 such rates shall be subject to revision and moditication by the Secretary 
 of the Inteiior. 
 
 Sec. ;}, That any railroad eom])any whose right of way, or whose 
 trade or roadbed upon such right of way, jiasses through any canyo'i, 
 pass, or delile shall not i)revent any other railroad company from the 
 use and occui)ancy of s;ii<l canyon, pass, or deiile for the i»ur])oses of 
 its road, in (ionimou with the road f rst located, or the crossing of other 
 railroads at grade; and the location of such right of way through any 
 canyon, i)ass, or detile shall not cause the disuse of any tramway, 
 wagon road, or other ])ublic highway now located therein, nor prevent 
 the location through tiie same of any such tramway, wagon road, or 
 highway where such tramway, wagon road, or highway may be neces- 
 sary for the i)ublic accommodation; and where any change iu the loca- 
 tion of such tramway, wagon road, or highway is necessary to i)ermit 
 the passage of such railroad through any canyon, pass, or delile, said 
 railroad company shall, before entering upon the ground occupiiul by 
 such tramway, wagon road, oi" highway, cause the same to be rect)n- 
 stru(!ted at its own expense in the most favorable locati(jn, and iu as 
 perfect a manner as theoriginal load or tramway: l'roriile>J, That such

 of the Interior, authorizing' the collection and specifying the rates of 
 toll: rrorided. That accurate printed copies of said written authi)rit.y 
 IVoiu the Secretary of the Inteiior, including tfdi, freight, and jiasseiiger 
 charges thereby approved, shall be ke])t constantly and cons])icnously 
 ])osted at each station where toll is demanded or colh^cted. And any 
 jieison, cor])oration, or com])any collecting or attempting to collect toll 
 without sucdi written authority fiom the Secretary of the Interior, or 
 failing to kec]) the same i)osted as luMcin I'ecpiired. shall be deemed 
 guilty of a nnsdemeanor, and on conviction theieof shall be lined for 
 each otfense not less than tilty dollars nor more than live hundred dol- 
 lars, and in default of ])ayment of such line and (-osts ol' piosecutiou 
 shall be imi)risoiie(I in jail not exceeding niiu'ty days, or until such 
 line and costs of prosecution shall have been paid. 
 
 That any person, cori)oratio]i. or com])auy (pialilied to construct a 
 wagon road or tramway under the provisions of this Act that may 
 heretofore have constructed iu)t less than one mile of road, at a <!Ost of 
 not less than live humlred dollars ))ei' mile, or one half mile of tramway 
 at a cost of in)t less than five hundred dollars; shall have the prior 
 right to ajtidy for such light of way and for lands at stations ami ter- 
 minals and to obtain the same pursuant to the })rovisioiis of this Act 
 o\er and along the line hitlierto constructed or actually being improved 
 by the apiilicant, including wharves connected therewith. That if any 
 ])arty to whom license has been granted to construct such wagon road 
 or tramway shall, for the ])eriod of one year, fail, neglect, or refuse to 
 com])lete tlie same, the rights herein grant«'d .shall be forfeited as to any 
 such un(;ompleted section of said wagon road or tramway, and there- 
 n])on shall revert to the United States without further action or deda 
 ration, the notation of such uncompleted s<>ctiou upon the records of 
 the land oflice shall be canceled, and the reservations of such lands for 
 the purposes of saitl right of way shall cease and become null and void 
 without further action. And if siudi road or tramway shall not be 
 kept in good condition iov use, the Secretary of the Interior may pro- 
 hibit the collection ol toll thereon pending the making of necessary 
 repairs.

 Si;(". !>. That the map and })rofile of definite location of such railroad, 
 waji'on road, or tramway, to be tiled as hereinbefore ])rovided, sliall, 
 when the line ])asses over surveyed lands, indicate the location of the 
 road by reference to section or other established survey (corners, and 
 Avhcre such line passes over unsurveyed lands the location thereon 
 iShall be indicated by courses and distances and by references to natural 
 objects and ])ermanent monuments in such nninner that the location of 
 the road may be readily determined by reference to descriptions given 
 in connection with said i)rolile map. 
 
