WHEREAS, the Raleigh Plains Diain was originally conPtructed under the pruvisions of the Municipal Law then in force, in or about the year of our Lord 1864, for the drainage of the lands in the immediate neighbor- hood thereof, and for preventing injury to same from the natural flow of water from the higher lands in the neighborhood thereof, and waters arti- ficially brought into it at that time. And whereas a number of drains in the Township of Harwich, Til- bury East and Raleigh have since been constructed, and drains and water- courses then existing have since been enlai'ged and su» .lightened, thereby bringing down an increased volume of surface water, silt and debris, with greater rapidity to the said Raleigh Plains Drain, beyond the capaoity of the said drain to carry oiT the same without injury to the lands adjacent to it, and otherwise rendering the same inefficient. And whereas, complaints from time to time from the owners of the adjacent lands have been made to the Council of this Municipality, and actions for damag«)S have been brought against the said municipality. And whereas the said Council have procured an examination to be made by W. G. McGeorge, Provincial Land Surveyor, being a person com- petent for such purpose, of the said Raleigh Plains Drain and Jeannette's Greek, the outlet thereof, and of the various drains using the said Raleigh Plains Drain as an outlet, and have also procured plans and estimates of the work to be made by the said W. G. McGeorge, and an assessment to be made by him of the real property to be befnefitted by such deepening, ex- tending, altering, widening, straightening and otherwise improving the said Raleigh Plains Drain, stating as nearly as he can the proportion of benefit which in bis opinion will be derived in consequence of such deep- ening, etc., by every road and lot or portion of lot ; and as well an assess- ment on the roads and lots or portions of lots using by means of said various drains the said Raleigh Plains Drain as an outlet, or from which by any means water is caused to flow upon and injure the said lands adjacent to the said Raleigh Plains Drain, directly as an outlet or by means of any other of the said drains, in such proportion and amount as, in his opinion, is properly chargeable for the reconstruction and maintenance of the said drain so used as an outlet, and for conveying from such lands injured there- by the waters so caused to How upon and injure same, being the assessment hereinafter by this By-law enacted to be assessed and levied upon the lots !" -,.. ^^■■••>iip ^^ I?? McOkoimik in r^sjject thereof, and of the said deepening, extending, altering, widening, straightening and otherwise im- proving the said Raleigh Pliiina Drain, he'ng as foUowh : CHATHAM, Sept. 30th, 1892. To the Municipal Council of the Township of Raleigh : Gentlemen, — I have recoivcd youtappointincmt and request to examine and report on the Raleigh Plains Drain and the iltnins leading into the same and using the tame as an outlet immcd'ately, and the branches tkereof using the said Raleigh Plains Drain as an outlet through them. In Ciimpliance with such appointment T have made an examination of all of said drains, and of the lauds the waters of winch find an outlet in the Raleigh Plains Drain through said drains and by the said Raleigh Plains Drain, and report to you thereon as follows :— 1. The surface of the wlnlo area of the land south of the Raleigh Plains Drain and now draihed by said other drains, and lands cast and west there- of, is flat, interspersed here and tlioro witli low lying ridges, all with a natural fall generally to tlio north-west, and which, before settlement and in a state of nature, was covered with dense forest, in general of wet-land timber, the surface waters in the wet season and high Hoods finding an out- let for portions thereof betwetui such ridges, iu swales and in places through depressions caused by the water cutting over and through such ridges, a great part remaining to disappear by the natural processes of absorption and evaporation, and the greater porti -n of said area would have remained unfit for settlement without artificial drainage, * 2. The Raleigh Plains Drain runs thiough an area of low lying lands in Raleigh, interspersed with sliglit elevations and depressions, which may be described as bounded northerly by the lands on the River Thames, southerly at or near Con. A, easterly at or near the 18 nnd 19 Side Road, and wescerly by Tilbury East, the land having a fall along the Raleigh Plains Drain from the middle of lot 15 in the 7 th Concession of Raleigh of 9| feet westerly to the Town Line of Raleigh and Tilbury East, 3| feet of this only being west of the 6 and 7 Side Koad, or Drake Road, in Raleigh. 3. The Raleigh Plains Drain was constructed in the year of our Lord 1875, for the purpose of providing efficient drainage for said plains lands east of the Drake Road, and for an outlet for the other drains then constructed leading waters from the south to said plains, and the natural flow where not artificially drained, so as to prevent the same from damaging the said plains lands; and when completed it was and remained for some years an efficient work for the purposes for which it was constructed. 