For the purpose of ensuring, as much as possible, uniformity in the administration of the privileges, hon- ors and benefits of the Independent Order of Odd Fel- lows within its jurisdiction, the Provincial Grand Lodge of Canada West— the Superior Tribunal of all Lodges within the limits of the Province of Canaaa West— doth hereby ordain the following Articles, as the Constitution of all Subordinate Lodges workuig under its immediate jurisdiction. Clause 9. — No Candidate who has been rejected can be again proposed for Membership, until, at least, six months after such rejection ; and no person who has been twice rejected on application for Membership in the Order, shall again be proposed as a Candidate. SECTION II. — DEGREES. Clause 1.— Every Brother, previous to his receiving any of the Five Degrees, shall present a certificate from the P. S. that he is not in arrears to the Lodge, and that he has paid all charges for the said Degrees, and shall then be balloted for. Clause 2.— If, on such ballot, 'i application be op- posed by more than three of the Members present, it shall be rejected ; otherwise, he shall be considered eligible, and shall be admitted to the Degree or De- grees in question. ^ Clause 3.— No certificate for Degrees shall be granted until after the Candidate shall have paid the amount required therefor. Clause 5. — Should this Lodge, or the Officers thereof, fail to make the Returns required by the preceding Clauses, for twelve months, it shall thereby become liable, to the forfeiture of its Charter j and it shall be the duty of the last-installed Officers to transmit or surrender to the Grand Master, on requisition from him to that effect, (or to such other Brother as may be appointed, by the Grand Lodge or Grand Master to receive the same,) the Charter, books, papers, fami- ture and funds of the Lodge. ARTICLE v.— FUNDS. SECTION I.— CONTRIBUTIOXS. Clause 1. — There shall be two regular Funds of this Lodge, to be known respectively as the Widows and Orphans' Fund and ^he General Benefit Fundj and the Lodge may provide, by its By-Laws, for the insti- tution of a Special Fund or Funds for any of the be- nevolent purposes contemplated by the Order : Pro- vided always, that in the case of every such Special Fund, the receipts and disbursements on account there- of shall be kept altogether distinct from the Regular Funds hereby established. Clause 3. — All officers shall wear the Regalia of their respective offices while present in Lodge, and all Members must appear in the Regalia of the highest Degree they have received. Clause 4.— The Regalia of P. G. shall be a scarlet collar or sash, and an apron, either white edged with scarlet, or scarlet edged with white ; such collar, sash or apron may be trimmed with silver lace or fringe, or, where the Brother has attained the R. 1'. Degree, with yellow metal. SECTION II. — FUNERAL REGALIA. G. who shall declare the re- sult to the Lodge, and said tellers shall, in no case, count any blank as a vote. No; 20 — As soon as each ballot is completed, the N. G. shall declare it closed, and no vote shall be re- ceived thereafter ; if there be no majority for a candi- date at any ballot, a new one shall forthwith be held, the name of the candidate having received the smallest number of votes being withdrawn by the N. G. No, 21.— The appointed Officers of this Lodge shall be Warden, Conductor, Outside Guardian, Inside Guardian, R. S. N. G., L. S. N. G., R. S. S., L. S. G. in the investing and charge of all invested funds of the Lodge 5 to make out, at the end of his term, for tibe Grand Lodge, a full return of the proceedings of the Lodge during the term ; and to perform all such other duties appertaining to his office, as may be required of him by the Lodge, or by his Charge. No. 27.— It shall be the duty of the P. No. 28. — It shall be the duty of the Treasurer to re- ceive from the P.S., all monies of the Lodge,and careful- ly to deal with the same, in such manner as may be re- quired by the By-Laws or vote of the Lodge, duly passed in conformity therewith j to pay all cheques signed by the N. G., if drawn on account of Benefits due under these laws j also all cheques signed by the N. G., and attested by the R. Secretary, but no others j to keep correct account of all monies coming into his hands j to invest all monies in his hands above the amount of Twenty Dollars, in the Savings Bank : to lay before the Lodge a statement of its funds, wnen- ever required ; to have his books made up within six days after the last meeting in each term, and to de- liver up, when called upon, all monies, bonds, papers, books, or other property of the Lodge, to his success- or in office, or the Lodge. No. 29. — At his installation in office, the Treasurer