As this work may fall very generally into the hands of the Student, and may perhaps be no less useful to him than to the Practitioner, more especially in regard to the Rules to be observed in respect of the keeping of Terms, the filing of Articles of Service, attending Lectures, &c., a few words on the Study of the Law may not be misplaced. Writers whom we cannot pretend to equal have discussed the subject in gen- eral terms, and we do not propose to treat of the matter so much in the sense in which Blackstone, Woodesson, and such eminent men have done, as with reference to the peculiar nature of the study of the Law, and how it is and can be studied in this country as distinguished from England. In England it is well known the professions of Barrister and Attorney are wholly distinct, and these again are each sub- divided, not indeed by Law, but by usage, as the result chiefly of great wealth and a highly refined state of society, by which not only the legal but other professions, as also trades and the arts of manufacture become subdivided ; thus, in the Medical profession, many in England devote themselves solely to some particular branch, as to pulmonary complaints, disease^ of infants, &c. And so also the trades and manufacturing arts are subdivided more than in Canada, a consequence of which is that an excellence is acquired in each particular branch by the time and labour devoted exclusively to it, which as a whole tends greatly to the benefit of the public. To instance the subdivision of the profession of Barristers in England it may be mentioned that many Counsel practise exclusively in some one of the Courts of Common Law, Equity, Bankruptcy, Admiralty, or the Divorce or Ecclesiastical Courts, and many again almost solely as conveyancers, special pleaders, equity draftsmen, criminal, nisi prius, advising, or chapiber 9Qvngel. .1' i. J.> ;.■! f \ Many Attorneys in England, either from the locality of their practice or peculiar circumstances, attend chiefly to particular branches of their profession ; some to criminal law, some to chancery, banlcruptcy, or agency business, &c. The writer was told of one Solicitor who had amassed a large fortune, and was chiefly consulted and called in to settle family differ- ences, and had acquired in this some reputation. On another occasion, having to call on a large firm of Solicitors in London, he was asked by a porter in constant attendance in the hall what was the particular class of business he had to see after, whether chancery, bankruptcy, common law, or otherwise, and was then referred according to the nature of the business to that particular member of the firm who attended solely to that branch of the business. As a general rule both Barristers and Attorneys (at least such who study with a view to practise for a livelihood) are drawn from the middle classes, — the former perhaps, however, from the wealthier and better connected among such classes, and having also this more important advantage over the latter, that with a view to their branch of the profession and the more arduous contest before them, they are more highly trained and educated, and have been perhaps selected for the higher in- stead of the lower grade as having evinced more than common natural ability or aptitude. The Barrister in England has usually had an University education, and after his call to the Bar has frequently for some five or six years sufScient leisure time not only to ground himself thoroughly in the knowledge of the profession, but to devote himself to general acquire- ments. Many indeed contribute largely to the literature of the day. As may be supposed, the expense attendant on entering the profession in England is very considerable. The stamp duty on the articles of Clerkship as Attorney is £80 sterling. An ordi- nary premiuin to even a country Solicitor in respectable practice is from £800 to £500 sterling, and the admission fees are high< Gounsel of standing are very particular as to whom they receite M students ; a friend 9f tke writer, who had studied three years ''i INTBODUOTORT OBSERVATIONS. 9 ''i in Canada, informed him that he applied to two or three emi- nent Counsel in England, and among others to Sir R. Bethel!, now Lord Chancellor Westbury, to be allowed to study un lor them. He was asked whether he had received an University education and questioned as to his legal acquirem- \ts, &r,. His frigid had not received an University education and his legal attainments were not of the highest order. The result was tb'*' t no arrangement was come to. The fee required in one or two instances was £200 sterling per annum. The study and practice of the Law in Canada differ widely from that in England. In the first place the professions of Barrister and Attorney may be and usually are followed toge- ther. The call to the Bar and admission as Attorney also frequently take place in the same term. So little does Cana- dian praetice agree with English ideas in this respect that by the universal etiquette of the Bar in England no Counsel re- ceives a brief or has direct communication with a suitor except through the intervention of an Attorney, and this practice was fio much without exception that it was supposed until a recent decision that counsel could not legally act in contravention of it, and we believe that recently a barrister was disbarred by his Inn of Court for so doing. Whilst those studying and