 HIS Majesty The King of the United 
 Kingdom of Great Britain and Ire- 
 land, and His Majesty The King of Spain 
 and the Indies, being equally convinced 
 of the great and almost insuperable diffi- 
 culties that have presented themselves in 
 carrying into efl'ect, by means of the 
 mixed Commission appointed under the 
 Convention concluded on the 12th of 
 March 1623, the stipulations of the said 
 Convention, respecting the claims pre- 
 ferred by subjects of both Nations, — 
 have considered that the most speedy 
 and efficacious manner of obtaining the 
 objects which Their Britannick andCa- 
 tholick Majesties proposed to themselves 
 in framing the Convention above-eion- 
 tioned, would be that of a compromise, 
 or amicable adjustment, in which Their 
 said Majesties, by common consent, 
 should assign fixed and proportionate 
 sums for the indemnification of the 
 Claimants of both Countries, so that 
 each of the two High Contracting Parties 
 should possess the power ot adjudging 
 and satisfying the legitimate claims 
 of its own subjects, out of the sums 
 which each Government should, for such 
 purpose, receive from the other, or of 
 distributing those sums among the in- 
 dividuals interested, by means of an 
 arrangement mutually agreed upon. 
 
 With this view. Their Britannick and 
 Cutholick Majesties have nominated and 
 appointed as their respective Ilcnipotcn- 
 tiarics, namely :— His Majesty The King 
 of the United Kingdom of Great Britain 
 and Ireland, the Right Honourable 
 fiieorge Earl of Aberdeen, Viscount Gor- 
 don, Viscount Formartinc, Lord Iladdo, 
 Methlick, Tarvis, and Keiiie, a Peer ot' 
 the said United Kingdom, a Member of 
 Hit Majesty's Most Honourable Privy 
 Council, Knight of tlie most ancient and 
 most noblu Order of the Thistle, and

 tiary on a sjjecial Mission to the Court 
 of His Britannick Majesty : — who, after 
 having communicated to each other their 
 respective Full Powers, found to be in 
 due and proper form, have agreed upon 
 and concluded the following Articles : — 
 
 ARTICLE I. 
 
 HisCatholick Majesty engages to make 
 good to His Britannick Majesty, the 
 sum of nine hundred thousand pounds 
 sterling, in s|iccie, as the amount ot the 
 whole of the English claims presented to 
 and registered by the mixed Commission 
 established by the Convention of the 
 13th of March 18^3.

 ARTICULO I. 
 
 Su Magestad Cat61ica sc obliga i ratis-

 lidad de las reclamaciones Ynglcsas pre- 
 scntadas y rcgistradas ante la Comision 
 mixta creada por el Convcnio de 13 de

 ARTICLE II. 
 
 His Britannick Majesty engages to 
 make good, in the same manner, the sum 
 of two hundred thousand pounds ster- 
 ling, as the amount of the whole of the 
 Spanish claims, presented to and re- 
 gistered by the mixed Commission, in 
 pursuance of the i^aid Convci.lion. 
 
 ARTICULO II. 
 
 Su Magestad Britanica sc obliga i ta- 
 tisfacer, en la misma forma, la cantidad 
 de doscientas mil libras esterlinas, |)orel

 ciones Espafiolas presentadas y rcgis-

 ARTICLE HI. 
 
 It shall be lawful for cither of the High 
 Contracting Parties to cause to be ad- 
 judged within its respective Territory 
 the claims of its own siibjects, in 
 order to satisfy, within twelve months 
 from the date of the exchange of the 
 Ratifications of the present Convention, 
 such claims as shall appear to be just 
 and legitimate, out of tlie sums which 
 one of the High Contracting Parties 
 shall receive, tor this purpose, from the 
 other : or it shall be lawful tor the Go- 
 vernment of either of the said High 
 Contracting Parties to agree with the 
 persons interested, or their assigns, upon 
 any other mode of arrangement which 
 may be deemed most expedient for satis- 
 lying thctn within the same term, with- 
 out the necessity of any previous and 
 iormal adjudication. 
 
 ARTICULO HI. 
 
 Cada una dc las dos Altas Partes Con- 
 tratantcs podra haccr juzgar dentro de 
 su respectivoTerritorio, las reclamaciones 
 d<; sus propios subditos, para satisfaccr, 
 dentro de uii ano contado desde cl dia 
 del cange dc las ratificaciones del pre-

 ARTICLE IV. 
 
 The Government of His Britannick 
 Majesty shall retain in its possession the 
 sum of two hundred thousand pounds 
 sterling, which, by the second Article, 
 is to be made good to Spain, in order to 
 set that sum against, or deduct it from, 
 the nine hundred thousand pounds ster- 
 ling which it is to receive from the same ; 
 but it is expressly declared, that this 
 compensation is stipulated on the under- 
 standing that Ills Catliolick Majesty, 
 within the period specified in the pre- 
 ceding Article, shall pay to His own 
 subjects the amount of their legitimate 
 claims against England, prcferrefMinder 
 the Convention of the 12th of March 
 1823, in specie, or in other eftectivevalue; 
 and in such a manner that His Britan- 
 nick Majesty may be exempted from 
 every responsibility for the amount of 
 such claims. 
 
