PvTchase of Stores and Provisiom: for Her Majesty^ Ships. The Commanding Officers of Her Majesty's Ships being required by their Instructions to authorise the purchase of all such Naval Stores and Provisions as may be necessary for their respective Ships, drawing upon the Accountant- General of the Navy for the amount, the Consul is only to consider this service as coming v/ithin his province, when, in Foreign Ports, the Captain, from not being acquainted with the language, or from other particular circumstances, shall consider it most advantageous for Her Majesty's Service to apply to the Consul to effect the purchase for him, or when it may not be in the power of the Commanding Officer to comply witli his Instructions; in such cases, when specially required in writing to do so by the Commanding Officer the Consul is to make the purchases, taking care to obtain Vouchers for the same, agreeably to Forms Nos. 1 and 2, for Stores,— 3, 4, and 5, for Provisions. II. Pilotage of Her Majesty's Ships. The Commanding Officers of Her Majesty's Ships are directed by their Instructions (pages 105 and 106) to grant Certificates in duplicate or triplicate to Pilots, for any pilot- age services performed at places abroad ; on the presentation of which at any neighbouring Consulate, the Consul is to pay the amount due for such pilotage ; and in order to prevent more than one payment being made thereon, they must all be addressed to the same person and place, and be marked across with the words Original, Duplicate, or Triplicate. When the Certificate is made payable by a Consul, he is to take the Pilot's receipt on the same for the amount paid in the currency of the place, and which he is to transmit as a Voucher to his account, taking care that the whole set of Certificates, in duplicate or triplicate as the case maybe, are delivered up to him in the same manner as a set of bills of exchange. If there be a Table of Rates for Pilotage, and Boat Hire connected therewilh, established by any local authority, a Copy duly attested must be sent with the Consul's first account ; if not, a Certificate is to be added to the Voucher, signed by five competent persons, specifying that the rate charged is the usual rate for the service performed. When- ever any alterations may take place in such Tables of Rates, the Consul is to lose no time in reporting the same to the Lords Commissioners of the Admiralty. HKK majesty's consuls aufjoad. 5 Whenever it appears by the Captain's Certificate of Ser- vice that the Pilot, through neglect or ignorance, has run the ship aground, the Consul is not to pay him, hut report the circumstances of the case to the Lords Commissioners of the Admiralty for their detonnination. in. Apjyrehending Deserters from Her Majesty's Shijis. The following Rewards are paid on this head :— l'"or any Deseiler, whether Seaman, Boy, or Marine, £3; for a Straggler, that is, a person when absent without leave, but not absent long enough to be marked as a Runaway on the ship's books, nor found endeavouring to escape from the immediate neighbourhood of the place where the ship may be, any sum, at the discretion of the Captain, not exceeding £1. Such payments are to be made upon a Certificate (Form No. 6) from the Commanding Officer of the ship in which the Deserter or Straggler was serving, wherein the name and quality of the Deserter, &c., and the name and occupation of the person who apprehended and delivered him on board the ship, are to be inserted, and in which it is also to be stated that the amount has been charged iiofainst the wages of the party on the books of the ship. The person who apprehended and delivered the party on board the ship is to sign a receipt for the amount upon the Certificate. These payments being fixed at sterling rates, are to be paid to the party entitled in the currency of the country, at par, and charged in the Consul's account at the current rate of exchange. IV. Distressed British ISmvien. SUBSISTENCE. This service is considered in an especial manner the duty of Her Majesty's Consuls, conformable to the Act 11th Geo. IV., cap. 20, sect. 82; and the Lords Commissioners of the Admiralty having, pursuant to the said Act, directed that Is. 6(/. a man a-day shall be allowed under this head, the Consul is to regulate his payments accordiiigly, and to trans- mit a Vouche. for such payments in the Form No. 8. If, however, a sufficiency of the necessaries of life can be ob- tained at a less rate, no more than is absolutely requisite to purchase the same is to be allowed, it not being the inten- tion of the Legislature to grant any superfluous allowance to Seamen in distress, or to encourage them to idleness by too comfortable a subsistence at the public expense. This relief is only to be afforded until an opportunity ofters for sending them to some port in Her Majesty's dominions, or otherwise disposing of them. If a sufficiency of the neces- saries of life for a day cannot possibly be obtained for the above-mentioned allowance, the men are to be subsisted uj)on the most reasonable terms in the