shall give with two sureties, to be approved by the Lodge, a joint and several Bond to the N. G. and V. G., for the term during which he is to serve, under such penalties and on such conditions as from time to time may be prescribed by the Lodge. No. 30. — ^It shall be the duty of the Warden to act as Chairman of the Property Committee j and to per- form such other duties as are laid down in the charge of his office. BY-l.AWS. CI No. 31. -'It shall be the duty of the Outside Guard- ian to keep tha ante-room^ ana Lodge roora clean and comfortable, and ohall hold keys for his own use j h<» shall assist the W. in placing and replacing the rega- lia J attend to lighting and heating the rooms j hare the doors opened in proper time, for any meetings of the Lodge ; and for such services, he shall receive Twenty-five Cents per night from the 1st April to the 1st October, and Thirty-seven and half Cents per night from the 1st October to the 1st April. No. 32. — The Chaplain, when present, shall assist in opening and closing the Lodge, according to the requirement of his office. No. 33. — Every Officer, (with the exception of the sitting P. G. of the quarter, ) who may be required to state his duties, or to deliver any Charge in the Lodge, shall commit his part to memory, within four weeks from the time of his installation. No. 34. — Any Officer, charged with improper con- duct in office, or conducts unbecoming an Odd Fel- low, may be suspended, or dismissed from office, by a vote of two-thirds of the Brothers of the Lodge pres- ent and votiag on any motion to that effect : Provided always, that no such motion be put to the vote at any meeting, whether regular or special, unless formal no- tice have been given thereof, by two Brothers of the Lodge in good standing, at the regular meeting next preceding, and written or printed notices of such mo- tion have been sent in consequence, [as it is hereby required that in such case they shall be,] at least eight hours previous to such meeting, to every Brother of the Lodge resident in town. 11 / 32 BY-LAWS. No. 35. — For absence during more than four snc- ever a motion to that effect may be made. Any Offi- cer, so dismissed, shall forthwith surrender, on demand to that effect, to the N. G. or to such P. G. as the Lodge may appoint, all books, papers, monies and other properties of the Lodge, which may be in his hands. No. 36. — On the occurrence of a vacancy in any elective office, the N. G , or, if the office of N". G. be vacant, the V^. G. shall cause written or printed notices thereof to be forthwith issued to every Brother of the Lodge residing in town j and the Loage shall proceed forthwith to elect a Brother to fill such vacancy, at the regular meeting next following the issue of such no- tices, (provided the said meeting take place at least eight hours after their delivery,) or at any special meeting which may be duly convened by such notices. And on the occurrence of a vacancy in any appointed office, other than that of Chaplain, the same shall be forthwith filled by the appointment of a qualified Brother, by the N. G. or V. G., as the case may re- quire. COMMITTEES, &C. No. 37. — The N. G., upon the night of his installa- tion, shall appoint, (subject to the approval of the Lodge,) the following Standing Committees to serve for th3 current term, viz. : — a Visiting Committee, a Finance Committee, and a Property Committee. . No. 38. — The Visiting Committee shall consist of seven members, viz, :— ^. G., R. S. N. G., L. S. N. BY-LAWB. 33 G., R. 8. V. G., L. S. V. G., W., and C, together with the N. G., who shall be chairman, ex officio. No. 39. — It shall be the duty of this Committee to visit every sick Brother of this Lodge within twenty- four hours after receiving information of his illnes*, provided he be in the city of London, or within one mile thereof J and to render to every sick Brother of his Lodge, such other aid as the Law provides, and as his case may require and admit. It snail be the duty of the Chairman of this Committee to make such ar- rangements as that sick Brothers of the Lodge, if with- in one mile of the city of London, shall be visited, at least once a day, during their illness, by one or more members of the Committee : to keep a correct roll of the names and residences of all the Brothers of the Lodge, for the use «f the Committee 5 and, whenever circumstances may require it, to call upon so many of the Brothers, in order as they stand on such roll, as may be necessary to secure the attendance and services of two Brothers to watch nightly with any sick Broth- In cases of contagious or infectious disease, it er. shall not be incumbent on members of the Committee personally to visit the sick Brother 5 and, should at- tendance be required, instead of calling upon Brothers, as above provided, the Committee shall employ a nurse, to be paid from the funds of the Lodge. No. 40. -The Finance Committee shal' consist of three members. It shall be the duty of this Commit- tee to superintend the financial affairs of the Lodge, to inspect and report upon all accounts referred to them by the Lodge, at the regular meeting next fol- lowing the reference of such accounts ; and to audit, quarterly, the accounts of the P. S. and Treasurer for § ! r 34 BY-LAWS. the previous quarter, and of all other oflficers or Committees charged with the receipt or expenditure of monies of the Lodge. No. 41.