Be it enacted by the Lieutenant-Governor, Legislative Council, and Assembly, as follows : — 1. The Governor in Council may appoint a Chief Superintendent of Schools, who shall perform the duties of Secretary to the Board, and fix his salary not exceeding three hundred pounds per year^ besides travelling charges and contingencies of office, and a Clerk or assistant, whose salary shall not exceed one hundred and fifty pounds per year. 8. The Governor and Council with the Superintendent of Schools, shall constitute a Provincial Board of Education. The Governor with three other members and the Superintendent shall be a quorum. 3. The Governor in Council shall from time to time divide the Province into four Districts, and appoint an Inspector of Schools for each District, and fix his salary not exceeding two hundred and fifty pounds per year, including travelling expenses. BOARD OP EDUCATION. 4. The Board of Education shall have power to establish a Training School, or continue any one now in operation, and a Model School connected therewith, appoint a Teacher of such Training School, and a Male and Female Teacher of ihe Model School. To make rules and regulations for the government of such Train- ing Sohool ; to prescribe the terms on which Students shall be recei- ved and instructed therein ; and to make such allowance for the expense of Teachers attending the School as shall be deemed necessary, not exceeding six pounds to any Teacher. To make regulations for the organization, government, and disci- pline of Parish Schools, and the examination, classification, and mode of licensing Teachers, and the mode of certifying the time taught and of paying them. To appoint examiners of Teachers, and to grant and cancel Licences. To hear and determine all appeals from the decision of Trusiees. To prescribe the duties of Inspectors of Schools. To apportion all moneys granted by the Legislature, for the sup- port of such Schools among the several Parishes, in proportion to the number and classes of Schools reported to have been efficiently conducted for the preceeding year, not exceeding an average of two hundred and fifty pounds to each Parish in any one County, nor three hundred and twenty five pounds to any one Parish therein. To provide for the establishment, regulation, and government of School Libraries, and the selection of Books to be used therein ; but no works of a licentious, vicious, or immoral tendency, or hostile to the christian religion, or works on controversial theology, shall be admitted. ?.«»,./«*, To make regulations for the construction and ventilation of Scliool Houses, and the furniture and apparatus to be provided and used therein. To make such other regulations as may be deemed necesary to carry into effect this Act. To apply all balances of mbnby arising from the sale of books, maps, and apparatus purchased for the use of Parish Schools, in procuring other books, maps, and apparatus therefor, and to appoint pcrsoils in each County to sell the same under their direction. To divide the City of Saint John into two Parishes for the purposes of this Act. ^ ^ SUPERINTENDENT. 6. The Superintendent shall have a general supervision and direc- tion of the Inspectors, the Training and Model Schools, and the Par- ish Schools, subject to the order of the Board of Education. He shall enforce and give effect to ail the regulations made by the Board. II St tc B ti IT] fc Ol S{ V( S ir t( He shall collect Information on Education, and hold public meet- ings in different parts of the Province, to which he shall invite the attendance of the Inspector, Teachers, and Inhabitants, and address such meetings on the subject of Education, using all legitimate means to excite an interest therein. He shall cause copies of this Act, with the Regulations of the Board of Education, together with all necessary forms and instruc- tions, to be printed and furnished to the Inspectors, Trustees, Schoo' Committees, and Teachers. He shall adopt the necessary measures to promote the establish- ment of School Libraries. He shall provide the necessary plans for the construction of School Houses, and recommed the proper furniture and appendages for the same, and the improvement and embellishment of the grounds on which they are situate. He shall have power to sue fsr books, maps and apparatus, pur- chased for the use of Parish Schools, and for all moneys due on the sale thereof; and every such action shall be brought and prosecuted by him in his name of office, and shall not abate by reason of any vacancy or chunge of officer. He shall annually prepare a Report upon the condition of the Schools and School Libraries, with such other information upon the system and state of Education generally, and the amount expended in promoting it, with such suggestions as he may deern necessary, accompanied with a return or the moneys received L ;m the sale of books and apparatus, which shall be laid before the Legislature within ten days after the opening thereof. TRUSTEES. 