commencing the practice of the profession in Canada have many advantages as regards ex- pense as compared with those in England, they have, on the other hand, very many disadvantages. They must be con- versant with the knowledge of the profession in all its branches, the practice as well as the principles, with Equity as well as Common Law, the Rules of pleading and those of evidence — in short, place themselves in a position to be able, without extrinsic aid, to advise a client on any matter in which he may require advice and to carry through a suit in all its stages. A further disadvantage as regards legal proficiency has been, that heretofore at least the practitioner on commencing business has gei},erally found himself too much eu ployed to be able to devote much time to a careful course of study. If ■•-■■ii I to secure a competent livelihood was honesty and attention to business. We apprehend that that time is now passed away, and that there is now also required a great amount of thorough knowledge of the profession. That this is so and is felt to be so is evidenced by the fact that as a general rule many students of the present day read harder than those of former years, and we have been told by one of the readers of the Law Society that some of the students who went up for examination for Scholarships in a recent Term were better Lawyers than many practitioners of several years standing. With the competition and the crowded state of the profession at the present day what is above stated might have been ex- pected, and both student and practitioner will find that more is required from them now than heretofore. The Benchers of the Law Society, following the example of the Inns of Court in England, have recently afforded to the student facilities for keeping pace with the increasing demand for sound legal acquirements. Four Barristers have been ap- pointed to lecture on the various branches of Law, and four Scholarships in each year have been established of £30, £40, £50, and £60 each. Of this an account is more fully given, page 46. We believe the action of the Law Society will be attended with very excellent results. Law lectures are more necessary here than in England, from the fact that in many respects the Canadian Law differs altogether ftom the English Law, and the student is apt to be misled consequently by English Text-books, the only books that he can refer to. In some cases, as for example the practice of the Courts, the present law of descent of Real Estate in Upper Canada, and the Registry laws, the student has really no text-book what- ever to instruct him. Nor is it only in the above that the services of the Readers will be of advantage. The student may have a difSculty in understanding the nature of such an interest as is named in the Dower Act, and out of which Dower may aiise, viz: an estate partly legal and partly equitable, equal to an estate of inheritance in possession ; in such and similar instances a carefully considered lecture may make clear ^ t I I IMTRODUCTORT OBSBBVATIONS. 11 that which perhaps some practitioners could not explain to their students at a moment's notice. Some gentlemen possessing and conscious of talents and ability more adapted for public or political life than the Courts of Law, select rather the country towns as their place of busi- ness than Toronto, or the other cities where there is great competition among those highly quaMed, some of whom are applying themselves to rise to eminence solely by the aid of their profession. The student, on commencing practice, judges for himself as to his pecuHar talents and the locality for their exercise, but he will find assuredly that to attain distinction in his profession by legal acquirements alone will require both industry and ability on his part. If conscious of these essentials, and of possessing also what is sometimes termed a good legal mindy by which we understand that peculiar class of intellect which eminently qualifies for a Lawyer, com- prising the power of close reasoning, of concentration, quick perception of the real points of a case, proper deduction from and application of principles, he may look forward not only to success at the Bar of Upper Canada, but to a fair chance of success at the Bar in England, for imder recent rules of the Inns of Court, Colonial Barristers are to be admitted to be called to the English Bar merely on payment of. the usual fees, less the amount paid on call to the Colonial Bar — an ex- tension of the right which hud been theretofore conceded to CTolonial Barristers to be heard before the Privy Coundl on appeals. Their jurisdiction extends to all personal actions where the debt or damages claimed do not exceed £50 ; and to all suits relating to debt, covenant or contract, where the amount is ascertained by the acts of the parties or signature of the defen- dant to £100; and in cases of torts to personal chattels to £30, and to all bail bonds and recognizances of bail given in the County Court to aqy amount, with trial by jury, but not to oases involv* ing the title to lands (eicept actions of ejectment in certain cases, as after mentioned), validity of wills or settlements, or actions for libel, slander, crim. con. or seduction. An appeal lies to either of the superior courts of Queen's Bench or Common Pleas. The County Courts also possess equity jurisdiction to the amount of £50, under 16 Vic. cap. 119, subject