— The Property Committed shall consist of the W.J 0. G., and three Brothers. It shall be their duty to take charge of all Resralia and other effects of the Lodge, not specially entrusted to particular officers, or to other Committees ; to procure for the Lodge such articles as may be necessary, or as the Lodge may di- rect 'j to cause to be made such repairs to the Regalia or other properties of the Lodge, as to them may seem requisite, or as the Lodge may direct ; and to make a full report of th^3ir proceedings at the last meeting in each term. No. 42.~It shall be the duty of the Investigatinc^- Committee, appc'nted under By-Law No. 4, to ascer- tam carefully, the age, state of health, profession, hab- its and character of the candidate proposed ; also, if the candidate is married, as to the health of his wife, and report to the Lodge at the next meeting, unless otherwise instructed. No. 43 —Any Committee, or members of Commit- tee, failing to discharge their duty, may be dismissed by vote of the Lodge CARDS. No. 46.— For every Card issued, there shall be charged the sum of Thirty Cents ; and all dues and charges which are or may become due under such cards, shall be deposited with the P. S. before any motion be put to the Lodge for granting such card, BENEFITS. No. 47. — Every Brother who has been a member of the Lodge for six months, in good standing, if rendered incapable of following his usual occupation by sickness or misfortune, not proceeding from immorality on his part, shall be entitled to receive the following benefits during his sickness or incapacity, viz., if a Scarlet Member, Three Dollars per week; if a Royai Blue Member, Two-and-a-half Dollars per week, otherwise Two Dollars per week, and a medical or other certifi- cate shall be required, in every case not under the direct supervision of the N. G. or V. G. ; and no benefit shall be held to be due for more than one week previous to such case being reported to the Lodge, unless ordered otherwise by the Lodge. No. 48. —If such Brother be resident, or if his sick- ness or disability as aforesaid occur, at a distance from London, it shall be necessary that a statement or statements of his case, setting forth the nature of his sickness or disability, the time of its commencement and its duration, be transmitted to the N. G. of this Lodge, certified by the N. G. of the Lodge, nearest to the place where he may be for the time resident or detained, and under the seal of sach Lodge ; or if he 36 BT-J*AWS. % i be not near to any Lodge, by a Justice of the Peace, or Clergyman, or respectable Physician ; and such Brother shall thereupon receive the benefit provided by the preceding Law. In case such Brother shall leave London, while in receipt of benefit as aforesaid, it shall rest with ^e Lodge, by vote, to decide whether or not the circumstances of the case are such as to require the continuance of such benefit during his absence from London No. 49. — ®n the decease of any Member in " Good Standing " there shall be allowed the sum of Forty Dollars, and on the decease of the wife of any Member in " Good Standing," the sum of Twenty Dollars, to assist in defraying the funeral expenses, under the charge of the N. G., in accordance with the Laws and Usages of the Order. No. 50. — The widow of any decea^d Member in ^^ Good Standing " at the time of death, shall receive from the funds of the Lodge, the sum of Forty Dollars per annum, payable quarterly during the widowhood. Should any deceased Brother leave no widow, or should his widow afterwards die, the said yearly sum of Forty Dollars shall be paid in like man- ner for the benefit of his orphan child or children — if any there be - under the age of fifteen years j the interest oi each such child in such benefit ceasing, as he or she shall attain the age of fifteen years, unless, in the case of any female child or children, it be other- wise ordered by the Lodge; should circumstances require it, the Lodge may withdraw from the widow of a deceased Brother the benefit, and grant the same to his orphans, under the prctviso above Bet forth. No. 51.