 ARTICLE V. 
 
 His Catliolick Majesty shall effectuate 
 the payment of the nine hundred thou- 
 sand pounds sterling, in satisfaction of 
 the English claims, by instalments, in 
 the following order: — 
 
 Two hundred thousand pounds ster- 
 ling shall be delivered over on the day 
 on which the exchange of the Ratifica- 
 tions of the present Convention sha'l 
 take place; and another like sum at the 
 expiration of three months from the ex- 
 change alluded to. 
 
 The compensation mentioned in the 
 preceding Article shall be considered as 
 the payment of two hundred thousand 
 pounds sterling more; and the remaining 
 three hundred thousand pounds sterling 
 shall be made good by two instalments, 
 at the rate of one hundred and fifty 
 thousand pounds sterling ; the one at 
 six months, and the other at nine 
 months, from the date of the exchange 
 of the Ratifications. 
 
 ARTICLE VI. 
 
 The two last instalments of one hun- 
 <dred and fifty thousand pounds each, His 
 Catliolick Majesty reserves to himself 
 the power eith-M- of paying np in specie, 
 at the time of that sum falliiiif due, or 
 of effectuating the payment by certifi- 
 cates of inscriptions in the English and 
 {Spanish language, expressing the pur- 
 ijose for which they are issued, bearing 
 interest at 6vc per cent, per annum, pay- 
 able half-yearly in London, at fifty per 
 cent discount. 
 
 ARTICULO IV. 
 
 El Gobierno de Su Magestad Bri- 
 t<inica retendrd en su podcr la suma de 
 doscientas mil libras csterlinas, que, por 
 el Articulo segundo, debe satisfaeer al du 
 Espatia, a fin de compensarlas 6 deducir- 
 las de las novccientas mil libras csterlinas 
 que tiene que percibir del mismo ; ])ero 
 queda cspresamcnte declarado, que csta 
 compensaeion se cstipula en la inteligen- 
 cia de que Su Magestad Cat6iica, dcntro 
 del tcrmino oonvcnido en el Articulo 
 prccedente, pagard d sus propios sub- 
 ditos el importe de sus reclamacioncs 
 legitimiJ contra la Ynglaterra, segun el 
 Convenio de 12 de Marzo de 1823, en 
 dinero, 6 en otros valores efectivos; y de 
 tal manera que el Gobierno de Su Ma- 
 gestad Britanica quede exento de toda 
 responsabilidad por el importe dc 1m 
 csprcsadas reclamaciomis. 
 
 ARTICULO V. 
 
 £1 pago de las noverientas mil libras 
 csterlinas respectivas i las reclamacionet 
 Ynglesas, lo realizard Su Magestad Cat6- 
 lica en diferentes plazos, por el ordcn si- 
 guiente : — 
 
 Sc entrcgardn doscientas mil libras 
 esterlinas en el dia que se verifique el 
 cange de las Ratilicaciones del prcsente 
 Convenio ; y otra igUal suma d los trea 
 mescs de dicho range. 
 
 Se considerara como pago de otras 
 doscientas mil libras esterlinas la com- 
 pensaeion de que va hecha mencion ea 
 el Articulo prec^dente : — y las trescientas 
 mil libras esterlinas rcitantes se satisfa- 
 ran en dos plazos, d razon de ciento y 
 cincuenta mil libras esterlinas; el uno 
 a los scis meses, y el otro a los nueve, de 
 la fccha del cange de las llatiticaciones. 
 
 ARTICULO VI. 
 
 Por lo que rcspecta u los dos ultimos 
 plazos de ciento y cincuenta mil libras 
 cada uno, Su Magestad Cat6lica se re- 
 serva la facultad de poder satisfacerlos en 
 numerario, al tienipo de su respectivo 
 vencimiento, 6 de verificarlo en certifi- 
 caciones de inscripeicnes estcndidas en 
 Yngles y en Espanol, con cspresion del 
 objeto para que se espiden, y con el in- 
 tercs dc cinco por ciento anual, pagadero 
 por semestres en Londres ; las cuales se 
 daran al descucnto de cincuenta por 
 ciento.

 I 
 
 For this purpose, His Catholick Ma- 
 jesty shall, within three months from 
 the date of the Ratifications of this Con- 
 vention, cause the sum oi sixty millions 
 of reals of velloii, in such inscriptions, 
 (being equal, at one hundred reals to the 
 pound sterling, to the sum of six hun- 
 dred thousand pounds sterling,) to be 
 iodgcd in the Bank of England, or with 
 the Banker of the Court of Spain in 
 London, with instructions to deliver one 
 half of them to the Government of His 
 Britannick Majesty, for the use of the 
 claimants, on the day of each of the said 
 instalments falling due, provided they 
 shall not be punctually paid in sterling 
 money. 
 