6. Three Trustees of Schools shall bo annually elected in each Town and Parish, at the time and in the same manner as other Town or Parish officers, who shall be subject to the same pains and penal- ties for neglect or refusal to act, or the non-performance of their duties, as other Town and Parish officers ; and when any Town or Parish fails to elect, the Sessions shall appoint as in other cases : in incorporated Towns, Cities, or Counties, the Council shall appoint the Trustees ; but the Trustees in office at the time of the passing of this Act shall, continue to act until others are appointed in their stead. It shall be the duty of Trustees to divide their respective Parishes into convenient School Districts, and from time to time to reconstruct them, and to define in writing the boundaries of each District, and file a description thereof with the Clerk of the Peace, and in incor- porated Counties with the Secretary-Treasurer, and a copy thereof with the Town Clerk. They shall give any licensed Teacher authority in writing to open a School in a District where the inhabitants have provided a sufficient School House, secured the necessary salary, and with their assent agree with such Teacher. They may •uapend or displace any Teacher for incapacity, or any improper or immoral conduct, and shall forthwith transmit a copy of their proceeding! to the Superintendent for the decision of the Board. They shall immediately after ratifying the engagement of a Teach- er, and annually therfeafter, call a meeting of the Ratepayers of tho Diitnct, for the purpose of electing a School Committee to consist of mree persons, giving seren days' notice, to be posted on the School House, specifying the time, place, and object of such me^Ming. The Trustees, when convenient, shall accompany the -Inspector in the examination and inspection of the Schools in their respective Pa- rishes. '^ They shall at least once a year «5xamine all the Schools in their respective Parishes, pursuing as near as may be the mode of exami- nation adopted by the Inspector. In any Town, Village, or populous District, the Trustees may authorize such number of Schools as the wants of the population may require ; and when they deem it necessary, authorite the employment of an assistant licensed Teacher in any large School. Wherever a convenient District can be laid off so as to include a portion of two Parishes, the Trustees of the two Parishes may lay off such District, with. tho consent of a majority of the inhabitants thereof. Thip'Trustees shall apportion among the School Districts in their respective Parishes, any money raised by County or Parish assess- ment for the support and maintenance of the Schools therein, in such manner as they shall deem just and equitable. Any Parish or District adopting the principle of assessment, and the sum required for the Teacher being assessed and paid, shall for every year such assessment is so made and paid, receive from the Province Treasurer ten per cent, over the iiUowance to Schools of the same class in Parishes or Districts net so assessed, to be appor- tioned and paid the Teachers therein. COMMITTEE. 7. The inhabitants of the School District being rate-payers, shall at the nneeting called by the Trustees as aforesaid, elect by a ma- jority of votes three persons who shall constitute a School Committee for that District, and shall continue in office for one year, or until others arc elected in their stead. The School Committee shall have the immediate charge of the School House, with the furniture, apparatus, and grounds. They shall, when necessary, call meetings of the inhabitants of the District for the purpose of providing a School house» books, maps, apparatus, School furniture and fuel, and for the support of the School and the comfort of the scholars. They shall have the immediate control of any Library provided by the District, and may appoint a Librarian, Secretary, and Treasurer. The School Committee may admit so many free scholars, and also children at reduced rates, being the children of poor and indi* gent parents, as they may deem prudent and just ; and they may apply the amount so received, to tne support of the School. DUTISS AND QUALIFICATION OV TBACHBRS. 8. The Teachers, .:nale and female, shall be divided into three classes, aualified as follows :— > Male Teachers of the first class to teach spelling, reading, writing, arithmetic^ English grammar, geography, history, book>keeping, geometiry, mensuration, land>surveymg, navigation and algebra ; — of the second class, spelling, reading, writing, arithmetic, Ei\glish grammar, geography, history and book>kceping ; — of the third class, epelling, reading, writing, and arithmetic. Every Teacher of the first and second class shall be qualified and enjoined to impart to his pupils a knowledge of the geography, history, and resources of the Province of New Brunswick, and of the adjoin- ing North American Colotiies. ^ Female.Teachers of the first class to teach spelling, reading, writ- ^'ingV aHthlmeltic, English grammar, geography, history, and common needle* Work'; — of the second class, spelling, leading, writing, arith- metic, English grammar, geography, and common needle work ; — of the third class, spelling, reading, writing, arithmetic, and conmon •needle Work. Every Teacher shall keep a daily register of the scholars, which ehall be open for inspectioii at all times; a Visitor^ boek, and enter therein the visits of the Inspectors, Trustees, and School Committee respectively ; maintain proper order and discipline, and carry out the regula^ons made for his guidance. Bvery Teacher shall take diligent care, and exert his best en- deavoura to impress on the minds of the children committed to his care, the principles of Christianity, morality and justice, and a sacred regard to truth and honesty, love of their country, loyalty, humanity -and a unive/sal benevolence, sobriety, industry and frugality, chastity, nioderation and temperance, order and : cleanliness, and all other virtues which axe the ornaments of human society ; but no pupil shall be required to read or study in or from any religious book, or join in lUiy act of devotion objected to by his parents or guardians ; and the Board of £du<^tion shall, by regulation, secure to all children whose parents or guardians do not object to