— Whenever it mav become known to the Lodge that any Brother of this Lodge has been reduced to a state of pecuniary distress by any sudden or unlooked-for dispensation, his case shall be referred to a Soecial Committee of three Brothers, whose duty it shall be to examine into the same, and report to the Lodffe whether anv, and what sum, in their opinion, should be granted for his relief, from the funds 'of the Lodge : and it shall be competent for the Lodge, by a vote of not less than two-thirds of the Brothers present, to grant him any sum not exceeding Fifty Dollars. If a member of a distant Lodge apply to this Lodge for relief, on the presentation of his card, his case shall be referred to the N. G. and one or more Members of the Scarlet Desree, who shall examine him j if found correct, they shall be at liberty to contribute at once a sum not exceeding Three Dollars, and shall report the same to the Lodge at the next meeting, when, if necessary, such further sum, on motion, may be voted as shall be deemed proper, which sum or sums shall be charged to the Lodge to which such Member relieved belongs. FUNDS. No. 52.— There shall be two Funds of this Lodge -the W'dow and Orphans' Fund, and the General 38 BY-LAWS. Fund— the former chargeable with all benefits to Widows and Orphans of deceased Brothers, the latter chargeable with all other benefits and exnenses of the Lodge. There shall be placed to the ^credit of the Widow and Orphans' Fund one-third of all dues, all fines, and any assessment made for the purpose. All other monies shall be placed to the credit of the* General Fund. ASSESSMENTS. No. 63.— This Lodge shall make an equal assessment on all its Members, whenever the state of its funds reqiire it, provided written or printed notice of such oe given to every Member in "Good Standing," at least forty-eight hours previous to such assessment being levied. INVESTMENT OF FUNDS, AC. No. 54.— All investments of monies of the Lodge, which the Lodge may not deem it necessary to keep in the immediate charge of the Treasurer, to meet its ordinary disbursements, shall be made either in the stock of some chartered Bank or Banks of this Pro- vince, or in some public stock of the Province, or other stock, fully guaranteed by Act of Parliament thereof. All such investments, and all transfers and sales thereof, or of any part thereof, shall be made in the name of the Trustees cf the Lodge, from time to time, as the Lodge may direct, by the N. G., V. G., and Secretary, for the time being, and under the seal of the Lodge. No, 64.— A member of any Committee failing to discharge any duty incumbent on him, shall be fined tor every offence not leas than Twenty-five Cents, nor i^re than One Dollar, on vote of the Lodge to that No. 65.— Any officer of the Lodge failing to dis- charge his duty, shall be fined, if elective. Fifty Cents, If appointed. Twenty-five Cents, for each offence. No. 66.— The P. S. shall charge Brothers with all fines incurred, when ordered to do so by the N. G. or the Lodge. SUSPENSIONS AND EXPULSIONS No. 6 7 .—Any Brother being twelve calendar months m arrear, on the books of the P. S., shall forthwith, upon due '^port thereof to the Lodge, be declared by the N. G. to be suspended from membership j unless, on account of any special circumstances, the Lodge see fit, by vote, to grant a further term for payment j but such further term shall on no account exceed three BY-LAWS. 41 or calendar months. G to have ceased to be a member j unless, on account of any special circumstances, the Lodge see fit, by vote to grant a further term for pay- ment J but such further term shall on no account ex- ceed six calendar months. No. 68.— Any Brother guilty of language or conduct in Lodge, meriting, in the opinion of the Lodge, a se- verer penalty than a fine ; or who shall bring charget against a Brother on evidence which the Lodge shall not regard as sufficient to warrant him in so doing j or who shall knowingly misrepresent the qualifications of any candidate for admission ; or who shall abuse, or attempt to abuse, in any way, the benevolent intentions of the Order j or who shall be guilty of fraud in any business transactions, or of other dishonorable con- duct, or of habitual drunkenness or immorality, or of infraction of the laws of the land, shall be suspended from membership, or expelled, as the Lodge may, by vote, determine. No. 69.