'!( DIVISION or THE CITY INTO WARDS* ARTIOiiB 1st. The City is divided into twelve Divisions or fire Wavdfs, which shall be known designated and bouiided as Mows : — VrfEit Tow». Ward No. 1. — Shall contprise all that p«tt of the City, beginning at the Corner of the Stables of the Castle of St. Louis, and proceedidg as far as the Western extre- mity of St. Anne-sireet, ascending from said St. Anne-street, towards the South as far as the base of the Fortifications. Ward No. 2. — Shall comprise all that part of the Ci^, reaching froiii St. John'd Gate, running to'the Eastward, andshiall contain the South sides of St. John, Couiliard, ancl St. George-street, as far as Rampart's- street, and thence to the commencement (^ Ward No, 1. At the first General Meeting of the Society, held after the nomiiiation of tht Members there- of by the General Quarter Sessions, of the Peace, in the month of July, eveiy year, and in default thereof, at any other General Meet- ing of the Society held alter the said first Gene- ral Meeting it shall be the duty of the Mem- bers of the Society to make choice of, and desi- gnate the quarter or Ward which Shall be assigned to each Member respectiv-ely, and it shall be the duty of the Secretary-Treasurer, of the Society, within three days aftei* such choice shall have takeii place, to gi'v'C notice to each Member of the Society, of the Ward that has been assigned him, and of'M limit^^ The Members of the Society etery time that a fire shall break out in any part of the? They shall cause the Captain of the fire Engines, to place them in such situation, as shall best conduce to the ^^ extinguishing of the fire. All Captains, Lieutenants, Firemen, Volun- teers and Constables, as well as all persons employed or ?iding in extinguishing the fire, ^ andsavinjrproperty,^aad|at£w;pj2asJi^^ cmSed to compel all idle, disobedient, or suspected persons, to quit the vicinity of such fire, and to commit them to prison in case of refusal : they shall fix m)on and point out safe and convenient places for depositing the jTurni- ture, goods and effects, saved from the houses or buiFdings on fire : they shall attend to the formation of line or ranks to convey water to the engines engaged at such fires and finally to make use of all necessary and proper me^ns to cpnopel obedience to tne orders and direc- tions that may be given for the extinction of fires, and for the preservation of property, and the maintenance of peace and good order^ Each Member of the Society shall make return to the first General Meeting to take place as aforesaid of the names of fiye persons who agree to become Volunteers as required by Law, and as soon as the Return shall be made, the Society shall constitute a Company of Sixty 1 41 * ! ■ i( I i !l 10 Volunteers to be under the command pfa Cap- tain and two Lieutenants, who shall serve for the period of one year. . DUTIES OF THE FIREMEN OR ENGINEER-MEN. As soon as^any Company of Volunteer Fire- men shall have been formed, in conformity to the 2d. of William the IV. Chapter 37, they shall be subject to the following Rules and Regulations. The Captain and Enginemen so chosen and appointed shall wear distinctive Badges, to to be chosen by themselves, and approved of by the Society: each and every Captain of an JKegine shall give information to the Society, of the death, dipability or long absence of any of the Eengin-men under his Orders, and send to the Secretary the names of others who are willing to fill up such vacancy for the approba- tion of the Society ; each and every Captain of an Engine, and upon the first signal, or alarm of&re^ shall immediately repair to their respec- tive Engine houses ,and convey or cause to be conveyed their said Engine to the place where the fire has broken out, with the Fire-buckets, hose and appendages and shall announce the arrival of the same, to any of (he Members of the Society then present and shall strictly obey and execute ail the Orders, they shall receive trom any Member of the Society, and do their utmost in order to extin^culsh the fap- for 11 fire. After the extinction of the fire, each Captain, and iPireman shall convey back the Engine under his care to the Engine-house, and the Captain shall make his report within forty eight hours to the Secretary, of any de- fect in the said Engine, or deficiency of buc- kets or other implements. The Captain of each F ire-Engine shall muster his company at least once a month, during the Summer, for the exercise and instruction of the company under his command, in the management of the said Engine and shall carefully replace it in its situation, and the Engine-men shall be obliged to obey such orders as they may re- ceive from their Captains, relative to the said Engine. Every Captain of an Engine or Engine-men, who shall neglect to conform to any of the Rules above mentioned, or who shall refuse to obey any order he may receive from any Member being legally authorized to ffive the said Orders, shall be liable to, and shall pay a fine which shall not be less than five shillings Currency and not more than ten shilling Currency, DUTIES OF THE COMPANY OF VO- LUNTEERS. . As soon as the company of the volunteers shall have been formed in conformity to the above mentioned act, they shall be subject to the following rules and regulations, viz: — The Captain, Lieutenant and Volunteers shall wear