' And whereas it is deemed advisable and necessary that certain ' alterations be made in the said Charter, for the more effectual * extension of the benefits of the Institution to all Denominations 1 1 ' Her Majesty's Subjects in the Colony, and that the said Charter ' may be rendered more productive of the benefits thereby intended;' I. Be it therefore enacted by the Lieutenant Governor, Legislative Council and Assembly, That for and notwithstanding any thing in the said Charter contained, His Excellencv the Lieutenant Governor or Administrator of the Government for the time being, shall be Visitor of the said College, in the place and stead of the Visitor named in the said Charter ; that the Chief Justice of the Supreme Court for the titan tieing shall be Chancellor of the said College ; and that the provisions of the Charter, " that the President of the said College shall be a Clergyman in Holy Orders of the United Church orEngland and Ireland," and " that the Archdeacon of the Province for the time being ahall, by virtue of such his office, be at all times the President of the College," be annulled, and that the President in future be appointed by Her Majesty, Her Heirs and Successors, or by the Visitor on Her Majesty's behalf. II. And be it enacted. That the College Council shall be fifteen in number, as follows, viz : The Chancellor, the President of the College, the Master of the Rolls, the Speaker of the Assembly, the Secretary of the Province, the Attorney General, and nine other Members, to be nominated by the Visitor, with the power of suspension in the Visitor, now vested by the said Charter in the Chancellor ; and that seven Members of the said Council shall at all times constitute a quorum for the dispatch of business. III. And be it enacted, That it shall not be required that Members of the said Council be Graduates of the said College, or of any other University, nor shall any religious test be appointed for or required of any Members of the said Council, or of any Professor of the said College, save and except the Professor of 'Theology, who shall at all times be a Clergyman of the United Church of England and Ireland. IV. (dU licit. «TATUTB». mvi.s« Ann OmmiVAHCB* KING'S OOLLBaB, ^^ Enacted 1th April, 1848." 4 '^KKTHEREAS by an Act of the General Aiwmbly of Uui ▼ ▼ ' Province made and passed in the eighth year of the Reign * of our Sovereign Lady the Queen, intituled '* An Act to amend • the Charter of King's College," certain alterations were made in the ' Charter of King's College ; and it is deemed necessary to revise, ' alter and amend the Statutes, Rules and Ordinances, relating ' to the government of the said College, heretofore enacted and ' declared ;' Be it therefore enacted and declared, that all Statutes, Rules and Ordinances heretofore made and declared for the government of the said College, and now in force, shall be and the same are hereby revoked from and after the first day of September in the !>resent year ; and in lieu thereof, from and after that day, the fol- owing shall and are hereby declared to be Statutes, Kules and Ordinances, for the government of the said College ; provided always, that the said revocation of the said Statutes and Ordinances shall not have the effect of invalidating, in any manner, any act, matter or thing, done, or to be done, prior to the said first day of September next, under and by virtue of the said Statutes and Ordi- nances so revoked, or any of them. 1. The Visitor shall and may, by and with the advice and consent of the Council, appoint some fit and proper person to be the Prin- cipal of the College : and the Officer heretofore known as the Vice President shall be henceforth known and designated as the Prmcipal. 2. The Visitor is hereby authorized and empowered to summon before him, within the College, the Principal, Professors, Graduates, and Undergraduates, and all inferior Officers belonging to the Col- lege ; to examine them on oath, or otherwise, touching the conduct of any of the Officers, or Members, or other persons aforesaid — except that no person shall be compelled to criminate himself ; to punish offences according to the Statutes, and to require a strict observance of the same. 3. An Annual Meeting of the Council shall be held on the Tues- day before the last Thursday in the month of June. 4. All other Meetings of the Council shall be convened by the Chancellor, or in his absence by the next senior Member of the Council then in Fredericton, (whenever he may think proper,) on three days notice in writing being given to each Member President, or at the time in Fredericton,) by the Registrar, and shall be held within the College or at such other place as shall be specially ap- pointed at the time of convening the Meeting. 5. Any Meeting of the Council may be continued by adjournment. (a: B48. n 6. The Chancellor, or in his absence, the senior Member, shall convene a Meeting of the Council within ten days after a request shall have been delivered to him in writing, under the hands of any three Members of the Council. 7. The Convocation shall assemble in the College, in their proper canTOc*tion. habits ; and not fewer than f '? Members shall form a Convocation. 8. The Convocation sh-il /^emble immediately after Divine Ser- vice, on the first day of - ' y Term, and on the days to which it shall be successively adjourned during such Term. 9. It may also be convoked by the Chancellor or President, or, in their absence, by the next senior Member of the Convocation, at any lime during Term, by public notice fixed in the Hall, and by summons sent to all the Members within five miles of the College, at least two days before the time nf Meeting. 