To the Warden and ^Members of the County Council of the County of Oxford : Gentlemen, — Your Committee appointed to consider the propriety of revising the County By-laws beg leave to report as follows : Your Committee have considered the suggestions in the com- munication from the County Clerk in reference to the revision of 4 BY.LArt^S OF THE COUKTY OF OXFORD. the County By-laws, and are of opinion that the suggestions niatle by him sliould be carried into eftect. Your Committee have examined the By-la^vs, and find them in a very unsatisfactory condition, some havinj; expired through lapse of time, some repealed or amended, and others rendered inoperative by acts of Parliament. Y»ur Comuiittee would therefore recommend that a Com- mittee of three be appointed to meet at some time before the next regular session of the Council, and make a thorough revision of said By-laws, and submit a full report of their work at the January Session with a view to publication in pamphlet form of the By- laws ot this County. To the Warden and Members of the Municipid Council of the County of Oxford : Gi:NTLEMi-:x,--The Select Committee appointed by the Coun- cil in December, 1S78, to revise the County By-laws respectfully, report as follows : Your Committee have carefully examined all thf- By-laws oi the Council, and after consideration have resolved to arrange them for the sake of convenience in reference, into the following classes,, viz: In the first class are included all such as are temporary in their characters and have therefore expired ; in the second class all such as have been repealed by other By-laws, cancelled, or superseded by acts ot Parliament, or (piashed by Court of Queen's Bench ; and in the t'iird class all that are in force at the present time. Your Committee recommend that the numbers and titles alone of the By-laws included in the first and second classes be printed. Ot those in the third class, that numbers Hi, 108, 130,. 136, 13S, 158. 159, 172, 175, 175, 177, 183, 193, 195. 211, 214 and 22+ be printed in full. In regard to the remaining 18 By-laws that are in force, it is the opinion of your Committee that they are not of sufficient public importance to require that more than the num- ber and title of each should be printed. Your Committee would also recommend that By-laws numbers 3, 6 and 62 be consolid- ated and repealed by a new Bydaw . Also that By-laws numbers 73, 92 and 171 be repealed by new By-laws. Your Committee beg to submit herewith ior your consideration draft copies tor the purpose of consolidating and repealing the above named By-laws. WHEREAS by Act 29 and 30, ^ ic, chap. 51, entitled an Act respecting the Tdunicipal institutions ol Upper Canada, sec. 355, sub-sec. 26, it IS enacted that the Council of every County Municipality, in Upper Canada, shallprovide by By-law that a sum not less than twenty dollars shall be payable as a reward to any person or person who shall pursue and apprehend, or cause to be apprehended, any person or persons guilty of stealing any horse or mare within the said County, and that such reward should be paid out of the funds of the Municipality on conviction of the thief and on ihe order of the judge before whom the conviction is obtained. WHEREAS it is necessary and expedient in conformity with the municipal Act, 26 Vic. chap. 4S, section ^^S, to fix the Salar- ies of the several Gaol Officials by By-law : Be it therefore enacted by the authority of the Council of the- Corporation of the County of Oxford : First --That the salary of the Gaoler be and is hereby fixed at the yearly sum of eight hundred dollars. SECOND—That the salary of the Matron of the Gaol be and is- hereby fixed at the yearly sum of two hundred dollars. Third— That the salary of the Turnkey of the Gaol be and is hereby fixed at the yearly sum of four hundred dollars. WHEREAS it is necessary and expedient to restrain and pre- vent thepractice of immoderate ndin,^ and driving of horses or other aninals upon the highways of this County, and to regulate travelling hereon, therefore the Corporation of the County ot Ux. ford, by th* Council therec ^, enacts as follows : FiRST-Tiat from and after the passage of this By-law it shall 108 BY-LAWS OF THE COUNTY OF OXFORD. % Y'< not be lawtul for any person to engage in or pursue the practice of racing, with horses or other animals, either by riding or driving in running or trotting races on any oi the highways in the County of Oxford ; and any person guilty cf riding or driving any horse or horses, or other animals, in a race, whether the same be by running or trotting, upon any of the highways in the County of Oxford, shall, upon conviction thereof, incur the