Provisionally adopted the 18th day of > WHEnEAS Oeorfte Kittlewell, owner of the southerly part of lot number one, in the 7th concession of the township of Caradoc, farmer, has complained to the council of the township of Ekfrid, :ind hP3 also claimed damages for the non-repair of Government Drain No. 1 and its iiisufliclent apacity '.o carry off the water brought into it by the municipal corporatior.H f the townships of Elcfrid and Cara'loc, and lias requested said drain to be elhciently repiiired ; And whereas John Dillon, owner of north half of lot number one, in the 3rd concession of the township of Caradoc, farmer, and other interested parties have also complained of the non-repair of s^id drain and have urged the neces- isity of VA repair ; 1 And whereas, thereupon, the said council of the township of Ekfrid has Ji'roc.ared an examination to be made by Jiimes Robertson, being a person rcompefpirt for such purpjse, of the s oads and lots or parts o* lots hereinafter In that behalf specially set forth and described, and the assessment upon the lands and roads in the township orCaradoc and in the township of Metcalfe being that herein- after set iorth in the report of the said James Ro'oertson a£ their contributions 'tn'TlSpact of said improvement, such report being as follows : To the Municipal Council of the Township of Ekfrid: Gkntlbjies,— Having been appointed by your honorable body to examine end report upon Government Drain No. 1 (which extends through parts of the townships of Ekfrid, Caradoc and Metcalfe, and along part of the townline be- tween said townships of Ekfrid an ' Caradoc) w^h a view to hav'nc the same recaired, so as to prevent damage to adjacent lands, and to specify such change ~ in course, or new outlet, improvement, extension or alteration, as may seem proper for the purposes thereof, aud to make such plans, specifications, esti- mates and assessments; for the work which I may propose, as is requirai and authorized by statute : I beg to submit this mj- report. I have made an examination of said drainage work, and have prepared plans, specifications and estimates for the work of repair and improvement •which I propose to have carried out, and have made an assessment upon the lands ana roads liable to assessment under "The Drainage Act, 1891" for the expense thereof. The said Government Drain has its head on the west side of the townline between the townships of Caradoc and Ekfrid at a point 67 rods southerly from the front of the north half of concession 2 of the township of Ekfrid. From this point its course is northwescerly along the west side of said town- line for a distance of 244 rods; thence it crosses the townline and runs through parts of lots 1 in the 4th and 5th concessions of the township of Caradoc, a distance of 134 rods ; thence recrosoing the townline and entering and extend- "ng through lots 1 and 2 in the 4th and 5th concessions of the township of ^^^^jCWrid, aSiftaru-fl nf fiTji rods; thence recrossing info Caradoc and continuing again the westerly townline of Caradoc, but now into the township of Met- calfe, and continuing through concessions 14, 13, and having its outlet on the west half of the south half of lot 3, in tue 12th concession of the township of Metcalfe, a distance of about fil6 rods in Metcalfe. The course of the ditch in Metcalfe is along a natural creek channel, which lias been straightened to a considerable extent, and the outlet is the same creek channel unimproved. That part of the ditch along the Caradoc and Ekfrid townline and for a distance of ill rods into Caradoc where it meets the Caradoc branch is bt.dly out of repair. From this point to about the centre of concession 4 of the township of Ekfrid the ditch is not so bad, being of almost sufficient capacity, but the sides and bottom are in places somewhat irregular. From about this point to where the ditch crosses into Metcal/e it gradually becomes contracted and in places the sides more irregular, so that it is totally insulhcient to carry the ever-increasing volume of water received from its tributaries. JusVbefore entering Metcalfe opposite the north half of lot 1, concession It of the township of Metcalfe, thecoiir.ieof the ditch is almost directly north- ward along the townline, and hare it encounters another ditch of much larger proportions from the township of Caradoc, coming in exactly the opposite direction, or southerly along the townline, with the result that the flow of water is greatly impeded, and this aids in the cause of overflow in this locality. In the township of Metcalfe the ditch is pretty generally uniform and in fair condition, except that it has become filled in to some extent in places, and jams of driftwood have been allowed to accumulate. This part is also, how- ever, totally insufficient to carry the water brought to it. The natural creek channel below where the present ditch leaves off is also of insufficient capacity aud does not form a sufficient outlet for the water of the ditch above. Over the course of the drain and extending to Bear Creek on the west half of lot 12, in the 4th concession, I have planted numbered stakes 8 rods apart, station number being at the head as afore described. I would recommend that the whole course of the drain, except from stake 24? to 26, passing under and adjoining the Canadian Pacific Railway, a dist- ance ot about 11 rods, be repaired and improved ; that an additional outlet be made for that part of the drain on the townline which lies south of the Can- adian Pacific Railway from stake 243. said outlet to run easterly south of the Canadian Pacific Railway lands a distance of .'jO rods to the Caradoc Branch of Government Drain whicli Tosses the railroad at this point, and to continue this work in the branch till we again unite with the original main drain at •stake 35, a distance of 90 rods; and that the waters coming into it as men- tioned on the west side of the townline opposite