Be it enacted by the Municipal Council ot the Corporation of the Townehip of Ra> leigh, in the County of Kent. 1. That the following sums be and they are hereby appropriated for the improye* ment of the Roads and Bridges In the Township of Raleigh, that is to say : In the First Rural Road Division, the sum of Three Hundred Dollars, In the Second Rural Road Division, the sum of Three Hundred Dollars. . \ ' ' In the Third Rural Road Division, the sum of Throe Hundred Dollars. ' . ' In the Fourth Rural Road Division, the sum of Three Hundred Dollars. In the Fifth Rural Road Division, the sum of Three Hundred Dollars. And that the Commissioners of the said R. R. Divisions respectively expend the same: On the Town Lines .between the Town of Chatham and Raleigh the sum of Twenty- five dollars, and that G. H. Dolsen be Commissioner to expend the same. On the Town Line between Raleigh and Harwich, the sum of One Hundred dollan, and that T. L. Pardo be Commissioner to expend the the same. On the Town Line between Raleigh and Tilbury East,' from the centre of the Eightli Concession, northerly to the River Thames, the sum of Fifty dollars, and tltat E. Si Dyke lie Commissioner to expend the same. On the Town Line between Raleigh and Tilbury East, from the centre of the Eighth oonoession southerly to Lake Erie, the sum of Seventy -five dollars, aud that Levi B. Marshall be Commissioner to expend^the same. Providing always that the next four preceding amounts are appropriated conditionally on the adjoining municipalities appro- priating equal amounts for the said purposes respectively. 2. That the following sums accruing from Statute Labor ^ax be expended in the Sta- tute Labor Divisions from which the same was collected as reported by the Clerk, that is to aay : In the First Rural Road Division, the sum of One Hundred and Ten 70-100 dollars. In the Second m h the sum of Ninety-seven dollars. In the Third » ■• the sum of sixty- one dollars. In the Fourth n u the sum of twenty-five dollars. In the Fifth n u the sum of twenty-threo dollars. And that the Commissioners of Rural Road Divisions superintend the expenditure of the same in their respective divisions. 3. That it shall be the duty of the said Commissioners so appointed, to expend the sums herein1)efore appropriated far the purpose, and in tho manner so provided ; and they are hereby authorized to grant orders on the Treasurer of this Corporation, to parties filling contracts thereon, not exceeding the amounts so appropriated for suoh purposes respectively ; less the amounts hereinunder specified as overdrawn by the Commissioners of the preceding year, stating on such order the nature of the work done, and where it was performed. Provided always that no Commissioner shall exceed I the amounts hereinl)efore appropriated, without haying first obtained the consent of I the Council, and the Treasurer notified thereof by the Clerk. 4. That it shall be the duty of the Treasurer to charge the respective accounts with the followingsums, shown by the Auditors' Report to be overdrawn, viz. : In Rural Road Division No. 1, $213.49. in Rural Road Division No. 3, $21.21. Whereas, a majority of the owners as shewn by the last Revised Assessment Boll of the property hereinafter set forth to be benefited by the oonstmotion of the MoOaigan Bnuin, have petitioned the Connoil of the said Township of Raleigh, praying that a drain- be constructed commencing at the line between lots 24 and 2o in the 16th Con- cession, and terminating at what is known as Boyce's Greek, on lot 24, in the 13th Oonoession. And whereas, thereupon, the said Council procured an examination to be made by Sherman M^oolm, P. Providonally adopted the 5th day of Angoat, A.D. 1889. Wheireaa on the Eighteenth day uf September, A.D. 1884, the Munidpal Council of the Townahip of Raleigh did paas a By-law to provide for the deepening and enlargement of -the Biuskas Drain in we said Townahip of Raleigh and known as "TheBaokna Drain By-law. " And Whereaa the aaid drain waa not completed in terma of the aaid By- law. And Whereaa complaint haa been made that the aaid drain ia in need of repair. And Whereas, alao, in conaequenoe ot the conatruotion of the Payne Drain, and the watera therefrom finding an outlet and caodng an additional body of water to flow into the aaid Backoa drun which waa not contemplated in its oonatrootion, and for the diaoharae of which the peaent capacity of the Backus drain is insufficient, and there- fore liable to fiood and mjure the landa along ita course. And Whereas^ it haa therefore been