10. All questions in the Convocation shall be decided by the majority of the votes of the Members present ; the presiding OflBcer to have a casting vote in case of an equality of votes. 11. It is the office of the Convocation to confer Degrees according to the Statutes ; to admit and incorporate Members of other Univer- sities ; to grant Letters Testimonial ; to grant Dispensations in cases not provided for by the Statutes, and not contrary to them ; and to deprive of Degrees, subject to the approbation of the Council. 12. The Convocation may suspend from any office or situation in the College, or rusticate any Member of the University, not being a Professor, for any grave offence (against the Statutes or Regulations founded on them,) for a period not to exceed two Terms, subject to an appeal to the Council. 13. The Principal shall reside within the College. principal. 14. It shall be the office of the Principal to maintain the observance of the Statutes, as well by the Professors, Tutors and Inferior Officers of the College, as by the Scholars and all other Members ; to enforce discipline by admonitions and punishments, (provided that in all cases of punishment by fine or imposition, no fine by him so inflicted shall exceed twenty shillings, and no one imposition require more than three days confinement) ; to order and preside over the Col- legiate Exercises ; to direct the economy of the House ; to regulate the Inferior Officers and Servants ; and to inspect all the affairs of the College. ^'* 15. It shall be competent to Her Mujutty's General or Local s.i.uur.a,i Government, or any Member thereof, or to the Incorporated Society ''*""*• for the Propagation of the Gospel in Foreign Parts, or any Diocese or District Committee connected therewith, or to any Association desirous of promoting Religion or Learning, or to Individuals, to found Scholarships or Fellowships, with such endowments, con- ditions and qualifications as shall not bo at variance with the Charter or the Statutes, and as the Council shall approve. 35. It shall be the duty of the resident Divinity Scholars to DmuitySciK observe, and take care that all others observe, the Rules and Regu- lations appointed by the Principal respecting attendance at Chapel, and report to the Principal every deviation from the same. 36. No person shall reside and board in the College who shall not have become a Member by regular Matriculation or Incorpo- ration. 38. The several Members of tho College sliall be entitled to choose vacant apartments according to seniority of standing ; but Members on the Foundation shall take precedence of others in this respect, subject in all cases to the control of the l^incipal. 39. On every Sunday in Term, all the resident Members of the DWine scrvi«. College, who shall not have obtained permission to the contrary, shall attend the Morning and Evening Service in the Cathedral Church of Fredericton ; on every ordinary day in Term, they shall attend the Morning and Evening Service in the College Chapel. 58. In the Chapel the Daily Lessons from the Holy Scriptures shall be read by the Undcrgn.duates ; and it shall be the duty of the ofhciating Minister to take care that they be read with distinctness, propriety, and becoming solemnity. 59. The Principal shall grant permission to any Member to attend such place of Public Worship as his parents or guardians may desire, or at which (if he be twenty one years of age) his own religious principles shall bona fide require his attendance; and to revoke such permission whenever be has reason to think it may be abused. GO. A Schedule, specifying the Lectures to be given during each i.rcture>. Term, and the days and hours of such Lectures, shall be affixed in the Hall on the first day of Term. 61. Every Undergraduate shall attend the appointed Lectures every day on which they shall be delivered, and shall not absent himself from any Lecture without special permission under the hand of the Principal. 62. Every Student, as soon as he has completed his sixth Term, Gxammatiini, shall be examined by the Examiners for Degrees, assisted by the President and Professors, in one Author of the Greek and one of the Latin Language, to be appointed by the Council at the beginning of the I'erm ; and in the Mathematical and Physical Sciences ; and in Composition in Latin and in English ; and to such as pass a satis ■ factory examination a testimonium shall be given in form following ; — " A. It shall be at the option of every Student to subject himself to an additional examination in Authors to be hereafter named by the Council. Kx^rriH**. Moth) roOiiuct 18 64. Those who pass this voluntary examination to the satisfaction of the Examiners shall receive a prize of Rooki<, value £2. 