to an appeal to the Court of Chancery, and jurisdiction in ejectment for the recovery of lands, where the yearly value does not exceed $200, in the followisf oases, viz.: (1). County Court Terms. — These terms are regulated by etatate 20 Yio. cap. 68. There are four of one week each in each year, oom- menoiog on the first Monday in January, April, July and Ootober, and ending on the Saturday of the same week. The sittings are the same as the Quarter Sessions, namely, the second Tuesday in March, June, September and December, in each year. Vaoation from 1st July to 21st August. Surrogate Clerk — Oharles Fitzgibbon, Toronto. These Courts, since September, 1858, have been regulated by the Consolidated Statutes U. C. cap. 16. The Court of Probate for Upper Canada is abolished, and its powers (with some excep- tions) exercised by the Surrogate Courts, of which there is one in each county, holding its sittings in the county town. The juris- diction of these courts relates to all testamentary matters and causes, and to the granting or revoking of probates of wills and letters of administration of the eflfects of deceased persons having estate or eflfects in Upper Canada, and all matters arising out of or connected with the grant or revocation of probate or adminis- tration, subject to an appeal to the Court of Chancery. There are four terms, commencing on the first Monday in the months of January, April, July and Ootober, and ending on the Saturday of the same week. The Judge of the County Court is ex'offieio the Judge of the Surrogate Court. By sec. 66 of chap. 16 of the Consolidated Statutes for Upper Canada, it is enacted that the Judge of any Surrogate Court may allow to the executor, or trustee or administrator, acting under will or letters of administration, a fair and reasonable allowance for his care, pains and trouble, and his time expended in or about the executorship, trusteeship or administration of the estate and eflfects vested in him, under any will or letters of administration, and in administering, disposing of (ind arranging and settling the same, and generally in arranging and settling the affairs of the estate, and therefor may make an order or orders from time to time, and the same shall be allowed to an executor, trustee or administrator, in passing his accounts. In England, there does not seem to be any statute or law for allowances to executors or administrators. In New York, the law is similar to the above ; and the decisions as to allowances, &o., in New York State, will be found in the American notes to the cas9 of Robinson ▼. The Court has alio the supervision of some of the accounts in the county, rela- ting to the admiDistratioA of justice, &c. Sittings second Tuesday in March, June, Septemher, and December, in each year, with power of adjournment. In the cities of Toronto, Hamilton, London, Kingston, and Ottawa, the Recorder's Court takes the place of the County Ses- sions, the Justices for Counties having no jurisdiction in the cities, tho care of which is confided to the Recorder, Mayor, Aldermen, and Police Magistrate of each. These Courts are held in different places in each county by the County Judge, for the summary disposal of oases ; but a jury of five persons may be demanded in certain cases. Their jurisdiction extends to actions of debt or contract amounting to £26, injuries or torts to personal chattels amounting to £10, but not to actions for gambling debts, liquors drunk in a tavern, or notes of hand giTen therefor, ejectment, title to land, &c., or any toll, custom or franchise, will or settlement, malicious prosecution, libel, slander, crim. con., seduction, or breach of promise, or actions against a justice of the peace for any thing done by him in the execution of his office, if he objects to it. Attachments against personal property of debtors absconding from the province, leaving property liable to execution, or remov- ing their goods from one county to another or from the province, with intent to defraud, or keeping concealed to avoid service of process, with intent to defraud, may be issued by the Clerk of the Division or by the Judge or any Justice of the Peace. Courts are held once in two months in each division, or oftener, at the discretion of the Judge. The Law Society of Upper Canada was first established in 1797, by the Act 87 George III. cap. 13, which enabled the then Prac- titioners of the Law to form themselyes into a Society, and make Rales for its goTcrnment, nnder the inspection of the Judges, aa Visitors. The Act of 1822 (2 George IV. cap. 6^, incorporated the ** Treasurer and Benchers of the Law Society," giving a per- petual succession, and a common seal, in the usual manner of Acts of Incorporation. Under these statutes, the Society is governed by the Board of Benchers, in the same manner as the various Law Societies in London, England. The Benchers sit in convocation every Term, for the admission of Students and Barristers, and the examination of fitness and capacity of Attornies, and for other general business. The examination for Students ai Law, which is a Scholastic exam- ination, is conducted in the presence of the Benchers ; and the examination of Barristers, at the end of the term of five years after admission, and of Attornies, after the service of five years as Law Clerk, is conducted by the Benchers in convocation. These last two examinations are in the various branches