The minutes of yesterday were read. The Warden addressed the Council on the subject ot* candidates for teachers in the Normal School. The matter was referred to a committee of the whole to-morrow. The following communications were read by the Clerk : From the Provincial Superintendent of Education. Referred to the School committee. From the clerk of the Peace. Referred to the Finance committee. From the Registrar of the County of Northumberland. Referred to a committee of the whole to-morrow. Mr. Jones presented a petition from Edward Follis and twenty-nine others for a grant of money for a road. Re- ferred to the Road committee. Moved by Mr. Simpson, seconded by Mr. Morrow, That it is the opinion of this Council that the most important part of the duties of the District Superintendent of com- mon Schools is to make periodical visits to the Schools, and to superintend the method of carrying on the details therein, and that the Council will require the Superin- tendent to visit all the Schools under his charge with the least possible delay. Carried. The Council went into a committee of the whole on the second reading of the By-Law to levy assessment on the District for common Schools for the present year, Mr. (Jreighton in the chair. The committee rose and reported the same with some amendments, which was confirmed. Ordered to be read a third time to-morrow. On motion of Mr. Simpson, seconded by Mr. Grover, That as several gross errors had been made by the (Jlerk of the Peace in carrying out the School assessment for 11 rk lOV the present year, the District Clerk do forthwith address a letter to the clerk of the Peace pointing out the said mis- takes, and stating that as a serious loss will be incurred by the District thereby, the Council cannot sanction any per centage for makinj^ out the said assessment. Carried. Mr. Simpson obtained leave to bring in a By-Law for limiting the amoimt of fees to Township collectors. The same was read and received. Resolved that standing rule No. 33, be dispensed with on the present occasion, and that the By-Law be read a second time forthwith. The Council accordingly resolved itself into a com- mittee of the v'hole thereon, Mr. Jones in the chair. The Council resumed. The chairman reported pro- ceedings, which were adopted, and ordered to be read a third time to-morrow. Mr. Ewiug obtained leave to bring in a By-law for the a]>pointment of a collector of Rates for the Township of Haldimand. The same was read and received. Moved by Mr. Simpson, seconded by Mr. Morrow, that standing rule No. 33, be dispensed with durhig the re- mainder of the session. Carried. The Council in a committee of the whole on the second reading of the By-Law, Mr. Graham in the chair. The connnittee rose and reported, report adopted, and ordered to be read a third time to-morrow. Moved by Mr. Munro, seconded by Mr. .Jacobs, that the District Clerk do notify the Collector for the Township of (Jlarke not to collect any taxes for building a School House in School Section No. 12 in said Township, nor from persons living on the North half of lots 32, 33, 34 and 35, in the 5th concession, nor on lots 31, 32, 33, 34 and 35, in the 0th concession, and 35 in the 7th conces- sion, said lots being attached to School section No. 19, in the Township of Darlington, previous to the assessment of School section No. 12. Carried. Mr. Munro gives notice that he will to-morrow bring in a By-iiaw to confirm certain new lines of roads m the several Townships of this District, also a By-Law to compensate persons for new lines of roads. Mr. Boucher gives notice that he will to-morrow bring 12 in a By-Law authorizing Township Clerks to form School sections in their Townghips where new sections are re- quired, and to report the same to the District Clerk ac- companied with a map of the Township with the sec- tions marked thereon. Mr. Creighton, seconded by Mr. Morrow, moves that the Warden do write to the President of the Board of Po- lice of the Town of- ("obourg, iuid inform him that the sum of eighty pounds was in llu; month of January last due to the Treasurer of the District by the said Town of Cijbourg, in conformity to 9, Vit. cli. 71, see. 3, and to re- quest the said sum be now paid. The Council resolved itself into a committee of the whole on the subject of candidates as students in the Normal School in Toronto, Mr. Morrow in the chair. The Council went into a committee of the whole on the comnmnication from the Registrar of the County of Northumberland relative to the erection of a Registry of- fice in Cobourg, Mr, PJiillips in the chair. The Council resumed. The chairman reported proceed- ings, which were adopted. The Council again in a committee of the whole on the second reading of the By-Law for taking the census of the District, and for the appointment of enumerators, Mr. Ewing in the chair. The committee rose. The chairman reported the By-Law with some amendments, which were adopted and ordered to be read a third time presently. The Council adjourned for one hour. At 3 o'clock the Council resumed. The By-Law to raise a certain sum of money for com- mon School purposes for the current year was read a third time, passed and signed by the Warden. The By-Law for limiting the amount of fees to be paid to Township Collectors was brought up to be read a third time and was lost. The By-Law providing for the appointment of a Col- lector of rates for ilm Township of Haldimand was read •a third time., passed and signed by the Warden. 