65. Candidates for the Degree of Bachelor of Arts shall be publicly examined in two Latia and two Greek Authors, to be named by the Council, and in Mathematical and Physical Sciences, and in some one Modern Language, and in Latin and English Com- position. At least seven days notice of such examination shall be given in writing by the Principal to the Registrar, who shall com- municate the same to the Members of the Council, and insert it in one of the weekly prints ; and it shall also be affixed in the Hall. 66. It shall be at the option of any Student to offer to be examined in other Greek and Latin Authors, or in other parts of Mathematical and Physical Science, or in any one or more Modern Languages, or in all these together ; those who acquit themselves to the satis- faction of the Examiners to be rewarded by a Prize of Books, value £5, and their names placed ia an Honorary Class List. 67. At the end of Trinity Term all the Undergraduates shall be examined by Examiners, appointed by the Council, both viva voce and in writing, one or more days, as the Examiners may deem necessary ; at the end of Michaelmas and Lent Terms they shall be examined by the President, Principal and Professors ; and Rewards shall be conferred on those who may have passed the best examinations , and it shall be the duty of the Principal and each of the Professors to furnish the Registrar with a note of the several subjects and Authors, specifying the particular parts of each in which the Students are to be examined in their several departments res- pectively, who shall notify the several Members of the Council one week before the several examinations. 68. All Undergraduates shall compose a Latin and English Theme alternately, once a week during Term, either !n Prose or in Verse, on subjects to be proposed, on the preceding Saturday, by the Principal. 69. Every exertion shall be made by all the Officers of the College to maintain good morals. 70. No Undergraduate shall resort to any Inn, Tavern, or place of public amusement, without special permission of the Principal. 71. No Member of the College shall promulgate any principles contrary to Christian Morals, or the British Constitution. 72. No Undergraduate shall remain out of College, nor any visitor in an Undergraduate's apartment, after ten o'clock at night, without special permission of the Principal. 73. No Member of the College shall break, deface, or otherwise injure the buildings, walls, doors, windows, fences, or other property belonging to the College. 74. Tht President, Principal and Professors, shall have power and authority to enter the apartments of all other Members of the College, at all hours. m^ u Hi 7 *). Junior* shall pay respect to their Seniors, both in public and private, by taking off their caps, giving place to them, and other usual modes f*'^ :. Common repasts for the College shall be provided at such *••"'• hours as shall be appointed by the Principal. 78. No Undergraduate shall require any repast to be provided in his private apartment, without special permission under the hand of the Principal. 79. Any Member of the College may introduce a friend to a common repast, paying such sum as the Council may appoint. 80. No smoking, or drinking of spirituous liquors, be permitted to any Student within the College. 81. The Academical Habits shall be the same as those which are Habiu. worn in the University of Oxford, as they are appropriated to each Degree, Faculty, Rank, Station, Situation or Standing, respectively. 82. No Member of the College shall appear at Church, Chapel, Lecture n Refectory, without his Academical Habit, or in the Town of Frcdericton, unless by the permission of the Principal. 83. No Term shall be reckoned towards a Degree without Acade' niical residence. 84. Academical residence shall consist in boarding in the College, and lodging therein, unless a dispensation be granted to the contrary, as hereinbefore provided, by the Principal ; in wearing the proper Habit ; in attending Divine Service and Lectures ; in performing Exercises ; and in complying with all other Academical regulations according to the Statutes. 85. The keeping of a Term may be disallowed by the Convocation for great irregularities, for not paying the College dues, or for con- tracting debts elsewhere ; and no Student shall be allowed to enter on any Term without first producing to the Principal the Registrar's Certificate that all previous dues have been paid. 86. Twelve Terms of Academical residence shall be necessary for a Degree ; but four Terms may be dispensed with in the com- putation of the Terms of Academical residence requisite for a Degree, in case on examination for Matriculation, it shall appear that the Applicant has made such proficiency at the time of examination as shall be usually attained after twelve months Academical residence ; provided that nothing in this Statute shall apply to Students who have been admitted under the Statute of 2Uth February, 1843. 87. A Table of all payments to be made to the College, and its cou»jtOuM. several Officers and Servants, by all Students and Members thereof, under the baud of the Registrar, shall be kept affixed to the great Hall. No person shall be admitted to the Degree of Doctor of Divinity unless he be a Uachelor nf Divinity of four years standing ; but Masters of Arts who shall have completed eighteen years, from their Mntriculation, may, by dispensation, be allowed to take the Degree uf Doctor of Divinity immediately after that of Bachelor. 103. The Candidate shall have publicly read a Latin Lecture, on some subject in Divinity, chosen by himseW, and approved by the President and Professor of Divinity ; and shall have preached a Sermon before the University on some Sunday appointed by the President. 104. He shall produce a Certiticate from the President and Pro- fessor of Divinity, that he has performed the appointed Exercises, and (if a Member of the United Church of England and Ireland) subscribed the Thirty Nine Articles. 