A NUMBER of persons formed into an Association for the purpose of creating a Public Library in Halifax, having met on the 17th day of October, 1831, agreed to the following Con- stitution; and all who subscribe to it bind themselves to con- fo'm to its provisions: — That the Library shall be called " The Halifax Mecha- nics' Library." That cases of immorality, insolence, or factious conduct, may occasion the suspension of the privileges of the Library, by a unanimous vote of the Committee ; or the forfeiture of such privileges, by a majority consisting of two thirds of a General Meeting of Shareholders ; such vote to be given by Ballot. That the majority of the Books purchased for the Library shall be such as treat of useful knowledge. That the sum which gi . es Subscribers the privileges of the Library shall not exceed Five Shillings per Quarter. That this Constitutior shall not be altered at any Annual or other meeting of Shareholders, so long as ten Shareholders agree to support it. That all persons becoming Shareholders, shall be shown the Constitution and Rules, and shall subscribe thereto ; and that in case of an infraction of the Constitution, a General Meeting shall be called to redress such infraction ; if redress be denied by the majority of the meeting, the Shareholders, willing to abide by the Constitution, provided they amount to ten persons or u])ward3, may declare the Society abolished, and proceed to reform it — the Stock to be retained or recovered by them, by virtue of this Constitution, to which all the Shareholders give their assent, and pledge their support at the time of taking shares. i 11 RULES FOR THE GOVEKNMENT OF THE Revised at the General Annual Meetin"' of Shareholders, held in the Library Kooni, 2nd of October, 18G0. 1 . Tliat the library now formed be called ' ' The Halifax Mechanics' Library," and that the name Mechanics' Library shall bear no exclusive interpretation, that term being only chosen as applicable to a library of useful knowledge, and of such pecuniary qualifications, as may place its privileges within the reach of any industrious person. 2. That the admission fee to membership in this associa- tion be ten shillings. 3. That such shareholders pay fifteen shillings a year quarterly in advance. Officers of the Society. 4. That all ofl&cers of the society, except the Secretary and Librarian, shall be chosen by nomination and ballot, and that the meaning of nomination shall be, that candi- dates for office shall be proposed by one member, and se- conded by another, and that the names of all persons so nominated shall be placed on a board in a conspicuous part of the place of meeting. 5. That a President and Treasurer be chosen annually. 6. That the President and Treasurer be ex-officio mem- bers of the committee. 7. The Treasurer's duty shall be to receive from the Librarian all sums of money collected on account of the Institution, as subscriptions, fines, benefactions, &c., and shall pay all accounts and debts incurred, which have been passed by the committee. He shall have ready and hand over to the committee, seven days before the general ^ RULES. 5 annual meeting, a complete and perfect account of all sums received and paid by him on the part of the Institution, together with every voucher (regularly numbered) which may be deemed requisite. 8. The Librarian, who shall also act as Secretary, shall bo appointed by the committee, and give such security as may be deemed necessary. He shall attend in the Library Room at sucli hours as may hereafter be stated, have custody and charge of all the books, and receive and exchange them as required by the shareholders, keeping an accurate ac- count thereof ; he shall also carefully examine the same, and acquaint the committee with any damage they may have sustained, in order that proper steps may bo taken against the offender. 9. The Librarian shall receive all subscriptions, fines and monies belonging to the society, and pay over the same into the hands of the Treasurer at least once every month, (tak- ing his receipt for the same in a book to be kept for that purpose,) provided the sum of money in his hands does not exceed £5 at any one time, in which case he shall innnedi- ately pay over the same to the Treasurer. He shall keep a distinct and correct account of all the moneys he may re- ceive, under the different heads from which they may arise, furnishing the committee with a copy thereof whensoever they may require it. He shall also have ready and hand over to the committee, at least seven days before the general annual meeting, an account of all sums received by him on behalf of the society, and paid over into the hands of the Treasurer, in order that the same may be compared with that officer's accounts, and laid before the general meeting. 10. That the offices of Secretary and Librarian be joined in one person, and that he receive .£37 10s. per annum for his services. Committee. 11. That the ordinary business of the society be conduct- ed by a committee. 12. That the committee consist of five members besides the President and the Treasurer, and shall meet monthly 6 RULES. or oftoncr if necessary ; and should a vacancy occur it shall be filled up by another shareholder chosen by the committee. 13. That members of committee be fined one shilling and three pence, for non-attendance on regular nights of meet- ing. 14. That the committee shall form such bye-laws as they may' deem ))Voper, such bye-laws to be subjected to a general meeting of sliareholders, and if approved of, be engrafted on the Rules. Meeting. 15. That a general meeting of shareholders shall be called annually on the first Tuesday of October, to appoint officers, and hear tlie report of the committee. IG. The committee shall have power to call a general meeting of shareholders, whenever they may judge it expe- dient to do so for the interest of the Association. 17. That twenty-five shareholders may procure a general meeting, by forwarding to the President a written requisi- tion, with their names attached. The meeting .shall not be held until six days after such notice. 18. That any person in arrears to the Library shall be deprived of the privilege of voting at the general meetings of the society. SlIAllEIIOLDERS AND TRANSFER OF ShARES. 