The departmental report of 1895, continuetl down to the end of that year, a nar- rative of tlie status of this question, and dealt quite fully with the different phases thereof, which came up for consideration during the year, embracing a reasonably comprehensive statement of the practical effect upon the sealing industry of the Paris award regulations and the machinery provided for their practical application to British sealing vessels. It is now proposed to briefly review the question in its different branches as it developed for the year 1896, just closed. UEPAKTURK OF THE SEALING FLEET. On the 12th February, the Collector of Customs at Victoria, B.C., reported that fifty-one sealing vessels had clearer! for the spring fishery, as against fifty-six in the season of 1895, the distribution being twenty-eight on the Asiatic and twenty-three on the North. American side of the North Pacific Ocean. This resulted in an attempt by the United States gf)vernment to make it appear that some such arrangement was not only necessary but tlesired by the sf;alers to protect them from graver inconvenience and loss, and that it should be extended to the vessels plying their calling in liehring Sea during the open season, to secure them against the suspicion of using conceided tire-arms, such implements l)eing forbidden in those waters. When the I'epre.seutations of the United States reached the Canadian govei-nment at the beginning of the year 1896, £.teps were taken to secure the vitnvs of representative sealers on the subject, because it was stated that the masters of sealing vessels had signified a desire that their arms should be sealed up as a protection. The conclusion could not l)e avoided that wiiatever rea'^ons existed against the voluntary measure in the first instance, which had pnived a failure, and which. Her INFajesty's government had declined to renew, retained tlieii full force and were indeed nmch stronger against the proposed obligatory arrangement. Such a course it was considered would change the appearance of necessity for an agreement for a practical extension of the award restrictions, out of which might grow other and perhaps more object ion.able expedients. It is not unlawful to carry fire-arms into Behring Sea on board sealing vessels ; only their efl'ective use there constitutes an oll'ence ; anil it cannot be conceded that the otlicers fiS of the United States government are justified in visiting and searching British vessels merely to ascertain whether or not they carry Hre-iirms, more especially when those implement's are not only necessary to certain periopendent information touching seal life on both the United States and Russian seal islands. In the event of a demand by the United States government, at the expiration of the term of the award regulations, for a revision thereof under the terms of the find- ings of the arbitrators, such a course was considered ex))edient to enable Her Majesty's government to approach any negotiations whicli may be instituted in a better position to judge how far, if at all, a revision may be necessary in the interests of the fishery. To this end steps were taken tf> supplement existing information on every possible point. Her Majesty's government appointed and sent from (4reat Britain Professor D'Arcy Thompson, as British agent to the Pribylov Islands (Alaskan), and Mr. Barrett Hamilton to a similar position on the Connnander Islands (Russian). These scientists spent the season in an examination into seal life within their respective fields of incjuiry, and will report direct to Her Majesty's government. The Canadian government selected Mr. Janies M. Macoun, of the Geological Survey of Canada, who had already on two previous occasions, been engaged in inquiry into seal life on the Pribylov Islands, as their representative there during season of 1896. Mr. Macoun worked in concert with Professor Thompson, and the result of his in(juiry and observations will be available in any negotiations which may arise having for their object a revision of the regulations. It is gratifying to learn from Mr. Macoun's investigations that there is no ground for the popular belief sedulously cultivated by interested parties, that the seals are being exterminated in Behring Sea. In order to render the inquiry into the conditions of seal life as full and compre- hensive as possible, the Department of Marine and Fisheries detailed one of its otKcials Mr. Andrew Halketi, for the duty of special observations into the conditions and habits of seals at sea, on board of one of the sealing schooners operating in Behring Sea during the sealing season there, Mr. Halkett conducted his inquiries on the sealing schooner " Dora Siewerd " of Victoria, the result of which will be available when needed. A large staff of scientists conducted similar researches into the natural history of the fur seal, on behalf of the United States government. IHK "COQUITLAM' case. This case had, at the period of writing the last report, rr aohed the Suptome Court of the United States, on the question of jurisdiction of the Court of Appeal from the District Court of Alaska. Judgment was rendered 18th May, 1896, upholding such jurisdiction. AVhen the case reached the United States Court of Appeal, a decision was given reversing the decision of the court below and dismissing the libel against the steamer "Coquitlam." 6S THE CASES OF THE UNITED STATES NEALINH SCHOONERS " LANINKA AND " ALEXANDKK. During the year (lecisions were reached in the United States Court of Appeals, for the Ninth Circuit, in tlie above Mimed cases to the I'floet tliat tlie Paris award regula- tions, in matters pertaining to sealing in iiehring Hea, must be upheld as the supreme law of the land. In view of the contentions of the United States government in connection with the Behring Sea iiui'stion, these decisions may not be without inter< • ' The cases were ajipeals in adunralty, from decrees of the District Court of Alaska, forfeiting the vessels upon the ground that they had been unlawfully engaged in killing seals in the waters of the territory of Alaska. The libel charged that the vessels and thc^ir crews "were engaged in killing fur seals within the limits of Alaska territory, and in the waters thereof, in violation of section li)5G, of the Revised Statutes of the United States, and of other Acts of Congress, and of the proclamation issued by the President thereunder. " In reversing the decision of the court below, these findings involve an authoritative construction of section ID.IG of the Revised Statutes of the United States in so frr as the phrase "within the limits of Alaska territory, or the waters thereof," and the words, "dominion of the United States in the waters of Uehring totn,' in the amend- ment thereto are concerned. The judge decided that this language must be construed to mean the waters within three miles from the shores of Alaska. While concluding thus the court disclaims deciding the cpiestion adversely to the political department of the government, explaining that while it i^ undoubtedly true, as has been decided by the Supreme Court, that in pending controversies doubtful (|uestions which are undecided, must be met by the political depaitment of the government. In the case under review there is no pending question left undetermined for the political department to decide. It was held to be settled, and that the award was to bo con- strued as a treaty which had become final, and which, when accepted and agreed to, became the supreme law of the land, binding the courts equally with an Act of Congress. Such being the latest expression of the sovereign will, it followed that, whatever •may have been the previous contention of the United States government, it had receded therefrom since the rendition of the award by agreement to accept the same as a full, complete and final settlement of all questions referred to by the arbitrators, and from the further fact that the United States government had, .since the award, pas.sed " an Act to give eflFect to the award rendered Vjy the tribunal of arbitration." Following some remarks upon the interpretation of the statutes and their applica- tion to citizens and subjects of all nations, it is held that it necessarily follows thut the citizens of the United States have the same right to rely upon the award as to their rights, as the subjects of England. Also that the Act of Gth April, 1894, contained no provisions which indicate any policy upon the part of the United States government, to enforce any rights against its own citizens, under the statute consistent with the contentions "from the beginning upon the important questions of its rights to protect its property and seal fisheries." On the other hand it was held that the entire Act clearly shows that it is the poliry of the United States government not to make any such distinction. The Act was passed enacting certain rules relative to the control of its own subjects, in the exer- cise of the right which, under the award of the arbitrators, the two countries had in common to kill seals outside the three mile limit.
