consist of an enquiry into the scientific attain- ments of the Candidate, based upon the course of study he has pursued. V. Before his Examination be entered upon, the Candidate for License mtist submit to the Board satis- factory testimonials as to his moral character— of his being of the full age of twenty-one years, and that he has pursued his studies uninterruptedly during a period of not less than four years, aiul that he has been regu- larly indentured during the said period of four years to one or more general Practationer or Practitioners duly licensed. VI. He must furnish evidence of his having attended for a period of not less than one year, or two periods of not less than six months each, the general practice of an Hospital containing not less than fifty beds — under the charge of not less than two Physicians or Surgeons; and that he has attended two three months or one six months* Course of Clinical Medicine, and the same of Clinical Surgery. VIII. No Class or Hospital Tickets will be recog- nised by the Board, unless accompanied with Certifi- cates of faithful and regular attendance. IX. No Tickets will be recognised from any Teacher who lectures on more than one of the six months bran- ches of Medical Study, previously enjoined — except in the instances of Clinical Medicine, Clinical Surgery, and Practical Anatomy.
