And it is hereby enacted by authority of the same, that from and after the passing of this By-law, it shall not be lawful for any person to engage in or pui "^s -..he practice of horse-racing, either by riding or driving, either in running or trot- ting h' i-^' )n any of the highways in this County, and any person guilty of riding or driving any h ;■ ■ ^r horses in a race, whether the same be by running or trotting upon any of the high- ways iii tills County, shall, upon conviction thereof, before any Justice of the Peace of this County on the oath of one credible witness, be liable to a fine of not less than five shillings nor more than five pounds to be paid forthwith ; and if not paid immediately upon conviction, to be levied by distress and sale of the goods and chattels of the offender in the usual way. 2, — That any person who shall voluntarily or knowingly allow or permit his or her horse or horses to engage in any horse race on any highways in this County, shall be liable to the same penalty as if he or she hod actually engaged in such race, by riding or driving such horse or horses. 3. — That it shall not be lawful for any person to ride or drive any horse on any highway in any village or hamlet in this County at an immoderate pace, and any person guilty of so doing, shall, upon conviction as hereinbefore provided, be liable to a fine of not less than five shillings nor more than five pounds to be levied and collected as above. 4. — That all fines collected under this By-law shall be applied as directed by the 185th sec- toin of the Act 12 Vic, chap. 81. Whereas, certain inhabitants of the Village of Aurora, in the County of York have by their petition addressed to tliis Council, prayed ihat the said village may bo constituted a I'olice Villape, in accordance with the Act VI Vic. cap. 81, section 42,[and it is expedient to comply with the prayer of said petition, therefore, 1, — Be it enacted, by the Municipal Council of the United Counties of York and Peel, and it is hereby enacted that so much of the Township of Whitchurch as is comprised within tho westerly eighty acres of Lot No. 80 and the westerly ninety-five acres of Lot No. 81, both in tho first Concession, and on the East side of Yonge Street, and so much of tho Township of King as is comprised within the easterly thirty acres of Lot No. 79, the easterly forty acres of Lot No. 80, and the easterly forty acres of Lot No. 81, all in tho first concession and on the West side of Yonge Street, shall compcso the Village of "Aurora," and shall, under the 42nd section of the Municipal Corporation Act of 1849, constitute a " Police Village." 3. — And he it enacted, That the first meeting of Freeholders and Householders of said village for the election of three " Police Trustees," shall bo held in the School House, in said village, on Lot No. 79, on the second Monday of January next, at the hour of five o'clock in tho afternoon, and that John Thomas Gurnett of the said village, Tanner, shall preside at such meeting. That Hy-Law Number Forty be, and the same is hereby repealed, except that portion that refers to the repeal of other By-laws. 3. — And be it enacted, That the said United Counties be divided into two School Cir- cuits, as follows, viz : — The County of York shall constitute School Circuit No. 1; the County of Peel, No. 2. 3. — And he it enacted, That there shall be appointed at the first meeting of the County Council by resolution thereof, in each and every year, one fit and proper person to the office of Local Superintendent in each School Superin tendency, and which School Superintendeneies shall be constituted and numbered as follows, viz : — BY-LAW s. ^0. Provided alwaijt^, that there shall be added to the receipt give to the Treasurer by each Local Superintendent of Schools, a certificate to the effect that ho has performed the duties required of him by the " School Act." That the Treasurer of the several Townships of these Counties shall be, and they are hereby appointed Sub-Treasurers of School moneys for their respective Townships. 7. — And be it enacted, That before any Sub-Treasurer shall receive any School moneys, he shall enter into a bond, with at least two good and sufficient securities, himself in the sum of at least double the amount of the Governnient appropriation for the Schools of his Township, for the present year, and each of his sureties iu a sum at least equal to such apportionment, lor the faithful performance of his duties as Sub-Treasurer ; And the Reeves of the several Townships of these Counties are hereby authorized and required, on behalf of this Council, to attend to the execution of said bonds, which bonds, after being properly executed and duly certified by the Reeve that the sureties are sufficient, shall be deposited with the County Treasurer, and shall be his warrant for paying to any such Sub-Treasurer the amount of School moneys in the Couniy treasury, and payable for the benefit of the Schools of the Township to which such Sub-Treasurer belongs : Provided always, that it shall not be imperative upon the parties appointed under this By-law, now in the possession of such Treasurer, to furnish new bonds, unless required to do so by the Councillors of their respective Townships. 