deemed expedient to deepen and enlarge the said Badras drain ao as to provide a sufficient discharge for the waters so caused to flow into it. ^ 'And whereaa, thereupon, the said Council procured an examination to be made by W. WHBRBAS it is expedient to make better provieion for the regulation of the trafto on the Pablic Highwaye ; to eet apart a portion thereof for the purpoM of a footpath, and to preeerve and maintain the aame, and tlie ditohea on each or either aide thereof. Be it therefore enacted by the Municipal Council of the Corporation of the Townahip of Raleigh, in the County of Kent, by authority oi »ud anbject to the restriction and proviaiona contained in <*The Municipal Act," and amendments thereto. 1. That from and after the passing of this By-law, all that portion of any and every highway in the said Township of Raleigh situate, lying and being between the boundary UMS-and the road ditch, on each or either side thereof, be, and the same la hereby set apart as a footpath, for the use and convenience of traveUers on foot only. 2. That all horses or other animals, led, ridden or driven, whether or not attached to any carriage, wagon, sleiah, machine, engine or any vehicle when passing alosg any public highway in the said Township of Raleigh, shul occupy only the poraon of such highway which ia situated between the ditches on eitiier side thereof, and in case there is no ditch on any or either side thereof, shall then occupy only such portion as lies be- tween Unes draw a fifteen feet from the boundary line of such highway, and all such t»£Bic, other than persons travelling on loot, shall be restrained and wholly prohibited from trenassing upon, injurfng or in any way using or occupying, for the purpose of such traffic, any portion of any highway, as is used ror the purpose of, or occupied by any ditch, foo^th or reserved space as aforesaid. 3. It shall be the duty of the Overseer in each and every Statute Labor division, or other officers ajppointed by the Municipality, to prosecute in the name of the Corpora- tion, any person or persons violating or ivfringing any of the provisions of this By-law who, if fovnd guil^ on the oath or affirmation of a credible witness, shall, in the dis- cretion of any Justice of the Peace having jurisdiction, forfeit and pay a penalty not exceeding ten dollars, nor less than two dollars and costs, to be levied by distress and sile of gpods and chattels ; and if no sufficient distress can be found on which to levy it shall and may be lawful for the convicting or other Justice to commit the offender to gaol for any period not exceeding twenty days, or undl the fine and costs of com- mittal shall be paid. One half of such fiae to be paid to the informant and the other hi^f to the Treasurer of the Municipality. 4. Any person other than the Overseer of Highways may, for the purposes of prose> cntion under this By-law, be the informant or complainant. 6. Any Overseer of Highways may expend a portion of the Statute Labor fund in his divinon in improving and keeping in repair the said footpaths, and may erect such posts, rails, fences and bridges as ne may deem necessary to protect the said feotpatlia from injury or treapaas. 6. MORRISON, Reeve. No. 529— A BY-LAW , |; ' '"' ' (As Amended by By-law No. 536), respecting Statute Labor. Be io enacted by the Mimicipal Council of the Corporation of the Townahip of Ra- leigh, in the County of Kent, under »ud by virtue of the powers in them vested by the Municipal and Assessment Acts. 1. From and after the passing of tliis By-law, all By-laws heretofore passed, provid- ing for the performance of Statute Labor, and the appointment of Officers to superin- tend and mforce the same, are hereby repealed ; and the performance of Statute La- bor in the said Municipality is hereby abolished, except aa hereinafter provided. 2. In lieu of t^e pwformance of Statute labor as aforesaid, a commutation tax of fifty centa for eadi &n' labor, shall be assessed and levied la each year, and shidl be placed upon ^e Collector's Roll, and shall be collected and accounted for as other taxes. 3. From and after the passing of this By-law all persons appearing by the last Re- vised Assessment Roll, to be rated for property liable to taxation, snaU commute for the Statute Labor in respect of such property, and pay the commutation levied thereon, in propordon to, and in accordance with the scale of service hereinafter set forth, that is to say : fSOO and nndsr, 2 days ; above 9600 and np to $1000, 3 days ; and for every additional tlOOO, 1 day. 4.
