May it please Your Excellency ^ Whilst >ve, the undersigned inhabitants of York and its vicinity, regret extremelj that our first welcome offered to Your Excellency should be embittered by complaint and prayer, and while it is far from our disposition or intention to call on Your Excellency, at the moment of your arrival, to interpose, in any manner, with the proceedings of the Courts of Justice, even with the most 8plen< did prerogative of your office, ''the administration of judgment in mercy;" yet, feeling ourselves disregarded and our rights endangered by many late proceedings of the Provincial administration, and amongst those proceedings, as especially worthy of notice on this occasion, by the late arbitrary and unconstitutional removal of a Judge highly and justly esteemed by us — by the destruction of one liulcpcndent Press — by a violence, almost burglarious, by Clerks, relations and dependents of men in office and power — by the silencing another Press by means of unconstitutional security, exacted of its editor, before conviction of any fault — and now, by the virtual suppression of a third Indepen- dent Press, by a most severe and disproportioned sentence, passed on its editor, Francis Collins, for a libel — a sentence fraught with a measure of punishment against the temperance and moderation expressed by the jury who convicted him, and against the spirit of the expressive charter of British Rights, that great pledge of safety to the subject, '' that no man shall be fined to his ruin." We, the undersigned, pressed by such grievances, entreat that Your Excellency will please, as speedily as possible, to convene the Provincial Parliament, to whom we may make our complaints ; and by which course, Your Excellency may, through that legitimate and constitutional channel, arrive at the knowledge of the true state of the country, a thing not attainable by Your Excellency through the advisers of Your Excellency's misguided predecessor. ^nd your Petitioners, as in duty bound, will ever pray. Times however are such, that you cannot like Marat, deprive him of the power of telling, if he should be disi nsed, without too great a risk for you to venture ; hut do you suppose that any niau of sense doubts your disposition ? You are egregiously mistaken. The peo- ple of this country are aware of the cora- forls of their situation. They know that all the proud advantages which Ihcy should inherit as the descendants of Englishmen are secured, and that their happiness de- pends upon their own industry and obser- vance of order. They may affect to be a- mused by your efforts to excite general dis- trust, but be assured that an understanding of your deserts is beginning to prevail. There is now a strong re-action in public opinion as to the principles of the tx-trea- lurer, and his son, under whose political dictum you act, though your own principles, as far as you possess any, are infinitely more abominable. The public indignation awaits you. The Board who examined your accounts in the " peculation" atfair, were not aware at the time of the detail of your conduct. Some of them are distinguished for clear- ness of understanding, but they were de- ceived ; and I doubt not, they are now con- vinced that the deficiencies which appear- ed between the amount received, and the actual vouchers jou could produce, were not occasioned by want of understanding a sim- ple account on your part, but a want of money, which you did not hesitate to take from the product of your " estimate," and quieted the minds of those who made needy importunities, with a belief that the govern- ment alone were in the fault. You do not seem to bo aware that all the intelligent of the country approve of the general conduct of the administration. These constitute the country's real strength, and upon any occasion that they might deem it an object worthy a little sacrifice of time from their own avocations, as they possess the talent, and the honesty, they would ex- ert it. When the truth came to be told, and the merits of both sides of questions discussed, you would find the honest deci- sion of the great mass of the people decided- ly in favor of the general measures of the Government. You act as though not awaro that the intelligent throughout the country, notwithstanding their quietness, examine, and understand the merits of every question that is agitated. They examine with the same scrutinizing eye, the measures of the Government, and the conduct of its oppos- crs— their minds are governed by senti- ments purely independent and manly — Not like yours, that bastard independence of exciting the worst feelings of which human nature is susceptible, in order that you may worm yourself into oflice, to deceive, and tyranize over the persons you have misled. This last is the only kind of independence that your mind is capable of grasping.