 Sec. 10. That any citizen of the (nited States twenty one years of 
 age, or any association of such citizens, or any corjjoration incorporated 
 under the laws of the I'nited States or of any State or TerritfTy now 
 authorized by law to lu)ld lands in the Territories, hereafter in the 
 jiossession of and oc*'Ui)ying ])ublic lauds in the J)istrict of Alaska in 
 good faith for the i)uri)oses of trade, manufacture, or other productive 
 in<lustry, may each purchase one claim only not exceeding eighty acres 
 of such land for any one ])erson, association, or corporation, at two dol-

 That all allidavits, testimony, proofs, and other i)apers provided for 
 by this Act and by said Act of March third, eighteen hundred and 
 ninety one. or by any departuu'utal or Executive rej,ida(ion thereunder, 
 by depositions or otherwise, under c(unmission from the register and 
 receiver of the land ollico, whi(di may have been or may hereafter be 
 taken and sworn to any where in the Tnited States, befo'.e any court. 
 Judge, or other ol'licer aulliori/ed by law to administer an oath, shall 
 be adnuttcd in evidence as if taken before the register and leceiver ol" 
 the pro|)er local land ol'iice. And thereafter such proof, together with 
 a certilied copy of the field notes ami i)Iat of the survey of the claim, 
 shall be tiled in the oHice of the surveyor-general of tiie I district of 
 Alaska, and if such survey and iilat shall be approved by him, certified 
 copies thereof, together with the claimant's application to purchase, 
 shall be tiled in the Inited States land office in tlie land district in which

 Skc. 11. That the Secretary of the interior, under such rules and

 may from time to time sell so much thereof as he nuiy <leem proper for 
 not less than the apprnised value thereof', in such (|uantities to each 
 purchaser as he shall prescribe, to be used in the IMstritt of Alaska,

 Sec. 1-. That the President is authorized and empowered, in his 
 disctretion, by Executive order from time to time t<t establish or <lis- 
 continue land districts in the District of Alaska, and to define, modd'y, 
 or chansic the boundaries thereof, and desitjiiate or ciianue the location 
 of any land ollice therein: and he is also autiiori/ed and eminnvered to 
 appoint, by and with the advice and consent of the Senate, a register 
 for each land district he may establish and a receiver of public moneys 
 therefor; and tbo rej;ister and receiver appointed for such district 
 shall, during- their respective terms of ollice. reside at the place desi«»- 
 nati'd for tlu' land office. That the rejiisters and receivers of public 
 moneys in the laud districts of Alaska shall each receive an annual 
 salary of one thousand live hundred dollars and the fees .i)r()vide<l by 
 law for like oflicers in the State of Ore^ron. not to exceed, including 
 such salary and fees, a total annual compensation of three thousand 
 didlars for eaidi of said ollicers. 
 
 SEf". 13. That native-born citizens of the Doiuinif»n of Canada shall 
 be accorded in said District of Alaska the same nnninjj ri;;hts and 
 ])rivileg('s accord' d to citizens of the Tnited States in iJritisli Columbia 
 and the Northwest Teirito'-y by the laws of the Donnuion of Cana<la or 
 the local laws, rules, and r '-jridations: but no greater rights shall be 
 thus accorded than citizens of the I'nited States or persons who have

 declared their i/iteution to become sncli may eiijoy in said District of 
 Alaska; and the Secretary of the Interior shall from time to time pro- 
 mulgate and enforce rules and regulations to carry this provision into 
 effect. 
 
 Sec. It. That under rules and regulations to be prescribed by the 
 becretary ot the Treasury, the privilege of entering goods, wares, and 
 merchandise in bond or of placing them in bonded warehouses at any 
 ot the jxnts in tlie District of Alaska, ai'd of withdrawing the same for 
 exijortatior j any ])hice in IJritish Colombia or the Northwest Terri- 
 tory without payment of dnty, is hereby granted to the Government of 
 the Dominion of Canada and its citizens or citizens of the United States 
 and to j)ersons who have declared their intention to become such when- 
 ever and so long as it shall appear to the satisfaction of the President 
 of the United States, who shall ascertain and declare tlie fact by procla- 
 mation, that cfuresponding iirivileges have been and are being granted 
 by the tiovernment of the Dominion of Canada in respect of goods, 
 wares and mercliandise i)as8iiig througii the teriitorv of the D(mlinion
