By section I. as amended by the Gth section of the act of 1841, the Governor and Council aro to appoint and commis- sion in every county of the province, Five or more Commis- sioners of Schools. In the county of Halifax, and in that of Guysboroi ,h, the Governor and C(5uncil have discretionary power to divide the county into two or more districts, and to appoint a similar Board for each, and to apportion the money appointed for each of the two counties accordingly. Tlie Commissioners arc to have the su^jerintendance, ma- nagement and control of all Schools in their county or district established under this law ; (subject to the authority confer- red on the Central Board, as specified in subsequent clauses.) Three Commissioners to be a quorum for transacting business. They are to be removable from office at the pleasure of the Governor, who may fill up vacancies occasioaed by such re^ moval, or by death of commissioners. The Board of Commissioners in each county are to divide and lay it off into school-districts.* Such intended division to be advertised, publicly, for one month, previous to its being confirmed, — to afford opportunity for objections by any parties concerned, and to render it as convenient as possible to each neighbourhood. The Commissioners are also empowered to alter limits of School-districts, if they see occasion, or to approve and con- firm previous divisions. When arrangement is finally made, the Commissioners are to furnish a description of the School- district, as laid out, to the trustees of each school established (underthis law) within it. Section 4. " Whenever any number of individuals, in any school-district so laid off and established, in any county or district in this Province, shall make application in writing, to- the said Board of Commissioners for such county or district, engaging to hire a teacher for one year, (or for any time not less than three calendar months. I f I I I (7) sioners for a participation in the said sum of money, so to be paid to the S9id county or district as aforesaid, then and in such case, the said Bonrd of Commissioners shall enter upon a list of schools to be kept by them for that purpose, such school for a participation in said money, and shall appoint onef two or three trustees, as they shall deem requisite for such school, which said trustee or trustees shall have power and authority to make and enter into all necessary conti acts and agreements with the person or persons applying for such school and the teacher or teachers thereof, which said contracts and agreements shall be good and valid, and which said Trustee or Trustees shall have power to sue and be sued in their own names, for and concerning all matter relative to such school of which he or they shall be trustee or trustees. [And such trustee or trustees shall have power to make re- gulations as to the hours of attendance of the scholars, the al- lowance and duration of holidaysand vacations, and for the general regulation and government of the school. Sec. 8. Act 1841.] Section C, The trustees of schools established in the school-districts under the law, nre removable at the pleasure of the board of commissioners for the county, who can also fill up vacancy thereby occasioned. Section 7. Enacts " that no teacher shall receive aid un- '' der this act, unless such teacher shall ^rst receive a license " to teach a school from the said commissioners." The eleventh clause of the act, 1841 further enacts "that no 'license shall be granted, to any teacher under the seventh clause cf the said f»ct" unless the commissioners shall be first satisfied of the good moral character and suitable qualification of such teacher. Section 8. The board of commissioners of each county or district are to draw the amount allotted to their county from the treasury, under the Governor's warrant by half-year- ly payments. This money the county bonrd are to pay into the hands of the clerk of their board, who is to pay the seve- ral teachers of the school-districts under the direction of the commissioners. No larger sum is however to be drawn for any county from the treasury, than the engagement be- tween the trustees and teachers of schools render necessary. Section 9. And be it further enacted, that the trustee or trustees of each and every school within the several school districts in way county or district as aforesaid, shall, once in every six months, render to the said Board of Commissioners for such county or district, a true and correct account qf the number, names and ages, of the scholars taught in such school, I / (8) and their progress in eduaUion, the amount and, pariicnlannf the trpenfliture ^ such school, the amount of the Salary of the Master, and inivhat manner the same ii paid, and thnt the sum to bo received from ll»o said Board, by tl»o said Trustee or Trustees is bona Jide payable to tho said master for his own use and be- nefit ; and also, that the several engagements entered into and made to the said Board, by the persons applying for such school at the time of such application, have beenlully kept and performed, and shall produce and give into the said Board a certificate from the teacher or teachers of such school (previously attested on oath before a Justice of the reace of the County, Sec. 13, Act I84i.) "that no part of the salary which the persons applying for such school have engaged to pay to such Teacher or Teachers is collusively withheld, and that the said engagement wis not made merely for the pur- pose of procuring a portion of the Provincial allowance here- inbefore mentioned. Section 10. Imposes a penalty of £10 on any Trustee or Trustees who '-shall wilfully render to