it, Uie reading of the Bible in Parish Schools — and the Bible, when read In Parish Schools by Eoman Catholic childiren shall, if required by their parents or guardians, be the Dou&y version, without note or comment. The Teacher shall be entitled to receive from the Treasury ac* cording to tha following rates:— if ale Teachers of the first class* thirty seven pounds ten shillings ; of the second class, thirty pounds ; ,8 of the third class, twenty two pounds ten shillings : Female Teachers of the first class, twenty seven pounds ten shillings ; of the second class, twenty two pounds ten shillings ; of the third class, seven- teen pounds ten shillings. * No Teacher shall be paid for a less period than six months with- out the sanction of the Boar J, nor in any case unless the inhabitants shall have raised by assessment, or paid for his support, an amount oqual to tho Provincial allowance, or shall have furnished him with boardj washing, and suitable accommodation during bis engagement. SVFERIOR SCHOOLS. 9. When the inhabitants of any School District shall raise by assessment or otherwise, for the support of a Superior School, the sum of fifty pounds or upwards, and shall have engaged, with the consent of the Trustees, a competent Teacher, they shall receive from the Province a sum equal to the amount so raised, not exceeding the rate of seventy five pounds per annum, to be paid to the Teacher upon the Certificate of the Inspector that the School has been taught to his satisfaction, and the payment made to the said Teacher a^ the rate of fifty pounds per annum by the inhabitants, but not more than one such School shall be allowed in one Parish. LlBRARiSS. 10. Whenever any School District shall raise a sum of money for the purpose of establishing a Library, or increasing any one already established, they shall be entitlen to receive from the Province Trea- sury, a sum equal to half the amount so raised, to be expended in the purchase of Books therefor, not to exceed five pounds in any one year. ' ASSESSMENT. 11. Whenever any County, Parish, District, or Miiuicipality, de- termine to provide for the support of the Schools therein l?y assess- ment, such assessment shal; be le'ied an(? collected in the s&me man- ner in all respects as other County or Parish rates. , . . 12. If the Council of any Municipality, determine to support ttieir Schools by assessment, they shall have power to make such bye laws as they shall deem necessary to levy and collect such assessment. 13. Every County or Municipality adopting the assessment prin- ciple, shall receive a sum equal to the amount so raised, if it shall not exceed the average of two hundred and fifty pounds to each Parish, but tho whole shall be expended in the payment of salaries of Teachers. 14. A public meeting of the rateable inhabitants of any Parish or District may be called by the Trustees, on the written application of twenty or more resident freeholders or householders in any Parish, or three or more resident freeholders or householders in any School District, by notice advertized at least fifteen days in a Newspaper publishad ui the Parish or District, if any, and in five or more of the most public places of the Parish, or two of the District, for tlie pur- pose of determining upoii the propriety of raising tb^ necessary amount of money required for School purposes by assessment ; at 9* which meeting the senior Trustee present, or in case of his absence, such person as the nr»ajorlt3' of the rate-payers present may appoint, shall presivie ; and it shall be the duty of the Chairman to take the sense of the meeting upon the question of assessment, if it is decided in the affirmative, then on the am9unt to be raised, and the object. 15. If a majority of the rate-pivyers present agree to raise a sum by assessment either for the support of the Teacher, the purchase of land whereon to erect a School House or other buildings for School purposes, the purchase or maintenance of a library, the building or repairing of any School House, the supplying the School with fuel, light, and other necessaries, the purchase of books, maps'or apparatus, for the use of any such School, or for any of such purposes, the Chairman si all transmit the vote ^r resolution specifying the sum to be raised, to the Assessors of rates for the Parish, in one of the forms following : — If the Assessment be made upon the Parish, the following shall be the Form : — To, Assessors of the Parish of You are required to levy and assess the sum of in and upon the Parish of being the amount voted at a Parish Meeting for the purpose of [here specify the object] and cause the same to be collected according to Law, and paid to the Trustees of Schools for the said Parish. Dated this day of A. D. 18 . C. D., Chairman. If the Assessment be made upon a District of the Parish, the fol- lowing shall be the Form : — To Assessors of the Parish of You are required to levy and assess the sum of pounds in and upon School District number in the Parish of being the amount voted at a meeting of the said District, for the purpose [here specify the object] and cause the same to be collected according to Law, and paid to* the School Committee for the said District. Dated this day of A. D. 18 . C. D., Chairman. 