8. — And he it enacted, That there be raised, levied, and collected upon the ratable Property in each of the Townships in the aforesaid School Superintendencics respectively, in the same manner, and in addition to all other rates and assessments in each and every year, the sum of one Pound five shillings, together with five per cent, thereon to cover the cost of Collection, Treasurer's per centage, and probable defalcations, for each School as enumerated in this section, for the purpose of paying the salaries of the Local Superintendents of Schools as follows : viz : — BY-LAWS. Whereas the Municipal Council of the Township of Whitchurch in pursuance of the Statute 20 Vic. cap. 69, has passed a By-law, bearing date the seventh day of April, 1658, whereby so much allowance for road between lots number 5 and 6 in the 8th concession of the said Town- ship of Whitchurch, as lies between the Westerly limit thereof, and a point fifty chains and seventy-five links eastward from said western limit, was conveyed to Robert Johnston, the pro- prietor of the western half of said lot, number 5, his heirs and assigns forever, and so much of the said allowance for road as lies between the eastern limit of the portion thereby conveyed to said Robert Johnston, and a point twelve chains and seventy-one links next eastward thereof, was conveyed to Philip Bartholomew the proprietor of the westerly, one-fourth of the east half of the lot number 5, his heirs and assigns forever, and the remaining portion of said allowance for road, was conveyed to Alfred Johnston, the proprietor of the easterly, three-eights of said lot number five, (except one and one-half acre on the north east corner thereof) his heirs and assigns forever. Whereas it is expedient to repeal By-law 58, and to make further provision in respect to the payment of grand and petit jurors. I. — Be it therefore enacted by the Council of the United Counties of York and Peel, that By- law number 58 is hereby repealed. 3. — Every grand juror attending at the Courts of Oyer and Terminer and general gaol delivery, or at the general Quarter Sessions, in these Counties shall be paid by the County Treasurer, out the County funds the sum of one dollar per day, for every day he shall actually serve on any grand jury at such court, and the sum of ten cents per mile, for every mile he necessarily travels from his place of residence to the Court House. Provided always, that whenever the grand jury shall adjourn during the sittings of the court, for a longer period than one day, everygrand juror Heident more than three miles from the court house, shall be entitled to half the usual mileage. 3. — The Sheriff shall make a pay list for grand jurors, and shall enter in such list the attendance of grand jurors, every day the grand jury shall assemble for business ; and shall also enter there- in the distances, the several grand jurors respectively travel, from their places of residence to the Court House, with the number of adjournments, for which an extra mileage is allowed, and on such pay list the Treasurer shall pay the grand jurors the sums they shall be respectively entitled to. The Treaeurer shall pay to every petit juror attending any of the Courts of Assize and Nisi Prius, Oyer and Terminer, General Gaol Delivery, General Quarter Sessiens of the Peace or County Courts in these Counties, the sum of one dollar and twenty-five cents per day, for every day's attendance, and ten cents per mile, for every mile necessarily travelled, from his place of residence to the Court House, out of the Countyfunds in his hands, and shall also pay to the Sheriff for every pay list of grand jurors the sum of one dollar, and for every day checking the same, the sum of twenty-five cents — and for every pay list of petit jurors prepared and kept ac- cording to the 141, and 142 sections of the Upper Canada Jury Law of 1858, the sum of one dollar — and for every day checking the same, the sum of twenty-five cents. The By-law shall be a sufficient warrant and authority to the Treasurer to pay the said allow- ance out of County funds in his hands and