105. No person shall be admitted to the Degree of Bachelor of Medicine, until he shall have completed Ave years from his Matri- culation. lOt). The Candidate shall have kept twenty Terms, including the Terms of his Matriculation and Graduation, the first sixteen Terms of which shall have been kept in all respects as they are appointed for Students in Arts, and the Council may dispense with his residence during one of the remaining Terms. 107. He shall have attended, during his residence, such Lectures as may be specially appointed for Students in Medicine. 108. He shall produce a Testimonium from the Examiners, that he had passed the examination requisite for the Degree of Bachelor of Arts; a Certificate from the President or Principal, that he has kept the requisite Terms, and attended the appointed Lectures ; and a Certificate from the Professor of Medicine, that he is bona fide fit to be admitted to the Degree of Bachelor of Medicine. 109. No person shall be admitted to the Degree of Doctor of Medicine, until he shall have completed three years from the time of his taking his Degree of Bachelor of Medicine ; but Candidates of eight years standing, from their Matriculation, may, by dispen- sation, be allowed to take it immediately after that Degree. 1 10. The Candidate shall have publicly delivered three Lectures, on subjects in the Science, approved by the Professor of Medicine ; and shall produce a Certificate from that Professor, that he has performed the appointed Exercises, and is bona fide fit to be admitted to the Degree. 111. Every Candidate for a Degree shall apply to the House of Convncntion for a Grace, by n PetitidTi presented by some Member of (he House. 1 12. Thin Petition shall state the nualiflcation of the Candidate, and be accompanied by the requisite Certificates. 113. In case the House shall be satisfied, the Candidate shall bo introduced into the Convocation, and led up to the Chancellor's Choir by the Proli'ssur of his Faculty, or some Graduate appointed by the President or Principal, and shall be presented in solemn form, and receive his Degree. 111. The Degree shall be forthwith entered in the Register of the Convocation by the Registrar; and Letters Testimonial granted at any time to the Graduate, if he desire them, under the Seal of the College. iniMiianuad. 115. The House of Convocation shall have power and authority to incorporate and admit to the snmc nr a similar Degree, Members of any University in the Dominions of Her Majesty, which nhall be duly authorized and acknowledged by Her Majesty's Government. 116. No Graduate shall be incorporated unless he shall have taken his Degree in the regular manner, after keeping the Terms, and performing the Exercises required by the Statutes of his own University ; nor unless the Professor of the Faculty shall certify that such qualifications substantially correspond with those required by the Statutes of this College for the Degree desired. 117. On the Thursday they shall repair to the College at twelve o'clock, noon, where the Public Academical Act shall be held. 12(). An Oration, in praise of the Founders and Benefactors of the Institution, and its objects, shall be delivered by the Professors in rotation. 127. Honorary or Regular Degrees shall be conferred as at other times. 128. Compositions which may have obtained the Gold Medal, founded by His Excellency Sir Howard Douglas, or other Prizes, which may be approved by the Council, shall be recited by the Authors, and the Prizes shall then be delivered to them by the presiding OtBccr. 129. The Public Act shall then be closed in solemn form by the presiding Officer. 130. All fines, forfeitures and pecimiary punishments shall be carried to the College Account by the Registrar, and duly levied by him ; and where they are not imposed as a compensation for injuries, shall be applied to the support of the Library. 135. That there be but one School, for the good conduct of which, in every respect, the Head Master be held responsible. 2. That the School continue as heretofore; Classical, Mathematical, English and French Instruction, to be given by the several Masters, in conformity to an Hebdomadary, which shall be made out and set up in the School Room at the commencement of each Term. 3. That the School be inspected by Visitors, to be appointed by the College Council, on the last Thursday of every month, at two o'clock, p. M. ; and that it be the duty of the Head Master to give notice the day before to the said Visitors. 4. That the subjects and mode ot Instruction be such as the Head Master may direct, with the approbation of the Visitors. 5. That the appointed hours of Instruction be punctually observed by the several Masters. 6. That all the Tuition Money be received by the Head Master, who shall pay to the Second Master one third part of the whole ; the Head Master being responsible to the Second Master for his due proportion of the same ; and if any Boy be reported by the Visitors, as being two quarters in arrear, the said Boy shall not be allowed to return to School until the arrear is made up ; and the account may be presented to the College Registrar, who shall take measures to obtain payment of the same, at the expense of the College. 7. That the hours of Instruction be in the Morning, from nine to one o'clock, and in the Afternoon, from two to four o'clock, in the Summer ; and from nine in the morning to three p. m. in the Winter. 8. That the names be called over every morning and afternoon by the Second Master, in presence of the Head Master, at precisely the time appointed for thu a&sembly of the School, and before any other business be entered upon ; and that the names of those who are absent be taken down. in i 28 9.
