In case of one vehicle being met or overtaken by another upon any of the highways in the County, and by reason of the extieme weight of the load on either of the vehiclos so meeting, and the driver finds it impracticable to turn out as aforesaid, he or they shall immediately stop, and if required so to do for the safety of the other vehicle, he shall assist the person in charge thereof to pass without damage. 5th. In case any person in charge of a horse or other animal, with or without a vehicle, used as the means of conveyance on any highway as aforesaid, through drunk- enness, be unable to ride or drive with safety to other persons travelling on or being on the highway, he or they shall incur the penalties imposed by this By-Law. Otli. All persons travelling upon any highway with a sleigh or sled drawn by one or more horses or other animals, shall have at least two bells attached to tlie horse, harness, or vehicle. 7th. It shall not be lawful for any person to ride or drive any horse or horses or other animal through any body of men assembled on the highways at a faster rate than a walk. 8th. It shall not be lawful for any person or persons to ride or drive with one or more horses or oLher animals on that portioii of the public highways set apart and improved for public sidewalks. yth. If any person contravenes this By-Law or any part thereof, and such contra- vention bo truly proved by one creditable witness before any Justice of the Peace having jurisdiction in the Cou)ity, the oft'endcr or olFenders shall incur a penalty of not less than one dollar or more than twenty dollars, in the discretion of the Justice or Justices, together with the costs, 10th. If the penalty and costs are not paid as ordered by the convicting Justice, he shall issue his warrant to levy by distress and sale of the goods and chattels of the oil'ender or offenders, and the surplus of the sale, if any, after deducting the penalty, costs, and charges of the 'sale, shall be returned to the owner of the goods on demand. 11th. That the said Solicitor shall for and in consideration of the yearly salary here- after mentioned perform the following duties : (rt) He shall at all times, upon the request of the Warden, the County Commis- sioners, the Chairman of Committees, or the County Clerk, give his opinion either ver- bally or in writing as requested, upon any question affecting the interests of the County, and shall give his assistance to any legislation required ; (i) He shall act as Solicitor for the County in any litigation or arbitration that may be commenced by any corporation or person in any matter in which the County may be interested, whether as a party to said litigation or arbitration or otherwise ; (c) The County Commissioners or the County Clerk shall at all times be entitled to ask the advice or assistance of the said Solicitor in any matter which in any way affects the legal rights of the said County ; {d) The said Solicitor shall receive as his sole remuneration, for the said services, the salary hereinafter provided, save and except in the cases hereinafter excepted. 4th. The said Solicitor shall act as counsel for the County in all matters of litiga- tion, arbitration, or dispute without extra assistance in thr way of counsel fees or other- wise, unless the said assistance is recommended in writing by the County Commissioners or the Warden, 6tb. The salary of the Solicitor shaU be the sum of $600, payable quarterly. Gth. The said Solicitor shall, however, be entitled lo receive, in addition to the said salary, all legal disbursements for counsel fees, or otherwise, actually paid out by him according to this By Law in the course of legal proceedings alfecting the interests of the County. 7th. When there has been a suit or action decided in favor of the County, in which by the judgment of the court the County is entitled to costs, to be paid by the opposing party, the said Solicitor shall, in addition to his said salary, be entitled to whatever amount, exclusive of disbursements for witness fees and court fees which may have been paid by the County, that the said judgment may award. 8th. Any porsoii exercising the calling of an Auctioneer contrary to this By-Law shall, upon conviction thereof before any Justice or Justices of the Peace having juris diction, be lined not less than ten nor more than iifty dollars, exclusive of costs, and if such fine be not paid forthwith, it shall bo levied bj distress and sale of the goods and chattels of the offender on the autliority of a warrant, under the hand and seal of the convicting Justice or Justices ; and if suiUcient distress cannot be found the convicting Justice or Justices shall commit the olfeudor to the common jail of tliis County for any term not exceeding twenty days, unless the fine and costs be sooner paid. WHEREAS the Council of tLo Corpoiatiou of the County of York has, in accord- ance with the law in that behalf, ostablishod a House of Industry and Kcfuge in and for said County. And whereas by the provisions of the Municipal Act, Chap. Ibi, Sec. 102, and Bub-scotions thereto. County Councils arc uuthorizod to make rules and regulations for the Bupcrintendcnce, cpre and management of said House of Industry. Therefore the Council of the Corporation of the County of York enacts as follows : ADMISSION OF INMATES. Ist. That Section SCA), Cbap. 4b, 80 