shall take effect and be in force on and after Monday next, 7th February, 1859. BY-LAW, To make provisions for the preservation of the Public Morals loithin the United Counties of York and Peel. Whereas under the provisions of an Act passed in the twenty second year of the reign of Queen Victoria, Cap. 99, entitled *' An Act respecting the Municipal Institutions of Upper BY-LAWS. m Canada," power is given to the Council of any County to pass By-Laws for certain purposes, and more particularly for thoso set forth in the 275th section of the said Act. 1. — Be it therefore enaoted by the Municipal Council of the United Counties of York and Peel, 1. That in pursuance and in accordance with the provisions of the Statute, 8th Vic, cap. 45, entitled an Act to prevent the profanation of the Lord's Day, commonly called Sunday, in Upper Canada, it shall not bo lawful for any person whatsoever in these Counties, to sell or expose for sale, or to purchase Wares, Merchandise, Goods, Chattels, or personal property, or any real estate whatsoever on Sunday, nor to do, or perform any worldly labour, businesn, or work of his or their calling, (conveying travellers, or Her Majesty's Mail, selling Dru{^.( and Medicines, and works of charity and noceisity excepted.) 2. That it shall not be lawful for any person to sell intoxicatin;^ liquors, or to allow or permit the sale of intoxicating liquors, or to use improper or profane language in any Inn, Tavern, Grocery, or house of Public Entertainment, or in any street or public place within these Coun- ties, on Sunday. 3. That it shall not be lawful for any pAon to play skittles, ball, racket, or any other noisy game, or to gamble with dice, or otherwise, or to run races on foot or on horseback, or in carriages or vehicles of any sort ; or to dance, or to play profane music on Sunday within these Counties. 4. That it shall not be lawful for any person to go out fishing, hunting, or shooting, or in quest of, or to taLj, kill, or destroy any deer or other game, or any wild animal, or any wild fowl, or bird, or fish, or use any dog, gun, or rifle, or other engine, or any fishing rod, net or trap for the above mentioned purposes, (except in defence of his or her life or property, from any wolf, or other ravenous beasts or birds of prey,) on Sunday, within these Counties. J8. — And it is further enacted by the authority aforesaid. That it shall not be lawful to sell or give intoxicating drinks of any sort, to any child, apprentice, servant, idiot, or insane person within thesd Counties, without the consent of the parent, master, legal protector, or physician of such person or child. 1. That it shall not be lawful for any person to post or circulate any indecent placaids, writings, or pictures, or write any indecent words, or make any indecent pictures or drawings on any walls or fences, or any other places whatsoever, or to circulate the same within these Counties. 2. That it shall not be lawful for any person to utter or employ any profane oath, or any obscene, indecent, b> fcpHemous, or grossly insulting language, in any of the streets or public places or highways, within the said United Counties. 3. That it shall not be lawful for any person to be drunk, or guilty of any drunkenness or disorderly conduct in any of the public streets, highways, or public places within these Counties. 4. That Vi, shall not be lawful for any person indecently to expose his or her person, or to be guilty of any indecent, immoral, or scandalous behaviour, in any street, highway, or public place within these Counties. 5. That it shall not be lawful for any person to bathe, or indecently expose hiS or her person by washing in any waters within these Counties, lying or running near any public highway, between the hours of seven o'clock in the morning and seven at night, unless provided with, and clothed in a proper bathing dress, sufficient to prevent any indecent exposure of their person. 3.— And be it enacted by the authority aforesaid, Tha'^ any person or persons guilty of a BY-LAWS. ituin purposes, i of York and violution of any of the pnvisions of this By-law, shall, upon conviction before any Justice or Justices of the Peace, having jurisdiction in the suid United Counties, bo liable to a fine of not Uiore than twenty dollars, nor less than one dollar, to be col'ectcd by distress and sale of goods aiii chattels of the said offender or offenders, and in case no goods or chattels are found belong- ing to 'ho said offender or offenders as aforesaid, on which to levy any fine or fees as aforesaid, it shall be lawful for any such Justice or Justices or the peace, to commit the offender or offenders to the Common Gaol or Lock-up within the said United Counties of York and Peel, for a period of not more than twenty days, nor less than one day, with or without hard labour, as the said Justice or Justices may determine. 