the Board of Com- missioners n/rfltu/w/eJU" ^^ or incorrect account uilder the pro- visions of this act, for the purpose of obtaining Provincial aid for the school, whereof lio or they arc Trustee or Trustees," to be recovared by action or suit by Clerk of Board of Com- missioners in the Supreme or Inferior Court of the county or district. Half the penalty to be for the Clerk, the other half to the Board of the County, for the purposes ol this Act. Section 11. " And be it further enacted, that the said sum of money to be granted and paid to each and every coun- ty and district as aforesaid, shall be apportioned and applied by the said board of commissioners, as soon as the said ac- counts of the said trustee or trustees have been rendered and received as aforesaid, in matincr following, that is to say :— - the bum of Seventy Pounds to be paid and applied by the said Board, to and among such of the inhabitants of the said, coun- ty or district, as uiay be unable lo keep up a school with fifteen scholars therein, to enable such inhabitants to employ a Teacher or Teachers for the whole or some portion of the year, to be paid and applied in. such proportions and under such regulations and restrictions as the said Board shall, from lime to time make and appoint. And be it enacted, That any Board of Commissioners, from and out of the sum of seventy pounds, placed at the disposal of such Board, by the eleventh clause of the said Act hereby continued, shall and they are hereby authorized to aid any sdioolfor instructing in the cwn- mon branches of education, the Blacks or people of colour, within the county or district for which such Board is or may be esta- blished, and for which school a school house shall have been provided by or for the Blacks, or people of colour ; and for aid to which application shall be made to the said Board, notwith- standing a common school may have be'jn established, and be in operation, and receive Provincial aid, for the school dis- trict or districts wherein the said school for the said Blacks or people of colour, may be situate.) Section 12. Provided always, and be it further enacted, That no school wherein thirty scholars and upwards are taught, shall be entitled to and receive any portion of the money here- by allotted to the several counties and districts in this Pro- vince, unUss it shall be satisfactorily made to appear to the Board of Commissioners for the county or district wherein such school is kept, by the trustee or trustees, that the teachr of such school did actually and bona fide receive, at least, the full sum of forty pounds pen annum, exclusive of, and in addition to, his Boarding, Washing, and Lodging; and no school (10) wherein less than thirty dndmore than fifteen scholars are taught, shall be isntitled lo receive any portion of the said money so allotted as aforesaid, unless it be satisfactorily made to ap- pear to the Commissionisrs that the inhab^ants interester m fiuch schcol, havfe actually raised for the use of such i^hool, cither by subscription or assessment the sum of iwrnty-fivi pounds per annum; (exclusive of and in addition to the Boarding, ticashing, and lodging of the teacher of such school, by Sec. l-l, Act 1841.) And provided lastly, that no school herein before mentioned, shall receive any Provincial aid, unless it shall also be made to appear to the said Board of Commis- sioners that a school house has actually been built or provided as herein before directed and prescribed. Section .3. And be it further enacted, that the said Board of Commissioners^ for each county and district shall op- point a Clerk to such Board, who shall receive and pay cdi mo- nies to be received and n:iid by virtue of this act, and shall keep a true and correct account and record of the proceedings of the said Board, and of the number of Schools and Scholars taught therein and of the different sums so paid and received un- der and by virtue of this act ; which Clerk shall receive two shillings and six pence for each license to be granted to any teacher or teachers by the said Board, and also fve per cent, [on^he amunt actually paid out by him, of monies to be received under these acts and no more, by Sec. 3 of the act of 1841,] to be de- ducted from srich payments so to be made by him as aforesaid. The Commissioners ot anycounty or district are empowered on complaint made to them, if they shall see fit, to remove and displace the teacher o»- teachers of such schools, and to annul any contract or agreement between such teachers and the trustees, and to withdraw the licenses of teachers complained of. Section 18. The Commissioners for each county or dis- trict are made responsible themselves, for the due and faithful application of the money drawn by their county or disirict un- der these acts, and they aie required to take good and suffi- cient security from the clerk of their board, "that he shall well and truly pay and apply all sums of money to be by him re- ceived," for the purposes in ihe acts mentioned. ■ I ■ ,'.L I n I ■ II . Whenever the irihdbitants of any' schbdl dis- trict in which a common school shall be established under thePjB acts, shallapply in writing to the Board of Commissioners fot the county or district, engaging that in addition to the branch- es of learning reiquired to be taught in such common school, to cause to be instructed there, from eight to fifteen scholari in the Classics, the practical branches of the Mathematics^ Geography, Algebra, English Grammar, or such of themaS may be required; — or in such application engaging for the instruction in the school of fifteeii scholars and' upwards, in the higher branches of education before