16. The Assessors shall, without delay, make out the Assessment list as near as may be in the form prescribed for County or Parish rates, and deliver the list to the Collector of rates, with a precept endorsed thereon in the form prescribed for County or Parish rates ; if the Parish have been divided into several Districts, with a District Col- lector for each, they shall furnish each Collector with a separate list, for the purpose of assessing the whole Parish ; but if only a School -. The Assessore and Collectors shall perform their duties under the same pains and penalties as in all other 3ases, a'ld receive the same fees and allowances. £• 18. Whenever a written application sho.ll be made to the Clerk o the Peace of any County not incorporated one month before the time of holding the annual election for the Town and Parish officers, signed by at leasl fifty freeholders or householders of the said County, requesting him to ascertain whether the rate-payers will adopt the principle of assessment for the support of Schools, he shall notify the Town Clerk of each Town or Parish thereof, whose duty it shall be to give notice, with the notice of the annual election of Town or Par- ish officers, that the question will be put to the vote of the rate-payers at such annual meeting, and the Chairman shall put that question to the meeting, and take the vote of those voting in the affirmative and negative, and certify the number so voting to the Clerk of the Peace, with the list of Town or Parish officers elected, and the Clerk of the Peace shall lay the return before the Sessions at their next meeting. 19. If a majority of the whole voting at such meeting have voted in the affirmative, the Sessions shall determine the amount to be raised upon the County for School purposes, and cause the same to be levied, assessed and collected, as other county rates, and paid into the County Treasury. 20. The Sessions shall apportion the money raised by assessment among the respective Parishes in such manner as they shall deem equitable, having regard to their population, and requirements. 21. The money so apportioned shall be paid to the County Trea- surer, to the credit of the respective Parishes. 22. When a County shall adopt the principle of assessment, any Parish or District therein having been previously assessed for the same year, shall not be liable to such County assessment, nor be entitled to receive any part thereof ; and when a Parish shall adopt such principle, no District in such Parish having been. previously assessed, shall bo liable for such Parish assessment, or entitled to receive any part thereof; bat such exemption shall not extend beyond the first year in which such County or Parish assessme.it shall be levied. 23. The assessment principle, when adopted, shall continue until reversed in the same manner as provided for its adoption. 24. Any District School supported by assessment shall be free to all the children residing therein. 25. A copy of the memorandum mentioned in Section 6, and of any nlan therein referred to- if any* certified by the Clork of thp Peace with whom filed, shall be evidence of the laying off of such District by the Trustees and the bounds thereof. n 26. The salary of the Teacher of ihe Training School shall not exceed two hnndred and fifty pounds per annum ; the salary of the Male Teacher of the Model School shall not exceed one hundred and twenty five pounds per annum ; and the salary of the Female Teacher shall not exceed seventy five pounds. 27. The Governor in Council shall issuo Warrants on the Province Treasury, for the payment of the several allowances and salaries provided in this Act, 28. Any Trustee or Member of the School Committee, who shall not expend the moneys received by him under any of the provisions of this Act, or who shall misapply the same, shall pav a sum not exceeding twenty pounds for each offence, which, when recovered, shall be applied for^the benefit of the Schools of the Parish or District. 29. Any Trustee who shall knowingly sign a false report ; any Teacher who shall keep a false register, or make a false entry or returns ; or any Inspector who shall make a false report, shall for each offence pay ten pounds ; when recovered it skall be paid to the Trustees of Schools for the Parish, to be applied by them for the benefit of Parish Schools. 30. Lands for sites of School Houses or other School purposes, may be conveyed to and held by the Sessions ; and in Incorporated Towns, Cities or Counties, by the Municipality. 31. Rate-payers in this Act shall mean Rate-payers upon real or personal property or income. 32. An Act made and passed in the twenty first year of the Reign of Her present Majesty Queen Victoria, intituled An Act to revive and continue Chapters 48, 49, 50, and 51, Title vii, of the Revised Statutes, " OJ Parish Schools,''* and the Act in amendment thereof, be and the same are hereby repealed. 33. This Act shall not come into operation or be in force until the fifteenth day of April in the present year of our Lord one thousand eight hundred and fifty eight The Governor in Council, under the third section, has divi- ded THE Province into the following School Districts, for the FURPOSE OF Inspection, viz : — The Counties of Victoria, Carleton, York, and Sunbury, to form a District.* , „ t t The Counties of Queen's, Charlotte, and Saint John, to form a District. The Counties of Kings, Albert, and Westmorland, to form a District. The Counties of Kent, Northumberland, Gloucester, and Restigouche, to form a District. The Governor in Council has also appointed a Chief Super- intendent, A Clerk, and four Inspectors, under the provisions OF 1st and 3rd Sections. The Provincial Board of Education has made the following Rules and Regwlations, for the promotion of the Parish School service : — I. of the chief superintendent. The first section of the Act provides that this Officer shall be Secretary to the Board of Education ; the second makes him a mem- ber of the Board ; and the fifth section fully sets forth his duties. 11. OF THE TRUSTEES. 