41, — And be it further enacted by the authority aforesaid, that all fines and penalties imposed and collected under and by virtue of this IJy-law, shall belong to, and be appropriated to the use and b'>iiefit of the Municipality of the Township or incorporated Village, in which the offence Wu3 committed. , Passed 4th February, 1859. Whereas under the provisions of an Act of Parliament, passed in the 22nd year of Her Majesty's Reign, cap. 90, entitled, "An Act respecting the Municipal Institutions of Upper Canada," authority is given to the County Council to pass By-Laws for appointing one or more Surgeons of the Gaol, and for the removal of the same, and for the appointment of the Keeper of the Court House. 1, — ^Therefore the Council of the United Counties of York and Peel enacts, That Dr. James H. Richardson b« appointed Surgeon of the Gaol, and that Michael Ryan be appointed Keeper of the Court House of the said United Counties, and that the said Surgeon and Keeper of the Court House shall hold their offices respectively during the pleasure of the said Council. ft, — ^That there shall be allowed and paid to the said County officers, hereby appointed, the following yearly salaries and allowances, out of the funds or revenues of the United Counties, for the due and faithful performance and fulfilment of their respective duties as such officers respectively, that is to say. To the Surgeon of the Gaol the sum of $500 per annum, for all services rendered as medical attendant upon prisoners confined in the Gaol, including not less than one visit per day, and for furnishing and dispensiig medicines. To the Keeper of the Court House the sum of $400 per annum, for all services rendered in the care of the Court House, cleaning and warming the building in every part, (private and leased offices excepted,) preparing fuel, and for his services as messenger to the County Council. 3. — That it shall and may be lawful for the Treasurer of the United Counties of York and Peel, and he is hereby authorized to pay quarterly to the within-named officers the several and res- pective salaries or allowance hereinbefore mentioned, out of the like funds j and that this By-law shall be a sufficient wurrant and authority to the Treasurer to pay the said hereinbefore men- , tioned salaries ; such salaries to be computed from the first day of January, 1859. Whereas it is expedient to provide by By-law for the improvement and maintenance of the several County lloads and Bridges within A^e United Counties of York and Peol, and of lload;^ and Bridges over which the Council of the said United Counties have joint jurisdiction with other Municipalities; and also to provide for the performance of Statute labour within the con- trol of the said Council, or payment of a commutation in money in lieu thereof: Be it therefore enacted by the Municipal Council of the Uni'^^ed Counties of York and Peel, and it is hereby enacted : ■ 1, — That the severalsectionsof Road 1/ereinaftcr particularly described, shall be improved and maintained by the several local Municipalities hereinafter mentioned, as follows, that is to say : 1. By the Township oi Marhham, so much of the road dividing the Townships of Markham and Whitchurch as lies opposite the second, fourth, sixth, eighth and tenth concessions of the said Townships of Mai kham and Whitchurch. 2. "7, — Every person liable for the performance of any such statute labour, who shall neglect or vefusc to perform the same, or to pay the commutation therefor, according to the terms of this By-law, or the By-law of tha local Municipality '.- which such land is situated, shall, upon con- viction before any Justice of the I'cace, forfeit and pay the sum of two dollars for every day's labou; charged against him, and the performance of which he has refused or neglected : and if such fine be not paid within the time fixed by the convicting Magistrate, not exceeding one month after conviction, it shall be levied by distress and sale of the goods and chattels of the offender; and if suflScicnt goods and chattels cannot be found to satisfy the warrant of distress, the offender shall be imprisoned in the common Gaol of the said United Counties for any period not exceeding twenty-one days, with or without hard labour, in the discretion of the convicting Magistrate. 8. — Nothing in this By-law shall apply to any private road or bridge, or anyroad or bridge in the possession of or owned by any incorporated road or bridge company.