mentioned, — ineither case the board of commissioners shall appoint two or more Trustees for the school and enter it as a combined Grsimmar and Common school. ', There are not to be more than three combined Grammair and Common Schools in anyone county or district ; and they are to be estaTjlished in such towns, villages and most populous settlements, as the Commissioners direct. The instruction in'the Classics niiy be dispensed with, in case a teacher qualified in this respect cannot he obtained ; and in such cases the other branches mentioned above shall be taught ; and the Commissioners shall not be bound to give the preference to a teacher on ac- count of his classical knowledge, if his other qualifications are inferior to those of his competitors. Section 22. There shall be paid from the treasury of the Province to every such ■combined Grammar and Common School, in which at least from eight to fifteen scholars are in- structed ir) the higher branches, £25 per annum; and to eveiry one. in which fifteen or upwards are so instructed, '£35 per annum. Section 27, Enacts that the sum granted for schools under the act, and divided among the counties, [that is £6000 per annum by the act of 1841,] shall be wholly applied to the be- nefit of common schools, and the extra allowances for combin- ^ ed Grammar and Common schools, are to be drawn in addi- tion by warrant on the treasury, under the Governor's hand and seal, and paid to the Boards of Commissioners to be ap- plied agreeably to the law. Section 18, act 1841, Authorizes the commissioners m case such extra allowance or any part of it should not be required for the use of combined Grammar and common schools, to apply it to the use of the common schools in their c ounty. ASSESSMENT. Section 19, act of 184!. This section authorizes the trus- tees of any school district, to call a public meeting of the rateable inhabitants within its limits. If a majority of the rateable inhabitants present at the meeting, agree to raise money for the support of the district school or schools by assessment, they are to certify their proceedings to the next General Sessions of the Peace for the county. The sums voted by this meeting shall then be assessed " upon " each of the inhabitants of such school district, in a rateable •'and equal proportion, according to his ability." The assess- ment and collection shall follow the same course the provin- cial law prescribes in case of poor rates ; and the monies col- lected shall be paid over to the Trustees of the school district. Sections 20 and 2 1 , act 1 84 1 , direct that the sum to be voted and assessed under the preceding clause, shall in no case ex- ceed £\5 in aid of a Common School, such as specified in the 12ih section of the act, 1832 ; of from fifteen to thirty scho- lars ',—£20, in aid of a common school of thirty scholars and upwards ;-or £2b in aid of a combined Grammar and Common School, described in section 22, act 1832, containing from ei"ht to fifteen scholars, who are taught the higher branches. "This limitation on the power of assessment if Iiowever, not to affect the arrangements of the 12th and 23rd clauses of the actofl8;j«2, by which, the teachers of such schools are enti- tled to receive at least £25. £40, and £100 ; in manner already pointed out : but the 'iiustees are to cause the defici- encies to be made up,-by fixing rates of tuition money to be paid by all scholars (except those poor scholars provided tor m the act,) in the schools, supported partly by assessment. ITINERATING SCHOOLS. Section 18, act 1841, authorizes the commissioners in any coi itv to establish an itinerating school, under such regula- tions as they may adopt, and to allow for its aid a portion of the sum allotted to the counly m this act. FEMALE TEACHERS. Section 10, act 1841, authoriies the commissioners to ex- ♦«nd aid under these acts, to any school taught by a female teacher, where she can be more advantageously enaployed than a male teacher, and it restricts them to license but one rnale teTcher in each school district, permitting them if they .ee fit, to license two female teachers in the same d^^jrict, and if necessary, in addition to any male teacher licensed therein. Sec U, act 1841. EXEMPTIONS OF LICENSED TEACHERS- Section 25, exempts every licensed teacher employed in any school in operaiion under the law, from 1. The payment of Poor and County Rates. 2. The performance of Statute Labor. 3. From Militia Duty. ACADEMIES. Section 24, act of 1S41. And be it enacted, that it shall and may be lawful for the Governor, Lieutenant-Governor, or Commander in Chief for the time being, to appoint and com- mission in every county of this Province, ^except the counties of Halifax, Pictou, Hants, King's, Annapolis, Lunenburg, Yarmouth, and Cape Breton, where Academies are at present established,) three or more fit and proper perpons to be trustees of an Academy therein— which said trustees, any, or either ot them, shall be removeable at the pleasure of the Governor, Lieutenant-Governor or Commander in Chief for the time be- ins, who shall also have power to fill up any vacancy occa- sioned by such removal, or by the death of any trustee or trustees Section 25. And be it enacted, that instruction shall be given at such Academies, as are now or hereafter to be toun- ded, in the Classics, in the practical branches of Mnihmatics, Ak^hra, Geography, English Grammar, History, andCompo- siaont and no person shall be appointed as the head master to any such Academy, who is not competent to teach all iho said branches, and also, am or more of the modern languages, whenever it shall be found practicable to introduce the same. Section 26.