Vic. and sub-sections thereto, shall be and furm part of this By-Law. 2nd. Any two or tuore of Her Majesty's Justices of the Peace in and for the said County of York may, by wntmg under their hands and seals, commit to the said House of Industry and Refuge, to be employed and governed according to the Rules and Regu- lations herein provided : — (1) All poor and indigent persons who are incapable of supporting therusclvcs. (2) All persons without the means of maintaining themselves and able to work, and who refuse or neglect so to do. (8) All persons leading a lewd, dissolute or vagrant life, and exercising no ordinary calling or lawful business sufficient to gain or procure an honest hving. (4) And all such as spend their time and property in public houses, to the neglect of any lawful calling. (5) And idiots. 8rd. The commitments of persons referred to in the Ist and 5th subsections of Section 2 of this By-Law may be under the hand and siul of the Reeve or any member of the Council of the County of York, if an actual and bona tide resident of the County of at least one year's standing, and may be iu the form of Schedule A 1 to this By- Law, or to like eti'ect ; and the warrant or order ol commitment may be in the form of Schedule 2 to this By-Law, or to like etl'ect; and that persons committed under this clause shall not leave the Home until discharged by the Corumissionors and the Inspector. EXPENSES Ob' COMMITTING INMATES. 4th. (1) A cash book, in which he shall enter all items of receipts aud expenditure at least once in two weeks, and balance the same at the close of each month. (5) A ledger, to the accounts in which he shall post from time to time the trans- actions shown in the cash book. (G) He shall at the times set forth in this By-Law, aud as directed by the Board of Commissioners, pay the accounts duly passed a.nd ordered to be paid by the said Board of Commissioners, and shall as soon as may be and not later than the fifteenth day of each month transmit to the County Treasurer a tr-mscript or copy of the entries in the cash book for the preceding month, attested by the said Board of ConMiiissiouers, together with the vouchers, which he will cojitinue to take in duplicate as at present. 9th. In addition to the foregoing, it shall also be tho duty of the Inspector to make a yearly report to the County Council for the year ending the yist of December in each year, aud at such oihcr time as he may be directed by resolution of this Council, in the form of Schedule F to this By-Law, together with any other matter he may think of sufticient importance to bring under the notice of the Council. 10th. He shall also, on or before the thirty-lirst day of December in each year, check the inventory of personal property belonging to the institution and value the amount of produce on hand, and report the same to the County Council at the time of making his annual report. DUTIES OF THE KEEPEE. 11th. It shall be the duty of the Keeper, and he is hereuy authorized and required to receive into the said House of Industry and Retiigc for their maintenance and sup- port such persons only ns are legally committed under the provisions of this By-Law. (G) He shall also keep a visitor's book, hi which parties visiting the institution shall enter their names with any remarks or comment they may see fit to mnke. He shall also see that every department and all furniture and utensils are kept neat and clean and in order, and that all provisions, fuel and every other article consumed in and about the promises are used with the strictest economy. 15th. He, or his assistants detailed for the pnrpose, shall also visit each and every occupied room after the ringing of the retiring bell, and see that the inmates have all retired (excepting those on duty) and sludl see that all the tires are made secure and safe and that all lights are extinguished, save and except only where lights are per- mitted to be kept for the benelit of the sick. IGth. He may also for violation of any of the rules, for disobedience or bad con- duct by any of the inmates, iullicli suitable punisluuent at his discretion (but employ no improper means) by confinement or othorwi.se, l)ut in cases of solitary confinement not for a longer period than twenty-four hours, unless by the direction of the Inspector. DUTIES OF THE MATRON. 17th. It shall be the duty of tlio Matron to lake charge of and genoraliy direct all indoor operations ; to ^,oo that all female inmates are provided for according to their respective wants ; and tliat cleanliness and order bo ob.sorved both in their persons and apartments. IBth. It shall also be her duty to exercise due care over such of the County's properly as may be committed to her charge, see that the same be not lost or embezzled direct the detailing of the women under her charge to such branchos of industry as in her judgment they are best fitted to perform. 