14 Mr. Munro obtained leave to bring in a By-Law estab- lishing and confirming certain new lines of roads, and for roads altered and diverted. The same was read a first time, and ordered to be read a second time presently. The By-Law to alter and amend By-Law No. 83, for assessing the inhabitants of Darlington to pay for the erection of a Town Hall was read a third time, passed, and signed by the Warden. Moved by Mr. Simpson, seconded by Mr. Morrow, that the thanks of the Council are due to H. S. Reid Esqr., War- den of this District, for the great labor and pains taken by him in drawing up " Abstract of By-Laws and Acts of Parliament for the use of District officers," and that the abstracts bo received, and 600 copies printed for the use of District officers, and 25 copies furnished by the District Clerk to each member of the Council for distnbution. Carried. ,, nr On motion of Mr. Simpson, seconded by Mr. Morrow, That the District Clerk do advertise in the Cohourg Star and Port Hope Advertiser for tenders for printing, stitch- ing, and cutting the By-Laws and minutes of the present session of the Council, and also for printing, stitching and cutting of '* abstracts of By-Laws and acts of Parliament to be published for the use of District officers" as well as any other printing required, the tenders to be delivered to the Clerk of the Council on'or before the 20th inst. When the tenders are received, that the said Cleric do send them to the Warden, who will select the tender which he may think it proper to accept, the printing to be performed on or before the 25th December. Moved by Mr. Ewing, seconded by Mr. Moore, that the Warden direct the Clerk of the District to notify the Clerk of the Peace, that John Arkland is appointed Collector by the municipal Council for the Township of Haldimand, for the year 1847. Carried. , The Council resolved itself into a Committee of the whole on the second reading of a By-Law to impose a tax on persons keeping dogs within the District of Newcastle, Mr. Armstrong in the chair. Mr. Phillips obtained leave to bring in a By-Law to alter the period heretofore fixed for the ordinary half- yearly meetings of the Council, received, and read a first time, and ordered to be read a second time to-morrow. The Council went into a committee of the whole on the By-Law limiting the fees to coUetors, Mr. Swain in the chair. The committee rose and reported, report received and adopted. The By-Law was then read a third time, passed and signed by the Warden. Mr. Munro brought in the report of the standing com- mittee on roads and bridges. With regard to the claim of Wm. Youall for an abatr- ment ot his taxes, no amount bemg specified, your com- mittee can.iot entertain the petition. Your committee beg further to remark that the Treas- urer has in his last two accounts, from October, 1846, to October, 1847, charged a percentage on the sum of about Jti480 for Assessors' and Collectors' fees, &,c., which your committee conceive to be directly contrary to the spirit of the By-Law regulating the Treasurer's fees, and are of the opinion that the Treasurer should place the per centago on the above sum, when revised by the Clerk, to the credit of the District ; and further, that in future all sums refunded by the Government for the administration of criminal justice, should be paid into the Bank like other monies, without any deduction for per centage by the IVeasurer, this sum being merely a refunding of monies on which the Treasurer has already received his per centage. The Standing Committee on Schools, beg to report to the Warden and Council the following matters laid before them : 1. The Committee have considered the Petitimi of Hart Massey and Charles Butler, Trustees for School Sec- tion No. 7, in the Toumship of Haldimand, praying for an assessment of twenty-eight pounds^ for erecting a School House. The committee have heard the evidence of the parties for and against the same, and recommend that the prayer of the petitioners be granted. 