4. I find that since the constiuction of the Raleigh Plains Drain in 1875, the drains from the south snd e st tlsen existing have been enlarged, and extended, and other drains and branches of drains constructed, all using the said Raleigh Plains Drain us an outlet to the Jeanotte's Greek fof the Y^at>ers from the lands in Paragraph One above rcentione^* ■:V ■-, ^';»-.... -, .ifi Hi • '-r > 8 5. I find all the drains lastly above referred to have a much greater fall per mile than the Raleigh Plains Drain ; that they are effective, and generally in a good state of repair, and bring down the surface waters from the lands they respectively drain in an immensely increased volume and rapidity to the Raleigh Plains Drain, and during the spring and summer, freshets far exceeding the original capacity of the Raleigh Plains Drala to receive and convey away the same. 6. I find that as a result the waters so brought down from time to time break over the banks of the Raleigh Plains Drain and flood, damage and injure the adjacent lands, and render the cultivation of the plains land a precarious undertaking. 7. I find, as a further result, that the Jeanette's Creek and the Raleigh Plains Drain have been so filled up and choked by the soil, sand, silt and debris brought down during such freshets, and by the wasting away of their banks, that they are not now adequate to carry off the volume of water equal to what was conveyed away by them when the drain was originally constructed as above mentioned, and the gradient is destroyed by the banks formed thereon by the silt, soil and debris deposited in places in the creek and drain. 8 I find and report to you that in order to put the Raleigh Plains Drain in a proper state of repair, and the better to maintain the same as an efficient and necessary outlet for the waters brought into it by said other drains, and to prevent further damage to the adjacent lands along its course by the overflow of water from said other drains seeking an outlet through it to Jeanette's Greek, that it be deepened, widened and straightened from station 0, marked on the ground on Lot 15 in Con. 7, Raleigh, to station 174, near the Drake Read at Jeanette's creek, and that Jeanette's creek be widened, deepened and cleared of the silt and debris deposited in it by said drains, where necessary, from station 174 to station 300, on lot 1, con. 4, Tilbury East. 9. T recommend and report that a new channel be cut from station 73 on lot 12 in the 6th concession of Raleigh, to station 104, on lot 10 in con. 5, in a course direct from one station to the other, in place of improving and enlarging the old curved channel between these stations, for the following reasons : — (a) The new channel will be six chains shorter, and being more direct, will have a better course and grade for the passage of water down it. (b) It would be necessary to expropriate land |or the enlargement of the old channel, the expenses of which would necessarily be great from the necessity that would arise in having to destroy two farm-house roads and a great number of shade and fruit trees, and to destroy or riinove wuoh fixed fe^piB|, an4 to rfo^py^ d\ym ipivv^ buildingi, •a I*'-.'" •.''■if.V W^'i A* '^ ^4 it i^'r/'. 4- M:i -iC: ■: ■ s if-- '•. fir;-' '■'.■■.• ;"■ #i,ia , '* ^ M, d And with such change in the course of the present drain, I recommend that it be enlarged and constructed of the widths and depths and with bot- tom gradients appearing upon my profile and in my specifications prepared therefor, from station to station 174, at or near the Drake road ; that from station 174 to the easterly side of Government I>rain number Two of Raleigh, it be enlarged to a top and bottom M'idth of 70 feet, with the bot- tom at the same elevation as shown on the profile at station 174 ; that from the easterly side of the Government drain number Two, on the Drake road, a channel be cut with a top width of 90 feet and a bottom width of 80 feet, and having the same bottom elevation as at station 174 ; all of said cuttings to be done, and all works in connection with the improvement of the said drain, to be carried out in accordance with my profile, plan and specifica- tions therefor accompanying this report. « 10. I estimate the whole costs of the proposed improvements at Fifty- six Thousand One Hundred and Ninety Dollars. 11. I have made profiles, plans and specifications for said improve- ments, and a detailed statement thereof, all of which accompany this report. 12. I find that about 2,800 acres of land in Harwich use, by means of the Flook Drain, the Raleigh Plains Drain as an outlet for the waters drained off the same by the Howard and Lewis drains and branches, and are ehargeab^e for outlet for said improvements. Said lands appear in de- tail in my assessment in a schedule annexed to this, my report. 13. I find that about 3,400 acres of land in Tilbury East use, by means of the Hickey Drain and the Government Drain No. 2 of Raleigh, the Raleigh Plains Drain as an outlet for the waters drained off same, which are also chargeable for outlet for said proposed improvements. Said lands also appear in detail in my assessment. 