Whereupon Marshall Spring Bidwell, Es- quire, was nominated by one of the Elect- ors' and his nomination was seconded bj another of the Electors, and taken down by the Poll Clork, by direction of the said Returning Officer, ^ho declared to the Electors that the said Marshall S. Bidwell was noiniiinted ns a Candidate, and re- auested them to nominate any other Candi'^ ates, if they pleased. — Matthew Clark, Esquire, and Thomas VVilhams, Esquire, were then respectively nominated. The said Thomas Williams objected to tlie said Marshall S. Bklwell's being a Can- didate, upon the grotind of bis having been born in the United States, and therefore be* ing ineligible, as well as incapable of hold- ing the necessary freehold property, tn reply it was stated to the Returning Officer, that although the said Marshall S. Bidwell Wat bora in the United Statea ; yet be waa in truth and in fact, within the protisions . of the Naturalizatior) ^(^cts of the British Parliament, by which, in the langaage of- Sir William Blackstone, " All children- born out of the Kiiig^s legiance, whose fathers, (or grandfathers by the father'a side) were natural born subjects, are now deemed to be natural born subjects themselves' to all intents and purposes ; unless their'satd 'An- cestors were attahited or banished beyond sea for high treason , or were, at the births of such children, in the service of a Prin'cei at enmity withGrcat Britain;" that, at the birth of the said Marshall S. Bidwell, his father, who was born a British subject, was not, nor had he ever been in the Service of a Prince at enmity with Great Britain; nor had he taken any oath of foreign allMriance containing woitdB of abjuration to the British Allegiance ; and ttmt the said Marshall S. Bidwell was therefore a natural born subject himself, within (he express terms of these Acts of Naturalization ; that such had been the practical construction put upon the law in this Province, in regard to the eligibiliiy^ of "persons born in the United Stales of A> merica, of British bom parents, and that it was a fiict well known, that there were in the present House of Assembly, ns there nave been in' foriiier Houses, Memberi who wei-c thiis bbhi in the said United States; that if freeholders were, on that 5 round, ineligible, afler seven year*' resi- ence here, they were also incapable of voting at elections, the qualificatioris of Members and Eloctorg. in this roBpfctt be- ing defined by the same Statute and in the »*v J^ I M«^ . 1 ^ same word*; jct no out bad «rer question* etl the rotes of suclr freeholders; and even the said Thomas Williams himself dec)af«4 he was willing that their votes should be re- ceived at this Election, (and tbej were in lact so received). It was further stated to the said Returning Officer, that the said Marshall S. Bidjvefl cape into this Frevince to.f«side, in the year 1812, before the late War with ttte United States, and* had re- sided here ever since, a term of more than seven years : that atler a regular C|erkship, aecoinaing tQ the rules of the Law isoc^ety^ he had been called and admitted to the pro- fession and practice of Law in this Province, as a Barrister and Attorney, and had taken the Oaths of DiJice, of Allegiance, Supr|!- macy and Abjuration, and Jhe declaration of belief in the Christian Religion, before ' His Majesty's Court of King's Bench ; that he was seized and possessed in his own right of the renuisite estate in fee simple, and was legally qualified as a Candidate for the election. — Wherefore in his behalf, and in b^ajf of the electors who nominated him, and those who intended and were ready to vote for him, the said Returning Officer was desired not to assume upon hiiaself to reject the votes aforesaid for the said Mar- shall S. Bidwell, having been born in the United' States, was an alien. ' The Qat^ of Office was then adminis- tered to the said John- McLean as Return- ijtig Qi|««r^ he not having taken the same aiftit^rflefliet^ad fonned and declared bis determmation to reieet al| votes for the ■aid Marshall S.