1, The duties of the Trustees are pointed out in the 6th section, and other parts of the Act. 2. The law imperatively requires only one joint Inspection of each School by the Trustees, during the year, but the importance of local supervision, (for which no general regulations or inspection by pro- vincial officers can forma perfect substitute,) demands frequent and zealous attention to the duty. It is therefore of great importance, that each of the Trustees should consider it his duty to make casual visits to the Schools within his parish, and to accompany the Inspector, when not unavoidably prevented, by which means the Board does not doubt regularity will be better ensured, the discipline improved, the correctness of the Registers ascertained, the zealous teacher greatly encouraged, and the progress of the pupils promoted. •The districts thus appointed, will for convenience be designated "Western, Southern, Eastern, and Nothern. 18 3. In the Division of Parishes into School Districts, attention should be given to the state of the country to be divided, both as to the number of children between the ages of six and sixteen years, likely to attend the district school, and the extreme distances the children would require to walk ; and no more Schools shall be authorized in Towns and dense settlements, than will allow at least twenty paying pupils to each School, without the consent of the Board. 4. The City of Saint John has agreeably to the requisitions of the Act, been divided into two parishes for Educational purposes. One of these parishes comprises King's, Queen's, and Wellington Wards; the other Duke's, Sydney, Guy's, and Brook's Wards. 5. An assistant Teacher shall not be employed in any School where there are not at least forty paying pupils, and where the amount actually certified to be paid by the parents, is not equal to fifty pounds. 6. With respect to the remuneration to be provided by the Inha- bitants, for the services of the Teacher, endeavours should be made to secure it in the following preferential order, — 1st, in money ; 2nd, in money, board, and lodging ; and 3rd, in board and lodging. 7. The authority by the Trustees to open a School, should be made in duplicate, in the form in the schedule to these Regulations : one copy to be delivered to the Teacher, agreeably to the Law, and the other copy forthwith transmitted to the Inspector of Schools in the District. III. OF THE SCHOOL COMMITTEES. 1. The duties of the district SchoDl Committees, are set out in the 7th section of the Law ; and in proportion to the necessity and ad- vantages of local supervision, the Board would solicit their zealous fulfilment. 2. The immediate charge of the School-houses, with their furniture, apparatus, and grounds, is given to the several School Committees ; and as the comfort, and in some respects the mental elevation of the scholars are connected with the School-houses and their appurte- nances, it is necessary that every School-house should be in a state of adequate repair ; the benches should have backs, and should be sufficiently low to allow the feet of the children, when seated, to rest firtnly on the floor, or upon a platform ; and the writing desks should be adapted to the benches. T?he Board is of opinion, that it would be a legitimate object of emulation among the several school com- mittees, to have the best school-house, kept in the best state of clean- liness and repair, the most suitable school apparatus, and the most carerdly and ornamentally laid out grounds. Jf ""he law also intrusts the Libraries to the District School Com- mittees. To this branch of their duty much importance is attached by the Board ; as well as to the correctness of accounts, and the pre- servation of the records of oil receipts and payments of school and library moneys. 14 II II 4. The School Committee will necessarily, in their collective and individual capacities, frequently visit the Schools, and enquire as to the comfort of the teacher and scholars, and on these occasions their Educational attainments should not be overlooked ; but the Board presses on their attention a correct noting of the time when the ser- vices of the several teachers periodically commence and terminate. 5. The Board invites the members of the School Committee to join the Trustees at the periodical visits of the Inspectors ; requests them to cause a copy of the School Act, and ol the regulations made mereunder, together with a Visitors' Book to be kept in eac'. school ; and especially to communicate from time to time to the Board through the Chief Superintendent, or Inspectors, whatever may in their opinion be calculated to promote the educational interests of the ju- venile population. IV. OF BOOKS, MAPS, AND APPARATUS; AND THE BOOK FUND. The existing selections and arrangements," as regards the Books, Maps, and apparatus, are continued until they shall be revised after due inquiry. V. OF SCHOOL DISTRICT LIBRARIES. 1. The Law allows a Library to be established in each School district, and appropriates from the provincial treasury a sum equal to half the amouijt raised for the purpose in each district ; but not more than five pounds can be drawn from the treasury in any one year. 2. The School Committee is appointed by Law, to have the i"f>- mediate confroul of the District Library ; and is authorized to appoint a Librarian, Secretary and Treasurer. The committee is necessarily empowered to determine where the Librai7 shall be kept, and to make regulations for its preservation. 3. Catalogues of Books suitable for these Libraries will be kept in the Chief Superintendant's office, and be furnished on application to the School Committees, who shall make their selections therefrom. 