14. I find that about 56,000 acres of land in Raleigh, specifically des- cribed in my assessment in the schedule annexed to this, my report, are also chargeable for outlet, and about 10,000 acres for benefit, as will specifically appear in the schedule of assessment. 15. ' e^'^'-f M ■f\ u w Be it therefore enacted by the said Municipal Council of the said Town- ship of Raleigh pursuant to the provisions of the Municipal Act : 1 That the said report, plans and estimates be adopted, and the said deepening, extending, altering, widening, straightening and otherwise im- proving of said Raleigh Plains Drain, and the work connected therewith, be made and constructed in accordance therewith. :^C 2 That the Reeve of the said township of Raleigh may borrow on the credit of the Corporation of the said Township of Ruleis^h the sum of Fifty- two Thousand Five Hundred and Forty-three dollars ($52,5^3,) being the funds neciBSsary for the proportion of work to be paid for by the lands in the Municipality of Raleigh, and may issue Debentures of the Corporation to that fUBOunt in sums of not less than $100 each, and payable within twenty years from the date thereof, with interest at the rate of four and a half per cent, per annum, that is to say : — In twenty consecutive annual payments, to be of such amounts that the aggregate amount payable for principal and interest in any year shall be equal, as nearly as may be, to the amounts payable for principal and interest during each of the other years of such peried of twenty years ; such debentures to be payable at the branch of the Canadian Bank of Commerce in the Town of Chatham. 3 That for the purpose of paying the sum of Forty four Thousand Four Hundred and Ninety-six Dollars and Ninety-eis[ht Cents, being the amount charged against the said lands to be benefitted or charged for the use of said drain as an outlet as aforesaid, other than lands and roads belonging to the said Municipality, and to cover the interest thereon for twenty years at the rate of four and a half per cent, per annum, the following special rates, over and above all other rates, shall be assessed and levied in the same manner and at the same time as taxes are levied, upon the under- mentioned lots and parts of lots in the said Township of Raleigh, and the amount of the said special rates and interest assessed as aforesaid against each lot or part of lot respectively, shall be assessed and levied as aforesaid in each year for twenty years after the final passing of this By-law, during which the said debentures have to run. Payne the owner of e hf of n hf lot 23, in the 3rd concession, E.B.L., of this Township, applied under the provisions of the Act respecting Tile, 8tono and Timber Drainage Debentures for a loan to be made to him for the purpose of draining the said land. And whereas the Municipal Council has, upon his said application, loaned the said Robert D. Payne the sum of one hundred dollars, to be re- paid with interest by means of the rate hereinafter imposed. WHEREAS a certain By-law numbered 641, and known as "The Raleigh Plains Drain By-law," was finally passed by this Council on the Seventeenth day of June, A.D 1895. And whereas, by subsequent resolution of this Council, Robert J. Morrison and Nelson H. Shepley were Appointed Commissionei s to superin- tend the construction of the said drainage works. And whereas, the said Conomissioners, pursuant to the powers vested in them by the said resolution, did, by public sale on the Second day ot July, A.D. 1895, award the contract for the construction of the said drain* age works to the>Chatham Dredging Company for the sum of $44,775. And whereas, the said Chatham Dredging Company did enter into a contract, with sureties for the due performance of said work, dated the 6th day of July, 1895, and which contract was signed and sealed by the said Company, and by their sureties, and by the Reeve and Clerk of the said Corporation of Raleigh on behalf of the said Corporation, and affixed the Corporate Seal thereto. And whereas, further, in pursuance of the said powers vested in them, they advertised for the sale of the debentures authorized to be issued by said By-law numbered 641, and on the Eighth day of July, 1895, awarded the said debentures to George H. Gillespie for the sum of ^54,950, being the highest tender received therefor. And whereas, it is expedient that the above recited acts of the said Commissioners be confirmed by By-law, and their powers and duties more particularly de6ned : — Therefore the Municipal Council of the said Township of Raleigh enacts as follows : — 1. The appointment of the said Robert J. Morrison and Nelson H. Shepley as Commissioners to let the contract and superintend the construc- tion of the said drainage works as set forth in the said By-law No. 641, and in accordance with the specifications of the iflngineer as filed with the Clerk, is hereby confirmed, 2. The contract entered into by them with the said Chatham Dredg-. ing Company for the sum of $44,77i5, and the conditions of sale upon whicl^ the said contract is based, is herebv confirmed. 