— No brother shall be permitted to appear in Lodge while suspended from menabership ; nor shall any sentence of suspension be considered to expire, or reversed, unless by special vote of the Lodge to that eflfect • and no motion to that end shall be put to vote more than once, in the case of any individual, in any one quarterly term ; nor unit ss at a regular meeting, and after formal notice thereof, at the two regular meetings next preceding ; nor, if the suspension have been pronounced for any fixed term, before the close of auch term ; nor shall any vote take effect until after any 42 BY-LAWg. S the Brother shall have paid up all dues to the Lodge, charged or chargeable against him, as well during term of suspension as previous thereto. No. 70.— -If any member of this Lodge shall disclose the rejection of a candidate for initiation, or for ad- mission by card, he shall be subject to expulsion, or such other punishment as the majority of the Lodge may determine ; and whenever such rejections occur, this Clause shall be read in the Lodge, and it shall be the duty of the Secretary, [should the Brother who proposed the candidate aecline,] to inform such person of his rejection, without disclosing any other circum- stance or proceeding of the Lodge. REGALIA AND JEWELS. •No. 7L— -The Regalia and Jewels of this Lodge shall be in accordance with the Constitution, and the Usages of the Griftnd Lodge. No. 72.— Every Brother shall supply himself with suitable Regalia within two months after his admission to the Scarlet Degree. LIBRARY. No. 7.3.— The Library being the result of donations by Brothers, shall be free to all, and shall be under thn control of the Librarian appointed by the N. G., who shall have full charge of it j be held accountable for the Books in his charge, subject always to the control of the Lodge. No. 74. — The Librarian shall charge a fine of five centB for any book being kept out longer than the tim^ specified in such book, which fine shall be appro- priatea to the use of the Liorary. BY-LAWS. 43 AMENDMENTS, No. 75. — No motion to repeal, suspend, or amend these By-laws, Rules of Order, or any part thereof, shall be put to vote until the same shall have been read in Lodge at three consecutive regular meetings; nor shall the consideration of, or the voting upon, any such motion be postponed after such third reading, unless by vote of the Lodge : nor shall such motion be declared to prevail unless, upon the final division thereon, two-thirds of the Brothers present and voting shall vote in favor of it. RULES OF OBDER •>.^.rM*\.r\/\/Wu'\/V Rule 1. — No special motion shall be offered in Lodge otherwise than in writing. Rule 2. — No question shall be put to the Lodge by the N. G., unless regularly moved and seconded j Bor be open for consideration until so put; and when put, no other motion shall be receivable, unless it be the motion, — 1. To adjourn; 2. To lay on the table; 3. To put the previous question ; 4. To postpone ; 6. To refer, or, 6. To amend ; and these several mo- tions, if made, shall have precedence in the order above stated ; and the first, second and third thereof, shall be decided without debate. RuLB 3. — The motion for the Previous Question shall only be put by the N. G. when made by foBT Brothers, and shall always be stated by him in these words, ^' Shall the Main Question be now put?'* and such Question shall forthwith be decided without debate, by Uie vote of the majority of the Brothers present and voting ; and, if carried in the affirmative, shall cut off all amendments to the Main Motion, and all further debate. RuLi 5. —When a> blank is to be filled, the question shall first be taken on the highest sum or number, or longest time, proposed. Rule 6.— The Yeas and Nays shall be taken and recorded, on the call of any Brother, duly seconded. Rule 7 — After any Question, except that of indefi- nite postponement, may have been decided, any two Brothers, having voted in the majority, may, at the same of next meeting, move for a reconsideration thereof J but no discussion of the Main Question shall be allowed upon such motion. Rule 8.— Every Brother of the Lodge shall have the privilege of speaking twice on any question j but not oftener, unless by permission of the N. G. Rule 9. — Any Brother intending to speak on a question, shall rise in his place and respectfully ad- dress the N.G., confining himself to the question, and avoiding personalities : and should more than one Brother rise to speak at the same time, the N. G. shall determine which is entitled to the floor. Rule 10. — The N. G., or any other Brother, may call a Brother to order while speaking j and in such case the debate shall be forthwith suspended, and the Brother so called to order shall not proceed, until the point of Order thus raised be determined, nor speak upon such point of Order, unless it be to make neces- sary application, or appeal from the decisition of the Chair. Rule 11. — In all cases where a Brother may appeal from any decision of the Chair, he shall use the words following, and none other, unless it be be for necessary $r ;.