4. In these Libraries no work of a licentious, vicious, or immoral tendency, and no works hostile to the Christian Religion can be ad- mitted. Neither is it compatible with the object to introduce works involving religious controversy. Subject to these exceptions and guards, as wide a selection as possible should be made of standard books of reference, and of useful and entertaining knowledge. VI. GP THE TRAINING AND MODEL SCHOOLS. The present Rules and Regulations for the Training and Model Schools will remain in force. VII. OF LICENSING TEACHERS. 1. Licenses to teach in the provincial Parish Schools horetofore issued and not cancelled under any general or special order, shall continue in force, until revised or cancelled by a general or special order of the Board. ^>*..,- 15 2. Licenses to teach will be granted by the Board as of the 1st, 2nd, or 3rd class, agreeably to the periodical classifications of the Teachers and Candidates, made by the Board, or the Reports from the Training School, to such applicants as shall have attended that establishment, been finally examined there, and received the neces- sary certificates of character and competency. 3. All licenses to teach in the Parish Schools shall be signed by the Chief Superintendent, and recorded in his office. Thoy shall be severally limited to a specified Provincial School District, and shall be transferable to another District, on the Licensee lodging with the Chief Superintendent, a renewed certificate of character from the Inspector. 4. The subject of granting 3rd class Licenses in other cases, will receive the attention of the Board. VITI. OF THE PARISH SCHOOLS. 1. There shall be two School terms in each year, — the summer term to extend from 1st of April to the 30th September ; — the winter term from 1st October to 31st March. 2. There shall be two vaoationsof two weeks each, in every year, on account of which no deduction shall be made from the Teacher's time ; to wit : one at Christmas, and one commencing on the second Monday in July. Every alternate Saturday, or half of each Saturday, and the Queen's Birthday, shall be a holiday in each School. 3. The hours of teaching each day shall not exceed six, exclusive of the time allowed at noon ; nevertheless, a less number of hours^for daily teaching, may be determined upon in any school, at the^ option of the Trustees. 4. Every Teacher shall secure to all children in the School, whoso parents or guardians do not object to it, the daily use an^ reading of the Bible in School ; and when read by Roman Catholic children, the Douay version, without note or comment, shall be used, if required by their parents or guardians. 5. A Register of the Scholars' attendance shall be kept in each school. In order to perfect it, the name of the pupils shall be called over and marked, once in the forenoon and once in the afternoon ; every evening the attendance must be correctly added up ; the ave- rage attendance shall be calculated at the end of every Term, and noted in the Register. IX. OF THE DUTIES OF TEACHERS. In addition to what is specified in the 8ih section of the Law. it shall be the Teacher's duty — 1. To use his best exertions to give effect to the Parish School Law, and the Regulations and recommendations of the Provincial Board of Education, and of the Chief Superintendent, as also of the Insspectors, Trustees, and School Committees. 2. To bo punctual in his attendance during the appointed school hours, and faithful in the preparation for, and in the execution of th« 16 duties of his office, as well as circumspect in his language and conduct. 3. To keep or see that the School House and premises are, (subject to the superior controul of the School Committee,) kept in proper order, as regards cleanliness, neatness, and ventilation ; and especially that the School House is ready for the reception of the pupils, at least thirty minutes before the time prescribed for commencing the exer- cises, in order to afford shelter in inclement weather, to those who may arrive before the appointed time. 4. At the commencement and close of each term, to examine the scholars separately, and note their progress in the several branches of instruction, to subject each pupil joining the school after the com- mencement of the term, to a similar examination, and to classify the scholars accordingly. 5. To afford full employment to each scholar during the school hours, and so vary the exercises and tasks as to sustain the attention, cultivate the intellect, and exercise the memory, and in all these res- pects the trained Teacher shall have regard to the principles illus- trated at the Training and Model Schools. 6. To exercise such school discipline as would be pursued by n judicious parent in his family ; and in this to remember that the maintenance of good order by mildness rather than by severity, and by such encouragement of the children as may gain their attachment and confidenc^e, and excite laudable emulation, must ever be regarded as the most satisfactory test of the disposition and ability of the Teacher in the moral training of his pupils. Absence from school, or lateness in attendance on the part of any scholar, must be regularly inquired into. Habits of order, industry, cleanliness, neatness, and subordination, should be cultivated. The school premises, furniture and books, must be carefully preserved from wanton abuse. 7. In cases of great depravity, likely to exercise a perniciou!^ in- fluence on other pupils, the Teacher may prohibit the attendance of the offender for a time, but he shall immediately report the circum- stances to his parents or guardians, and to the School Committee, in order that adequate means may be taken to promote reformation, or to enforce permanent expulsion from the school. 