the north half of lot I in the nth concecsinn of Metc^Jfe bncut off and diverted so n.s to enter at stake 162 in a manner that will not so seriously impede the How of water; and also that 'the drain be extended to Bear Creek, a distance of about t or pait of Lot. The water does now, and will after tlio proposed work shall ' nttvetieen completed, overflow and cover adjacent lands in Metcalfe, and some of the pastures will be injureil temporarily by the earth thrown out ar'^. other inconveniences arise from the work os planned and specified, yet lands frequ- ently are improved for pastnrage or otherwise by drainage which will in J ordinary seasons make them more useful in summer months, although in 1 spring freshets, or after heavy rains, they may bo from time to time flooded, f and although injuries or inconvenience may arise in consequence of the con- ,' struction or operation of the drainage work, I have taken these matters into ( consideration in making the assessments and have not assessed any land un- j less in my opinion it will be made on the whole more useful and valuable and j consequently benefitted, and I have charged only for the net benefit to be de- rived ; and where in my opinion the injury or disadvantage will about equal J the advantages from the proposed work as laid out and specified I have made ^jo assessment ; and in no case will the proposed work or consequences from it depreciate the laud. I therefore do not allow anything to any of the parties owning lands adjacent to'lhe drain as damages occasior/ed by the disposal of ■the earth as specified. The profile accompanying this report shows the depths and other dimeft- aious of the work I recommend to be carried out. That part of the drain along the townlme and to stake 3.'> where it joins the Caradoc branch will be about ^ feet bolow the surface of the adjoining land, with a bottom 3 feet wide. iVom stake So to 8.')4 where Government Drain No. 1 branch from Ekfrid enters, the average depth will be about GJ fuet, and the bottom 8 feet wide. From 85J to 112 where the Kirtlewell Drain from Ekfrid and Metcalfe enters, the average depth will be about 6i feet, and bottom 10 feet wide. From 112 to Vii where the Inrge ditch from Caradoc joins, the average depth is about 7 feet, and the bottom width 12 feet. From 162 to 3182 at Bear Creek the bottom will be 20 feet wide and the average depth about 7 feet to stake 240, thence gradually decreasing to about i feet at SlBg. The additional outlet from stake 24B will be about ;! feet 3 inches deep and 3 feet wide in the bottom. The divei ted part of the ditch entering opposite con. 14, Metcalfe, shall be G feet deep and nave a bottom 10 feet wide. The si^e slopes througluiut shall he onaioot vertical to one foot horizontal, and tUe bctoin Uniterm, bo tuBrttie watef will nor stAna aobgn.ict thcrrrtn. --' The material taken from the drainage work shall be disposed of as fol- lows:— The earth taken from that part of the drain along the townline shall, Avhere it is of a mucky nature, all be cast to the west side, but where_it is aandy it shall all be cast to the east side and snread evenly at least 15 feet wide on the road grade. Through the lands and where tlie present channel is ■followed the earth shall be oast as nearly as possible equally on both sides, except where a fence or steep bank above the edge of the ditch is along one side, then upon the opposite side. Where the old channel is left for the pur- pose of straightening, all the earth shall be cast on that side on which the old channel is, and where the old channel is not further away than 6 rods from the new one the earth removed shall be deposited in said old channel, or at least so much of it as is required to fill it, and the remainder disposed of about equally on both sides. The earth from the drain shall not at any place be left closer than 4 feet to the edge thereof, and where the old or existing draiu is ^^uler than the new work, then 4 feet from the edge of the old. No excavated inaterial sliall be cast or left in the sides of the old drain, or into any lateral drain or channel l)y which water enters the main drain. The side slopes of the spoil bank shall not be steeper than 2 feet horizontal to 1 foot vertical on that side next the ditch, and next lateral drains or channels. All stumps, roots, logs, willows and other obstructions shall be cut and ren>oved from the body of the drain and from a width of 2 rods on each side (except standing timber further away than 5 feet from the edge) and shall be either burnt or removed so as not to find its way back into the channel at times of freshets. A suitable culvert shall be constructed across the travelled portion of the to'.cnline between Ekfrid and Caradoc at stake 24;j, said culvert to be at le.ist 20 feet long, 6 feet clear inside and with the surface of the cover on a level with the grade of the road at the place, for which an allowance is made in the estimates. The bridge which affords access from the east part of the south half of lot 1, concession ;i, in the township of Ekfrid, to the travelled portion of the town- line shall be enlarged to suit the ditch, and an allowance for this is also made in the estimates. The farm bridge in the lane on the west half of the south half of lot 1, in the Tith concession of the township of Ekfrid, shall be enlarged by the owner to at least 22 feet clear inside, and the bottom of ary chords, stringers or other timbers used in the construction of said brldee and crossing the ditch shall not be lower than the surface of the ground at the place, and I have fixed the v.ilue of the enlargement thtreof to be paid to the owner entitled thereto as Mhewn in the estimates. ■ The plan shows the location of the drainage work by the red line. The blue lines represent ditches or channels leading to the main ditch. The black dottel and green line shows very approximately the limit of the territory draning through this work.