penalties imposed by this By-law! Second— That no person shall drive furiously any horse orother animal, or shout, or use any blasphemous or indecent language upon any highway ; and in case any person so drives, or shout's, or uses blasphemous or indecent language, he shall incur the pen' alties imposed by this By-law. Third— That every person travelling upon any highway in the said County of Oxford with a sleigh or sled, drawn by horse or mule, Shall have at least two bells attached to the harness. Fourth— That in case any person travelling or being upon any highway in the said County of Oxford, in charge of a vehicle dravn by one or more horses or other animals, meet another vehicle dravn as aforesaid, he shall tum out to the right from the centre of the road, allowing the vehicle so met one-half the road. Fifth— That incase any person travelling or being on any ligh- way in the said County of Oxford, in charge of a vehicle as ifore- said, or on horseback, be overtaken by any vehicle or horiemau travelling at a greater speed, the person so overtaken shall (uickly turn out to the right and allow the said vehicle or horsemantopass. Sixth— That in case of one vehicle being met or oveiraken by another upon any ot the highways in the said County of Oxford, if by reason of the extreme weight of the load on either of tie vehicles so meeting, or on the vehicle so overtaken, the driver fnds it im- practicable to turn out as aforesaid, he shall immediate^ stop, and if necessary for the safety of the other vehicle, and if reiuired so to do, he shall assist the person in charge thereof to >ass without damage. Seventh— That in case any person in charge of av^ehicle or of a horse or other animal used as the means of conveyanc or travelling, «^ BY-LAWS OF THE COUNTY OF OXFORD. 100 or being on any highway as aforesaid, be through drunkenness un- able to ride or drive the same with salety to other persons travel- Hng on or being on the highway, he shall incur the penalties im- posed by this By-law. Eighth— That it sliall not be lawful for any person to ride or drive any horse or horses or other animal through any body of men assembled on the highways of the said County of Oxford at a faster rate than a walk, under the penalty imposed by this By-law. Ninth— That if any person contravenes this By-law, or any part thereof, and such contravention be dulyjproved by the oath of one creditable witness before any Justice of the Peace having juris- diction within the locality where the offence has been committed, the offender shall incur a penalty of not less than one dollar, nor more than twenty dollars, in the discretion of the Justice, with costs. Tenth— That if not paid forthwith, the penalty and costs shall be levied by distress and sale of the goods and chattels of the offender, under a warrant signed and sealed by the convicting Justice; and the overplus, if any, after deducting the penalty and costs and charges of sale, shall be returned on demand to the owner of such goods and chattels. Eleventh— That in default of payment or distress, the offender shall, by warrant signed and sealed as aforesaid, be imprisoned in the Common Gaol of the County of Oxford for a period of not less than one day, and not more than twenty days, at the discretion of the Justice, unless such fine, costs and charges be sooner paid. Twelfth— That every fine collected under this By-law shall bc paid to the Treasurer of the local municipality or place in which the offence was committed, and shall be applied to the general purposes thereof. I 1^) WHEREAS certain inhabitants oi the tract of land hereinafter formed into the Village of Norwich, being not less than one hund- red resident freeholders and householders thereof, and of whom one half and over are freeholders, by petition have prayed the said Municipal Council of the Corporation of the County of Oxford to erect the said lands into an incorporated village, by the name and with the boundaries hereinafter described. And whereas, by a census taken under the direction of the said Council, it appears that the said parcel of land contains over seven hundred and fifty inhabitants, and that their residences are sufficiently near to form an incorporated village, , therefore the Municipal Council of the Corporation of the County of Oxford enacts as follows : First— The land hereinafter mentioned, am' the inhabitants of the same, shall be, and are hereby constituted and erected into an incorporated village; apart from the Township of North Norwich, by the name of the Village of Norwich, and with the boundaries hereinafter declared. WHEREAS it is necessary and expedient, in accordance with the Statutes passed by the