distinctive Badges of their owo choice, to be approved oi'by the society. B I !l ^ i ii The Captain of the company shall, as soon as it shall have been organized, make out a list of the christian and surnames, places of residence, and calling" of all the individuals composing the said company, and shall give a number to each of them. He will report to the society the names of all those who mav die or absent them- selves from the society, and the names of such as are willing to replace them. The person so chosen to fulfill the duties of volunteers and accepted as such by the society shall forthwith name and appoint, by the majo- rity of votes a Captain and two Lieutenants, and chose their distinctive badg-es, with which each volunteer shall furnish himself at his own cost: the Captain, Lieutenant and Volunteers, shall, as soon as they hear the fire-bell, or otherwise become aware of the existence of a fire, repair immediately to the place where it has broken out, and report themselves to the member of the ward wherein the fire has broken out, or to any member then present; and under the di- rections of the members, they shall do their ut- most to stop the progress ot the fire, and save and protect property: and to that end the com- pany of volunteers shall be divided by the Captain into two subdivisions of thirty volun- teers each : the first subdivision to be under the command of the first Lieutenant, and it shall be their particular duty to endeavour to stop the progress of the fire : this division shall consist .as much as possible of carpenters, joiners and other persons accustomed to and in the habit of 13 demolishing buildings : said demolishing to be made by the joint order of two Magistrates, and five citizens, proprietors ; and the second sub- division to be under the command of the second Lieutenant, and they shall be provided with large bags made of strong canvass, and it shall be the specia duty of each volunteer belonging to this second division to receive and save all such articles as are in danger of being destroyed by the fire and to place the effects which shall be so intrusted to them in a place of safety; such articles shall be considered as under their res ponsibility, from the moment they receive them, until they are deposited in a place of security; and it shall likewise be the duty of every volun- teer of this division to take great care that such goods be not broken or damaged. The several tools and instruments which shall be put into the hands of the company shall be delivered in good condition by the secretary treasurer, to the Captain of the said company, who shall be accountable for the same to the society ; and each volunteer shall equally be ac- countable to the Captain for the tools or other instruments with which he may have been fur- nished. DUTIES OF THE PEACE OFFICERS. As soon as the peace olficers shall have been appointed and sworn in conformity to the af<>re- mentioned act, they shall be subject to the fol- lowing rules and regulations. Each and every one of them shall be provided with a staff of of- fice, at the cost of the society. . , ':= 11 • ■ . They shall on the first alarm repair imme- diately to the fire with their staves of office, and shall report themselves to the member of* the ward or to any member of the society. They strictly obey all orders they shall receive fVoih the members of the society. They shall use their best efforts to prevent theft. 'They snail send away from the vicinity of such fires all vagabonds and suspected per- sons : they shall cause the persons present to form ranks or lines to the nearest place where water may be had for supplying the fire en- gines ; they shall take up and keep in their cus- tody all persons committing robberies, or cau- sing any disorder whatever, or who shall refuse to assist at such fire, when thereto required by any member of the society or who may abuse or ill treat any member of the society or any other persons working at such fire, and shall make a report to some member of the society, of such arrest. No peace officer shall absent himself from any fire, without the leave of the member of the ward wherein the fire has broken out, and in his absence without the leave of some other member of the society then present, under a penalty ft)r not complying with this rule of five shillings currency for the first offence, and often shillings currency for each and every subsequent offence. DUTIES OF THE SECRETARY TREASURER. The secretary treasurer after having given tiie security required by the law, shall be bound m IS to obey and strictly execute all the orders wln6h he shall receive from the majority of tlie mem- bers present at any meeting of the society. He shall also notify in writing the meetings to the members of the society, and of the day and hour when such meetings will lake place. He shall assist at all such meetings, and shall take down in writing all its proceedings. He shall see that the resolutions of the society be executed. He shall receive the monies due to and pay the debts due or that may become due by the so- ciety as soon as the same is approved of by any meetings of the members of the society reg-ular- ly convened and shall regulate and render hiS accounts to the society on the first monday aflef the expiration of each quarter* ' DUTIES OF THE COLLECTOR. The collector shall, before entering