of legal learn- ing. Each Student at Law, on admiflAion, is a member of the Society, and entitled to the use oi the Library. The Revenue of the Society consists of the fees paid by Students-at-Law, and Barristers, and Attornies, on their admission ; and the fees called Term Fees, charged to practising Barristers. By an agreement with the Government, the Society furnish the Superior Courts with suitable accommodation, for ever, for the sum of £6,000 currency. The Library of the Society is of considerable value, and is of great service to the Students and Practitioners. CLASSIFICATION. All Candidates passed and not classed in the University Class or Senior Class, shall be classed in the Junior Class. Candidates passed in the University Class shall be classed according; to their rank, if Graduates in the same University ; or according to the dates of their Diplomas or degrees, if Graduates of different Universities. Candidates passed in either the Senior or Junior Class shall be classed according to their merits. PETITION— PRESENTATION AND DEPOSIT OF FEES. Every Candidate for admission shall, some convenient time pre- vious to the examination day or the day on which he is to be ex- amined, report himself to and deposit with the Sub-Treasurer, at Oagoode Hall, bis presentation and the amount of fees payable on admission, together with his petition for admission. He shall, on the last day of each of snob four Terms, exhibit or transmit to the Secretary of the Society a certificate from each Lecturer who has delivered Lectures, of the number of Lectures attended by such Student for that Term. The form of the Diploma of Barrister-at-Law of this Society, shall be in the form in the Schedule No. 14. CERTIFICATES OF FITNESS FOR ADMISSION AS ATTOR- NEYS OR SOLICITORS. TO KEEP TERMS. Every Candidate for Certificate of fitness for Admission as Attorney or Solicitor, shall keep two Terms pursuant to the Statute in that behalf. The two Terms to be kept by Articled Clerks under the Statute shall be kept by thoir attending the sittings of the Courts of Queen's Bench and Common Fleas, or one of them, agreeably to the proTisions of the said Act and of the Rules of the said Courts in that behalf, every day on which such courts, or either of them sit during Term, and by their entering their names, and subscribing their declaration of attendance in the Articled Clerk's Attendance Book of such Courts, or either of them, pur- suant to the said RuUd of Court respectively. Every such Candidate shall leave with the Secretary of this So- ciety a certificate or certificates of such attendance from the Clerks of such Court or Courts, together with his petition for certificate of fitness, articles, and other papers, or au^oiently excuse the production thereof as prescribed by the said Act, and the Rules oC the Society respecting the same. EXAMINATION FOR CERTIFICATES OF FITNESS. Candidates for Certificates of Fitness shall be examined in writ- ing, and orally in like manner as Candidates for Call " simply," according to the rules of the Society in that behalf, and in the following books and subjects, that is to say : Blackstone'c Com- mentaries, 1st volume; Smith's Mercantile Law; Williams on Real Property ; Story's Equity Jurisprudence ; The Statute Law ; the Pleadings and Practice of the Courts, or in such other books and subjects as the Benchers in Convocation (or as the Examiners, with the assent of the Benchers in Convocation) may from time to time for that purpose prescribe and appoint. Candidates for Certificates of Fitness for Admission as Attorneys or Solicitors shall attend at Osgoode Hall on the last Wednesdays of the vacation previous to the Term in which their petitions are- to be presented, and shall receive from the Examiner of the Society copies of the questions to be answered by them in writing, and shall then and there, under the supervision of such Examiner, frame answers to such questions, and deliver such answers in writing to him for the Benchers in Convocation. The attendance of such ttindidates for the purposes mentioned in the foregoing section of this rule shall be at 10 o'clock, A.M.,' and the answers shall be delivered to the Examiner by 8 o'olook» P.M., of the same day. The Secretary shall report upon the petition of every Candidate for Certificate of Fitness for Admission as Attorney or Solicitor,' and such report, together with the petitions and documents to which they refer, shall be laid on the table of Convocation on the first day of Term ;-^he shall also make a Supplementary Report upon the articles of clerkship when received by him, of applioanti' whose term of service expires daring the Term. QJiiJj FEES. ADMISSION FEES. Every Student, upon his admission, shall pay the sum of ten pounds, and the fiirther sum of twenty pounds when Called to the Bar. Every Barrister of any other part of Her Majesty's dominions admitted into this Society, and called to the degree of Barrister- at-Law under the Statute in that behalf, shall pay a foe of thirty pounds, being ten pounds on his entry ns a member of the Society, and twenty pounds on his Call, the same corresponding in amount with the fees payable by Students under the last Section. m ] 42 THE UPPER CANADA In case any Candidate for admission on the books as a Student, or for Call to the Bar, or for Certificates of Fitness for AdmiBsion as an Attorney or Solicitor, withdraws his application, or