OPINIONS. *• The preface to this work is very modestly conceived by the aathor, who is widely known in this country as an authority on railway law. But even a cursory glance at the work discovers that the subject has been dealt with in a manner which displays a know- ledge and grasp of the principles contained in the Railway Act, and of the railway law of this country, only to be obtained by one long familiar with the matter. A commentary on the railway Iftw of a country, at all times difficult and ardurous, is rendered doubly so in h. „f tl.o l.,sl est u o ^„^,, bonchw.1 b ^^ ^^^^^ j mBmmm liftbiliiy of tne » ) \ ^i C. The autlior has a"oidod the mistake of mixing the references with the text. " It is, in fact, a digest of the decisions of the Privy Council, pre- faced by a sketch of its history, a statement of the constitution and jurisdiction of the tribunal, and a summary of the procedure before it.^ The value of the digest may be estimated from the heading " Appeal," in which, under thirty-two heads, th<- -"ules laid down in successive oases are arranged and shortly statec, fith occasional extracts from judgments laying down the principles. The work seems to be inva- luable to practitioners in the Supreme Colonial Court of Appeal, and on several points, such as the right to extension of patents, will be of use to the general pr&ctitionev."— The Solicitor's Jonrnai and Reporter, London, Eng. " The author of this most excellent work has conferred a real boon upon the profession by G^iving them, in this handsome volume of 934 pages, the result of the decisions of the " first tribunal of the world." We hope that the bar will, by its hearty support, enable Mr. Beau- champ, in some measure, to reap the fruits of his labours. Such a work has long been needed and expected, and, after a critical exami- nation, it appears to us to fill every requirement. It is called a digest, but is really more than that in many instances, as tho judgments of the Court are not seldom given in exteiuo. The arrangement of the aubJGCt and classification throughout, we have found to answer every test we have subjected them to. Nothing more can be said in praise of a digest and book of a reference such as this is. The notes on the constitution of the Privy Council are good, and the summary of pro- cedure, with useful instructions, tariffs of fees, and forms, is eminently practical. Appendix A treats of the British Colonies and of the nature of their civil law, and condenses a great-deal of information in tabular form. The book is handsomely got up, good paper and clear type ; the bhiding is specially neat and tasteful. In conclusion we can only say that this work should, and doubtless will, at once, take the high place in the legal library that it is justly entitled to." — Western Law Times, Winnipeg. In order to complete fch ork, Mr. J. J. Beauchanip, B. C. L., Q.C., Revising Officer, and tu^bor of "The Jurisprudence of the Privy Council," undertook the publication of a complete index. It is an admirable work ; it contains all the decisions mentioned in the Revue Legale. Besides a statement of the case and the judgment, it men- tions the authorities which were cited, the names of the judges and the courts, whether judgment was confirmed, reversed or modified, and, moreover, the date of the judgment, the names of the parties and the page of the Revue Legale, at which the case is reported at length, There is also an index of reported cases. This work will be useful to all who desire to study the jurisjirudence of our courts, even though they do not possess the Revue Legale ; for it is complete in itself, and it contains not only the decisions which have been cited at length in the latter, but also a great deal of the jurisprudence con- tained in other judicial reports of the Province, a short synopsis of which was published periodically in the Revue Legale. Over 4,0()0 cases are reported. "—JfemW, Montreal. BEDABD, Code Municipal de la Province de Qu6bec annot^. The arrangement is perfect,'the index being alphabetically arranged, the subjects being arranged chronologically and a numerical arrangement follows the chronological in references to the Civil and Municipal codes. C. St-Pierre, Q.G., Montreal Bar. " The work comprises over a thousand pages in all, and, while containing a vast amount of information, is yet in a convenient form forthe practitioner's library. The introduction contains a notice of the sources of our Criminal Code, and has the salient remarks of English judges who were members of the Royal Commission which, Drew up the English Draft Code. It notices also the new offences which the new code has constituted, such as breach of trust, con- spiracy to bring a false accusation, sending false telegrams, spreading false news, etc. , , . mi. i The arrangement of the book is clear and perspicuous, ihe remarks and notes being in smaller type than the sections of the code, each of which is prefaced by a heading in heavy black type. The illustrations are numerous and most informative. The attention given to the crime of murder, with all its numerous legal accompaniments, such as circums- tantial evidence, is prominent, while the annotations on the offence of bigamy are particularly full and throw much light on an offence which has hitherto received slight illustration. Libel, as a criminal offense, is very completely dealt with, both in effect and procedure. The new legislation on theft and embezzlement receives copious eluci- dation, and no spaco is wasted by any immaterial discussion or any reference bo the advisability of any section. Forgery is another crime claiming a large share of the author's information. The appendixes are many and are of the greatest use, giving a distinguishing value to the work. The