upon of^ fice, be bound to give to the society two suffi- cient securities to the satisfaction of the Presi- dent for the due execution of the duties of his office. It shall be his duty to make a statement of all the houses in the City and suburbs in or- der to ascertain the number of stoves for which each proprietor will be liable to contribute ac- cording to law in lieu of keeping tire buckets. xie shall also make enquiry if there be any weH« to the houses, and at what distance they are from the middle of the street. He shall be authorized in the dajr time for this object to enter into any house m the City and suburbs of Quebec, and shall report to the society the names of those persons who shall refuse to give htm either the necessary information or ad< mittanco in order to carry into effect tma present rule. He shall be accompanied in the circuit which he will have to make by the members of the society, each in the quarter which shall have been assigned to him and also by the secretary treasurer : he shall also collect all the monies owing by the proprietors of houses, and who have to pay in lieu of keeping fire buckets as well as the monies proceeding from the sweepingofchimnies, which shall be collected every month, and he shall every Saturday render accounr of and pay into the hands of the secretary treasure- all monies collected after payincf the chimney sweepi ers, and for the other necessary things relating to the sweeping of the chimnies as aforedaid, such as ropes, brooms, scrapers, &c. He shall engage a number of chimney sweepers, sufficient to sweep all the chimnies of the City that are made use of once a month and shall make a re- port every month to the secretary treasurer of those persons who shall have refused to allow their chim- nies to be swept as aforesaid . He shall cause the chimnies of paupers to be swept gratuitously, upon a certificate of pauperism, signed by a Priest or a Minister or a Justice of the Peace. DUTIES OF THE ENGINEER. The engineer shall be present at all fires. He shall place or cause the fire engines to be placed in the 17 ?no8t effioienf situationB for extinguishing the fire under the directions of the members of tlie society, and after the extinction ofthe fire, he 8hall cause to be returned to their respective engine houses, and put in good order all the fire engmes, buckets and other articles appertaining to the said house. He shall attend, whenever the company exercise themselves at the engines and shall cause the en- gme and articles appertaining to such house to be put in good order and placed in their respective houses. He shall likewise examine twice a year into the state of the engines, the horse, the fire buckets and other ttiings appertaining to the engines, as also the state of the engine houses, and report to the secretary treasurer such repairs as are necessary to be made to the same. DUTIES OF THE PRESIDENT. The president shall preside at all the meetings of the society. He shall cause decorum to be obser* ved, and determine all questions of order (from which however the members shall have a right of appealing). He shall appoint committees which shall not in any case consist of more than seven rnembers, and he shall put in force the rules and re- gulations of the society. He shall likewise have the right of calling an extra meeting when he shall consider it necessary, or when he shall be required thereto by three members of the society. In case ofthe absence of ihe President, ihe members assem- bled shall make choice of and appoint a President pro tempore, from amongst the members then pre- sent, who shall pel form the daties of the day. \ I I !H m if: 18 TO PREVENT ACCIDENTS BY FIRE Ist Every person building, or causing to be. built or erected in the City of Quebec any false chimney or bye-chimney, or making or causing to be made any Fire place at a dis- tance irom the pricipal chimney or from the Cbimnies of any house communicating with such Cbimniesby a bye-funnei in order to conduct the smoke into the said principal pr other Chimnies [Franklin or oher stoves, the ^moke joi which is conveyed into the Chimney, by sheet iron pipes well secured excepted,] shall be liable to and p^iv for each Chimney or iire filace so built or erected, a fine of one pound Currency: as well as a further sum of five shillings Currency for every day that such Chimney or iire place shall be and remain undemolished, from the day that notice for the demolition of the same shall have been ^iven by the society; provided always that the said fines together, shall not exceed for one offence, the sum of five pounds Currency. And every Mason, or other workmen who shall be employed in building such Chimney or fire place s>hall incur and pay a fine of five pounds Currency; and all Chimnies or fire places of the above des- cription now existing in the city shall be ta- ken down or effectually stopt up, within one month from the publication of this Rule, under a fine often shillings Currency per day, to be paid by the person or persons not complying with this Rule ; provided ?lways that this fine shall in no instance exceed ihe sum of five pounds Currency, 19 ' 2d. All kettles or Boilers used by Tallow Chandlers, Soap Makers, Painters, Chemists, XIruggists or others of the like dangerous oc- cupatibns shallbe embedded in brick or stone .work cemented with mortar so as to