8. Every Teacher shall keep accurate school Registers in the pre- scribed form, and be prompt in forwarding the appointed Returns to the Chief Superintendent, and Inspector. He shall receive cour- teously, all official visitors, and afford them every facility for ascer- taining the state of the School and recording their opinion ; and in particular he shall appoint some day towards the close of each semi- annual term, for holding a public examination of his scholars, and shall use his best exertions to secure the attendance of the members of the School Committee, and of the parents and guardians of his pupils, as well as of those in the neighbourhood, who take an interest in school duties. 17 or X. 0? THE DUTIES OF PUPlLi. It is the duty of each pupil, — 1. To come to School clean in person and clothing. 9. To be punctual as to the time of assembling, and never to leave the school room without the teacher's leave. 3. To be respectful and obedient to the Teacher ; friendly to his school-fellows ; dilligent in the preparation of the lessons and other school exercises ; and attentive to all instruction. 4. To deliver accurately, and as soon as possible, all messages to or from his parents or guardians, and from time to time, remind them when the school fees are due, and when books, or paper, pen or ink, pencil or slate, or any other thing may be Wanted for use in the School. 5. To remember that persistent disobedience as to lessons, or behaviour, absence from school, without satisfactory excuse, or con- duct tending to corrupt other pupils, may lead to expulsion from the school, which however trifling it may appear at the time to bad boys, is in truth a very heavy penalty to themselves, because it must injure their prospects in life, and is a source of great grief to parents. XI. OF THE teacher's PROVINCIAL COMPENSATION. 1. Every teacher intending- to claim the provincial allowance for his services, shall semi-annually, as near as may be antecedently to the 30th September, and the 31st of March, in each year, or other ^mi-annual period of his engagement, produce in duplicate to the Trustees of Schools in the Parish, a Return including the School Register, and other information required by the Board of Education, or the Chief Superintendent, (of which forma will be furnished,) and shall obtain the signatures of the whole, or some two of the said Trustees, to the following certificate, to be endorsed on, or otherwise connected with the said Return, and forthwith transmit one copy to the Chief Superintendent of Schools, and the duplicate to the In- specter of the District : — " The undersigned do hereby certify that in District No. {or called) , a School House has been erected {or premises have been engaged) for the purpose of a School House ; that A. B., a Licensed Teacher of the class, and who has been duly ap- pointed to teach in the said District,|has taught therein from the day of to the day of instant, {or last,) to our satisfaction ; and that there has been bona fide paid to him, the same having been raised by Subscription {or Assessment as the case may be,) the sum of for his services during the same period, {or Board and Lodging have been furnished to the said Teacher, [adding— together with the sum or value of ij any,] towards the support of the said School during the said period.) The Cliief Superintendent uhall frame and certify schedules, arranged ns to Counties and Parishes, of the claims so perfected, and which are confirmed by the Inspectors, specifying the Teacher's name, sex, and class, period of service, and amount cluimod ; and shall forthwith, as soon as may be, after 30th September, and Slst March, in each year, transmit the same to the Provincial Secretary, with the view to the preparation of the Warrants on the Treasury, for the payment of tho several Teachers. XII. OP SUrKUIOR SCHOOLS. 1. No School shall be deemed a Superior School which is not kept in a School House large enough to allow in the principal school room, not less than 150 cubic teet of air for each pupil ; fully sup- plied with all necessary appurtenances; and in which there are not cempetcnt pupils studying some branch of Mathematics, other than Arithmetic, in addition to the more ordinary branches taught by first class Teachers, together with any other branches which the Trustees may deem necessary. And no Teacher shall be eligible to take charge of a Superior School who does not hold a first class License, or who has not received the approval of the Provincial Board of Education, on the certificate of the Inspector of his District after examination, that he is fully qualified to teach all the branches re- quired by Law to be taught by a first class Teacher. 2. To entitle himself to the allowance provided for a superior School, the Teacher shall maJcc up and transmit to the Chief Super- intendent and the District Inspector, returns similar to those required from the Teachers of the ordinary Parish Schools, and must receive from the Trustees of the Parish in which the School is kept and tho Inspector, a certificate in the following form, and forward the same to the Chief Superintendent of Schools, to be certified by him to the Pro- vincial Secretary, with a view to the compensation of the Teacher : « We hereby certify, That A. B. has been duly sanctioned as the Teacher of a superior School, under the Act 21 V., C. ix ; that he has taught the said School, in District No. , to our satisfaction ; and that the sum of pounds has been raised by subscription, (or has been assessed and collected.) and paid in cash to the said Teacher. [Parish and Date.] "C. Trustees. "G. H., Inspector for the Dislrict.