Acts and clauses of Acts not affected by the code are given in detail. The debates in the House of Commons, including Sir John Thompson's deliverance in moving the second reading of the bill throw much light on the raison d'etre of various clauses, while the collection of the Extradition Acts and the Extradition Treaty with the United States brings into convenient com^mss enactments which have hitherto been scattered and inconvenient for ready use. —Mail and Empire, Toronto. " The handsome volume which Mr. Crankshaw has prepared upon the Criminal Code deserves high recognition for the uniform skill and conciseness with which it treats that important division of our law. To produce a work which, in completeness and facility for ready reference, is suited to the requirements of the judge and the practising barrister, and is equally well adapted, by brevity and clearness, for the use of the student is an ac aievement of which any legal writer might be justly proud. It is only common justice to concede this praise to Mr. Crankshaw, and to congratulate him upon the distinctioa which it confers upon the Bar and the University to which he belongs."— McGfiZi Fortnightly, Montreal. it iTHe ^nrk which forms a volume of over a thousand pages, has alreadyreceived the commendation of the chief justices of both Queen's 14 CANADIAN LAW BOOKS PUBLISHED BY Bench and the Superior Court, and several of the other judges, a» well as the leading members of the Bar. " In this work, after a short introductory account of the origin of the office of Justices of the Peace, and their mode of appointment, powers, duties and responsibilities, the learned author deals with the parties to crimes, the extent of the law as to time, persons and place, the prosecution of criminals, in which is included the question of jurisdiction, summary proceedings, etc., and devotes very usefully a large space to the analytical index, which in fact is a compressed digest of the code with useful citations of cases on the varions fran- chises. The work, while necessarily concise in its matter, is in reality very full in its treatment of the whole subject, and is the most com- plete work of its kind yet published in Canada."— Canatiian Law Time, Toronto, March 1895. The author has already made a continental reputation in the field of legal literature, and is regarded in the profession as a leading authority on criminal law." — Spectator, Hamilton. " Although chiefly based on the Canadian code it gives so much general information of importance to magistrates in a condensed form that it is probably the best book that can be purchased by one need- ing a Justice's manual. The tables of offences, their punishments, before whom they may be tried, and periods of limitations, with references to sections of the code bearing on them in the book, alone are "a practical guide to magistrates." " Mr. Lemieux has successfully treated the ditticult subject selected ♦>y him. The author first gives an historical review of the question. 'In this review he treats the subject very thoroughly. He begins by sketching the legislation of Fersia, of China, of Egypt, of Greece, and ven of the Jewish people, followed by a notice of Roman legislation under paganism as well as under Christianity. Then, after a rapid review of the various systems of the Middle Ages, ho brings the reader gradually down to the modern system of law, and closes his exami- nation of the question by setting forth the various jihases of our •Canadian legislation. In the second part of his work Mr. Leini<3UX examines the cases in which contrainte par corps, or coercive empri- I «onment, is authorized by law. In the third ])art he indicates the mode of execution. The two latter parts of the work form an excel- lent commentary of the second title of the Code of Procedure. This is the practical part of the work, the reader finds therein the solution of the difficulties which present themselves. The jurisprudence on the subject is accurately stated, and when it seems to go astray the author lays down the principle which he conceives should govern." — The Gazette, Montreal. New and very important Peaturei? to which we specially call the attention of the public is, that contrary to all other codes published so far, this edition contains a concordance or references of the different articles to the same code, or, with the Code of Civil Procedure and the Code Napoleon, to be found at the foot of each article, will prove, it is hope, of special advantages and considerable value. The index which comr^lete the Code, is alphabetical and analy- tical and is very complete. Dr. WEIR'S, Code of Civil Procedure of the Province of Quebec. Promulgated 1st September 1897, with statutory amendments verified, collated, containing a concor- dance of the different articles to the same code, and the authorities as reported by the Commissioners, also in appendix the Report of the Commissioners, the Rules of Practices, the Tariff of fees, and a general index. This work is to supply the lack of an accurate and convenient work- ing Code of Procedure. In general appearance and arrangement it will be found to resemble the author's edition of the Civil Code, so cordially received by the Ba-' The text is clearly printed in double columns without commentary. After each article is placed in brack- ets ( ) the corresponding article in the former Code, and the remain- ing references are confined to all the relevant articles in the Code, of Procedure itself, and those in the Civil Code. The practical advantages of a concordance of this kind will be at once apparent. The Report of the Commissioners is placed in the appendix, where it properly belong. The Rules of Practice, the Taviff, and a copious index are also features of the work.