fails to pass the necessary examination, or be rejected on any other ground, the fee required to be deposited by him for the u^e of the Society, according to the Statute or the Rules of the Society, shall be returned to him by the Treasurer. TERM FEES. Every Barrister shall pay to the Society a fee of two shillings and six pence in each Term, according to the condition of his bond in that behalf. SUB-TREASURER AND SECRETARY'S FEES. Such suspension shall not preclude the adoption of proceedings by impeachment or otherwise, according to the course of this Society, before the Benchers thereof in Convocation, for disbarring and ezpelling such person from this Society, on the same grounds upon which any such Couit may have proceeded to remove him from their Bolls, or any other that may render such proceedings necessary or proper in that behalf. That there be established a School of Law, to have its seat at Osf;oode Hall, and to be designated the "Law School of Osgoode Hall." 2. That the tuition of the pupi'^ attending such Law School be by means of lectures, readings, and mootings, and otherwise, as may from time to time be prescribed by rules and regulations for the conduct of the said school, to be framed by a Standing Com- mittee of the Society on Legal Education. 8. That the tuition of the pupils of the said school be oondacted by four readers, to be designated respectively— the Reader on Common Law, the Reader on Equity, the Reader on Commercial Law, and the Reader on the Law of Real Property. 4. That the said Readers be selected from the members of this Society of the Degree of Barrister-at-Law, and that they be elected annually on the first Saturday in Michaelmas Term in each year. 6. That to each of such Readers there be paid out of the general funds of the Society a yearly salary of £150; such salary to be paid in quarterly payments, in accordance with the rules of the Society regulating the payment of the salary of the present Lecturers and Examiners. 6. That the existing rules of this Society as to the keeping of terms and compulsory attendance on lectures during term by Students-at-Law do remain in force, with this addition, that there be two lectures on each day during term, instead of one, as here- tofore ; the hours of such lectures and the division of the lectures in term amongst the four Readers to be determined by rules from time to time to be made by the Committee on Legal Education, but the lectures during term to be nevertheless considered as delivered in the Law School, and as forming part of the course of instruction in law afforded therein. 9. That in addition to the lectures in term, there be established courses of lectures to be delivered during the educational terms of the Law School, of which educational terms there shall be three in each year, to commence respectively on the first Monday after Hilary, Trinity, and Michaelmas Terms, and to continue during six consecutive weeks ; during each of which educational terms each Reader shall deliver a course of lectures upon a sub- ject of legal science, to be selected by the Reader and approved of by the Committee on Legal Education. 10. That in addition to lectures, the Readers during such educational terms shall hold readings,- shall preside at mootings, and shall perform such other duties as may be prescribed by the rules and regulations to be framed by the Committee on Legal Education. 11. That attendance on the lectures in the Law School daring the educational terms shall be voluntary. 12. That tickets of admission to the Law School daring each educational term shall be issued by the Secretary to Students, at a charge of one dollar for each ticket, and the proceeds shall be carried to a separate account in the books of the Society, to be styled *' The Law School account." 18. That all written examinations in law shall be conducted in the Law School, in the presence of at least two of the Readers and one Bencher who is a member of the Committee on Legal Education. 14. That there shall be four Scholarships in the Law Society. Any Student who has taken any degree entitling him to call in three years, shall he considered as a Student of over two years in reference to these Scholarships. These Scholarships shall be open to all Students in Upper Canada on the books of the Law Society of the prescribed standing, whether Students in the Law School or not. 15. That the annual allowance to such Scholars shall be paid to them out of the general funds of the Society quarterly, on the first Monday after each term. 16. That the examinations for Scholarships be conducted by the same persons and in the same manner as other examinations in laW; and in such books and on such subjects as the Committee on Legal Education may determine, subject however to the disal- lowance or revision by Convocation of any rules which such com- mlttee may make. 17. That the successful candidates for such Scholarships be determined by Convocation, and the Scholarships be awarded in a formal manner by the Treasurer in open Convocation. 18. That the Readers to be appointed under this rule shall be in the place of the Examiners for Call and Lecturers appointed under the present general rules of the Society, and such rules are hereby declared applicable to the said Readers, who shall perform the duties heretofore performed by the Examiners, receiving only the salaries affixed to the office of Reader by this rule.
