 Son Exckllence le Gouverneur en Chef n'a point lu sans surprise la 
 -sentence prononcee contre Joseph Prudhomme, Pierre Arnois et Etienne "Rate 1, Mili- 
 -ciens dans le Troisieme Bataillon de la Milice d'Elite et Incorporee, convaincus devant 
 une Cour Martiule Ge'n^rale tenue a Montre'al les 18, 19, et 20 deFevrier dernier, 
 d'avoir commence et excite une rautinerie cu sedition <'ans le uit Bataillon, et d'avoir 
 commis d'autrcs crimes d'une nature trop atroce, pour etre repe'tes. 
 
 Pour une violation aussi serieuse de la discipline Militaire, qui feit retomber 
 -autant de disgrace sur le corps, oii eile a eu lieu, la Cour a condamne Ics dits Joseph 
 Prudhomme, Pierre Arnois, et Etienne Uatcl, a ctre conduits, les Fera aux mains i 
 Icur Bataillon, pour demander pardon a genoux, de leur mauvaise conduite, et a 
 etre menes ensuite a la Prison commune du District ou sera ators leur Bataillon, 
 pour y £tre confines durant I'espace de trois mois de Calendrier. 
 
 Devant la memo Cour Martiale Gcncralc, Antoine Simon dit D'Arpentigny, 
 Sentinelie dans le corps des Voltigeurs Canadiens, a ete traduit sur les accusations 
 <i-apres mentionnees, savoir : d'avoir deserte de son Piquet, place' au lieu appelie La 
 Mascoutiiie, dans le District de Montreal, allant ;i rennemi, le ou vers le matin du 
 quinze de Fevricr dernier, et de n'elre retournc a son Bataillon que le seize du meme 
 mois, etant ramend par uu parli qui I'a arrete pres de la ligue de la Province. 
 
 Sur quoi la Cour a donne la decision suivante : 
 
 La Cour est d'opinion que le dit Antoine Simon dit D'Arpentigny est coupable 
 i^'avoir de'seyte' de son Piquet. a la Mascoutine, dans le Di-jtrict de Montre'al, le quinze 
 de Fcvrier dernier, mais I'scquitte de la partie de I'accusation qui le charge d'avoir 
 lessaye de de'serter pour allcr a I'ennemi ; en consequence la Cour condamne le dit 
 Antoine Simon dit D'Arpentigny a quatre mois de travail aux ouvrages du Roi i 
 Quebec, et a etre confine solitairement tootes les nuits, et a etre reconduit ensuite 
 a son Bataillon, et a passer dans les rangs, un Billot aux pieds et les Fers aux: 
 mains. 
 
 Son Excellence le Gouverneur en Chef en approuvant la de'cision de la Cour 
 doit exprimer ses craintes, que lorsque dts crimes d'une nature si enorme sont aussi 
 bien prouves, et sont punis d'une maniere si disproportionree, les Membres de la 
 Cour en infligeant ces punitions n'etoient pas suflisamment pine'trds des grandes obli- 
 gations ou ils eroient de maintcnir dans loute sa force la discipline de la Milice, et 
 di soutenir la dignite et I'importance d'une Cour Martiale Ge'ne'rale, par une cniuJuitc 
 plus de'cidc'e. 
 
 Son Excellence le Gouverneur en chef ordonne que son opinion, ainsi que les 
 accusations, et la decision et la scrtencc de la Cour, sui^nt lues a la tete de tous les 
 •corps et soient emegistrfies dans les hvres des ordres generaux. 
 
 II plaira au Mujor-Gene'ral De Rotterburg, de faire mettre les sentences cl-dcs« 
 sus a execution.

 MILITIA GENERAL ORDER, 
 
 Fits Excellency the Governor in Chief, has not read without surprise 
 the sentence awarded against Joseph Prudhoinine, Pierre Arnois, and F.ticnne Ratel^ 
 privates in the 3d Battalion of Select and Embodied Militia, convicted before a 
 General Court Martial held at Montreal on the 18th, I9rh, and 20ih of Feb.-uary 
 last, of havir.;^ commenced and excited in the said Battalion a mutiny, and of other 
 crimes of too atrocioLS a nature to be repeated. 
 
 For such a serious violation of military, discipline, highly rcHcctIng d'sgrace 
 en the Corps in which it occurred, the Court sentenced the said Joseph Prudhomme, 
 Pierre Arnois, and Etienne Ratel to be conducted, h.ind-curi'ed, to their Battalion 
 to ask pardon for their misbehaviour on their knees, and to be confined afterwards 
 in a cell of the Common Gaol of the District wherein their Battalion may be at 
 the t;me, during the space cf three calendar months.

 Upon which the Court came to the following decision : 
 
 fhe Court is of opinion that the said Antoine Simon dit D'Arpentigny !e 
 w,uiiLV of having deserted from his picket stationed at La Mascoutino, in the District 
 of Montreal, on the fifteenth of February last, but acquits him of the charge laid 
 against him of having endeavoured to desert to the enemy, therefore, the Court 
 condemns the said Antoine Simon dit D'Arpentigny to four months labour in the 
 King's works at Quebec, and to solitary confinement during the nights, after which 
 hi will be reconducted to his Battalion, and will pass in the ran'.v hand-cuffed, and 
 a log tied to his feet. 
 
 His Excellency the Governor in Chief in approving the finding of the Court, 
 must express his apprehension that when crimes- of so enormous a nature are so sat- 
 ibfactorily proved and so inadequattly punished, the members of the Court coulJ not 
 be suiuciently senfible of the high obHgr.tions they were under to maintain entire 
 the discipline of the militia and to preserve the dignity and importance of a general 
 Court Martial, by a more -decided he? of conduct. 
 
 His Excel: -ncy the Governor in Chief directs that his opinion together 
 with the charg-es and the fi;id!ng and sent-enc-i of the Court, snail bj read at the 
 head cf ev.-ry c^irp.; and entered in the General Order Book. 
 
 Major-Gcncral de Rotteiiburg will be pleased to have the foregoing sentences 
 carried i:uo execution.
