 in the County of Middlesex, Gent 
 
 lliinibly complaining, shews linto your Lordships, your orator. Samuel Glass, 
 the younger, as follows : 
 
 1st. — That under and by virtue of an Indenture of Bargain and Sale, by way 
 of Mortgage, bearing date on the 24th day of September, A. d., 1854, and made 
 lietween Charles G. Moore, of the City of London, in the County of Middlesex, and 
 Province of Canada, Esquire, of the first part, and Eliza Hector Moore, A'ife of the 
 said Charles G. Moore, (who joined in the said deed for the purpose of barring her 
 dower, of the second })art); and James Wallis, of Peterborough, in the County of 
 Peterborough, and Province aforesaid, Es(|uire, of the third part ; and a transfer 
 thereof, made by deed, dated the 'Jlird day of .Ad}-, A. D. 1801, and made 
 between the said James Wallis of the llrst part, and your orator of the second 
 ])art, your orator bet'anie and is now the assignee of the said deed by way of 
 Morgage of certain ireeliold property therein comprised, being composed of all 
 and singular that certain parcel or tract of land and premises, eituat", lying, and 
 being in the Townshij) of North Dorchester, in the County of Middlesex, contain- 
 ing by admeasurement one hundred acres, be the same moie or less, being com- 
 posed of the north half of lot number thirteen, in the second coucesssion of that 
 part of the Townsiii]) ul' North Dorchester, wluch was formerly North Dorchester, 
 in the County of MitUllesex ; and also, all and singular that cc/tain other parcel or 
 tract of land and premises, situate, lying and being in the Township of Charlotte- 
 ville, in tiic County of Norfolk, c(mtaining by admeasurement one hundred and 
 twenty -oni! acres, be tiie same nu)re or less, l)eing composed of lot number thir- 
 teen in the nintii concession of tlic said Townsiii)) of Charlotteville, in the said 
 Cnuuty of Norfolk, which is the whole of the last named lot, comp(;sed of two 
 hundred acres, except seventy-niiu' acres, being that portion of the said last 
 named lot which was sold for taxes l)eibre the date of the said mortgage, as ex- 
 pressed in the said mortgage, for securing tiie sum of ,£241 Is. Dd. and interest. 
 
 2nd. — That the said mortgage was registered in the Registry Office of the 
 said County of Miihllesex on tiie 20th day of September, a. i). 1864. 
 
 3rd. — That the time for ])ayment thereof has elapsed. 
 
 4th. — Tiiat no sum has been jiaid on account of either principal or interest, 
 except ,£llo paid on the 7tli day of October, A. n. ISof). 
 
 otli. — That your orator has not been in the oci'upation or possesion of the said 
 mortgaged premises or of any i)art thereof, or in the receipt of the rent and 
 profits thereof, or of any part thereof. 
 
 Otii. — That large amounts of taxes have accrued due upon the said mortgaged 
 jiremises during the existence of the said mortgage, of which your orator has already 
 liaid about $100, and there is new due thereon aliout ?100 more, which will have 
 to be paid, and which your orator intends to pay in order to save the .said premises 
 from being sold to satisfy the same. 
 
 7tli. — That there is now jiistlv due ujum the said security for principal and

 8th. — That on the 2oth day of September, A.n., 1864, the defendant Charles 
 G. Moore became tli(> piircliaser in fee. and had conveyed to him by Deed of Bargain

 12, according to a plan or mai) of he same, which was duly registered in the 
 Registry Office of the said County of Middlesex. 
 
 lot, —That on the Gth day of , aniuiry, A. D.. 1857, the defendant Charles G. 
 Moore sold and conveyed, subject to he said mortgage, ten acres of tiu' said last 
 named land, being sub lot number th "ec, according to the said plan or map to the

 11th. — That on the said 6th da\ 
 
 defendant William Shepherd, of th( 
 
 Durham, yeoman; and the said conve} ance to the said defendant William Shepherd,

 of January, the defendant Charles G. Moore 
 sold and conveyed ten acres of the sa id lot in Dorchester being subject to the said 
 mortgage sub lot number four, accor ling to the said plan or survey to the defen- 
 dant Richard Hallett, and tiiat the said conveyance to the said Richard Hallett 
 wa** duly registered in the Registry Office of the said County of Middlesex, on the 
 same day. 
 
 12th. — That on the said 6tli day of January, the said defendant Charles G. 
 Moore sold and conveyed, subject to the said mortgage, ten acres of the said lot 
 in the said Township of Dorchester, being sub lot number seven, according to the 
 said plan or survey to the defendant William Rol)ertson, of the said City of London, 
 in the said Count_ of Middlesex, surveyor, which said last named conveyance was 
 duly registered in the Registry Office of the said County of Middlesex, on the 
 same day. 
 