Legislature of the Province of Ontario, in the thirty-sixth year of the reign of Pier Majesty Queen Victoria, chaptered forty-eight, to pass a By-law licensing, regulating, and governing auctioneers and other persons selling or putting up for sale goods, wares, merchandise, or effects by public auction, and hawkers or petty chapmen and other persons carrying on petty trades who have not become permanent residents in this County, or who go from place to place or to other men's houses on foot, or with any animal bearmg or drawing any goods, wares, or merchan- dise for sale, not being the growth, produce or manufacture ol this Province, not being liquors within the meaning of the law re- gulating to taverns or tavern licenses. Section I.— Be it therefore enacted by the Municipal Council of the Corporation ot the County of Oxford in Council assembled, and it is hereby enacted by authority of the same, that from and after the passing of this By-law it shall not be lawful for any per- son or persons to act as an auctioneer or sell or put up for sale any goods, wares or effects by public auction within the jurisdiction of 112 BY-LAWS OF THE COUNTY OF OXFORD. this Council, nor carry on the business of hawkers or petty chapmen, or to carry on any petty trade (not having become a permanent resident in this County) ncr to go from place to place or to other men's houses on foot or with any animal bearing or draw- ing any goods, wares, or mercnandise, not being the growth pro- duce or manufacture of this Province, and not being liquors within the meaning of the law relating to taverns, or tavern licenses, without first purchasing and obtaining a license to exercise his calling as hereinafter provided, under a penalty of not less than one dollar nor more than twenty dollars, exclusive of costs, for each offence, such penalty and costs to be recovered before any or more of Her Majesty's Justices of the Peace in and for the County of Oxford, and in default of payment the same to be levied by distress and sale of offender's goods and chattels, and in ccfault of distress found, out of which such penalty can be levied, such offender to be confined in the County Gaol at vVoodstock, with or without hard labor, tor any term not exceeding twenty-one days. Section II.— There shall be issued by this Council licenses for each of the callings set forth in the preamble of this By-law. signed by the Warden, attested by the Clerk, and sealed with the seal of the Corporation in each year in the form of the schedule attached to this By-law marked A, such licenses to be in force lor periods of one year, nine, six or three months as mentioned therein from the date thereof and to be dated either on the first oays of January, April, July, or October, and shall be issued and sold by the County Clerk only. Section III.— That every license to practise the calling of auctioneer, or to sell, or to offer for sale goods, wares, merchan- dise, or effects at pubHc auction, the sum of $12.00 for twelve months, from the first day of January; $10.00 for nine months, from the first day of April ; $8.00 for six months from the first day of July, and $6.00 for three months from the first day of October. Section IV.— That every license to practise the calling of a hawker or petty chapman or to carry on any petty trade (not being at the time a permanent resident of this County) or to go from place to place or to other men's houses on foot with goods, wares or merchandise for sale, not being the growth, produce or manufacture BV-LA.WS OF THE COUNT\' OF OXFORD. 113 of this Province, aad not being liquors within the meaning of the law relating to taverns and tavern licenses, the sum of i^j.oo for twelve months from fust January, $4.00 for nine months from first April, $3.00 for six months from first July, and $2.00 for three months from first October, and for every animal bearing or draw- ing such goods, wares or merchandise, the further sum of $8.00 lor twelve months and a proportionate sum for nine, six or three months. Section V. — Any person when exercising any ot the above callings within this Corporation shall have with him his license, and shall upon demand being made by any Inspector of Licenses, Municipal Councillor, or by the Clerk of any Municipality, or by any Justice of the Peace for this County, or by any one of the ratepayers of the Municipality in which the demand is made, produce the same ; and if he neglects or refuses to do so, he shall be held to be acting without a license, and shall be liable to the same penalties as if he were exercising his calling without license. Section VI. — All Reeves, Deputy- Reeves, and Clerks are here- by required to see that all persons found acting in contravention of any of the provisions of this By-law are prosecuted. Section VII. — AH licenses issued under this By-law shall ex- pire in the year in which they are issued. Section VIII.