 This was an actiim brought in the Court of King's Bench for the District of Three-Rivers, 
 the Term of September last, grounded on, and arising out of certain clauses, stipulations and 
 reserves contained in a Donation cntrc vifs, by the Appellants to Respondents, and executed 
 on a5th October, 1819, before Ranvoyz'6, Notaiy, and Witnesses, by which the Appellants 
 gave to the Uespondants — 
 
 ^ First. — A lot of land of tliree acres in front by twenty-two in depth, situated in the Town of 
 Throe-ltivers, with a Barn thereon erected. 
 
 2iidly. — .Vnotlier lot of seventy feet in front, by upwards of three hundred in depth, with a 
 
 house tliiTeon. 
 
 3dly. — Another lut ui'land of an acre in front. 
 
 4thly. — A buil(lin<r lot situated in the Town of Three-Rivers, of one hundred and thirty feet 
 in front by ninety tiet in depth, with an Oil Mill and House thereon. 
 
 5thly. - A lot of land situated in the Town of Three-Rivers, of thirty-six feet in front, by 
 one hundred and cigliiy-six feet in depth. 
 
 Gihiy. — A lot of hind ii\ the Common of the said Town of Three-Rivers, containing two 
 hundred and thirty fi'ct in tVoiu by one hundred and twenty feet in depth, with two Houses, a 
 Stable, a Store, and otlier dcpcnik'ncies built thereon. 
 
 7thly. — A lot of land situated in St. Philip street, ofthe said Town, of two hundred bndsix feet 
 in front uiul onohuiiibvdand fifty-seven in deptV 'igcther with all tlie farming utensils and all the 
 moveables, meubk /"cw/jA/h*, of which they wcie possessed or might be possessed of at the time of 
 their decease, except Mr reserves in the said Lfoiialioti mentioned, to Kit, alt the moveables and house-

 lite dlutmeur) then the Appellants and Respondents should each name an Expert for the 
 purpose of fixing and establishing une rente oti pension xiagerc for the said Appellants in con- 
 formity with iliH ])io|)erty so given by the Ajjoellants, the said Appellants expresely reserving 
 to themselves the right of taking all the Houstliold furniture for their use, also, a horsv, harness 
 and such carriages as tlici/ might think fit to take, also, the enjoyment of a lot of land and house, 
 situated in Three- Hi jcrs, then in the occupation of one James Burns, bounded on one side by 
 the property of one Fra)H;ois Rousseau, and on the other bi/ the house and premises of the 
 Appellants, and in which they resided id the lime of making the said Donation, 
 
 As early as the month of March following, some disagreement and misunderstanding having 
 taken place, evincing too strongly the incompalihiliti d^humeur, the Appellants left Three- 
 Rivers and went to reside at Montreal, whereupon Any lequired the Rebpondcnts in compliance 
 with the provision made in the donation, lo name an expert, and on the lOlh of Aug^t^l, 'he Ap- 
 pellants by Genevieve Rousseau the wife of Pierre Goiiin, his special Attorney for that purpose 
 (see Exhibit, No. ^) and Uespondents went before Badeaux, N. P <V witnesses, and there entered 
 into an agreementof which the following extract is only material, "que le 250ctobre de I'ann^e
