That the rate of Commutation for Statute Labor, in the Township of Raleigh, shall be for each day assessed on the Assess^ ment Roll, in each year thereof, the sum of One Dollar, in all . cases where a person pays money in place of labor. 2. WHEREAS, ft is expedient and necessary for e£fectually re- inoving all Obstructions m Streams and Water Courses in the Township of Raleigh, according to the true intent and meaning of the above recited By-law, that the following sections be enacted, and attached to said By-Law : Be it therefore enacted, by the Municipal Council of the Cor- poration of the Township of Raleigh, under and by virtue of an Act, chap. 54, of the Consolidated Statutes of Upper Canada, en- titled an Act respecting the Municipal Institutions of Upper Canada. 1. That, notwithstautiing anything contained in the above men- ove men- BV*LAW|. * tioned By-law, it shall bo, and is hereby provided, a duty inoum- bent on the Overseers of Highways, in each of the statute labor divisions, in the Township of Raleigh, to inspect the Creeks and Water Courses in their respective divisions, in order to see ifthay are obitruotedby trees, brushwood, limbs or other material, and to remove the same, if any therein, in accordance with the FOJ*^* ions of the Moond section of the above recited By-law : and shall for the performance of said duties herein imposed on such Over- seer receive therefore the sum of One DolUr for each Creek or Water Course, so cleared from such obptructions, extending thro his statute labor division, in accordance with the provision herein contained. . , v rk c 2. Any person or persons interfering with such Overseer ot Highways, in the Township of Raleigh, in th6 discharge of the duticH of Lis ofl&ce, in removing such obstructions in any creek or water course in his statute labor division, shall, on conviction thereof, before any Justice of the Peace, of the County of Kent, be liabio to a penalty of not more than Ten Dollars nor loss than One Dollar, together with costs, at the discretion of the convict- ing Justice. , a. On the Overseer of Highways, in any statute labor division, itt the Township of Raleigh, refusing or neglecting to fulfi the duties herein imposed in this By-law, upon such overseer, shall, on o«nviption thereof, before the Reeve, Deputy Reev«, or Justice of the Peace, of the Township of Raleieih, be liable to a penalty ot not more than Ten Dollars, nor less than One Dollar, with costs. at the discretion of the convicting Magistrate. 4. WHEREAS, by a By-law passed by the Municipal Corporation of the County of Kent, on the 15th day of June last, entitled A By-law to raise a sum of money to meet the current expenses of the County of Kent for the year 1861, the Municipality of the Township of Baleigh is required to raise the sum of One Thous- and Nine Hundred and Ninety-one Dollars as their proportion for said year, to be paidover to the Treasurer of the County of Kent, without any deduction whatever, on or before the 81st day of December, 1861. Whereas, by a By-law passed by the Municipal Corporation of the County of Kent, on the 13th day of March, I8n9, entitled a 3^y-law to appc^ion the' sum. of ^ive Thousand Two Hundred Doliai 8 amongst the several Townships of the County of Kent, for purchasing seed, the Township of Raleigh is required to raise the sum of Two Hundred and sixty-six Dollars, being one-third of Eight Hundred Dollars granted this Municipality on the 30th day of March, 1859, to purchase seed grain, together with interest from that date to the 3lst day of December, 1861, at six per cent, per annum, to be paid over to the Treasurer of the County of Kent, without any deduction whatever, on or before the Slst day of December, 1861, Whereas, the apportionment of the Legislative School Grant for the year 1861, for the Township of Raleigh, amounts to Four Hundred and one Dollars, according to the mstructions of the Clerk of the Corporation of the County of Kent, the Municipali- ty of the Township of Ralegh is required to levy at least an equal sum of money according to law in such case made and provided. Whereas, it is necessary to raise the sum of Six Hundred Dol- lars to meet the current expenses of the Corporation of the Town- ship of Raleigh, for the year 1861. WHEREAS, a majority ol the qualified Electors of the Town- ship of Raleigh have petitioned the Municipal Corporation of stid Township as follows :— That the present division of the Township of Raleigh into Wards is fraught with many evils, and so strong- ly are we convinced of the fact that we are unanimous in our wish to have the wards abolished,andhave one general election; and by section *ni, chap. 54 of the Consolidated Statutes of Upper Canada, it is enacted, that when a majority of the Electors so de- sire, it shall be the duty of the Council within one month there- after, to pass such By-law, in manner aforesaid. And whereas, we the undersigned are certain of the benefits that would result to the Township from the repeal of the present By-law dividing said Township into Wards, we pray that your hon- orable body will be pleased to take this, our petition, into_ your consideration, and grant the same as desired. And whereas, by the 271 section of the Municipal Act, it is en- acted that, in case a majority of the qualified Electors of a Town- ship, on the last revised Assessment Roll, do, by petition in writ- ing, signed by them, apply to the Council of the Township to di- vide the Township into Wards, if not already so divided, or to abolish or alter, in manner specified in petition, any existing Divi- sion into Wards, the Council shall within one month thereafter, pass a By-law to give effect to the petition, and shall in the By-law recite the petition and also the present section of this Act, and pliall declare that the By-law is passed in compliance with the prayer of the petition. And the Bv-law shall take effect on the first day of Deoember next, after one month from the date of its first publication in some newspaper published in the County or un- ion of Counties, in which the Township is situated, or by printed handbills posted in at least twenty public places in the Township. Be it theiefcre enacted by the Municipal Corporation of the Township of Raleigh, under and by vinue of an Act, chap 54 of the Consolidated Statutes ot Upper Canada. 1. That all By laws now existing in the Township of Raljigh. with regard to the formation of the Township into Wards, be, and the same are hereby repealed, in compliance with the prayer of the herein before recited petition. 2.