2. The Petition from James Craig and others^ referred from last session, to have the school house now stand- ing in school section No. 7 in the Township of Haldi- mand remain as the school house for said section, The committee recommend should not be complied with, and that the Deed for the site thereof be returned to the parties who handed the same to the Council. 3. The Petition of the inhabitants of the gores of Hamr ilton and Cava?i, praying that lots 31, 32, 33, 34 and 35 in the 10th Concession, and lots 33, 34 and 35 in the 9th Concession of the gore of Hamilton, and lots 22 and 23 in the 2d Concession of the township of Cavan, may be added to Section No. 1, in South Monaghan. The committee recommend that the prayer of the petitioners for annexing lots 22 and 23, in the Township of Cavan, to Section No. 1, in South Monaghan, be not complied with, and that lots 31, 32, 33, 34 and 35, in the 10th Concession, and lots 33, 34 and 35, in the 9th Con- cession, gore of Hamilton, be annexed to School Section No. 1, in the Township of South Monaghan. 30 4. WHERMVS, by an Act of the Provincial Legislature, " passed m the eiglith year of Her Majesty's reign, entitled -'An act to empower the District (.'oimcils of Municipal Districts, and i3oards of Police of iiicoj-oorated tx)wns m l^pper (Canada, to impose a tax on dogs 'within tlieir respective Districts and Towns," power i.'/given to District Councils to tax dogs within their respective^ Districts ; and whereas, it is necessary to impose a tax on persons kee])iiig dogs, and to make provision for X\w keeping dogs : Be it therifore enacted by the District Council in Council assembled, That from and after the fust day of January now n(!xt ensuing, every person residing within the District of Newcastle, with the exception of the inhabitants of tlie incorporated towns of Cobonrg and Port Hope, shall pay the sum of five shillings n year for e^ch and every dog over six months old, which he or she may possess, provided that every houseliolder whose name shall appear on the Assessment Roll, shall be entitled \G keep one dog without paying any tax under this Bv- Law. 2. And be it further enacted by the authority aforesaid. That in making out the Assessment Roll, the person whose duty it may be to make out the same shall, and he is hereby required to insert a separate column, wherein the Assessor of each Township shall insert opposite the name of each individual such number of dogs as he or she may possess, exclusive of the exemption lieieia before referred to. 42 3. And he ii further enacted by the mithority aforesaid, That every person who shall mglect or refuse to give to the Assessor, when apphed to by him, a true and correct statement of the number of dogs over six montlis old. which he or she may possess, shall be liable to forfeit and pay tlie same sum as is imposed on persons neglecting or refusing to d(!liver to the Assessor a true list of his or her rateable ])ropcrty, according to the provisions of an Act passed in tlic first year of Her Majesty's reign, entitled, "An Act to alter and amcjid sundry Acts regulating the appointment and duties of Township Officers." 4. And he it farther enacted by the authority aforesaid. That the Collector of each Township shall demand of every person borne on his Assessment Roll, the sum of money which he or she may be taxed tliereon for dogs, and shall pay to the Treasurer of the District, the total amount collected by Iiim on account thereof, at the time at which he is now required by law to pay over his other collections, and to settle with the Treasurer for the same. 5. And he it further enacted by the authority aforesaid, That in case any person or persons shall neglect or refuse to pay the sum which lie or she may be taxed for keeping a dog or dogs, tlie Coll(H:tor sliall recover the same in like maimer as he is now by law authorized to collect and recover the district rate or assessment. A nd he it further enacted by the authority aforesaid, That it shall be deemed and held sufficient proof of the ownersliip of any dog upon which a tax may be levied, according to the provisions of this By-Law, if the said dog is known to the Assessor of any Township to frequent any dwelling or lodging house as a home, and the owner or occupier of such dwelling or lodging house shall be lield liable for the payment of the tax on any such dog, and any person being generally or frequently attended or followed by any dog, shall be deemed and considered for all the purposes of this By-Law, as prima facie owner thereof, and liable as such owner for the payment of such tax. 7. And he it farther enacted by the authority aforesaid, That tlie Township Clerk of each and every Township in this District shall, at the hxsX animal Township meeting 43 after the passing of this By-Law, read the same to the iuliabitaiits there collected. 8.
