' ">>'^'^ In detailing the reafoft^ in juftification and fupport of their application, they alledge that, " in confequence of their el|!0i|fal oif the AmericaJn cdufe, they "^^ere driven to the neceffity of flying frdm Candda, and of taking refuge within thefe United States, and that finding them- feiv€S at the clofe pf the late American war, in very dif- trefled circumftances, efpecially as they feemed preclu- ded from all hope of returning to Canada, to recover their property and efFefts, no notice having been taken of their interefts, nor any provifion made for them in the treaties of peace between the United States and Great- ^ ^:f m > ? ^ • 1 '( 3 ■) «*i>>i> Britain, they did, in behalf of themfelves and others, refugees from Canada, in the month of April 1783, prefent a memorial to Gongrefs, praying that honorable body to take their unhappy cafe into confideration, and to grant them fuch relief as fhould be deemed juft and proper. — ^That accordingly, on the 23d of the fame month, Congrefs were pleafed to paf« fieveral refolves in their favour, to which they beg to refer, and which they were then given to underiland, fully included them- felves and their fellow-fufferers. — That, with unlimited faith in the juftice of Congrefs, and fatisfied with the affurances given to them by the refolves before referred to, they have patiently waited the convenience of the public to fulfil the prdmifed relief, 'till the prefent day." The refolutions of Congrefs of the 23d of April, are in the following words, viz. " That the memorialifts be informed that Congrefs retain a lively fenfe of the fervices the Canadian officers and men have rendered the United States,, and that they are ferioufly difpofed to reward them fdr their virtuous fufferings in the caufe of liberty. " That they be further informed, that whenever Con- grefe can confidently make grants of landi they will reward, in this way, as far as may be conliftent, the officers, men and other refugees from Canada." Thefe refolutions unequivocally acknowledge the me- ritorious fervices and fufferings of that defcriptiori of men whofe cafe is reterred, and contain apromifethat they fliall be rewarded by grants of land, whenever it may confiftently be done. • Although there may not exift a doubt of the inerit of thofe in whofe favour the petition has been made, and of the juftice of their claim upon the United States for the ftipulated retribution, yet the refolutions above recited, and the petition itfelf, which diredly refers to them, neither render it proper, nor indeed leave the committee at liberty to report in favour of a compenfation in any other fpecies of property than lands. Under this impreffion and reftri£l:ion, the committee have fought for that kind of information which might as far as poflible, enable them to form a ( 4 ) right judgment zs to the numl^r of acr««, OAd the Situ- ation and value of the land which ought to be fet apart for that purpofe, or at lead what value in fpecie (hould be eAablifhed as the meafurc of the donation. In this enquiry, they confefs that they have not received as fuU fatisfa^ion as they had hoped for from the undertaking. Altho' eiiimates of the adual lofles and facrifices of fome individuals have been made out and laid before the committee, they are however fo few in number, and bear fo fmall a proportion to the whole, that they afford no fatisfa^tory rule by which a tolerably accurate .deciiion may be made as to the aggregate of the lofles fuilained. From the beft information which the com- mittee have obtained, there appear to have been about 229 refuges from Canada (fome with and others with- out families) 22 of whom are fuggefted to have been die principal fufferers, and the reft to be fi^fierers in a fmali degree. Of both defcriptions, fome, as has been fuggefted, and is believed, have been already compen- fated, either wholly or in part, and not a few returned to Canada, both :\'fbre and fmce the peace, to poflefs their property or to .purfue. their bufiaefs j neither the names nor {numbers of whom have been exa formity with the refolutions of Congrefs, of the 23d of April 1783, promifmg the fame. The Committee to whom was referred the report ofibi Secretary of War i on the petitions of Thomas Faulkner ^ Edward Faulkner and Simeon Cheftery refugees from the Britijh province of Nova-Scotia ; Jofeph Green, Pre/hue