19. That any person wishing to become a shareholder, shall leave his name with the Secretary, to be laid before the committee at their next meeting, for approval. 20. That whenever a shareliolder shall be in arrears to the amount of his share, he shall forfeit his interest in the Library, provided the Librarian shall give him a month's notice thereof. 21. That if a shareliolder, wishing to sell out, procure a purchaser for his share, he shall inform the committee of such wish, and of the name of the proposed purchaser. The committee may object to purchasers, until a suitable person offer, or they may purchase the share at a fair price, and dispose of it themselves, if they think such a course advi- sable. A t RULKS. Books. 22. That books of an immoral character shall not be ad- mitted into the Library, or if there by accident, shall be re- moved l)y the committee, when reported to them. 23. That a nomination list 1)6 kept, on which sharehold- ers may place the names of books which they wish to have purchased, tlie list to be subject to the discretion of tlu^ committee, and the books on it, if approved of, to get the precedence of other books. 24. That books on the list be chosen or rejected, accord- ing to the order in wliich they stand. 25. That tjjc number of days limited by the committees for the perusal of each book, also the fine for each day'.'^ detention of it after the specified time, shall be placed on the inside of the cover. 26. That the rate of fine shall be, for each day for a book 2d., for a pamphlet or magazine Id. 27. That the fines for the detention of books beyond the specified time, be in all cases strictly enforced, 28. Every sliareholder shall be at liberty to take all the volumes of any novel or work of that description, at the same time ; Itut each volume is to be returned at the expi- ration of the period allotted for reading it ; he may also be allowed to take out one volume of any other series, or a magazine, provided the same shall have been in the Library upwards of one month ; and at all times every person shall be allowed to retain in his possession, any atlas, book of plates, or illustrations, which may belong to the said book exclusively, initil ho has completed the reading thereof. 29. That persons not shareholders be allowed one volume at a time, upon the payment of 7s. 6d. for a half year in advance, such subscribers in all cases to be admitted upon the recommendation of a shareholder, who shall be respon- sible for the safe return of the books. 30. That a shareholder on returning a book or magazine, may have it re-entered to him, provided no other shareholder shall have a])plied for it, and provided the work shall have been in the Library full one month. 31. That any shareholder entering his name for any book p M RULES. to 1)0 kept for him, can take out but one sot whilo so doing, anil any sub.scril>or wishing to enter his name for any book must return the book he may have out to the Librarian be- fore entering his name. 32. That if any book sliall be returned written on, or otherwise defaced, the Librarian shall report, and the sub- scriber or shareholder shall not receive another book, until the committee determine on the case. The committee may order tine, ])ayment for the book or set of books, or deposi- tion of a similar copy or copies. 33. That no person take books from the shelves of the Library except the Librarian. 34. That any person removing a book from the Library room, without informing the Librarian, shall uicur a penalty of 2s. Cd. 35. Tiiat any shareholder who shall lend from out the house in which ho resides, any L^ook or magazine belonging to the Library shall pay a fine of 2s. Gd. for each and every offence. 36. The committee shall, at least once in each year, at such time as may be deemed most convenient, call in all hooks ' donging to the Listitution, which call must be strict- ly attended to by the shareholders, and shall suspend the further circulation thereof, until, with the Librarian they have examined into their state and condition, and a report of such as are damaged, or of such as are recommended to be sold out of the Library, shall be prepared to lay be- fore the general annual meeting or any other general meet- ing which it may be found necessary to call before that period. Funds of the Library. 37. That the Treasurer shall not pay any money without a written order from the President. 38. That the Treasurer shall at all times, when desired by the committee, furnish them with a written statement of his accounts as they stand at the time required, and showing the balance of cash he may then have in hand. 39. ICT OF INCOllPOEATION. Be it enacted by the Governor, Council and Assembly, as follows : 1. The following persons, that is to say, James C. Hume, M. D., Robert H. Wetmore, Robert M. Barratt, John L. Whytal, Gcorf^e A. V. Paws Cuthbert C. Vaux, and Samuel Caldwell, and all such other persons as now are, or shall here- after become members of this Association, and their succes- sors, shall be a body politic and cor])orate by the name of the Halifax Mechanics' Library Association. 2. The object of the Association shall be the diifusion of Science and Literature among the Mechanics, Artisans, and others, of the City of Halifax, by means of a circulating Libra- ry and otherwise, and the books and papers now belonging to the Society shall be vested in the Corporation for the uses thereof. 3. The Association shall not at any time hold Real Estate of greater value than Two Thousand Pounds. 4. The Association shall be governed by a Committee ol' not less than seven members, comprising a President and such other OiHcers as may be designated in the Bye-Laws of the As- sociation, to be chosen at some general meeting by a majority of members nresent thereat, according to the Regulations now in force in the Association, or hereafter to be made with re- spect to the Office-bearers. 5. It shall not be necessary in consequence of this Act to reappoint any of the ])ersons now managing the affairs of the Association as the Office-bearers thereof, but they shall con- tinue to act for the ]ieriod for which they were appointed. 6.
