Upon the decease of the said James Francis McCarthy, your com- plainant, and the said defendants James Brown McCarthy, Clara Carrall McCarthy, Dorinda Cornelia McCarthy, Catharine Teresa McCarthy and Frances Eleanor McCarthy, each became and now is entitled to one undivided sixth part of the said lands, subject to the right of the said Jane McCarthy to dower out of the said lands. 4. That Letters of Guardianship of your complainant and James Brown McCarthy, Clara Carrall McCarthy and Dorinda Cornelia McCarthy were on the 12th day of November, A.D. 1863, granted to the said defendant Daniel Carrall the elder by the Surrogate Court of the County of Oxford, being the proper Court in that behalf, hiid your coniplutnnnt and the said defendant James Brown McCarthy have since attained the age of twenty-one years, and the said Clara Carrall McCarthy and Dorinda Cornelia McCarthy are still infants under the age of twenty-one years, and the said defendant Daniel Cirrall the elder is now their duly appointed guardian, so appointed as aforcsaiu. That letters of guardianship of Catharine Teresa McCarthy and Frances Eleanor McCarthy, who are still infants under the age of twenty-one years, were on the 12th day of November, A.D. 1863, granted to the said defendant Jane McCarthy by the Surrogate Court aforesaid, the same being the proper Court in that behalf, and she the said defendant, Jane McCarthy, is now the duly appointc'i guardian, so ap[K)inted as aforesaid, of the said defendants last named. 6. That the said defendants, Jane McCarthy and Daniel Carrall the elder, have been in possession and in receipt of the rents and profits of the said lands from the death of the said James Francis McCarthy up to the present time. That a partition may be made of the said lands, under the direction of this Honorable Court, and that proper con- veyances may ]>e made by all parties for that purpose. 2. Or that the said i)remise8 may be sold under the decree of this Honorable Court, for cosh, or upon such terms of credit as ma}' appear reasonable, and thut the i)rocoeds of such sale may be divided ainongs't the parties entitled thereto aectu'ding to their respective rights. 3.