 It is likewise hereby agreed, that the 
 Government of His Catholick Majesty 
 shall have the power of redeeming the 
 inscriptions thus created, during the four 
 years succeeding, and upon giving six 
 months notice, at the rate of fifty-6ve 
 
 Iiounds for every hundred pounds so de- 
 ivered. After such period of four years, 
 the Spanish Government shall only pos- 
 sess the power of redeeming the inscrip- 
 tions referred to, at the rate of sixty 
 pounds for every hundred pounds. 
 
 ARTICLE VII. 
 
 His Catholick Majesty sliall he at 
 liberty to cfTcot the payment of the 
 second instalment of two hundred thou- 
 sand pounds sterling, mentioned in Ar- 
 ticle V, by delivoring, on its being due, 
 fifty thousand pounds in ready money, 
 and one hundred and fifty thousand 
 pounds in inscriptions at fifty per cent., 
 making three hundred thousand pounds 
 in inscriptions; but this arrangement is 
 only to take place on the express condi- 
 tion that the payment of one of the two 
 last instalments of one hundred and fifty 
 thousand pounds sterling, mentioned in

 tad de cllas al Gobicrno de Su Magestad 
 Britdnica, d beneHcio dc los reclamantes, 
 en el diu del vencimionto de cada uno de 
 los referidos plazos, si no estuviese satis- 
 fecho para aqiiel dia en moncda cstcrlina. 
 
 Sc ha convenido igualmente que el 
 Gobicrno de Su ^fagestad Cat6lica 
 tendrd la facultad de podcr redimir las 
 inscripciones crcadas al efecto, en los 
 cuatro primcros anos, y dando aviso, con

 Su Magestad Cat61ica podrd haccr cl

 ibras esterlinas, mencionado en cl Arti- 
 culo V, entregando d su vencimiento cin- 
 cuenta mil libras en efcctivo, y ciento 
 y cincuenta mil en inscripciones al cin- 
 cuenta por ciento, que haccn trcscicntas 
 mil de esta especic ; pero, en este caso, 
 serd precisamente obligatorio cl pago en 
 dinero cfectivo de uno de los dos ultimos 
 plazos de ciento y cincuenta mil libras, 
 dc que se hace mencion en el Articulo 
 VI.

 Las inscripcioncs que se espidan por 
 el Gobicrno dc Su Magestad Cat61ica, de- 
 berdn ser confbrmes, en todo lo esencial,

 There shall be given up also, on the 
 part of the Government of His said Ca-

 in the preceding Article, all the docu- 
 ments relative to the Spanish clainis

 ARTICLE Xr. 
 
 To prevent any of those claims wliich 
 shall be satitied by the present Conven- 
 tion, from again being produced undur 
 any other form or pretence, it is hereby 
 agreed that the mixed Commission aj)- 
 jiointed under the aforesaid Convention 
 of the 12th of March 182.J, shall, prior 
 to th'' cessation of the exercise of its 
 functions, add to the lists already formed 
 of the English and Spanish claims, pre- 
 sented to and registered by the same, 
 such notes or remarks, relating to the 
 documents in support of those claims, as 
 may be deemed necessary, in order that 
 the said lists and notes, after being given 
 up to both Governments in an authen- 
 tick form, may serve them as a security, 
 tiU the delivery of the original documents 
 «hall take place. 
 
 ARTICULO XL 
 
 Para cvitar que ninguna de las rccla- 
 maciones que ban de quedar fenccidas 
 })or el presente Convenio, pueda aparecer 
 de nuevo, bajo otra forma 6 pretexto ; se 
 ha convenido que la Comision mixta 
 nombrada en consecuencia del referido 
 Convenio de 12 de Marzo de 1823, antes 
 de cesar en el egercicio de sus funciones, 
 deberd anadir d las listas ya formadas de 
 las reclamaciones Ynglesas y Espanolas 
 presentadas y registradas ante el la, las 
 notas 6 apuntaeiones referentes a los do- 
 cumcntos de las mismas reclamaciones, 
 que se crean necesarias, para que entre- 
 gadas d ambos Gobiernos dichas listas y 
 notas en forma autentica, puedan ser- 
 virles de resguardo, hasta tanto que se 
 vcrifique la entrega do los documcntos 
 originales. 
 
 ARTICLE XII. 
 
 The aforesaid Convention of the 12th 
 of March 1823, and the several articles 
 and things therein contained, except so 
 far as the same are altered by this pre- 
 sent Convention, are hereby declared to 
 be, and shall remain, in force. 
 
 ARTICLE XIII. 
 
 The present Convention shall be rati- 
 fied, and the Ratifications shall be ex- 
 changed in forty days from the date 
 hereof, or sooner if possible. 
 
 In witness whereof, tlio respective 
 Plenipotentiaries have signed the same, 
 and have afhxed thereto the seals of their 
 Arms.