Consul's power. All Foreigners who sliull have served in time of war for three years in any of Her Majesty's Ships, are, by the .'kdand4lh Will. IV., cap. M, entitled to the same privileges as Jiritish Seamen, who by the 6th section of the said Act are described to be as follows: — "Seamen, the natural born subjects of His Majesty, his heirs and successors, and persons natu- ralized by virtue of any Act of Parliament, Oi made denizens by letters of denization, and persons who have become His Majesty's subjects by virtue of conquest or cession of some newly acquired country, and who shall have taken the oath of allegiance to His Majesty, or the oath of fidelity re- quired by the treaty or capitulation by which such newly acquired country came into His Majesty's possession." In all cases of Shipwreck of British Vessels, where the Master or Crew apply to the Consul for assistance while engaged in remaining by the wreck for the preservation of the property, or for the collection and disposal of the mate- rials and stores, tliey are, while so employed, not to be con- sidered as distressed Mariners, to be relieved at the public expense, but the Consul is to obtain a written undertaking from the Master to pay the amount of any pecuniary assist- ance which the Consul may deem it advisa lo to aftbrd them, and the same is to be charged by him as a separate item in his general Quarterly Account with this Dt'partnient, in order that the amount thereof may, if practicable, be recovered from the Owners, for whose benefit alone such expenses can be considered as having been incurred. And as by the 46th clause of the Act 7th and 8lh Vict., cap. 112, no Seaman can be discharged abroad, nor abandoned, or left beiiind, withoiit the sanction of the Consul, great care I'uist be taken that such sanction is never given except in cases of absolute necessity. Men falling sick while their ships are in Port are not to be considered as entitled to relief, but are to be cured, as far as practicable, by the means with which, under the 18th clause of the Act before referred to, every ship must be pro- vided; if, however, the man should continue ill up to the time of the vessel sailing, and it shall appear that he is unable to proceed to sea in the vessel, in such case the Con- sul may consent to his discharge, and subsist him as a dis- tressed British Seaman. Men injured in the service of the ship, and also Appren- tices (so long as they continue with their vessels) are not con- sidered in the light of distressed Seamen ; and for any expense which the Consul may incur on account of such, separate Vouchers are to be rendered with his Quarterly Account, in order that the amount may be recovered from the Owner. Should it become necessary to continue Men on charge longer than one month, an explanation of the necessity thereof is to be noted against their names in every sub- sequent Subsistence List. V. Passage of the Seamen. Masters of Merchant Vessels bringing home distressed Seamen are not to be paid by the Consul, but are to be HBR majesty's consuls ABROAD. 9 informed, that upon their transmitting to tfiis Office the following documentH, they will he paid Is. dd. a man a-day for every man brought home, who has not acted during the voyage as part of the crew of the vessel. Ist. A Certificate or Order from the Governor, Minister, Consul, or other authorities by whose directions the men were received on board, specifying the name of each man and boy, and '< he day he embarked. 2nd. The Master's declaration as to the time ho sub- sisted them, stating, as the case may bo, whether the ship was or was not during that lime deficient in her full comple- ment of men, and if she was, how many thereof sho wanted, and for what length of time. As no prosecution can be instituted with success against tlie Masters of Merchant Ships for refusing to take a Seaman on board for a passage to a British Port without the evidence of the parly, the Consul is, in all such cases of refusal whore he considers it proper that this Act should be enforced, to direct the Seaman who shall subsequently obtain a passage, when he shall have arrived in this Country, to call at the Admiralty, with a Letter from the Consul detailing fully the circumstances of the case, (marking on the outside of such Letter, that the bearer is to leave his address with the Chief Clerk, at the Admiralty, Whitehall). In all such cases a duplicate of the Letter sent by the Seaman is to be for- warded by the Consul at the same time by post. Whenever, from the absence of British Merchant Vessels, the Consul, ii; order to avoid the detention of men who are in a fit state to be sent home, shall consider it more econo- mical for the Public Service to engage a passage for any distressed Seamen in Foreign Merchant Vessels, he is to 10 INSTRUCTIONS FOR THE OOVERNMFNT OK avoid, if pratioable, makiiicf any payment for such passage, but to furnish the Master with the requisite Forni.