10th. He shall alno, in a book to be furnished for that purpose, note all cases of treatment by him ; in case of death to certify therein the cause, and shall also record in such book the births that occur in said Home, and shall prepare the necessary regis- tration certificate in each case. 22ad. He shall also when called upon by the Keeper examine any of the inmates feigning illness or otherwise, as to their alulity to work, and HJiall visit the Home at least once in two weeks, and report to this Council at the June Session in each year the number of deaths, all cases of illness, cause of illness, the disease in each case, the number of visits made to each case. BURIAL GROUND. ^^8rd. If deemed advisable by the County Council or its Standing Committee, a suitable place on some part of the said Industrial Farm shall bo selected and set apart for a burial ground for the burial of such of the inmates as may die in said Homo, and whoso bona fide friends or relatives request the bodies to be buried therom, as aforesaid ; such burial ground to be fenced in and properly laid out in tiers or rows, and the graves plainly numbered. A burial register shall also be kept in the fn-m of Schedule C to this By-Law. BINDING OUT OF CHILDREN TO SERVICE. 24th. If it is desired by any person of good morals and repute to take any child from the House of Industry and Refuge a.-i an apprentice to any lawful trade, profession or cmploymont, or to take one on trial for n short time with the intention of having him or her t.o apprenticed, the Inspccctor may, if satisfied of the character of the person making such application, give his consent thcrctd, and cause application to be made by the Keeper to the Chairman of, and at the Court of, General Sessions of the Peace, to have such child put and bound out as an apprentice in conformity with Cap. 188, R. S. 0. 25th. Provision shall be made to have such child sent to school, and also requiring that at the expiration of the apprenticeship ho or she shall be furnished with an outfit of good and comfortable clothing. 26th. A register shall be kept in the form of Schedule B to this By-Law of all children bound out. RULES FOR THE INMATES. 27th. The following shall be and are hereby adopted as Rules and Regulations to govern the inmates. RULE I. 4^ At the ringing of the morning bell, every inmate in the Home (the sick excepted) must rise, dress, wash and be in readiness to proceed to the duties of the day. 84 BY-LAWS OF THE COUNTY OF YORK. No inmate shall be allowed to trade or exchange clothing, or any other article in their possession, nor bog of those visiting the Homo : nor shall they receive any money or other article without the consent cf the Keeper or person in charge. HULE VI. All inmates shall diligently and faithfully perform the duties assigned them by the Keeper or others in charge. RULE VII. Any inmate guilty of drunkenness, disobedience, immorality, obscenity, disorderly conduct, profane or indecorous language, theft or waste, or who .shall absent himself or herself from the promises without the permission of the Keeper, or who shall be guilty of injuring or defacing any part of the House or furniture therein, or who shall commit waste of any kind, .shall be punished as the ease may seem to demand. RULE VIII. In all cases of soHtary confinement the prisoner shall be debarred from seeing or conversing with any person except the Inspector, the Keeper, or the person employed to supply their wants ; and the food of sucli prisoners shall consist solely of bread and water unless otherwise ordered by the Inspector or Physician. RTILE IX. Any inmate who shall have communication, either directly or indirectly, with any one thus confined, without permission, shall be subject to punishment by a like con- finement. RULE X. No inmate shall go beyond the limits of the Industrial Farm unless by the per- mission of the Keeper, nor remain out beyond the time specified by the Keeper. RULE XI. The Sabbath Day shall be strictly observed, and no irreligious diversion or unneces- sary labor be indulged in. All persons aggrieved may prefer their complaints to the Inspector when he is visiting the House, or to a member of the County Council. 28th. A By-Law to authorize aud empower the Metropolitan Street Railway Company to extend their line of railway from their present northerly limit to the top of York Mills Hill. WHEREAS by agreements made between this Comity and the Metropolitan Street Railway Company on the twenty-fifth day of June, 1884 ; the twentieth day of January, 1886 ; the twenty-eighth day of June, 1889 ; and the seventeenth day of December' 188!j, respectively, the MetropoHtan Street Railway Company has power and authority to operate tiieir Street Railway on Yonge Street, between the Northerly hmits of Toronto and Glen Grove Park ; And whereas divers ratepayers of the County are desirous of having the Company extend their Street Railway North to the top cf York Mills hill ; And whereas it is deemed advisabk and in the public interest to allow the said extension ; Be it therefore enacted by the Municipal Co lil of the Corporation of the County of York : 1st. That the Metropolitan Street Railway Company be and the same is hereby authorized and empowered to extend and operate their Street Railway by Electric or Cable Power or Horse Power from the present Northerly hmit of said road on Yonge Street to the top of York JMills hill, under the conditions of the agreement hereinafter referred to benig carried into ciFect. 2nd. That an agreement be prepo,red to amend the agreements of this County with the Company, allowing said Company to extend their Street Railway to a point indicated in Clause 1 oi' this By-Law, subject to such restrictions, cond'tions and pro- visions as the Warden and Commissioners of County Property and IVir.