— All fines and penalties imposed by this By-law shall be paid one moiety to the party complaining, and the other moiety thereof to the Treasurer of the County, and shall form part of the funds of the County. Section IX.— All other By-laws or parts of By-laws of this Corporation in any wise contrary to the provisions of this By-law are hereby repealed. Read third time and passed 7th December, 1876. Seventh.— That each Member of the Board of Examiners of the Public School Teachers shall receive the sum ot ^^ tor each days attendance, as members of such Board, and also the addi- tional sum oi ten cents per mile tor each mile necessarily travelled thereunto. Eighth.— The Keeper of th^ Court House and Offices shall receive the sum of $150 per annum, as such Keeper of the Court Room and Offices. A By-law of the Municipal Council of the Corporation of the County of Oxford, to consolidate and repeal By- laws Nos, 8, 6, and 62 ; providing for the protection of materials growing or lying on County Roads ; for im- proving and keeping in repair County Roads, and for providing and regulating Statute Labor thereon. Be it therefore enacted that all timber, stone, gravel, or other materials growing or lying on County roads in this County shall be under the care and protection of the Reeves of the Municipali- ties between which such roads Me. And be it further enacted that if any person or persons shall wilfully or maliciously commit any damage or injury x.^ or upon any oi this timber, stones, or other materials, growing, lying, or BYLAWS OF THE COUNTY OF OXFORD. 117 beiiiR upon any of the Courty roads in this County, shall be prosecuted, and upon conviction before any Justice or Justices of the Peace, acting within this County, sliali forfeit or pay such sum or sums of money not exceeding fifty dollars as shall appear to such justice or justices to be a reasonable compensation for the damage committed, and u\ default of payment to be levied by dis- tress-warrant under the hand and "^oal of the said justice or justices upon the goods and chattels of tiie offender, and in default of suffi- cient goods and chattels said offender shall be confined in the com- mon gaol with or without hard labor for any time not exceeding twenty-one days. Be it further enacted that if any two or more adjoining Munici- palities deem it expedient for the better maintenance of the roads and bridges may direct the aoplication of statute labor thereon as well as such other monies as they may from time to time have at their disposal. " Be it further enacted that the Reeves of said adjoining Munici- palities be, and they are hereby authorized and empowered to sell any timber, stones, gravel, or other materials growing, lying, or being on any allowance for road between said Municipalities, to expend the proceeds thereof in the improvement of said roads. And be it further enacted that all persons rated on the Assess- ment Rolls or otherwise liable to perform statute labor residing on lots adjoining any County roads dividing any two Municipalities within the County, or on County lines adjoining other ^^ounties, although such roads may deviate so as in some places to be wholly or in part within one Municipality, shall perform their statute labor on such County roads or pay a commutation of money in lieu thereof; provided however that such persons residing on corner lots adjoining side lines may under direction of the Reeves perform statute labor on said side lines or pay a commutation oi money therefor. And that such statute labor or commutation money shall be performed or expended on said County roads and bridges whenever and in whatever manner the Councils of such Munici- palities shall through their proper officers direct. Be it further enacted that it shall be the duty of said architect to see that all resolutions of the Council and clauses in Reports of the Committees on County Buildings and Property, and other Com- mittees regarding changes or repairs on County Buildings, be pro- perly carried out ; and should any changes or repairs become neces- sary and require to be made during the period intervening from the previous to the next session of the Council, the said architect being informed thereof shall notify the Chairman of the Committee on County Buildings and Property, who shall either give his order for said repairs to be done, or should he deem it necessary that the Committee should meet to consider the same he shall give his order accordingly.