Trepagne, Atigu^fiine Trepagne^ and Gregoire Trahan, Mary^ the widow of Francois des Jardins, and Francois Rabutaille, refugees from the province of Cana- da; — andalfoi on the petition of William Lawrence, from the faid province of Nova-Scotia^ i^nmt^ REPORT— >0^ w/iw f THAT your committee have examined the relblu- tion of Congrefs, of the 234 of April 1783, on the memorial of brigadier general Hazen, promifmg, ( 6 ) that " whenever Congrefs can confiflently make grants of land, they will reward in this way, as far as may be confident, the officers, men, and others, refugees from Canada," as recited by the Secretary in his Report, but which does not apply to the petitioners from that pro- vince ; who, as they fet forth in their petition, do not claim as refugees, but for fervices rendered in Canada, by the orders of general Schuyler and col. Livingfton, for which they fay they were promifed pay, and fome a bounty in lands. From all the enquiry your committee could make, they cannot find, that thole officers had any authority to promife a bounty in lands, to be paid by the United States to the petitioners ; nor are there re- turns or vouchers filed, by which the pay claimed can be afcertained. < i - , > Your committee alfd find i r^foliitioh bfCJbtlffrfefsJ of the 13th of April 1785, (which has been omitted by the Secretary) in the following words, viz. " Refohed^ That Jonathan Eddy, and other refugees from Nova- Scotia, on account of their attachment to the interefl of the United States, be recommended to the humanity and particular attention of the feveral ftates in which they refpeftively refide, and that they be iiiformed, that whenever Congrfefs can, confiflently, make granti of land, they will reward, in this way, as far as may be confiftent, fuch refugees from Nova-Scotia, 'as may be difpofed to live in the weftern country." .^V^\% That the petitioners, Thomas Faulkner, Edward Faulkner and Simeon Chefter, were inferted in the lift returned by the faid Jonathan Eddy, as refugees from the Britifli province of Nova-Scbtia, and had abandoned their property there, on account of their attachment to the caufe of America. That William Lawrence has produced fufficient proof, that he is alfo a refugee from the faid province, and has abandoned his property there, from the fame caufe. That in the ordinance paiTed by Congrefs, the 20th day of May 1785, it is ordained, " That three town- Ihips adjacent to lake Erie, be referved, to be hereafter f ■'Vi t ( 7 ) i; ^ difpofed of by Congrefs, for the ufe of the officers, mca and others, refugees from Canada, and the refugees from Nova-Scotia, who are or may be entitled to grants of land under refoluiions of Congrefs now exifling, or which may hereafter be n^ade refpefting them, and for fuch other purpofesas Congrefs may hereafter direft." From the expofed fituation of thofe townihips, a grant there, at prefent, would aftbrd but little relief to the pe- titioners ; but, from the bed information the committee could obtain, the United States poflefs no lands adjacent to lake Erie, which they can now grant or difpofe of. On confideration whereof, your committee fubmit the following refolutions : Refolved^ That the prayer of the petitioners Jofeph Green and others, from Canada, praying a bounty in lands and other pay, tor fervices rendered in the late war with Great-Britain, ought not to be granted. Refohedj That a traft of land, not exceeding acres, be laid off north-weft of the Ohio river, beginning at the mouth of the Great Miania, and ex- tending down the Ohio, not exceeding three times the breadth in length, be immediately appropriated to com- penfate the refugees from the Britifh provinces of Cana- da and Nova-Scotia^ purfuant to the refolves of Cpn- grefs of the 23d of April 1783, and the 15th of April Refohed^ That each refugee be entitled to. five hun- dred acres of land. Refolved^ That the following conditions and reftric- tions ought to be obferved^ to entitle the applicants to a grant of lands : . , . . ift. That the applicant fhall make proof, before fome court of record, of his actual refidence in one of the provinces aforelaid, previous to the day of id. That he was compelled to abandon his refidence aforefaid, in cenfequence of his attachment to the Ame- rican caufe. r i 3d* That all fuch applications be made and lodged with the Secretary for the department of war, within years.
