PBINTED AT THE INQUIRER OPFICB. 1842. RULES AAD KEGULA'J'JUxNS. Meetings and Adjournments of the Council. Resolved— That this Council do meet at nine o'clock, A. M., and if at thirty minutes past nine o'clock, there is not a quorum, the Warden may take the chair and adjourn for half an hour, II, That when the Council adjourns, the Members shall keep their seats until the Warden leaves the chair. III. That whenever the Warden is obliged to adjourn the Council for want of a quorum, the hour at which such adjournment is made, and the names of the Members then present, shall be inserted in the Journals. Quorum, IV. That upon the appearance of a quorum the Warden shall take the chair and the Members pe called to order. 4 Minutes. V. That immediately after the Warden shall have taken the chair, the Minutes of the preceding day shall be read by the Clerk, to the end that any mistake therein may be corrected by the Council. Warden. VI. That the Warden shall preserre order and decorum, and shall decide qucotiona of order, subject to an appeal to the Council. Members. VII. That every member previous to his speaking, shall rise from his seat uncovered, and address himself to the Warden. VIII. That when two or more Members rise at once, the Warden shall name the Member who is first to speak, and the other or others may appeal to the House if dissatisfied with the Warden's de- cision, by the queation, ^^ Which Member was first up ?" That every Member who shall be present when a question is put shall vote thereon, unless the Council shall excuse him, or unless he shall be personally interested in the question. That when the Warden is putting a question, no Member shall walk out of or across the hous e; nor when a Member is speaking shall any Mem- ber hold discourse to interrupt him, except to XI. That a Member called to order shall sit down unless permitted to explain, and the Council, if appealed to, shall decide on the case, but with- out debate ; if there be no appeal the decision of the Warden shall be submitted to. XII. That no Member shall speak disrespe^-tfully of the Queen, or Persons Administering I. . Go- vernment of this Province ; nor shall he use unmannerly or indecent language against the Droceedmgs of this Council, or against particular Members : nor shall he speak beside the ques- tion m debate. 6 XIll. That each Member may oi right require the question or motion in discussion to be read for his information at any time of the debate, but not so as to interrupt a Member speaking* xiv. TiMt no Member shall speak more than once on the same question, without leave of the Coun- cil, except in explanation of a material part of his speech, which may have been misconceived ; but then he is not to introduce new matter. XV. That no Member shall speak more than once, without leaTe of the Council, upon a previous question. Journals^ Sfc» XVI. That the Journals be written in a plain legible hand, and that the Clerk do immediately make an Index to the Journals of the Council referring to the several matters therein contained. Rules of the Council, ] XVII. Division of the Council. XVIII. That upon a division in the Council the names of those who vote for, and those who vote against the question, shall be entered upon the Minutes, II two members require it. Motions and Questions, XIX. That a motion to adjourn shall always bci in order. '' XX. That a motion that the Chairman leave the chair shall always be in order, and shall take place of any other motion. XXI. That no motion shall be debated or put, unless the same be in i Ating and seconded. XXII. That after a motion is read by the Warden, it shall be deemed to be in possession of the Coun- cil, but may be withdrawn at any time before 8 decision or amendment, with permission of the Council. XXIII. That when a question is under debate no mo- tion shall be received unless to amend it, or com- mit it, or to postpone it to a certain day, or for the previous question, or for adjournment. XXIY. That all questions, whether in Committee or in the Council, shall be put in the order they are moved. XXV. That no motion piefaced by any preamble shall be admitted in this Council. XXVI. . That every motion when seconded, ought to be received and read by the Warden, except in the cases provided for by the Rules of this Council. XXVII. That it shail be the duty of the Warden, when- ever he shall conceive that a motion which he has received and read, may be contrary to Law or to the Rules of the Council, to apprize the Council thereof immediately before the question m of the '. no mo- or com- y, or for nt. nittee or they are )reainble ought to jxcept in uf this n, wben- vhich he r to Law rize the question on which motion is put, and to cite i..e Law or Rules which are applicable to the case. BYE-LAWS. xxviir. That no Bye-Law shall be committed or amen- ded until it shall have been twice read. XXIX. That all amendments shall be reported to the Council by the Chairman standing in his place. After report the Bye-Law shall be subjected to debate and amendment in the committee before the question to commit it shall be put. XXX. That every Bye-law shall receive three several readings previous to its being passed. xxxr. That when a Bye-law is read in the Council, the Clerk shrill certify the rcadmgs and the time on the back. XXXll. That Bye-laws committed to a committee of the whole Council shall first be read throughout by the Clerk, and then read by the Chairman, leaving the Preamble and Title to be last con- sidered. 10 XXXIU. /- Jl^^V^^n®" a Bye-law passes the Council the Clerk shall certify the same with the date thereof at the foot of the Bill. Petitions. XXXIV. That Petitions, ^lemorials and other papers addressed to the Council shall be prcsentod l.y a Member m his place, who shall be answerable to this Council that they do not contain improper or impertinent matter. That papers laid before the Council or refer- red to a committee for their consideration, are of right to be read once by the Clerk or Chair- man at the table, that when once read to the Council, or Committee, they arc then like every other paper that belongs to the Council to ho moved for to be read, and if objected to, to bo decided by taking the sense of the Council cr the committee. n Committe' XXXVI. s. That in forming a Committee of the whole Council, the Warden shall leave the chair, and fihall before leaving the same, appoint a Chair- rran to preside, wco slmll have the same autho- rity in the chair of the Committee as the Warden in the chair of the Council, and in other com- mittees the chairman shall have the same autho- rity. XXXVII. That the mode of appointing a Special Com- mittee shall be first to determine the number it shall consist of, then each Member naming one which shuli be written down by the Clerk; those who have most voices shall be taken successively until that the number is completed : and if any difficulty should arise by two or more having an equal number of voices, the sense of the Council shall be taken as to the preference ; but but it shall be always understood that no Mem- ber who declares himself or divides against the boiiy or substance of the Bye-law, motion or matter to be committed npon any of the readings -^thereof, can ho nominated to be of a committee upon such 13ye-law, motion or matter. XXXVIII. That every Member who shall introduce a 12 Bye-law, Petition or Motion upon any object which may be referred to a committee, shall be one of t!ie committee, without being named by the Council. XXXIX. That of tho number of Members appointed to compose a committee, such number thereof as shail be equal to a majority of the whole number chospn, shall be a quorum competent to proceed to business in all cases where the number to form such quorum shall not be specially fixed in the motion of appointment. Orders of the Day. XL. That the Order of the J}ay shall have prefer- ence to any motion before the Council. XLI.