^^ XIII. OF THE INSPECTORS. It shall be the duty of the Inspectors : — 1. To give their undivided attention to the promotion of the pub- lic and individual advantages, which are inseparably connected with sound education. 19 5» 2. To use their best exertions to give efFect to the Parish School Act, and the Regulations made by and under the authority of the Provincial Board of Education. 3. To visit each School in their Districts, at least twice in each year, thvW. is, once between the 1st April and 30th September, and once between the 1st October and 3l3t March, as near as may be, at the most distant intervals ; mid at these visits, (adopting the course of examination agreed on at their recent convention) to enquire us to, and note the qualications and standing of the Touchers, the number and progress of the Pupils, the discipline, system, and effect of Instruction imparted, the state of the ichool Registers, supply of Books, Maps, and Apparatus, the condition of the School Houses, their fitness, furniture, and external conveniences, and such othe r points as may be necessary to the complete filling up of the pre scribed statistical and other educational returns. 4. To make careful enquiry, and collect such statistical and other information as may bo freely communicated to them, in regard to all private Schools and other establishments under the rank of Gram- mar Schools, which receive pecuniary aid from the provincial chest. 5. To advise the Teachers in all that may tend to promote their efficiency, and the character and usefulness of their Schools. 6. To assist and advise the Trustees and School Committees, whenever opportunity may occur, and encourage them to the full discharge of the duties confided to them; and especially to notify them of their visits, in order that these officers may, when practica- cable, be present at the visitation of the Schools. 7. To give full attention to the establishment and efficiency of superior Schools. 8. To deliver in the most populous Districts, once a year if possi- ble, a public Lecture on the objects and principles of practical Edu- cation, and to animate Parents, Guardians, Trustees, and Teachers, to improve the character of the common Schools, and secure the universal and sound education of the young, and as a means to pro- mote the establishment of District School Libraries. 9. To meet and confer with the chief superintendent, at such times and places as he may appoint, when making an official visit, and to impart to him such locol and other information respecting the schools, the teachers, and the pupils, as he may require and they may possess. 10. To fill up the appropriate blanks in the several returns for- warded to them by the teachers ; in particular with the number of scholars present on the day of inspection, and any special matter touching thc^statc of the school, and qualification and standing of the teachers. To make a semi-annual abstract in such form as may be prescribed, of the information collected, and as soon after 1st October and 1st April, as may be practicable, transmit the same together with the teacher's returns connected therewith, to the Chief Superin- tendent, notingthe schools for keeping which teachers claim compen- sation, but which gere not inspected for causa to be shown. 20 11. To prepare and transmit to the Chief Superintendent, on or before the Ut day of December in each year, an annual return of all the provmcial school statistics collected during the year, and a report on the general character of the schools in their respective districts, the means of increasing their usefulness, and such other points as may suggest themselves, or to which their attention may be specially drawn by the Chief Supcintendent. XIV. OF SCHOOL HOUSES. 1. The Law gives the Board of Education power " to make Rules and Regulations for the construction and ventilation of school houses, and the furniture and apparatus to be provided and used therein." 2. The Board cannot do more at present than call the attention of all parties to this subject. The importance of having School houses constructed on the very best principles, will bo universally admitted. 3. It is desirable that many of the buildings now used for this pur- pose should be immediately improved, both in their external av)pear- ance, and in their internal arrangements. As respects -cny new erection, the laws of health, as well as the convenience of the greatest number, should be consulted in selecting the site ; the school-house should be large enough to accommodate as many scholars as may be expected to attend, the ceiling should be at least twelve feet high, and means should be provided to have it properly lighted and venti- lated. There should also be sufficient out-buildings and a play- ground, and whenever it is practicable, land enough should be secured for a garden and Teacher's residence. This last remark is especially applicable to the establishment of a Superior School in any district. The Board would particularly press on the attention of the Trustees, the importance of all School Houses, and the land on which they are erected, being made public property. 4. The Chief Superintendent shall keep in his Office, ready tor immediate reference, the plans of school -house grounds, school houses, and descriptions of furniture, recently published in Canada, Nova Scotia, and the United States, and shall exert his best endea- vours to aid the school committees in making selections and arrange- ments, ptoportioned to the money to be expended.
