An Order in Council of February 8, l»n (publisbed by this Department as Uiroular G. »47) defines 'le terms Wine, Beer, Whisky, Rum, Gin, etc., and the definitions given are consititant with the ordinary use of theee terms. Recoit legis- lation in several provinces of Canada has restricted or forbidden the sale of alcoholic liquom of the kinds referred to; and interested' parties have, in some instances, placed "n the market would-be substitutes for these, and have not hesitated to adopt the t*rm8 wine^ beer, rum, etc., in describing audi substitutes. In oonsequeaoe of such action, complaint has been made by purveyors of alcoliolio liquors, and also by purchasers, who have been duped into buying wine which is not wine; whisky, which is not whisky, etc. Under the Order in Oouneil above referred to, Wkiaky, Brandy and Rum are required to contain not leas than 43.76 per cent fvolvmM) of absolute alcohol, equivalent to 75 per cent by volume of proof spirit. Wn must contain not less than 37 p«»r cent of absolute alcohol, equivalent to 66 per cnstitu«it of Wine; aw) actual wines show amounts varying from about . . J p«r cent of proof spirit. Three (3) samples arc sold aa brandy which fail to meet tliem^ rei)uirements. Porter.— U required to possess a spirit Htrencth of at least fl per cent. Two (8) siti)|iles sold as porter contain less than 2 jwr <'<>nt. One sample sold hs WhUley. one as hmn, mid one as Lager Heer, fail to meet Maiidard requireroente for these beverages. Doubtless these articles are manufactured and M.ld with intent to meet the niiuirements of provincial temperance legislation. They must, however, be compelled to bear properly descriptive names; otherwise they are adulterated under section 3 t./i of the Act. .\11 of these sample* are technically adultcrpted. Whether or not it will be well to indict penalty in theee cases, I leave you to decide. I have expressed the opinion that th.y are not what they claim to be; and the above-quoted section of the Adulteration Act applies. I would respectfully draw your attention to the fact, which becomes more and mor.« . \ ileiit as my correspondence increases, that in the majority of cases the manufacturers iir.' meeting exceptional conditif.ns to the best of their ability, and without any inten- ti..n of violating the provisions of the Act. Recent provincial temperance legislation has interfered with the legitimate busi- II.— < in alcoholic beverages, and it is not a matter of surjirise that manufacturers should iitii'inpt to meet existing conditions.