 13th. — That on the .said Gth day of January, the said defendant Charles G. 
 Moore .sold and conveyed, subject to the said mortgage, ten acres of the said lot in 
 tlie said Township of Dorchester, l)eing sub lot number ten, according to the said 
 plan or survey, to the said defendant Tliomas Moore, of the Town of St. Thomas, in 
 the County of Elgin, yeoman, which said last named conveyance was registered in 
 the said Registry Office of tlie said Count3' of Middlesex, on the same day. 
 
 14th. — That on the said 6th day of January, the said defendant CharUs G. 
 Moore sold and conveyeil, suliject to the said mortgage, ten acres of the said lot in 
 the said Township of D-jrchester, being sub lot number eleven, according to the 
 .said ])lan or survey, to the said defendant (jleorge Railtim.of the Town of Cobourg, 
 in the County of Northiimlierland, Esquire, which said last named conveyance was 
 duly registered in the Regi; try Oflice of the said County of Middlesex. 
 
 loth. — That on the said 6th day of January, the said Charles G. Moore sold 
 and conveyed, subject to the said mortgage, ten acres of the said lot in the said 
 Township of Dorchester, being sub lot ninnl)er nine, according to the said plan or 
 survey to cme, Edward P^mery, of the Townsiiip of Westminster, in the said County 
 of Middlesex, Gentleman, which said last named conveyance wsvs duly registered 
 in the Registry Office of the said County of Middlesex, on the same day ; and the 
 said Edward Emery, did, on the 7th day of June, a.I)., 1862, l)y Deed of Bargain 
 and Sale, convey the said last named ten acres to the said defendant George Crow, 
 of tlie said Township of Dorchester, yeoman, and the said last named conveyance 
 was duly registered in the Registry Office of the County of Middlesex, on the 14th 
 day of .'fune, A.D., 1862. 
 
 16th. — That on the said Gth day of January, A. d., 1857, the said defendant 
 Charles G. Moore sold and conveyed, subject to the said mortgage, t^n acres of the 
 .--aid lot in tlie said Township of Dorchester, being sul) lot number twelve, according 
 to the said jilan or survey, to Johnstone Waddell, of the City of Montreal, Canada 
 East, Gentleman, wiiich said last named conveyance was duly registered in the 
 Registry Office of the said County of Middlesex, on the same day. 
 
 17tli. — That the said defendant Henry Crow, is the owner in fee, subject to the 
 >A\d mortgage of ten acres, and also has an e(jMital)le interest in twenty acres more of 
 the said lot In the said Township of Dorchester, suliject to the said moitgage. 
 
 18th. — That the sait defendant Cliarlc! G. Moore is now the owner in fee of 
 the remainder of the said lot in the said To'.vnship of Dorchester.

 the said Township of Charlotteville, by the said defendant Charles G. Moore to 
 
 le, the said defendant David Farrar, was inform- 
 
 f. Moore, and had full knowledge of the exist- 
 ; it covered the said land in Charlotteville, and 
 r, agreed at the time of the said conveyance to 
 umi as aioresam, lo pay on ana discharge the said mortgage. 
 
 21 St. — That the said mortgage was registered in the Registry Office of the 
 said County of Norfolk, on the 6th day of Oct<iber, a.d., 1 860. 
 
 22nd. — That the said defendants Charles G. Moore, William Robinson, John- 
 stone Waddell, Thomas Moore, George Railton, Richard Ilallett, William Sheplierd, 
 George Crow and Henry Crow are entitled to the equity of redemption of tlie 
 several portions of the said north half of lot number thirteen, in the second con- 
 cession of the said Township of North Dorchester, which are more fully hereinbe- 
 fore described, and that the said defendant David Farrar is entitled to" the equity 
 of redemption of the said lot number thirteen, in the nintli concession of the said 
 Township of Charlotteville. 
 
 Your orator therefore prays : 
 
 1st. — That he may be paid the said sum 
 of $994:47c. and interest, and the sums so ad- 
 vanced and paid by him for taxes on the said 
 lands as aforesaid, and the costs of this suit, and 
 in default thereof, that tlie ecjuity of redemption 
 of the said mortgaged premises may be fore- 
 closed, or if your orator shall .so elect that the 
 faid mortgaged premises may be sold, nnd tlie 
 proceeds thereof applied in and towards the pay- 
 ment of the said debt, interest, taxes and >8< . 
 and that the said defendants Charles G. Mot -«■ 
 and D;ivid Farrar, or either of them, may be 
 hold lia;)le and ordered to pay the balance of 
 the said mortgaged debt, interest, taxes and 
 costs, after deducting the amounts realized by

 directions may be given, and accounts taken, 
 and that your orator may have such furthex and 
 other relief in the premises, an to this Honora- 
 ble Court nuiy seem meet.