— You io not understand that the government must of necessity persevere in its honesty and consistency, and that one weak step in truckling for a moment, with you, or your masters (the ex-treasurer, and his son^ would loose them more substantial populari- ty than all the railing which you(Ar«e, and your satellites could deprive them of, should you live and exert yourselves for half a ceiUury. I am not actuated by any trifling motive in addressing you. Although I cannot hope to correct your disposition, yet I may be instrumental in restraining your actions, and thereby render substantial services to the country, in point of illegal taxation at all events ; and in doing this I shall look for the fair, and honorable co-operation of the law society at facts may be brought before them. They at first prescribed a meeting at Jesse Ketchum's on Indepen* dence day, — 1th July — but we understand, tliat the smell of the Tan-yard was pronounced by Dr. Baldwin, to be unwholesome, and Messrs. Kctchu -, Stoyelles and Moses Fish, were afraid of being suspected if they celebrated Independence; so the plan was chauged; and there is to be a meeting at Mr. Bishop's Rooms on Saturday at lO o'clock. — It is supposed that some of the Doe* tors who were called in, communicated the disease thcinseWes, in order that they might have em* ployment curing it. Dr. Bolph, it is said, stated to the Meeting, that he had come down from Middlesex, very much frightened, indeed. He says, he sees rery little change of getting in there, and is very much alarmed, for fear he may not be able to get in any where else. — Ilia constituents, he says, have condemned his conduct, and asked him to tell them what good he has done, in his four years service— -upon which he resolved not to answer any such impertinent questions, but to come down at once, and tell Dr. Baldwin what a very " ALARMING CUI81S" was coming on.— Dr. Baldwin stated tliat he was in ** great state of alarm," and that he found himself more easily frightened now than he used to be formerly* — ^He said he was not a bit frightened w hen his friend and relation, Mr. Russell, being Governor and Receiver General, and Auditor General, appointed himself a Judge; aho, that he was not in the least alarmed, when Mr. Russell granted to himself and his Sister, and his Cousins, a great many Thousand Acres, of the bes. Lands in tapper Ca« ' nada, and that indeed he thought it no grievance at all — he said he was not alartned at nil, when he used to enter Judgments, and issue Writs, and act in Court as Deputy Clerk of the Crown for about Fifteen Years, when there was no Chief Justice, and that he felt quite bold for about Ten Years, to do his duty as a Lawyer in Court, when there were only two Judges, and even in last April Term, while the Chief Justice was away. But last Term he said, he got so frightened, and so did ms ROBERT, and Mr. ROLI'H, when they saw the Chief Justice not in Court, that they all pulled off their Gowns, and ran away, and have never been bark since. He thought this was a very "ALARMING CRISIS" indeed. He added that he was afraid the Governor would have Justice administered, notwithstanding all he and Mr. Rolph could do— « which was enough to frighten any body. Mr. Ketchum said he was considerably alarmed — he was not half so much scared when the Yankey Fleet came here in 1813, because he knew they were civil people and very gooti to their friends, and besides he did not go close enough to be frightened, till all the danger wa^ over. He said he was afraid that since the Alien Bill was pas^jeJ. they could find no more grievances — and that the People would be contented, and like their Kin{>, and their Government. — Hides were getting dearer at Bufiulo, — and Captain Matthews was sick, — and Major Randall, had not been heard of for a month, — and the People in most parts of the Country, seemed satisfied in spite of all fte, and old Shephard could do,— altogether it was "A MOST ALARMING CRISIS.^ Moses Fish said, now he was made a natural born BWtish Subject, he felt like a '^FISH OUT* OF WATER." He said he was afraid there was too many English, Irish, and Scotch, in the Town of York, tind that the Canadians, were almost as bad, — tliat he was afraid Mr. Ketohum and he, would stand no chance, but he kept up his courage till he saw that Mr. Ketchum wag frightened, and then he thought it must be "A VERY ALARMING CRISIS." Dr. Morrison said he was very much alarmed at a report being heard about Town, that thev meant to replace hira as a Clerk in the Surveyor General's Office, and make a Government Man of him, which of course would make him as corrupt and tyrannical as he was before, and be the means of his loosing his Election. He said he was afraid Dr. Baldwin might get in, if he did not — that the Doctor was in for four years and did nothing at all, and was now so much alarmed that he was sure he could do nothing. He was going to add more, when some body made a noise under the Window, with a Horse Fiddle, at which the Meeting took friglit and separated. When Americans friendly to our institutions, come into tliis colony to settle amongst us, to bear a part of our burthens and to lead a life of honest industry as fanners, mechanicks, merchants, &c. we hail them as brothers. For if the United States are not afraid ofreceiving 10,000 idle or discontented, British and Irish every now ind then— neither is John Bull likely to become alarmed at a small impor- tation of Jonathans into British America. But when we see Yankee wooden clock pedlars, wooden nutmeg gentry, lottery ticket venders, pretended hawkers of the lives of La Fayette and Washington, by subscription, and others of that stamp, openly gulling our neighbours out of their hard earned dol- lars to increase the coffers of Baltimore and Connecticut gamblers and cheats, and to impoverish the poor inhabitants of this infant colony, depress and ruin our mechanicks and artists, and injure our commerce with Britain, we perform an imperative duty by exposing them to tlie just indignation of every friend to this country. We have warned the public that one S. Thompson, lately from and of the United States, prea- cher and pedlar — had gone about the country and obtained 000 subscribers for a quarto bible to be prin- ted