In conformity with Section 1\', of tlie Act of the Dominion Legislatore, passed on the i8tli of May, 1S82, a meeting of the Beneficiaries was held pursuant to notice from the Chair- man of the Temporah'ties Hoard, in St. Pauls Churdi, Mont- real, on the 28th June last, when certain resolutions were i)assed by the Beneficiaries in regard to the future administration of the fund, and recognizing the necessity of applying to the Dominion- Parliament for such legislation as would modify the provisions of the existing Act anent the 'lemporalities Fund. Among other matters the Beneficiaries expressed their opinion that all arrears then due to them should be ]jaid by the Hoard, and that '• in the event of its being found that there are legal obstacles in the way of the Board's carrying out this recom- mendation, such legislation should be sought as shall enable the Board to give effect to said communication. ' Being desirous as far as pcjssible of meeting the wishes of the Beneficiaries, the Board lost no time in .submitting the question of payment of the said arrears to tlieir legal advisers, Messrs. Strachan Bethune, Q.C.. and John L. Morris. The opinion of these gentlemen was obtained in writing, and a copy of the same was sent to each of the Beneficiaries. Now prior to the passing of the I'rov. Statute :!8 Vic. cli 04, the Board had not, in our opinion, any legal authority to encroai'b on the capital fund of which they were Trustees. The arrears referred to by the Beneficiaries had arisen from the non-payment of the amounts that had fallen due to the non-priv- ileged ministers on the 30th of J une, and the 3 ist of December, 1881, and for the unexpired portion of the following half year, up to the i8th of May, 1882, when the payments could be legally resumed. It was a matter of deep regret to the Hoard to find that they could not legally make payment of these arrears. In order, however, to obviate the very serious inconvenience, if not embarrassment, that must in consequence be experienced by many of the Beneficiaries in being thus deprived of a not inconsiderable i)ortion of their incomes, the Executive Com- mittee of the Board took upon themselves the responsibility of directing that, in the meantime, an amount should be i)aid to each of the Beneficiaries in arrears, equal to the customary pay- ments for one whole year /// advance^ counting from the i8th of May, 1882. In accordance with this instruction on the 30th of June following checpies were sent to each of the Beneficiaries in arrears for $200, less the usual payments in iheii behalf of $12 to the Ministers' Widows' and Orphan.s' Fund. Lkgislatiox. — In regard to the recommendation of the Beneficiaries that steps should be taken to secure such amend- ments to the existing Act as might be necessary to enable the Board legally to give effect to their suggestions, the Board took the earliest possible opportunity of considering the whole question. They appointed a committee of their number to draft a bill such as they should deem suitable in the circum- stances, with instructions to put themselves in communication with the committee appointed by the Beneficiaries in order that by their united action as much unanimity as was possible might be attained before approaching the Legislature. The result of their joint deliberations was a draft bill, which, after- careful consideration by the Board, was on the whole approved, and Mr. Morris was instructed to take the proper steps to have it introduced in the Dominion Legislature. It was placed / in charge of Mr. John Charlton, M.J'., who sccurt'd I'ur it a first and second reading in the I'ouse of Conimonii. At this stage, however, further progress was arrested in tonse(|iience of communications received from a number ot the Henefuiaries whichlndicated a wide diversity of o|)iiiion in regard to some of the jirovisions of the Bill. By the atlvice of the members of the House who had undertaken to promote the Bill, the representatives of 'he Board deemed it their duty in the circum- stances, to request that the leave of the House be asked to withdraw the Bill. This having been granted no further action was taken in the ])remises, and it now devolves upon the Board to continue the administration of the Kund. to the best of their judgment, under the existing statute. FiNANCK.-— The par value of the I'und at this date is shown in the Appendix, Schedule' A, to be $284,278.65. The actual cash value is estimated to be $300,308.63. The annual in- terest accruing froni the investments is $17,436.50 — a fraction over 6% upon the par value of the fund. The total e.xpendi- ture for the year as per Schedule B, was $47,931.19; the payments made to ministers amounted to $34,438 ; the ex- penses connected with litigation and legislation to $10,294,70. $2000 were paid to Queen's College. $600. 1 1 lor the ordinary ex|)enses of management, $444.66 was due the l)ank frt)m last year, and $189.01 represents accrued interest on mortgages accpiired. The balance on hand at credit of the revenue account is $1840.25. The following changes were made in the investments. 'I' wo mortgages were paid up, amounting to $1 1,000. .Several new mortgages were acquired making in the aggregate $52,950, of this class of investment, all at 6% per annum. Harbour Bonds bearing 6i^% interest, to the value of $60,000, will mature on the 5th of July next, which will have to be replaced by other securities. • Expense Fund. — Contributions from private individuals and congregations have been received during the year, amount- ing in all to $6320.08 towards discharging the expenses of legislation and law costs. Changes in the Manage.meni'. — Two members of the Board were removed by death, namely, Sir Hugh Allan who died in Edinburgh, on the 9th of December, 1882, and Mr. James Michie, who died at Toronto, on the 13th of January last. Sir Hugh Allan had been a member of the Board ever since it was established. He was for a number of years its chairman. 1 he Rev. D. M.