-s, and inform- ation for his guidance, in claiming payment from this Department. As the Act of Parliament on this head provides for the relief of distressed British Seamen, and for no other persons, the Consul is not to cluirt^e to this Department expenses incurred on account of any person whatever not coming within this description, or to order a passage for them to this Country; but in the event of applications being made to him by other British Subjects, he is to govern himself by such directions as he may receive from the Secretary of State's Office, and to use his endeavours to procure passages for such persons in the same manner (by agreements with Masters of Vessels) and on similar terms as for Seamen, drawing on ^he Lords of the Treasury for the amount of the expenses so incurred. Distressed Seamen may be sent home in Packets the same as in Merchant Ships. VI. Clothing, Medical Attendance, ^'c. In supplying Clothing lo distressed British Seamen, the Consul is to take particular care that they be not provided at the Public expense with more than is absolutely necessary, and that no superfluous or expensive Clothing be on any account allowed : they art) not to be provided with Boots, but with Shoes only ; neither are they to be allowed Silk Handkerchiefs, Gloves, Mitts, or such like articles, except in cases of pressing necessity, to be explained by the Consul. No Bedding of any description is to be purchased for them, it being considered that Beds will be provided for them in ;. The Consul is to transmit bills of particu- lars and receipts from the persons to wboni the money is paid ; the signature or mark of the Seamen, in proof that they were supplied with the articles, or received the Medical Attendance charged for j together with a Certificate from him- self that the Clothing or Medical Attendance was absolutely necessary, and could be obtained by the parties in no other way. No difference is to be made in the quality of the Clothing supplied to Masters, Mates, and common Seamen. Tliese expenses (Art. 4, 5, and 6) are to be defrayed, as far as possible, out of the wages of the Seaman, if any be due to him on his discharge from his ship, which the Consul is (with the sanction of the Seaman) to require the Master to pay into his hands, which money is to be shewn on the Subsistence List, and the Consul is to debit himself therewith in his Cash Account. In any case of unusual expense, or where the Consul may consider it absolutely necessary to deviate from his Instruc- tions, he is to be very particular to explain the causes thereof in the Letter with which he transmits his Accounts. VII. The Consul's Accounts are to be kept in the currency of the place. If any Vouchers should be luiavoidably taken in a foreign language, translations thereof are to be sent with the original documents. At the end of each quarter all the Payments made therein are to be brought into a General 12 INSTRUCTIONS FOR THE GOVERNMENT OF Account (Form No. 9). The Vouchors are to be numbered progressively ; corresponding numbers are to be given to the respective charges in the Account. His Disbursements are to be converted into Sterling, as shewn in the Form of Account No. 9, and on the amount a commission of 2i per cent, is to be added, by way of compensation for his trouble. The Consul is to draw a bill upon the Accountant-General of the Navy on the^ last day of the quarter or period on which he closes his Account, for the balance or sterling amount, at three days' sight (Form No. 7), transmitting to that Officer a Letter of Advice tliereof, and if in his power the Account and Vouchers at the same time. If the Account and Vouchers are regular, the bill will be paid, and the amount allowed at once ; but if they are not, the amount will be charged as an imprest against the Consul, until sufficient Vouchers or a satisfactory explana- tion shall have been received. If it should be impracticable, under particular circum- stances, to obtain the Vouchers required by the foregoing Articles, declaration is to be made to that efFect ; and after specifying as fully as possible the nature of the payment, it is to be stated in the Declaration that they were bond fide made on the Public Service, without any profit or advantage to the Consul, except the commission hereinbefore mentioned. The Consul is at liberty to charge in his Account his actual expenses for Postage of Letters on account of business specially connected with this Department. In the event of the Consul's absence, or of the relinquish- ment of his Consulship, he is to deliver these Instructions to his successor, or to the person who may act for him (luring his absence. HER MAJESTY S CONSULS ABROAD. 13 In addition to the foregoing Instructions, the Consul is referred to the Act of ParUament recently passed (7th and 8th Vict., cap. 112), for Amending and Consolidating the Laws relating to Merchant Seamen, in which will be found many clauses having reference to his powers and duties in preventing the improper discharge of Seamen in Foreign Ports, and the consequent expense which has been caused to the Public for their subsistence and passage home, and which Act repeals the Act of the 5th and 6th of Will.