on home made paper, in Upper Canada, to cost five or six dollars, and that he had told the people they were subscribing for the first Canada edition of the scriptures, — as also, that he had since expres- sed to us and otiiers his intention of palming on his subscribers some Yankee stereotype edition in place of the Canadian one for which they had signed. We have now to state that this Thompson has his Yankee books nearly ready printed, wherewitli to impose upon his signers, and that he expects to bring them across the Niagara in a few days. Thompson says in an advertisement that our former statement was unfair and FALSE ; tliis is impudent enough on his part. We refer to Mr. John Eastwood, paper maker, Mr. Francis Collins, printer, (who published his advertisement) and Mr. Maxwell, cabinet maker, all of York — and if need be we can bring 100 credible witnesses to prove that this person has been guilty in form and manner as charged in our lite indictment. We wish the country well, and therefore offer a timely caution to all manner of persons against ha- ving any thing to do with this Thompson's Yankee Bibles and Testaments. There was an act passed in London on the 5th July 1835, (eto Geo. IV. Cap. Hi.) by which " books, such as are prolii;;'«ed to be imported into the United Kingdom :" are "prohibited to be im- ported" into Upper Canada • from foreign parts. Bibles and Testaments in the English language are permanent copy right works in the hands of the King's printers and the two imiversities, and may not be lawfully imported into the United Kingdom, consequently cannot lie admitted from the United States into Canada f . And if Thompson shall attempt to smuggle tlieri: in, contrary to the true and e- I'll vident intent and meaning of the above imperial act, he may rest assun^d that we and others our associ- ates will look sLarjily after him, as we are well aware that there is no collector of the customs who dart admit them to pay 30 per cent duty contrary to law. The LiEL'TEXANT Governor thinks proper to call the attention of the House of Assembly, to a subject which he has long regarded as one of much importance to the Province, and of particular interest to a large portion of its Inhabitants. The House of Assembly is aware that of those persons who have come to this Province from Foreign Countries, and more especially at an early period of its settlement, many had been Citizens of the United States of America, and Subjects of that Government. Whatever difference of opinion may have formerly prevailed with respect to the Civil Rights of persons so situated, from the circumstance of the United States of America having once being British Colonies, the solemn decision of the quest iott in the Courts of the Mother Country whose Laws we have adopted, leaves no room for doubt — And these Inhabitants of the Province are exposed to the inconvenience of finding those rights denied which they have hitherto enjoyed, but which whenever they may be questioned must be decided upon by those to whom the Administration of Justice is committed according to Law, and without regard to incon- veniences which might be much regretted. There are also in this Province a number of Emigrants from other Foreign Countries, and many discharged Soldiers of Foreign Corps who not having strictly complied with the provisions of those British Statutes, under which they might have been entitled to the privileges ol subjects, are equally by law exposed to the danger of being regarded as Aliens. Of all the persons thus situated the greater part became Inhabitants with the know ledge of the Government, between those and others it does not appear necessary to discriminate. In the perstiasion that they might all be safely received and acknowledged as subjects, with no other qua- litications than those which the Legislature of this Province has from time to time thought it expedient to impose, the Lieutenant Governor has earnestly pressed the subject upon the consideration of His Majesty's Government, and has it now in his power to communicate to the House of Assembly, that he has received I^is INIajesty's express sanction, to assent to an Enactment v\hich may aiVon\ relief to such persons as ore now in the Province, and the Lieutenant Governor doubts not, that a subject so im- portant, will receive the early and attentive consideration of the House of Assembly. Mr. Examiner, — ^After passing many an hour of pain and uneasiness from a bad tooth, which I was advised not to have extracted, I was recommended by a friend to make use of a remedy, which he stated to be infallible ; and as both he and myseu have found benefit firom it, I feel desirous that otlicrs, who may be sufferers from the^same cause, may share the same advan- tage, and know no better method uf making the remedy public than resquesting a corner in your Examiner for tlie insertion of this letter: the recipe is as foUows : — Take a nut-gall, break it, and put a timall piece of the inside into the hole of the tooth, and after being there for naif an hour or an hour, it must be removed, when it will be found to be covered with a white matter, and a fr<>sh piece of nut-gall is to b« puf iato t*" tooth, so long as any matter shall be found to come away ; and when that ceases to be the case, the cure will be found to be effected, not temporarily, but permanently ; for my frie'Ad assures me his tooth has never troubled him since using tliis remedy, and is now as useful as any ho has in his head : I scarce need add, Uiat the saliva had better not be swallowed. — I am.
