The Water Station at Windaor, I believe, waa completed be- fore I went into the empbyment of the Company. I cannot state whether it wm completed according to coatraot, M I had nothing to do with it I found the PlaintiA in the act of building the Way Station at Lennoxville, that ia, they had partially completed it. I told plainti A to put men on, and complete the Lennoxville Station at once, m the Company wished to have it completed for immediate um. I found part of the Verandah floor had been laid, and that the joico (jotita) was broken down. I also found the joice WM amaller than the dimensions specified in the epeoifioation. via : they were three inches by six, instead of four inchM by eeven. I told him to take Uiom out and put in larger oom which would be in accordaaee with the speciflMtions. I wm then abMnt from the work for a week, and when 1 returned to Leimoxville I found two men at work there ; they had put in some joiee 2^ inches by seven, and had cut them so short that by shoving them up the joice at either end, they would fall. I ordered them to take them out. I in- quired where FraMr wu. They aaid he wu at Waterville. I requeated him to meet me there, Lennox- ville, on the third or fourth day afterwards. He did not come. I then went to Waterville to sm him. I told him 1 had instructions from the company to put on men and finish np the work, but that I did not want to do it, and that he had better put on men and finish the work. He promised to do so, but did not. I went to him wveral timn, to no avail, he often promised, but did nothing. Thia converMtion alluded to the Sutiona at Lennoxvillo, Waterville, Coaticook. But I more particularly requHted him to flniah the Len- noxville Station firat, M the track wm laid there, and the Company required to um it I put no men o^ the work until plaintiA got hie (their) dismissal from the Company. This waa some time in the month of June. I handed him the letter of diamisMi myself. The paper now shown me. plaintiA' Exhibit No. Mvca ia the aame, h I believe, to be the letter I refer to. I then put men on the Station to finish it. Some portions of the work at tha Lennoxville Station was well enough, and some of it wm poor, both aa to materials and vorkmaaahip. The roof I found poor. The contract required pine shingles, 18 inchM long and laid 4} InchM to the wMther. I found that spruce shinglM were used meMuring 16 inchM, and laid 6, 6 and 7 inchM to the wMther, causing the roof to leak badly, and we were compelled to got shinglM and repair the rooi^ but could not make a good job of it then. The architraves were to have been six inchM, 8 incli Aured. I found only a plain skirting, only four and a half indwa wide; the loeka were to have been ear- penter'a loeka, I found email iron locks, and all out of repair excepting one ; the office door waa to be a aaah door, opening into two halvM in the centre, which door we removed and put in a new one ; we also had to take down a portion of the chimney and rebuild it ; the boards, by the apeeifioationa of the ontaide, were to have been inch boards, tongued and grooved, doubled, that is, two boarda one inch thick, but there WM only ono thiokncM 6f boardF^ and they had been put on green, and had ahmnk ao much that we were «,bliged to remove them repair them and put them on again. At the time when the plaintiHb war* diaoharged ttom Mid work* the rtondition of the Way and Water Statiotf at WatarviUo was aa follow*:— Tke Water Station wm framed and raiaed, rongh-boarded and shingled, and tha water tank plaeed in it. There wu nothing done to the Way Station there, nor wa* th*ro any matoriala on the ground for it. Tnora wu soma window aaah, doors, couple (coupling) block*, door (lrame«,and some window frames, in Mr. Fjandera' akop at Watorville, but.with the exception of two or three of the coupling block*, and a f*w of the window and door framee, aneh work and material* wa* (were) not according to contract ; the coupling block* were too small and the doora nearly a foot ahorter than the plan. The Company besides never got possession of any of tkoM things from Flandem* shop, they refused to let the company have thorn for the reason that the plain- tiA owed him, and that he would not let tUcm go until he was paid. Supposing that the material* and partly finished work at the Waterville Station had been good and had been made according to the said *pa- dfleation*, th*ir value wotdd not have amounted to forty pound* ourraney. I made that estimate of their value, allowing fifteen per eaat additional, m set forth in Defendants' Exhibit No. 2. I allowed forty pounds in my estimate for tha materiala and labor don* at Waterville, cud that waa a very large allowance. Tha situation of tha PUiatiSi worka at Coatieook, when tiie work* were taken out of their hand*, wa* a* Callows : — Tha Way Station waa about half framed, part only of the materials were on the ground for the frame, and another part which Lad been got out, as I understood, by Mr. Baldwin, but he would not deliver it, that is, the portion that waa lacking, unlaw I would psM my word that he should be paid for it.