3. The 'sale of Debentures amounting to the principal sum of $52,039.24 and consisting of twenty bonds, payable one in each year for twenty years, each of such bonds being for tho sum of $4000.42, and a^ar^lpd to George H. No. 645— A BY-LAW To assess and levy rates for the County, Township and School purposes for the year 1895. 3E IT ENACTED by the Municipal Council of the Corporation of the Township of Raleigh, in the County of Kent. 1. That the following sums dhall be levied and collected upon and from all the rateable property of the Township of Raleigh, :'q the year of our Lord 1895. (1.) The sum of $5048 86 for the general purposes of the County of Kent by a rate of 2 1/10 mills in the dollar. (2.) The sum of $7589.36 for the general purposes of the Township of Raleigh, as per Schedule "A" hereunto annexed, by a rf te of 3 1/10 mills on the dollar. (3.) The sum of $2018.86, being an amount equal to the Legislative School Grant of $496 ; and $1522.50, the amount required to be raised for each school section by general rate, as provided in Section 109 of " The Public Schools Act, 1891," exc'usive of the property of certain supporters of Separate Schools, by a rate of 93/100 of a mill in the dollar. 2. That the Clerk of this Corporation is hereby required to levy a spe- cial rate (over and above all other rates) upon, and which shall be collected from all the rateable property inclitded in each and every School Section, the Trustees of which shall furnish him, on or before the 24th day cf Au- gust, with a written statement signed by the Secretary-Treasurer, and cer- tified by the seal thereof, of the amount required for Public or Separate School purposes in each School Section (less the amonnt required to be raised as aforesaid by general rate), such a rate pro rata rs will amount to the sum so required as near as may be; and the Treasurer of this Corpora- tion is hereby authorized and instructed to pay to the order of the Secre- tary-Treasurer or Trustees of each School Section all moneys so levied and credited to such School Section. 3. That the rates so imposed by this By-law shall be collected by the •ollector of rates for the said Township of Raleigh, and paid over to the Treasurer of this Corporation, in bankable funds, on or before the Four- teenth day of December, A.D. 1895, in so far as the law will einable him so to do, unless otherwise ordered by this Council. 1^ ' *• 41.. 4. That Harvey Tenner be and he is hereby appointed Collector of rates for the said Township of Raleigh dating the current year, and until the said rates are all collected and a due return made to the Treasurer of this Corporation, (the amount so collected to be paid at least every two weeks), conditionally upon his furnishing bonds duly executed by himself, and good and sufficient sureties to be approved by this Council, in the sum of twenty thousand dollars. Be it therefore enacted by the said Municipal Council of the said Township of Raleigh, that an annual rate of fourteen dollars and seventy- two cents is hereby imposed upon the said land for a period of twenty years, such rate to be levied and collected at the same time and manner as ordinary taxes are levied and collected. No. 649— A BY-LAW To confirm certair proceedings respecting, and to authorize the undertaking of the repair and improvement of the Indian Cree]{: and Mud Creek Drains in the Township of Raleigh. Finally passed the 20th day of Jan vary, 1896. WHEREAS, Indian Creek drain and Mud Creek drain are drainage works originally constructed under the provisions of Acts of the Province 'i On- tario, respecting drainage by local assessment. And whereas, the same have became out of repair and inefficient, and complaints have been made to the e£Eect that lands adjacent thereto have been overflowed and damaged by reason of such disrepair and inefficiency. And whereas, the Council of said Township deem it expedient for the better maintenance of said drains, and to prevent damage to lands and roads, to enlarge or otherwise improve the same, and by resolution appoint- ed one W. G. McGeorge, ^.L.S., to examine the same and to prepare a re- port, plans, specifications and estimates of such drainage works as he might propose or recommend, and to make an assessment of all lands, roads, par- ties or municipalities assessable therefor in any way under the Drunage Act, 1894. And whereas, the said W. G, McGeorge has found and reported that the said Mud Creek drain and the said Indian Creek drain, (into which the said Mud Creek drain empties), need to be repaired, enlarged and otherwise improved, as more particularly appears by h;s report filed with the Clerk of the Township on the Eighteenth day of January, 1 89 G, and the plans, profiles and specifications attached thereto and forming a part thereof. Be it therefore enacted by the Municipal Council of the said Town- ship of Raleigh : — 1. That the hereinbefore recited appointment of W. G. McGeorge, P* L. S., and all proceedings by the said Council and by the said Engineer respecting or in connection with his report, plans, specifications and esti- mates filed in pursuance i said appointm<> At, be and they are hereby con- firmed. 2.