prevent all communication between the fire and the meterialstobeused in such Kettles &c. Every stove which shall be put up af- ter the publication of this Rule, and made use of in any house or building in the City and suburbs shall be at a distance of at least eight inches from any wooden partition with a bul* ged tin fixed between the stove and partition and of twelve inches if there is no such tin» and every stove so made me of shall have a stove pan of a proper size made of some uietal which shall be placed in front of the door of such stove, and the Bottom plate of such stove shall be at least ten Inches distant from the floor of the room under a penalty of twenty shillings Currency against any person trans- gressing any part of this Regulation ; and every stove used in the position they are now fized^ and contrary to this Rule» shall be changed, if necessary, after three days notice given by the society to the occupier of the house* to con- form and submit to the present Regulation, 6th. Every person occupying a house or other building, who afler the publication of this Rule shall ke«p or permit to be kept any bay or straw, except such as he may use for bedding, which must not be loose, but enclosed io canvas or other 21 tnateriala of that nature in any part of the house which he occupies or who shall keep any ashes on wooden floor, or in a wooden vessel in the said house or any out-house, shall forfeit a sum of one pound Currency for each and eveiy offence; and likewise the hav or straw which shall be found in any part of the house or building shall be forfeited and become the property of the Society, to be ap- plied towards defraying the expences oftheSociety. 7 ih. Every person occupying a house or other building who shall cause to be burnt any chips, ^havings, straw or other combustible in matters any street, lane or square of this City or suburbs, or in any enclosure which shall not be at least fifty feet distant from any buildig, intending to consume the same, shall incur and pay for every such of- fence the sum of twenty shillmgs Currency ; provi* ded always that this Regulation shall not be under- stood to prevent any person or persons from singe- ing their hogs on their property m the day time. 8th. Every person who shall smoke or shall have .in their possession any lighted pipe or cigar in uny shop, stable, shed, store or out house in this City or suburbs, shall incur and pay for every such of- fence a sum of five shillmgs Currency to be paid - by such offender, or by his or their parents^ guar- • l)ians, masters or mistresses. ;. : ^ .« 9th. All owners or occupiers of houses, both in the City and in the Suburbs shall keep their ohim^ nies in a proper state of repair, and free from all obstructions so that they may be easily swept. Every stove pipe shall pass into the Chimney and no person shall allow more than two stovepipes 10 go mto the same chimney on each story. And on complaint of any Chimney being defective, th6 Member of the ward sLall cause the same to bt inspected by the collector of the Society or such other person as he may deem necessary, and should he find the said Chimney wanting repairs he shall report the same to the Secretary Treasured for the consideration and order^of the Society ; and on any order given to that effect the owner df 0C« cupierofsuch house shall repair the same im* mediately, under a penalty of five pounds Currency and if the work is performed by the octupier, he shall be allowed to deduct the same from aAdout of his Rent* provided there is no Agreement to i^ contrary. 11th, Every Carpenter, Joiner, Cooper or other Tradesmen working in Wood, shall cau^e all the Chips and Shavings which Ehall be in his work shop or other buildings wherein he may have worked, to be collected every Saturday afternoon and conveyed to some place of safety, under a penalty often snil« lings currency ; and ine Member of each Ward is hereby authorized to examine all such Shops or other buildings on each and every Saturday. Every person occupying a house or olhei^ building, shall report to the Hociety within thirty days from the publication of this Rule ; the number of wells there are in the house or dependancies in his possession, and to moniion in his report to be made in writing and adressed to the Secretary Treasurer, from or at what distance such wells are from the centre of the street. 13th. In the event of a fire all persons in the vi- cinity of such fire, who have wells in their housea or premises shall on the requisition of any member of the society be bound to open them tor the use of the society during the continuance of such fife. , 14th. The engine which shall first arrive at any house Actually on fire, shajl entitle the company to ^hich such engine belongs to a reward of not less than ten ehillinga currency and not more than fivO pounds currency, at the discretion of the society and to be paid out of the Ainds of the said society. 15th. The first carter who shall arrive at a fire with a load of water shall be entitled to receive froiki the funds of the said society the sum of five shillings currency; the second to the sum of two shillings and six pence currency ; the third to the sum of one shilling and three pence currency ; and also this #um of six pence currency for each and every other load of water that may be brought to the said fire, Quebec, October, 1832.
